Pease delete this photo which i uploaded by mistake in a batch work at some day long time ago.
I am not able to undurstand how this photo of wikipedian is of so much value to you unless you want to harass me , because im a female wikipedian and make a mistake.

- The poster art copyright is believed belong to the distributor of the film, the publisher of the film or the graphic artist, but is Commons Attribution-ShareAlike. The entire poster: because the image is poster art, a form of product packaging or service marketing, the entire image is needed to identify the product or service, properly convey the meaning and branding intended, and avoid tarnishing or misrepresenting the image. The copy is of sufficient resolution for commentary and identification but lower resolution than the original poster. Copies made from it will be of inferior quality, unsuitable as counterfeit artwork, pirate versions or for uses that would compete with the commercial purpose of the original artwork. As film poster art, the image is not replaceable by free content; any other image that shows the same artwork or poster would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary. While FOP exists in Germany and it might cover murals, however this appears to be a derivative of a copyrighted photograph of the subject, which the painter is not able to "release".

- Just out of curiosity: What would be the issue if there weren't? FOP in Germany appears to cover murals, but I could not find legal evidence that one has to verify the originality of the photographed works. - No! FOP, or freedom of panorama as it is called, is the right to photograph copyrighted works without the 2D-photograph infringing on the underlying artwork you've photographed. If the artwork however is a copyright infringement, so does the 2D-photograph become. - In order to permanently place an artwork in to "the public" they need to have the legal authority and ability to do so. If you do not own the copyright of the artwork, you can't legally place it in the public without that being a copyright infringement. - If a copyright holder places a work permanently in public, then it "limit the right of the copyright owner to take action for breach of copyright against the creators and distributors of such images. It is an exception to the normal rule that the copyright owner has the exclusive right to authorize the creation and distribution of derivative works." The argument seems to hinge around the question whether the depicted graffito is a derivative works of its own according to § 24 Abs. 1 UrhG. If it is, it is in and of itself a protected work that does not need permission by the rights holder of the work from which it was derived. The way it is contextualized with a political slogan, as well as the production style with (possibly) a distinctive style of spraypainting by the artist can each be arguments for the graffito to be covered by at least the same umbrella of copyright legislation as the selfie that the work was based upon. Just out of curiosity: Are there precedents where the Wiki Commons community starts trying to preemptively delete images of works of art because they suspected them to be copyright infringement themselves? --stk (talk)

@Achim55: Thank you very much! The difference between these two files is in RAW editing software used for. In the case of Γαλαξείδι 01.jpg the RAW editor was RawTherapee software instead of Silkypix used for Γαλαξείδι. Σεπτέμβριος 2019.jpg file. This software can read more pixels from the outer area of the camera sensor than used by the build-in JPEG engine of the camera. Zmieniłam na "zdjęcie portretu namalowanego w 1830 r.". Rzeczywiście fotografia została zrobiona trochę później, w II połowie XIX wieku, przez syna Józefa. Przepraszam, ale trudno mi się zorientować co, gdzie i jak tu się pisze i edytuje, interfejs i zasady są zbyt skomplikowane. Pozdrawiam AweAb
- Proszę nie kłamać. Puchalski nie służył w armii Królestwa Polskiego, więc w 1830 roku nie mógł nosić munduru. Wysłałem zdjęcie do znajomych specjalistów epoki. Wg nich postać na portrecie nie nosi munduru z czasów Księstwa Warszawskiego, ani z czasów Królestwa Polskiego; mundur pochodzi raczej z drugiej połowy dziewiętnastego wieku. - Kriis ale można nieco mniej agresywnie, prawda? Mamy tu do czynienia z dwoma różnymi sprawami. 1. Czy zdjęcie przedstawia tę osobę, którą sądimy. 2. Czy nei narusza praw autorskich. Na commons nie zajmujemy się de facto 1. To leży w gestii lokalnych wikipedii, gdzie w hasłach nie powinno się umieszczać nieweryfikowalnych elementów. Na Commons, możemy dodatkowo oznaczyć to zdjęcie, jako wątpliwe. Co do 2. to zdjęcie jest już zapewne w PD, ale należy to udowodnić. Die bemalte Mauer ist ein klassisches Beispiel, weil hier davon auszugehen ist, dass dieses Motiv dort dauerhaft, zumindest aber länger bleibt. A prerequisite for panoramic freedom in Germany is the permanent installation of a work of art above the height of creation. The painted wall is a classic example, because here it can be assumed that this motif will remain there permanently, or at least longer. - I haven't checked all of those files, but most of them seem to belong to Category:International Youth Congress of Esperanto, some of them specifically to Category:International Youth Congress of Esperanto 1988 (Zagreb, 1988). We just need to rwad the description, even though it is „only“ in Esperanto, partially als in Polish. Thus IMO those pictures are definitely not out of scope, they are documents of historical events. A different question, though, could be whether the licensing is correct. Some of the images have a watermark saying that A. Sochacki is photographer – which is a different name than the uploader's user name. A. Sochacki sounds like a polish name to me, some of the images have descriptions also in polish language (chosen by the uploader). So possibly things are okay, but I'm not sure yet about this point. - The issue was seized by the en:Office of Alien Property Custodian per the link [4]; URAA was not restored. (This source [5] explicitly says no copyright in US). - Perhaps you did your best but not everything is on the Internet but often in the archives. IMO I think it's not a good idea to force the issue with this ad-hoc {{PD-because|seized enemy property}} (I'm really not sure it becomes magically a public domain U.S. work) or {{Anonymous-EU}} (work is signed so not anonymous and it seems to me -but I might be wrong- that they are case laws on Commons on this subject). - Comment @Buidhe: check out {{PD-US-alien property}}. Also, {{PD-EU-no author disclosure}} may be a clearer alternative to {{Anonymous-EU}}. I think it's safe to say that Paske is a pseudonym, but the laws regarding pseudonymous works in Germany are pretty touchy when it comes to author disclosure (COM:GERMANY#Anonymous and pseudonymous works). If the identify of Paske was revealed at any time in the 70 years since this was published, the copyright term is no longer publish + 70. clpo13(talk) 23:03, 10 June 2020 (UTC)

Deleted: So that illustration is apparently in the PD in the US. Since this is clearly a German work, German law is what really matters however. The illustration is signed, so it's not anonymous. That "Paske" is a pseudonym is a convenient assumption, it could just be that person's actual family name as well. "It's not clear who he is" or "We don't know who that is" does NOT mean that this a pseudonymous work. Which means we have to assume it's still protected by copyright per the usual 70 years pma formula. So I've deleted the file, along with some other "Paske" files from the same series. They're all from 1940, so they can all be restored in 2061 with {{PD-old-assumed}}. - Keep. It's not a content of "Der Stürmer" by any known contributor but a poster of the "Stürmer Verlag" who ceased to exist in 1945 with no hint to any identifiable contributor. There is no proof that this poster - just an idea of Buidhe - that this poster is not "genuinely anonymous" or "likely copyrighted". - @Xenophon: Well, first of all the image appears to have a signature in the upper right corner. I cannot read it but we would have to investigate if it is a known individual before assuming that no one could claim the copyright. - Comment This is a clear photograph of a man wearing a neckbeard. He is the only person of colour currently represented in Category:Neckbeards, which is dominated by old, dead and/or white men. The photograph was cropped from the original (see File:Jameseastmontmalloakland3.jpg) in order to suggest it as an option to represent neckbeards on the English Wikipedia page for Beards (we were trying at the time to locate more diverse images of men with facial hair, as someone had objected that the page was dominated by white faces.). In my opinion, the image is completely within scope, and - particularly given current affairs - it would be bad optics to delete the only PoC from the neckbeards category simply for being considered "out of scope" when there is nothing comparable in the rest of the category. 2005 photo of 1997/1998 works by Takashi Murakami, who is still alive. The sculptures themselves are under copyright. The photos were taken in Turin, Italy at the Perrotin Gallery - look at other photos in the Flickr uploader's photostream and compare to the images at the gallery website. The person photographed served as Second Lady of Mexico between 1911 and 1913. In 1969, her contribution to Mexico Society was considered sufficient for her to be awarded the Belisario Domínguez Medal of Honour by the Mexican Senate. This is the highest award the Mexican Government awards its citizens. Please note that both images selected for deletion are relevant. - One of the photographs is of María Cámara Vales posing with José María Pino Suárez, who served as Vice-President of Mexico between 1911 and his assassination in 1913. (His wikipedia page can be consulted here: https://en.wikipedia.org/wiki/Jos%C3%A9_Mar%C3%ADa_Pino_Su%C3%A1rez.) His assassination in 1913 was one of the most violent periods of the Mexican Revolution and María Cámara was an important historical figure during these events. - On the other hand, the other photograph is a portrait of María Cámara Vales and is shows her wearing the Belisario Domínguez Medal of Honour. - @DaveEscher: It's not a notability problem but a lack of permission. "Private collection" doesn't mean nothing here since we are only interested in who the photographer is. Therefore claiming {{Own}} for these images is a false claim because "own" denotes that "you personally created the entire original image by yourself". The date is unvalid too (please read Template:Information). - Copyright laws don't distinguish between logos, icons, emoji (which are a subcategory of icons), and other graphics. What is important in this context is that their design is above the threshold of originality, and that the copyrights and trademarks associated with the emoji designs are the property of Apple Inc. The Guidelines for Using Apple Trademarks and Copyrights stipulate the following:
- "2. Apple Logo and Apple-owned Graphic Symbols: You may not use the Apple Logo or any other Apple-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Apple, such as a reseller agreement."

- I just read up some more on copyrighted graphics in general and Apple-copyrighted icons/emoji in particular. Very educational. I agree that both of the files we are talking about are unambiguous copyright violations.
- On a personal note; while researching this I found that to my eye Apple has better looking emojis that the Linux and Windows machines I use. Whoever Apple hired did a great job. This would influence me towards buying an Apple machine if I was a heavy emoji user, so I can see that Apple has a strong financial interest in defending the copyright on their valuable images. --Guy Macon (talk) 04:02, 4 June 2020 (UTC)
- There are zillions of nicely designed free emoji on the Web. And when I say free I mean they are for free and under a free licence. For example, you can get 2,986 emoji (in various formats: SVG, PNG, and TrueType colour font) all in one download if you click the green button at the Noto Emoji font repository. Or you could search them here starting from Category:Emoji by subject. It is strange this user resorted to commercial graphics. — I hardly ever use emoji, but I use a Firefox add-on that displays a different set of emoji than the ones that ship with my OS. - Keep Buidhe, as I told you on en.wiki, you can verify the book exists here on Google Books, in note 433 from Heidegger and the Jews: The Black Notebooks by Donatella Di Cesare, published by John Wiley & Sons in 2018. The note indicates that the book was published in German in 1921 and in English in 1923. Given that, it is out of copyright, and it makes no difference who made the images, Rosenberg or an illustrator: everythong published in 1923 is now out of copyright and in the public domain. - In the absence of any indication of an illustrator other then Rosenberg, the presumption must be that either Rosenberg did the drawings, or that they were a work for hire which would be covered under Rosenberg's copyright. We know that Rosenberg died in 1946 (by hanging), so the 70 years has elapsed. - OK, the book the illustration seems to have come from may be Bolsheviks and British Jews: The Anglo-Jewish Community, Britain and the Russian Revolution by Sharman Kadish, published in 2013 by Routledge. The book has a list of illustrations which includes the entry: "facing page 140 Caricatures of Lenin, Radek, Martov and Emma Goldman from Alfred Rosenberg's The Jewish Bolshevism, published in England by The Britons in 1922 {London, Wiener Library, Britons Collection)". [13] With the exception of the credit to the library, this is exactly the text on the prevision revision linked by clpo13 above. - Delete on Commons, but transfer to enwiki and other projects that may allow it under local policies. From what I can tell from the above link to Heidegger and the Jews and page 87 of Haters, Baiters and Would-Be Dictators by Nick Toczek, the referenced text "The Jewish Bolshevism" is only a portion (essay? chapter?) of the book Totengräber Russlands (in English, The Gravediggers of Russia), published in Germany by en:Ernst Boepple in 1921, then re-published in England by The Britons/Britons Publishing Society in 1923. According to Toczek's book, It consisted of thirty-two caricature cartoons by Otto von Kursell, each of a leading Russian Jew and purported to illustrate the different kinds of Jewish physiognomy. That description matches the picture here, so I'm okay with assuming this image is present in the book. Otto von Kursell died in 1967, so his illustrations won't be public domain in Germany and other life+70 countries until 2038. However, since the book containing the illustrations was first published in 1921, they're public domain in the United States. Works must be free in both the United States and the country of origin in order to be hosted on Commons (Commons:Licensing#Interaction of US and non-US copyright law), but enwiki only requires works to be free in the United States (en:Wikipedia:Non-U.S. copyrights). - What I can ascertain from looking at available copies of Totengräber Russlands and The Gravediggers of Russia or Russia's Gravediggers is that Boepple does not appear to be an author, he appears to be a publisher. The publisher credit on the listing for the German edition from 1921 says "München, Deutscher Volks-Verlag Dr. Ernst Boepple". The author is given as "Otto von Kursell / Dietrich Eckart", confirming what clpo13 wrote above - von Kursell was the artist, Eckart wrote the words. [14] However, the English edition (new, published in 2019) gives Rosenberg as the only author. [15]. The GErman edition is very pricey -- all copies were going for over $1,000. The new English edition is not dirt cheap at under $30, but I think I may order a copy so we can short-circuit this discussion and come to a conclusion. Amazon also has three different English edition, two of which are unavailable, but the covers are interesting. [16],[17],[18] In the last, the credits are drawings by von Kurfell, "verses" by Eckart, and introduction by Rosenberg. The second one mixed up von Kursell and Eckart. - Comment - The copy of the brochure I ordered just came. Here is a description:
- The cover says "Russia's Gravediggers / Alfred Rosenbergm Otto Kurfell (Ill.)"
- Next two pages are advertising for the publisher, "Facsimile Publisher" of New Delhi, with an address.
- The next page says "Russia's Gravediggers" and has the ISBN 4-444000-406954
- The next page has the same text as the cover, with Facsimile Publisher's logo at the bottom (which is not on the cover)
- The following page has the same information as the cover, plus the ISBN number, plus "Reprint in 2020 in India by Facsimile Publisher" and their address
- the title page (finally), which is numbered as page 1, has the title "Russia's Gravediggers", then "Drawings by Otto Kurfell" and then "Foreward by Alfred Rosenberg" Plus the drawing of Trotsky from inside the pamphlet, which has been filled-in, dimensioned, and shadowed and placed against a background featuring a menorah, dead bodies, skulls, the Eye of Providence in a triangle (such as on the back of the US $1 bill), and other images that I cannot make out
- The next page (2) has a quote from Goethe
- Pages 3 through 9 is the forward by Rosenberg, which is titled "The Jewish Bolshevism" and dated "Munich, November 1921". It is signed "Aflred Rosenberg (reval)"
- Page 10, titled "The grave diggers of Russia" begins the caricatures, which continue through page 38. Most pages have a caricature, a name I.e. "Sinowjeff-Abfelbaum (Appletree)", a description "Societ Governor of Petrograd, President of the Soviet Commonwealth of the North, President of the Executive of the third International" followed by four lines of verse. Some pages (32, 33 36, 38) have two caricatures with descriptions and verse. Page 14 has two photographs, the first labelled "An interesting meeting of the Soviet Leaders" about which it claims possession in Russia is "punished by death"; the second photo is "A Squad of Murderers" and depicts what appear to be Cossacks on horseback.
- Page 39 is in some ways the most interesting for what it says about the "facsimile" edition. Although it is numbered, and therefore one would think it is part of the facsimile of the original, it contains a URL, which, of course, could not have been in the original. The contents are:
- "Today's America is as Judaized as the Soviet Union was! /Same names, same faces, same age-old agenda"
- "Who Controis America" and the URL, which I won't give, but will say that it includes "ZOG"
- A drawing of a man lieing on the ground being help down by a man's foot and leg (see Orwell's "1984") with the Statue of Liberty in the background
- A quote labelled as being from Goebbels: "As long as the Jews remain anonymous, they are secure. The moment they lose their anonymity, the racial problem became acute and required a suitable solution. ... Jewry's strength is in its anonymity."
- The following page is also numbered (40), but also seems likely not to have been in the original. It has two images. The first is a drawing showing a stereo-typical hook-nosed Jew is in the center of a Star of David, with a dollar sign above the star to the left, and a hammer and sickle above to the right. The second image is a photo of Mussolini at a microphone with his left arm stretched out in front of him, pointing slightly upward.
- The next page (41) says: "The Secret World Government / or / 'The Hidden Hand' / by Maj. Gen. Count Cherep-Spiridovitch // The Unrevealed in History / 100 Historical Mysteries Explained // Read this book and the World will never a gain [sic] seem / the same to you." This is the final page, excepting some blank leafs.
- The rear cover has the Facsimile Publisher's logo, its name and address, the name and address of the distributor "Gyan Books Pvt. Ltd." of New Delhi, the ISBN and barcode, and the prices. "US$ 10.00 / R. 500.00"
- As I think the final three pages make clear, this is not a "facsimile" edition as we would usually understand it, it's purpose is to distribute modern anti-semitic propaganda attached to hkistoric anti-semitic propaganda Whether this version was created by Facsimile Publisher, or whther they merely re-printed someone else's propagada is unknown. Given that, I'm not sure how much we can trust the material on pages 3-9 (Rosenberg's foreward), and 10-38 (caricatures and verse) to be accurate representations of the original pamphlet, with nothing left out. Those modern propaganda pages case doubt on the rest of the content.
Assuming, though, that the bulk of the pamphlet is accurate, some things to note:
- There is no mention of Dietrich Eckart as the writer of the verse, although we know this from other sources
- There is no place in this pamphlet in which four caricatures are together on one page with no text, so this specific image under discussion must have been assembled by someone else for some other purpose. The pamphlet sheds no light on the question of who did that, or for what text.

- A bit more information: a web search indicates that Gyan Books (the distributor) is either the parent of Facsimile Publisher, or vice versa. Their catalog doesn't jump out to me as being politically biased, but I know little about the culture and politics of India. The advertisement for Facsimile in the pamphlet says things like: "demand Any Rare Book", "Print & Publish: If you wish to get your book printed or published, we have the service for you", and "We offer customization of books as per the demand of the customer." This sounds very much ike a "publish on demand: operation, and lends credence to the supposition that the pamphlet's inclusion of modern antisemtic propaganda was done by someone else who then contracted with Facsimile/Gyan for printing and distribution. - Weak delete I can't find anything in Argentine copyright law to suggest that all news articles are public domain. The relevant article, Article 28, sounds more like fair use than public domain. I also can't quite tell if the authors are anonymous (and the copyright would be held by the newspaper) or if they are not (and the authors would hold copyright). If it was anonymously published, copyright would have expired after 50 years in 1990, before the 1996 URAA date. Otherwise, we'd need to know the names and death dates of the various authors. Unfortunately, even if all the authors died as soon as it was published, the newspaper wouldn't be PD in time for the URAA date, so the file would be non-free in the US. --AntiCompositeNumber (talk) 00:08, 16 February 2021 (UTC)

- Keep, this is clearly taken and published before World War II as can be inferred from the title translated into "Merger of SDP (Sudetenland Deutsche Partei) and NSDAP (Nazi Party)" meaning that it is PD since the annexation of the Sudetenland during the Appeasement era occurred in 1939 just before the War. As you can see by the Blutfahne and it's holder Jakob Grimminger, it is definitely before the war so it is I assume Public domain. PyroFloe (talk) 05:27, 10 February 2021 (UTC)
