Vorweihnachtliches Magdeburg
[edit]Du hast da Bilder vom vorweihnachtlichen Magdeburg hochgeladen und in die Weihnachtsmarkt-Kategorie gepackt. Aber nur die Hälfte sind auch vom Weihnachtsmarkt, die andere Hälfte ist vom Platz zwischen Dom und Landtag vom Category:Magdeburg Domplatz Lichterwelt 2024. Auch auf dem Weihnachtsmarkt gab es "Lichterwelt". Umgekehrt gab es auf dem Domplatz aber keinen Weihnachtsmarkt, sondern nur den Hauptteil der Lichterwelt. - Ah, dann aber vielleicht einen kurzen Erklärungstext in die beiden Kategoriebeschreibungen? Dass die Dateien einmal die Endung png und einmal jpg haben, hatte ich nicht gesehen. Sah für mich eher wie ein Serverschluckauf aus, bei dem identische Dateien doppelt katgorisiert sind. Und das "jpg" als Namensergänzung habe ich auch erst bemerkt, nachdem ich die Katgorienamen minutenlang angesehen habe. Ich dachte es sei zweimal derselbe Name, einmal mit einem Tippfehler drin, erst zuletzt habe ich gesehen, dass der "Tippfehler" am Ende ist, und die Ergänzubng "jpg" für ein Unterscheidungmerkmal zwischen Fotos, Videos, Audios und PDFs gehalten. Baustellenschilder, Wahlwerbung u.a.

danke für Deine großartigen Photos und Deine tolle Arbeit hier auf Commons.
Mit Interesse las ich Deinen Hinweis bei der Diskussion zu Grand-Ducs Löschanträgen zu deutschen Baustellenschildern bezüglich der Werbung auf Omnibussen, deren photographische Veröffentlichung bzw. Weiterverbreitung von einem deutschen Gericht offenbar urheberrechtlich als zulässig angesehen wurden.
Auch hast Du auf Commons offenbar selber Photos von deutschen Wahlplakaten veröffentlicht.
Dies läßt mich die vergangene Diskussion mit Gnom bezüglich der Löschanträge auf meine Fotos von Wahlplakaten wieder in Frage stellen:

- @KaiKemmann: Hi lieber Kai und danke für dein Lob, das freut mich sehr zu hören :). Die Thematik von Werbung auf Omnibussen habe ich hier noch mal gefunden: https://www.lto.de/recht/hintergruende/h/bgh-urteil-izr24715-aida-kussmund-foto-bewegtes-objekt-schiff-urheber-werbung-marke/2. Die Panoramafreiheit in DE ist in manchen Fällen eine Interpretationsfrage, besonders bei Begriffen wie "bleibend".
- Und die Thematik mit den Wahlplakaten wurde und wird hier fleißig diskutiert. Die Einen sagen, dass die Panoramafreiheit greife, da die Schilder teils nur während ihres Aushängens existieren (nur zum Zwecke der öffentlichen "Präsentation") und dann ggf. weggestellt oder vernichtet werden, und die Schilder meist praktisch 1 Monat oder länger hängen. Andere, die tendenziell vorsichtig sind und Begriffe strenger auslegen, sehen Wahlplakate wie Werbeplakat an Plakatflächen, die da nur 2 Wochen hängen und dann wieder weg sind (nicht bleibend). Momentan ist man wegen COM:PCP eher bei Letzterem, solange nicht Ausnahmen wie freie Lizenzen oder "oberhalb der Schöpfungshöhe". Ich habe meine Wahlplakate vorsichtshalber löschen lassen, aber es kann durchaus sein, dass irgendwann eine Gerichtsentscheidung diesbezüglich Klarheit schafft. Meinungen, Erkenntnisse und Rechtsauffassungen können sich jederzeit ändern. Bei Sonderfällen wie "vergessenen" (Wahl-)Plakaten lässt sich auch trefflich streiten.
- Bei Bautafeln sehe ich aber einen "bleibenden" Charakter. Sie sind so konstruiert ("gebaut"), dass sie lange stabil da stehen (eben auch länger als 1 Jahr) und "an öffentlichen Straßen" sowieso. Die Tafeln werden ja in die Öffentlichkeit gestellt, um der Gesellschaft lange genug Informationen zu präsentieren (und in Deutschland wissen wir ja sehr gut, das Baustellen lange dauern können (bei uns in Hof Wilhelmstraße 3 ca. 2021–2025; FOS/BOS 2020–mind. 2025; Neubau an Sana Klinikum 2021–vrs. 2025. Und die Tatsache, dass sie wieder entfernt werden, hebt eine Panoramafreiheit nicht auf. An einer Realschule wurde mal das Logo an der Straße geändert, aber es hatte eben "bleibenden" Charakter. Die Panoramafreiheit in Deutschland ist tendenziell eher großzügig ausgelegt. Deshalb halte ich die Löschdiskussion (auch aus anderen Gründen) für überzogen.
