Missing EXIFs. Dubious copyright claims: Flickr owner claims ownership of images shot in space though he is not an astronaut. Patrick Rogel (talk) 22:29, 19 May 2020 (UTC)
- Hi there, Daniel Molybdenum is a NASA photographer who visited the Space Station Processing Facility (a factory at Kennedy Space Center) in 2007, 08 and 09. I've met him in person several times, and he took some incredible photographs or edited NASA ones to make them look more beautiful. He emailed me that image earlier today when he was going through his archives, where he remembers meeting Tommy there in the high bay. The SSPF is a factory where members of the public can visit, especially during the ISS construction era. Also NASA images are public domain.User:Raphael.concorde (talk) 22:42, 19 May 2020 (UTC)
- @Raphael.concorde: Hi. Then first he could modify the problematic Public domain mark for a valid one. --Patrick Rogel (talk) 23:15, 19 May 2020 (UTC)
- @Patrick Rogel: I sent him an email and he's updated the status on his flickr page. Also by the way what tag code do I need to put in the image (because I couldn't find a template)? Thanks User:Raphael.concorde (talk) 07:45, 20 May 2020 (UTC)
- @Raphael.concorde: He has to choose "Some rights reserved" on Flickr but there's nothing to change to the file description page here. --Patrick Rogel (talk) 07:54, 20 May 2020 (UTC)
- @Patrick Rogel: Okay he's done it now. What's next? (Also he stated in his latest email he's a little confused about this suituation - he dedicates his images as free to use and share). User:Raphael.concorde (talk) 08:08, 20 May 2020 (UTC)

- Keep BUT the licensing must be changed, because the license on the Flickr upload is CC-BY-SA 2.0 (which is fine for Commons), but it's not PD. StrangeloveFan101 (talk) 14:25, 22 May 2020 (UTC)
- @Patrick Rogel: I fixed the licensing on this (since the picture is licensed as CC-BY-SA on Flickr), and it seems like it should be fine now. (Edit: also pinging @Raphael.concorde: ) StrangeloveFan101 (talk) 22:48, 23 May 2020 (UTC)

Image vandalism/hoax by a long-term troll. The Flickr source is the user’s own. The original is at https://images.nasa.gov/details/KSC-07pd0899, and as a NASA work, it’s freely licensed and might be worth keeping (without the Tommy Lee Jones face swap). Adeletron 3030 (talk) 04:24, 25 October 2023 (UTC)
Deleted: photoshopped dishonest troll image - it was not noticed in the previous discussion that this was a photoshop putting someone who wasn't there in the photo (it's rather less obvious than some of the user's other pranks). Flickr user "Daniel Molybdenum" since added to the bad Flickr user list. Note User:Raphael.concorde vouching for "Molybdenum" above - if they are not the same person, they are collaborators in promoting hoaxes; User:Raphael.concorde has since been indef blocked both here and on en:w. I have not been able to get given source link to work, neither directly nor via archive org at various dates. In reverse image searches I see many similar photos, but have not found this exact one. Statement "This image was retouched and enhanced by John Chryslar" makes me suspicious, as Flickr user "John Chryslar" has uploaded dishonestly photoshopped images to Flickr, and the Commons uploader User:Raphael.concorde has shared some of the hoax photoshops and edited in furtherance of hoax on Wikipedia. -- Infrogmation of New Orleans (talk) 00:41, 25 October 2023 (UTC)
- Keep; This looks like it might be legit. There's a nearly identical image at [2]; the only difference I can see is that the colors are less washed-out in the original. Omphalographer (talk) 01:25, 25 October 2023 (UTC)

- The Google Arts and Culture web site is unusually difficult to get images out of. There are apparently some tools (e.g. [3], [4]) to download and reconstruct their images, but that's a little more work than I'm ready to put into this image right now. Omphalographer (talk) 02:31, 25 October 2023 (UTC)
- The image also appears to be hosted at https://picryl.com/media/ksc-07pd2527-c82fb8, though it's from a site that asks for a donation for downloading high-res images, which isn't something I'm willing to support. Adeletron 3030 (talk) 22:05, 25 October 2023 (UTC)

Per COM:L, images must be free in the US and country of origin. Uploader themselves acknowledges these are not free in the US due to URAA by inclusion of {{Not-PD-US-URAA}} template. That template explicitly says "New files should not be uploaded with this tag, or they will be deleted," and these are indeed new files--uploaded 2021 (the template is for the cleanup of old files and is retained to inform that new uploads are not accepted)

Kept: no valid reason for deletion: it has been agreed that the restored copyright in the US shouldn't be the only reason of deletion. Commons is very open, but a possible use in an educational way is the minimum. These images did not cover this minimum requirement. Commons is not a replacement for private web space.

Some of the nominated images are so close to the originals that they are outright copyright infringements. Another part pretends to be exactly that, but in the end they are just bad fakes (especially "trading cards"). And other images clearly affect trademark rights. People don't even shy away from forging film posters. And the fourth part is miserable fake portraits of celebrities, some of which are so bad that they aren't even bad caricatures.
Marcus Cyron (talk) 20:00, 5 October 2023 (UTC)
Deleted: per nomination - There's a grab-bag of problems here, such as the fake images of real people being out of COM:SCOPE and many of the files being substantially similar to copyrighted works. In the future, breaking these mass nominaitons in to smaller batches, each with a specific problem, will make adjudicating them easier. --The Squirrel Conspiracy (talk) 08:32, 16 October 2023 (UTC) |
There is insufficient information to determine if these files are public domain in the United States. They are sourced to Facebook/Twitter pages which post old photos, or to recently-published articles; no information is available about the original publication. We don't know whether or not they were published in the United States within 30 days of publication in Argentina, and we don't know whether or not there was a copyright notice. All of them were published after January 1, 1928, so we need these details to know whether or not they are copyrighted.

- Of course, Keep - I can understand that some users nominate non-PD-URAA images (like it happened in previous DR), but this DR was really unexpected. Some of the images uploaded were taken from the National Archive of Argentina (which has even provided files to the project, per Category:Files provided by Archivo General de la Nación Argentina). Images provided from Facebook or Twitter pages dedicated to historic images of Buenos Aires and Rosario have historic value, like the AGN images have. A similar (but much more specific) DR can be seen here.
- On the other side, this DR seems so absurd that the user even nominate obvious newspaper photographs or chronicles (File:Copa argentina savoy vs chacarita.jpg and File:Chacarita vs godoy cruz cronica partido 1969.jpg), which is clearly showed at the soure page. Other images (File:Racing club equipo 1932.jpg was also taken from a newspaper or magazine. File:Vandalismo en paradas colectivos buenos aires.ogg was a news short film released in 1956 in theaters (as source indicates) with no credits to auhtor/s so what is wrong with the {{PD-AR-Anonymous}} license?
- To finish, I would like to know what is the criteria to establish the copyright status of some images, considering that Category:Works by Annemarie Heinrich (an Argentine photographer died in 2005) has a lot of portraits of artists taken by her (such as File:Laura Hidalgo (Pasea Faerman) por Annemarie Heinrich.jpg to name just an example) which were not published on the media. And I'm not complaining but only citing this case as a reference. Fma12 (talk) 09:56, 25 October 2023 (UTC)
- @Fma12: I agree that these photos may have historical value; however, we need to have accurate source information to demonstrate that they are public domain.
- Just because the photos are from a newspaper does not mean they are public domain in the United States. If the newspaper was published in the United States within 30 days of its publication in Argentina and included a copyright notice, it would still be copyrighted in the US today. The blog post did not include the entire newspaper, so it is impossible to determine whether it included a copyright notice.
- For the news short film, the source you linked just now is different from the source which you provided when you uploaded it, which did not include any information about the original publication of the video. The {{PD-AR-Anonymous}} license does not work because it was published in 1956, which means its copyright didn't expire in Argentina until 2006. This means that it was in copyright on the URAA date in 1996, which means its copyright doesn't expire in the US until 2051. –IagoQnsi (talk) 01:31, 26 October 2023 (UTC)
- Keep per Fma12. S5A-0043Talk 10:59, 25 October 2023 (UTC)
- Keep per above. No actionable evidence presented, just generalized fear, uncertainty and doubt. --RAN (talk) 11:39, 25 October 2023 (UTC)
- @Richard Arthur Norton (1958- ): I made this DR after having spent a lot of time making many other DRs for uploads by Fma12 which were provably not public domain. Or finding uploads by Fma12 which I eventually determined to actually be public domain, but only after much work on my part (for example, the photos in Category:1969 Topps American football cards and several other Topps categories, which are nonsensically tagged {{PD-US-not renewed}} despite being post-1963 – eventually I located images of the backs of the cards, and determined that {{PD-US-defective notice}} could apply). My understanding of Commons is that the burden falls upon the uploader to provide accurate and complete source information which demonstrates that an image is free, not upon everyone else to prove that it is not. –IagoQnsi (talk) 01:31, 26 October 2023 (UTC)
- Keep, the sources where the files come from are well documented. This massive DR is meaningless. Banfield - Amenazas aquí 00:05, 26 October 2023 (UTC)
- Twitter and Facebook pages aren't the original sources of these images. The source is whatever book, newspaper, or newsreel the images were first published in, and those sources aren't appropriately documented here on Commons. Omphalographer (talk) 00:24, 26 October 2023 (UTC)
- Twitter and facebook are not the only sources cited. I gave several examples above.
- ess Fma12 (talk) 01:38, 26 October 2023 (UTC)
- The only other specific example I see above is a page on Blogspot, which certainly isn't the original source of the image either. The sort of original source we need is "La Revista, edition of 25 October 1933" -- or whatever. Omphalographer (talk) 03:22, 26 October 2023 (UTC)
- @Banfield: Most of these photos are sourced to Twitter/Facebook pages (and in most cases, only the URL to the account is provided, not to the specific post which might have more information). These pages are definitely not the original source; the original source is unclear. –IagoQnsi (talk) 01:31, 26 October 2023 (UTC)

- Comment This DR should be closed because the argument of bad sources in such wide array of images makes little sense. If there are good arguments for some files (e.g. screenshots of films) a separate DR can be open. I agree with the person that opened the DR that Fma12 on some of their uploads doesn't bother to check the US status of the images, but that is not reason to nominate images that have little chance of being copyrighted in the US. For example, File:Chacarita vs boca copa argentina 1969.jpg was taken from a blogspot, but it had full scans of the news article with date and publisher. The only chances of this particular image being Copyrighted in the US are (1) the Argentine newspaper was also published in the US with additional copyright symbols stamped all around and followed all renewal formalities (2) an unknown US-based magazine published it short afterwards. For (1) there should at least some tangible suspicion that the newspaper was published also in the US. Common sense states that Argentinian daily newspapers were not published simultaneously in the US in the 1960s. After all, we don't expect uploaders to check that a US-magazines from the 1960s was not published simultaneously in the UK. For (2) even if the scan was from the Library of Congress the uploader wouldn't have a chance of finding out that the image was used in another obscure publication (this image is not Maradona holding the World Cup). Other images like File:Chacarita vs godoy cruz cronica partido 1969.jpg, being a news article and not a photograph, is likely to have copyright issues as it has longer protection. Günther Frager (talk) 21:35, 26 October 2023 (UTC)

Two issues with this 1958 photograph. One, it is a 1958 photograph with an unknown country of origin, the Expo 58 was held in Brussels, Belgium, and in most of the EU, 1958 photos are still under copyright. Second, the architect of this building died in 2002, so it would not be free until 2073. Abzeronow (talk) 16:11, 25 October 2023 (UTC)

Derivative work, see Commons:TOYS. Art is too detailed to qualify as simple geometry. If somebody made identical replicas of these and sold them they would be violating the original artists copyright. - Keep There are lots of logos tagged as "own work" althought they aren't. A simple change of license to {{PD-textlogo}} is enough. This logo is extremely simple to be under copyright. - Fma12 (talk) 13:09, 27 October 2013 (UTC)

FOP Switzerland does not apply for interior places. It is generally held that the interior of a church cannot be depicted under Article 27. The sculptor of the artifacts is Dolores Blasco who doesn't seem to have died yet and the artifacts are located in the interior of a church. The church was inaugurated in 1964, so it will still need some time until it will be in the PD.

- What do you mean? This is a mural about the founders of Ruskin, Florida and its namesake. There is not much of Ruskin's history in the town and this mural is the only public depiction of its history. It is near the post office. I took the picture. Kmccook (talk) 02:07, 25 October 2023 (UTC)

The image was published in the website of Buenos Aires government, but it is not their work, and thus the CC-BY license doesn't apply to this image. The image appears in an announcement of a show in September 2023 without attribution. However, one can check the metadata and see that the photo dated October 2022 was taken by Martin DarkSoul, a well known photographer of the Argentine heavy metal scene [14]. Moreover, images from the same set and also attributed to Martn DarkSoul appears in an articule of Rollings Stones magazine in December 2022 [15]. That is, they were not even arranged by the City government. We cannot keep this image unless Martín DarkSoul sends an explicit permission to COM:VRT. [edit]These are both derivative works of a non-free third-party plan of the church. The plan occupies most of the picture, so it's not de minimis. It's a complex drawing, well above the threshold of originality. And freedom of panorama in the UK doesn't extend to graphic works.

The source is a recent article in the Argentine government website, however the cannot use their CC-BY license because this image doesn't belong to them. The photo is a portrait of Else Bornemann (1952-2013) and one can find it on her website [16] (notice the copyright notice at the bottom). To keep this image we need a permission from the actual photographer. Günther Frager (talk) 20:17, 25 October 2023 (UTC)

This source is a recent article from the Argentine government website, that has its content licensed with CC-BY. However, we cannot use their license because they don't hold the copyright of this particular image. One can find it all over the web, and for example here they credit Rubén Blades for providing it. That is, it is likely a press release photo. We can only keep it if we obtain an explicit permission from the photographer. Günther Frager (talk) 20:39, 25 October 2023 (UTC)

Moreover, the image appear in several interviews published before. For example this article from October 2021 or this one from April 2022. - Keep - Normally I'd say delete given this was a drive-by "dick pic" uploader but given the images are of high quality and given they all include more than a penis (ie torso/body) IMHO I see no real reason to delete. If these were of mediocre quality then it would be a firm delete however that's not the case here. –Davey2010Talk 21:03, 19 May 2022 (UTC)
- Comment at Commons:Administrators' noticeboard/User problems#Porn user an admin suggested deleting some of them as spam, and keeping the best ones. I’d recommend deleting File:Nude male cock ring anal view.jpg first and foremost as a fairly generic ass pic. Probably any of the ones that include masturbation/cum can be deleted as they’re unlikely to be used educationally and distract from the genuinely artistic torso shots. Dronebogus (talk) 21:38, 19 May 2022 (UTC)
- I’m removing File:Nude male shaved body.jpg as it’s clearly very good quality, tasteful, and there’s no valid reason to delete. The others I’m unsure about since many are oddly lit and nearly identical. Dronebogus (talk) 21:44, 19 May 2022 (UTC)

Not clear when this photo was taken, or even if it was originally published around the time when it was taken. Uploader estimated it was taken circa 1990, but there's no clear indication in the source link. If the photo was first published after March 1, 1989, it would not be public domain in the United States per COM:HIRTLE. There are significant doubts about the public domain status of this photo, so it should be deleted per COM:PCP. IagoQnsi (talk) 03:36, 25 October 2023 (UTC)

Card cannot be public domain in the United States if it was published after March 1, 1989. The precise publication date is not clear; however, it is from the 1989/90 season, which started much later in 1989. In the source link, a 1990 copyright date is visible on the backside of the card. Altogether it appears unlikely that it was published before March 1, 1989, so it should be deleted per COM:PCP. IagoQnsi (talk) 03:52, 25 October 2023 (UTC)

- Original uploader has to provide the source before other people use the picture online. Not providing original sorce is bad and makes it impossible to verify the status of the work. What if the paper copy they scanned said who the photographer was but they decided to hide it (which I personally suspect since they cropped out half of the name Cukurs Herbert in the bottom of the image, like they were trying to hide something) to make the photo look free? IagoQnsi (talk) 01:04, 26 October 2023 (UTC)
- In the USA copyright registration was not automatic, you had to apply for a copyright, and all perceivable copies needed to have the copyright symbol on the image, up until 1989. This image does not appear in the copyright registration database. You can play the "What if?" game all day, but in the end we use Occam's Razor, a man who was born and died in Buenos Aires, we apply Argentine copyright law. But what if he was visiting Switzerland, and the image was taken there? --RAN (talk) 02:26, 26 October 2023 (UTC)
- If this photo appeared in any work (newspaper, magazine, etc) that was syndicated to the United States, it could very well be in copyright. There are a lot of Argentine expats in the US so it would not be at all surprising to see Argentine periodicals be exported to the US (for example, I know El Grafico started publishing in the US in the 1970s). Such a periodical could easily still be in copyright if it included a copyright notice (as many newspapers/magazines did). We need to know what publication this originally appeared in. –IagoQnsi (talk) 02:42, 26 October 2023 (UTC)
- Again, if you have actionable evidence, now would be the time to present it, otherwise you are still playing the "what if? game". You can play the "what if? game" endlessly, What if he was on a ship in international waters when the image was taken? What if he was standing on the border of two counties, one foot in each country? What if the image was taken in 1960 in Argentina, but it sat in the camera undeveloped until it was posted to Commons? What if the picture was published in a newspaper, but not a single person looked at the image? What if Pepe had an identical twin brother and they were separated at birth and the identical brother lived in France, and this is an image of the twin brother in France? --RAN (talk) 03:39, 26 October 2023 (UTC)
- Per COM:LI, "All description pages on Commons must indicate clearly under which license the materials were published, and must contain the information required by the license (author, etc.) and should also contain information sufficient for others to verify the license status even when not required by the license itself or by copyright laws." Per COM:PCP, "where there is significant doubt about the freedom of a particular file, it should be deleted." We do not know where this file came from at all; we only have a reupload from 50–60 years later with no details. No one is able to verify the license information. –IagoQnsi (talk) 03:50, 26 October 2023 (UTC)
- Keep. Although the license doesn't apply to this photo for other reasons mentioned below, I'm not sure that in general the license of argentina.gob.ar doesn't apply to cultura.gob.ar. Has that point been examined in other DRs? cultura.gob.ar links directly to argentina.gob.ar and cultura.gob.ar doesn't seem to have terms distinct from argentina.gob.ar. However, in the case of this photo and other photos at the source, they are noted as being courtesy of the collection of an individual and of archives of the family of Pepe Biondi. As such, they would probably not be under the general license of the website, whatever that may be. Anyway, for photos of that time, the solution is the legal expiration of copyright. If there is no evidence to the contrary, this photo can reasonably be said to be an Argentinian photo and PD-Argentina + PD-1996. Commons generally does not assume that everything could have been published in the U.S. unless there is actual indication to conclude so. PCP does not require that. -- Asclepias (talk) 16:22, 26 October 2023 (UTC)

We generally rely on Occam's Razor, we accept the simplest explanation and we don't delete on hypothetical speculation. If you want something deleted, you need to provide actionable evidence, not Fear, uncertainty, and doubt, which could be used to denigrate any image. For instance: Who took the picture? What if the photographer was in the bathroom, and an assistant pressed the shutter release. What if the photographer's spouse pressed the shutter release while the photographer adjusted a light. What if a monkey entered the photo studio while the photographer, their spouse, and the photographer's assistant, were inattentive and the monkey pressed the shutter release. What if the camera was on a random timer, and no one was responsible for pressing the shutter release. --RAN (talk) 02:22, 26 October 2023 (UTC)
- If this photo appeared in any work (newspaper, magazine, etc) that was syndicated to the United States, it could very well be in copyright. A newspaper/magazine did not need to place a copyright notice on every image; just one copyright notice somewhere in the issue was enough. I am not speculating that something wild or impossible happened to the photographer; I'm not even asking that we know the photographer's name. I just want the name of the publication that it was published in, which seems like a bare-minimum level of sourcing to me. –IagoQnsi (talk) 02:44, 26 October 2023 (UTC)

There's only very limited freedom of panorama under Lebanese copyright law per COM:FOP Lebanon, and it doesn't seem applicable in this case. This means that the copyright status of the statue itself needs to be clarified. Given that the statue is found in the the Sanctuary of Our Lady of Bechouat and the sanctuary seems to date back to the 1700s, it's possible that the statue itself is also too old to still be eligible for copyright protection. More information about the statue's en:provenance, however, will need to be found to determine whether it has entered the pubic domain per COM:Lebanon. I don't think this photo can be kept by Commons per COM:PCP unless it can be shown that the statue either was never eligible or is no longer eligible for copyright protection. -- Marchjuly (talk) 05:30, 25 October 2023 (UTC)

Copyvio of https://www.youtube.com/watch?v=s1M30Zk93Yc (which is just the first result when you search YouTube for the title) – I haven’t done a technical analysis, but I’m sure it must be the same recording, there’s no way the timing and tuning and everything matches by accident. File:Republic of Rose Island.ogg is another copy by the same user.
(Side note: in the file’s history, I reverted some IP changes as “IP vandalism”; I only noticed afterwards that the pre-“vandalism” license info was also suspect, and that the IP has made several other edits related to the uploading user and is probably the same person. But even if the IP changes weren’t vandalism, the attribution there was still not correct, and in any event the YouTube video simply isn’t CC-licensed.) - Note that the BEIC photos are in a different situation than the others. Proof of the photographer's license has already been sent to Wikimedia. - The link you provided says that the author of a derived work needs the permission of the original artist (Art. 4 LDA prevede che chi realizza elaborazioni creative di un’opera ne ottenga i diritti esclusivi, senza pregiudizio dei diritti dell’autore dell’opera originale. Se chi elabora un’opera altrui deve rispettare i diritti dell’autore originale, e quindi ottenere il permesso per la riproduzione e l’elaborazione, a maggior ragione il permesso è necessario quando l’elaborazione non è creativa. – @Nemo bis: thanks for providing it). BEIC photos have the permission from the photographer, but the OTRS permission doesn't contain one from the sculptor. This issue has been raised in other occasions, e.g. Commons:Deletion requests/File:Paolo Monti - Servizio fotografico - BEIC 6361509.jpg, Commons:Deletion requests/File:Paolo Monti - Servizio fotografico (Venezia, 1956) - BEIC 6342541.jpg, Commons:Deletion requests/File:Paolo Monti - Servizio fotografico (Italia, 1955) - BEIC 6341250.jpg, etc.
- We have to see if the photo changes completely the appearance of the original artwork (what's called "Protection threshold" in the document – Soglia di protezione); in other words, we still need the permission of the original author if the "identity of the original work is reproduced" without any "relevant semantic difference". --Ruthven (msg) 17:49, 15 October 2018 (UTC)

Photo of Alberto Giacometti with his art by Erhard Wehrmann
[edit]Photo's with a VRT ticket of the photographer, however, these photos show a copyrighted work of Alberto Giacometti (1901-1966). Two cropped versions are available on Commons, where the artwork has been cropped to show the portrait of Giacometti, File:WehGi (cropped)2.jpg and File:WehGi (cropped) (cropped).jpg. The original versions can be undeleted in 1966+71=2037.
Ellywa (talk) 20:22, 25 October 2023 (UTC)
- The definitive photograph was taken in 1962 at the Biennale in Venezia. Other photo artist and photo reporters were there and also took photos of Giacometti with his artworks. As can be seen from these photos, they were clearly taken with his consent. Here a photo taken probably on the same day: Photo by Ugo Mulas. It can therefore be assumed that Giacometti also at least silently permitted the present photo. Erhard Wehrmann was a well known photo artist by that time. Giacometti is looking in the direction of Wehrmann and has certainly noticed that one or more photos have been taken. He was certainly also aware that he was standing in front of his own artwork. Giacometti was furthermore at the Biennale. Therefore, he was aware of the purpose, nature and extent of the photographic recordings on site. He had to expect that the photographs of him and his artworks would be published. I would say, that a implied-in-fact consent for the photograph to be taken of him and the artwork can be assumed. Waterborough (talk) 09:00, 28 October 2023 (UTC)
- Giacommetti gave silently consent for a photo of himself with his artwork. But would he give consent if his artwork would be cropped from the photo to be printed elsewhere, for instance on a pink teapot or on a raggy T-shirt? This is what ccbysa would allow. You simply do not know if he would give consent. And you do not know if the heirs of his copyright would give consent. Somebody could ask them. But that is what copyright is all about. An owner of copyright can control all copying. So imho we cannot keep this on Commons. Regards, Ellywa (talk) 14:31, 28 October 2023 (UTC)
- With this way of argumentation you can delete half of all images on wikimedia. It is not a question of whether the person granting permission agrees in detail to any possible form of redistribution, but whether there is consent for the photographing person to continue to use the artwork as he or she wishes. And according to you, that is the case here. Giacometti undoubtedly knows where he is and who he is. It is clearly in his interest that photos should be taken. His consent is valid beyond death, so that the heirs cannot object to it.Waterborough (talk) 22:00, 31 October 2023 (UTC)

Deleted: The Make-a-Wish logo is PD-textlogo, but image of the Genie from Disney's Aladdin film definitely is not free and it's too large to be de minimis. —holly {chat} 21:31, 22 January 2024 (UTC)
Screenshots of Javier Milei
[edit]Possible COM:LL. Screenshot from a YouTube video of a supposedly official channel. The channel is not the official one, for several reasons. It has a low number of followers (1.5K) and the party was second on the latest presidential elections in Argentina. It has a only a handful amount of videos. Most importantly checking the candidate's official webpage when this video was uploaded here one can see that the official YouTube channel at that time was this. This channel is still the official one, has nearly 300K followers, and hundreds of videos, and none of the ones I checked has a CC-BY license. - Keep If you check the website of LLA (https://lalibertadavanza.com.ar/) in the section of social networks, they link to the Instagram official account of 400K followers and the Facebook account of 50K followers together with the Youtube account from which the images were extracted. Moreover, if we check previous versions of the website of 2021 and 2022 they all link to the same youtube channel. It seems that both the website and the channel were only in use for the 2021 legislative election, which explains their irrelevance nowadays, but everything points to the fact that the discussed images came from official sources of the party. Duplicated (extract of 2 pages from the whole 677 page book File:Historia de los condes de Urgel (IA historiadelosco00mascgoog).pdf). It was created for ca.source purposes, but now it has been overriden (using the whole book). Thanks. Aleator (talk) 18:22, 25 October 2023 (UTC)
- I've nominated for deletion also the whole PDF book file for other reasons, but the rationale for nominating this DjVu continues: it is a Djvu of 2 pages extracted from another file we already have. The Djvu was created because we wanted a "light" scan in ca.source, but now the source is the whole book, the "correct" scan (File:Historia de los Condes de Urgel (tomo II).pdf). You can see the transcription in these pages: 541 and next (the transclusion is here). So I cannot figure out what this DjVu can be used for now. -Aleator (talk) 00:29, 26 October 2023 (UTC)

Kept: per King of Hearts. Photos from 1962 would not have EXIF, so that must have come from the digitization. —holly {chat} 19:58, 23 January 2024 (UTC)

- Keep This DR statements are not sufficiently substantiated IMO. The Central Bank is part of the Argentine government since it was nationalised in 1946. In fact, its authorities are designated by the President of Argentina like any other government agency of that country.
- The images are indicated as "Imagen: Banco Central de la República Argentina" but these images were published only at the Government of Argentina website (under the Cc-by-4.0/Argentina.gob.ar license) so which copyright law would be infringed? Under those circumstances, that license would not be unappropriated.
- About the Argentina:currency, that guide/MOS was written before the argentina.gob.ar website published the banknotes (the Argentine copyright law was promulgated in 1933) Fma12 (talk) 23:23, 25 October 2023 (UTC)
- As I wrote in Commons:Deletion requests/Files found with insource:"Argentine peso banknote": The Terms and Conditions of the website is about the content available on the website. It doesn't give a wildcard for the content of the whole Nation. The Central Bank is an autarchic entity (like the national universities), so they have their own policies and regulations. The Argentine mint (Casa de la Moneda) is a state-owned company and is no difference from other companies. The banknotes have design and the intellectual property of the design belongs to the designer. The current intellectual property law doesn't provide any exception for coins, stamps, etc. nor has a clause about work of state employees being in the public domain. The copyright law is a law, and only the legislative branch makes laws. The T&C of a website controlled by the executive branch is not a law and cannot overwrite one. In this particular case they acknowledge the image is from the Central Bank, so they cannot re-license it in the same way as they cannot re-license scans from newspapers [26], or paintings from an artists [27], etc. Günther Frager (talk) 00:23, 26 October 2023 (UTC)
- Keep per above; Argentinian Central Bank is state bank and thus, part of the government. Argentina.gob.ar has the right to license these images as CC. Banfield - Amenazas aquí 00:16, 26 October 2023 (UTC)
- Comment I think that this DR is an exagerated view of any precautionary principle. Unlike the national universities, which had their own statutes and their authorities are elected by an internal assembly (p.e. the University of Buenos Aires), the Central Bank directory is designated by the executive power. And decisions about the issues of new banknotes are taken by the National Government, not the mint.
- On the other side, and as user:Banfield stated above, the Government of Argentina website has the right to license those images under a CC license. Those banknotes designs were not published neither on the Casa de Moneda website nor on any other website prior to Argentina.gob.ar. Fma12 (talk) 14:48, 26 October 2023 (UTC)
- The Central Bank has also its statute, and yes the president elects the directory with the approval of the senate. The president elects also the members of the Supreme Court, both the Central Bank and the Supreme Court are independent entities. You are confusing the owning the intellectual property and owning a copy. I said that both the images had a different source (I didn't invent it, the webpage literally says it), and that the design of the bills are protected by copyright. The design is done by Casa de Moneda [28][29]. Moreover, the images of the $1000 banknotes were published first at the Central Bank on 23 May 2022 while the source cited on these images was the next day. See the press release and its accompanying images. The $2000 bank notes were initially announced (including images) on 2nd February 2023 [30], and were officially released on 22 May 2023 while the source cited was again published the next day. See the announcement and the accompanying press kit. The footer of the website states: "Copyright 2006-2023 © | Banco Central de la República Argentina | Todos los derechos reservados".
