Recreation of speedy deleted page: Category:2019–20 coronavirus pandemic in Frankfurt by User:A.Savin with resolution no point in micro-categories. The file in the Frankfurt category has since been moved to covid in Germany category and than to covid in Hesse category, but is no part of this category: https://commons.wikimedia.org/w/index.php?title=File:Personal_protective_equipment_nCoV.jpg&action=history

Category:COVID-19 pandemic in Saarland

Recreation of speedy deleted page: Category:2019–20 coronavirus pandemic in Illingen by User:A.Savin with resolution no point in micro-categories. The file in the Illingen category has since been moved to covid in Germany category

Saarland (= federal state) is not like Illingen (= small city) --> so wrong comparison --> keep Triplec85 (talk)
commons ist not wikipedia. I guess there will be a lot more pictures than articles.
there should be categories for states and at least for their federal states. For larger cities, in my opinion, there is no reason to choose a subcategory, otherwise the federal state category will be overcrowded. Why are categories deleted at this time? This crisis will probably accompany us for months or years and there will surely be countless pictures, no articles.
Saarland is a federal state of Germany. Like california of USA. I guess you then will also delete Category:COVID-19 pandemic in California ?!?

In this point, i also don't understand Commons:Categories for discussion/2020/03/Category:COVID-19 pandemic in Braunschweig. There are still 47 Pictures in Category:COVID-19 pandemic in Braunschweig, so it would overcrowd the federal-state-category Category:COVID-19 pandemic in Lower Saxony.
It is also a question of the systematics and location of the images. More pictures are being uploaded to COVID-19 every day. Lower Saxony has some big cities like Braunschweig. 1000 + x unsorted pictures at a time 2020 in a federal state category make no sense. This manuscript was created in 1879, it automatically is in public domain per US Copyright law where any work published before January 1, 1925 is PD. Please let me know if this works. I just closed a deletion request for this file with a decision to keep it, but now it seems to me that I misunderstood the reasoning of nominator Elisfkc. I thought they were referring to the Commons account with "the account's only image", but in fact this user (Ifwest) has uploaded quite a lot, and I assume now that Elisfkc meant the original source, flickr account "Zwitterio Cromenale", where this is indeed the only image - which I also find rather suspicious. This is nothing against wonderful contributions by We hope, who had extensively made research about copyright notices and registrations of various works yet... well, hasn't edited for two years. However, this image is used not just in a Billboard magazine advertisement but also as part of the original vinyl gatefold release of Joni Mitchell's 1974 live album Miles of Aisles (see discogs and eBay listing). Also, the live album has the copyright notice on the back cover, "(P)(C) 1974 Elektra / Asylum / Nonesuch Records", indicating that the record labels owned by Warner Bros. hold copyright to not only the whole album recording but also more likely the images associated with the album, including the photo also used for a Billboard magazine ad. I am unsure why the ad lacked copyright notice, but the fact that the ad didn't have a notice doesn't make the photo ineligible for copyright, especially when the album contains the copyright notice. Useless picture. At first it looks like a thermal image but then you see this in the image description: "I took a picture of a duck and turned it thermal using iPhoto editor." So this is in fact just a normal photograph of a duck, with the colours modified to make it all strange-looking. Other hints include that the duck should show up much warmer than the surrounding soil or plants but is in fact the same colour, and part of the duck's wing shows in its original white colour. That's great, can you follow the instructions at Commons:OTRS and ask the author or copyright holder to forward the permission information to the permissions-commons@wikimedia.org address? Then OTRS can mark the image that they have verified that permission from the author or copyright holder was granted to upload the image under a free licence.     • You mean the recording (performer's rights are usually about authorizing their performances being recorded; unauthorized recordings are a problem but usually not authorized ones). However the recording itself has a copyright and that would have to be licensed. It's possible that someone uploaded these to archive.org but those uploads are not vetted in any way.  Delete unless we get more information on the recording itself, to either show a free license or PD status of the recording itself. Since some images are used in some articles of English Wikipedia, a good case could be made for their retention as fair use, according to the rules of the English Wikipedia; ditto, m.m., for any other Wikipedia or Wikimedia projected that is contaminated with a fair use clause. Obviously, it's time for another Cloud Gate DR. I've tried to be as generous as I felt was reasonable about only including the images that violate the copyright in this sculpture.

For context, en:Cloud Gate is a public sculpture erected in 2006 in McCormick Park in Chicago. It is not only copyrighted (with no FOP for sculpture in the US), but the City of Chicago has licensed it from the artist, and requires permission for any commercial use of photographs (which is incompatible with Commons).

I've tried to weed out the ones where either the Bean is a de minimis aspect of an image of the park itself, or where it's shape is not visible and it's only 'a mirrored object'. Most of these are simply not okay.

I'm sorry that you find this 'sudden and troubling', but I suggest looking at the history of this DR page. As you will see, nearly all images of this work have been deleted on a periodic basis for half a decade now (previously, 'all' images were deleted, but those DRs were filed for the 'category' instead of just files in it, and are thus not here). That copyvio images are sent to DR is nothing novel, this is just something that most people don't realize is copyrighted and like to photograph, to the extent that photography of it is discussed in it's article. In File:The Bean and McCormick Tribune Plaza.jpg, the bean is de minimis, image hardly even has the bean in the photo. The sculpture is not even visible in File:Tented cloud gate.jpg. File:Cloud gate construction.jpg is simply a photo of a construction site, the sculpture had yet to be erected. It is inarguably de minimis in File:2005-10-13 2880x1920 chicago above millennium park.jpg. It is also minimus in File:Millennium park,chicago.JPG. It is hardly even visible in File:Millenium Park (7391867314).jpg. Seems to be de minimus in File:Bean from Kemper Tower (14958184744).jpg. Also, hardly the primary focal point of the image File:Chicago Bean.jpg. Not at all included in the image File:Cloud gate, Chicago skyline.jpg, as far as I can tell (not sure why it is in this category). Certainly not included in the image File:2008TIBE Day5 Hall1 ThemeSquare On the Road with Cloud Gate.jpg (should not be in this category at all). Not the primary focal point of the image File:The Bean - Millennium Park - panoramio.jpg.

@JWilz12345: TOO does matter here; I could for example extract one of the squiggly lines from Donald Duck's head and it would suddenly fall below TOO. So just because the work as a whole is above TOO, doesn't mean that a small portion of the work is necessarily also above TOO. For images like File:The Bean Chicago United States Travel Photography (112096191).jpeg, the shape of the outline is almost certainly below TOO. So the artist here has essentially created an algorithm to transform the surrounding Chicago skyline, in the form of a mirror reflection. The question becomes: Does the creator of this algorithm have enough creative input to have a copyright stake on its output, which was chosen by the photographer? -- King of ♥ 04:39, 14 August 2021 (UTC)[reply]
@King of Hearts: it seems we are entering another part of the gray area of the no U.S. freedom of panorama for any protected public artworks concept. The sculpture may be a simple kidney-shaped bean that is "ordinary" in the eyes of most people, though it has created headaches for one end-user (National Rifle Association). Kapoor himself is a noted litigous artist, and one attorney asserts that only the City of Chicago has the right to commercially use images of this copyrighted work. Previously these were categorized under Category:Millennium Park so they got undetected. There is no freedom of panorama for all copyrighted artworks in the United States, see COM:FOP US. US de minimis is sharper (COM:DM United States), as it uses "triviality" concept instead of "incidental".

Several new files have been added that populate this category. I'm also tagging several older files that haven't been discussed before to gather consensus on whether they should be kept on de minimis grounds.

At issue is that these files depict Cloud Gate, a copyrighted sculpture permanently installed in the US where there is no freedom of panorama for public art. Quoting an earlier successful deletion request, "this sculpture has been the subject of a copyright lawsuit by its living sculptor, Anish Kapoor, against a commercial user, NRA. See also the following resources regarding Kapoor's lawsuit against NRA: Artnet, The Guardian, and BBC." IMO the litigousness of the copyright holder should not affect our consistent application of standards around copyright law but it's been brought up before so I suppose it's worth bringing up again.

First, there is one photo that is entirely of Cloud Gate for which a de minimis rationale would not apply:

Second, there are several photos in which Cloud Gate appears at a distince within the larger context of the setting. A de minimis arguement could be made for these, and we have kept two files in the past (File:2005-10-13 2880x1920 chicago above millennium park.jpg and File:Millennium park,chicago.JPG) on these grounds. However, in both of those cases Cloud Gate is a significantly smaller and less focal portion of the image.

Third, several photos depict a portion of Cloud Gate up close, often with the inclusion of other elements in the foreground or background. Do these files qualify as de minimis inclusion of the copyrighted work? Consider this file which had most of Cloud Gate coropped out to focus on the background elements instead.

Finally, one photo is simply a selfie taken by way of the mirrored surface of Cloud Gate. This might be argued to be entirely a photo of the sculpture, or to be a completely de minimis usage. In either case, I'm nominating it here for consensus:

I disagree. I think this is a correct list:

  •  Keep
  • UK, Hong Kong -- FOP OK for interior public space even with an admission charge
  • Australia -- the same as the UK
  •  Delete
  • USA -- no FOP for sculpture
  • Germany -- no FOP if the photographer is indoors
  • Netherlands -- the law does not permit an admission charge for FOP interior spaces
  • Austria -- while our summary says interior spaces are OK, it does not say whether that includes places that have an admission charge. The law simply says
"sich bleibend an einem öffentlichen Ort zu befinden"
"be located permanently in a public place"

so that does not help. Until we get that clarified, I think we must assume that it does not include places that charge admission.

There is also the question of "permanent". We have generally made a judgement call on this. The photos of the Captain Cook figure outside and on board a modern boat appear to be associated with an event in 2012 where the figure was transported on a modern boat from the Captain Cook Cruises company to commemorate a transit of the planet Venus across the Sun. (According to the event details, the real Captain James Cook tracked a transit of Venus back in 1769.) Australian freedom of panorama is stated as applying to permanently situated works; however, the listed photos show the Captain Cook figure from a temporary display.

Wenn die Veröffentlichung gegen Recht verstößt, sind die Dateien zu löschen. Zum Zeitpunkt der Erstellung der Dateien befanden sich bereits zahlreiche andere in der betreffenden Kategorie, so dass Ersteller der Meinung war, dass die betreffenden Wachsfiguren nicht unter die Urheberschutzregeln fallen. Zum Zeitpunkt der Fotografien bestand außerdem kein Fotografierverbot, oder Hinweis, dass Fotografien nicht veröffentlicht werden dürfen. Da offensichtlich alle bei Madame Tussauds weltweit hochgeladenen Fotos gelöscht werden sollen, scheint das eine neue Richtlinie zu sein. --Dguendel 07:23, 27 March 2020 (UTC)

  •  Comment As far as I can tell there have been some debate about deleting or keeping the files. Per Commons:Copyright_rules_by_territory/United_Kingdom#Freedom_of_panorama FOP apply for sculptures. The question is "if permanently situated in a public place or in premises open to the public". As I understand it then it is open to public so the the key word is permanent. The link above does not provide much guidance on what permanent means. I bet that in 1 million years all the buldings and sculptures we have today will be gone. So permanent can't mean forever. It could perhaps mean as long as the building or sculpture can last. Alt least it should mean that there are no plans to remove it in near future. Unless someone can point to a law or something that says otherwise I would say we can only keep if the statues are meant to stay on display for several years. --MGA73 (talk) 20:39, 26 March 2020 (UTC)[reply]
 Comment: I think you have misunderstood the concept of 'permanent' in this context (and let's face it, intellectual property law is a complex jungle to navigate). For the purposes of Freedom of Panorama (FoP), if the photographer cannot reasonably determine in advance how permanent a subject is when the photograph is taken, then it is considered permanent.
Take the current context. A waxwork (which is copyright in its own right) is displayed in a public place in the museum. If there is no indication of any time limit as to how long the waxwork will be displayed, then the display is considered 'permanent' for the purposes of FoP. (which for the avoidance of doubt means that the waxwork is the subject of copyright, but no claim can be made on the photographer).
However: if the waxwork is displayed in a special exhibition as part of (say) a curated display, that is publicised as opening for a limited period, then the display is not 'permanent' for the purposes of FoP.
Simply put: If any of these waxworks were displayed in the generally open part of the museum on a daily basis with no time limit displayed at the time the photograph was taken, then Freedom of Panorama can be claimed as far as copyright is concerned. If the waxwork is (or was) part of a display that publicised a time limit, then Freedom of Panorama does not apply, and any photograph taken is a derivative work. There is an issue that the time limit must be reasonable. Putting on a display that advertises a twenty year limit, and then suing a photographer of that display for copyright violation is unlikely to arose any interest from a judge as the twenty year limit would be regarded as a sham to attempt to invoke copyright status where none really exists. -RFenergy (talk) 14:38, 11 April 2020 (UTC)[reply]

I can only refer you to the Copyright, Designs and Patents Act and various precedents established by case law. However, I (along with many of my colleagues) often use photographs taken in museums etc. in formally published papers. For this purpose, a working knowledge of copyright issues is indispensable. The interpretation above is that which case law has generally established and I have had no issues with copyright. I initially made my example above based on an art gallery with occasional exhibitions. But I had to change it because I remembered that photographs of copyrighted paintings are not covered by Freedom of Panorama (as it does not apply to two dimensional works).
In the case of the subject images, provided they were in the regular publicly accessible part of the venue, then it is unlikely that there was any publicly visible evidence that the display was anything other than permanent (for FoP purposes). For copyright purposes involving Freedom of Panorama (or indeed any copyright case), it is for the person claiming copyright infringement to demonstrate, on the balance of probabilities, that (a) they own the copyright; (b) that the alleged infringing copy is a copy of the copyrighted work (i.e. has not been independently created) and (c) that there are no circumstances under which copyright cannot be enforced (i.e. FoP, de minimis etc.). Simply put, for FoP issues, the copyright holder has to demonstrate that the photographer would have been aware of the temporary nature of the display (which requires a specific date - 'for a limited time only' does not cut the mustard). After all, all displays are 'for limited time only' as many of the images listed are no longer on display, a fate that will befall all of them at some point or other in time.
Another often overlooked aspect of copyright disputes is that under English and Scottish law, for a copyright holder to bring a claim for copyright infringement, the plaintiff (copyright holder) has to demonstrate that they have incurred a real and quantifiable financial loss. If you use a copyright image in a publication out of which you make no money (such as a scientific paper or a published work that you sell at cost price), the copyright holder has no case as they have not suffered a quantifiable financial loss. Such images should credit the copyright owner. However: having said that, other jurisdictions may vary considerably.
The biggest problem in copyright is organisations trying to assert copyright where none exists. Record companies in particular somehow believe that the copyright in a released record is somehow renewed if the record is re-released, even if any copyright has long expired. I have even come across reproductions of photographs, drawings and paintings made in the 19th century or earlier where the exhibitors (or more usually, the owner) display a copyright message showing the current year! I have even had a minor skirmish with a theatre proprietor when I took a photograph of a view from the back of the theatre, and the proprietor attempted to claim that I could not use the photograph because the set that happened to be on stage was copyrighted. I had to acquaint said proprietor with the principle of de minimis as the purpose of the photo was to illustrate the theatre and not the set which was entirely incidental. -RFenergy (talk) 13:26, 12 April 2020 (UTC)[reply]
I found Commons:Copyright_rules_by_territory/Germany#Permanent where there is examples of what permanently means: if "from the point of view of the general public, [it is] intended to remain in the public place for a long, mostly indefinite, period of time". So if the viewer should not realize it is for a limited time it is permanently (limited time can be ice sculptures, sand castles and graffiti which is expected to be painted over sooner or later). So with that argument I would also think that it is permanently unless it is clearly stated that is it only for a limited time.

Hi A1Cafel, the files meet the "GENERAL TERMS AND CONDITIONS FOR THE USE OF (AUDIO-)VISUAL MATERIAL ADMINISTERED BY THE NETHERLANDS INSTITUTE OF MILITARY HISTORY (NIMH)" as stated here: https://nimh-beeldbank.defensie.nl/gebruiksvoorwaarden. I see that other files from NIMH have the CC-BY-SA-4.0 licence, I assume that would be the correct licence for all other files from this source?  Delete There is no explicit license at the cited page. To be sure, there is an implicit license, but there are two conditions that probably make it too restrictive for Commons:

It is forbidden to use the material in manners contradictory to public order or common decency.
It is forbidden to distributre the material to third-parties without enforcement of these general terms and conditions. In case of distribution, one is responsible for upholding the terms and conditions.

First, these images are all claimed to be "own work" of the subject. Since none of them appear to be selfies, that is probably not correct and they cannot be kept without a free license from the actual photographer(s).

Second, the tattoos shown are the copyrighted work of one or more artists. These images infringe on those copyrights, so the images cannot be kept on Commons without a free license from the artist(s). This second item does not apply to the next to the last image and possibly not to the third.

According to LG Kassel, 10.05.2007 - 1 T 75/07 and this summary, it is unlikely that the original photo violates the rights of the car owners as it isn't easy to link the car plates to their owner's names in this context. Auch lässt der Ort einen Schluss auf die Arbeitsstätte der Kfz-Halter zu. Ich gehe nicht davon aus, dass die Halter in die Veröffentlichung eingewilligt haben. Außerdem verliert das nicht an Aussagekraft, wenn der untere Teil mit den Kennzeichen entfernt wird.  Keep Es handelt sich nur dann um personenbezogene Daten, wenn das Kennzeichen tatsächlich mit dem Halter verknüpft werden kann. Der Zugang zu den Halterdaten hat sich aber seit dem Urteil von 2007 nicht geändert. Da dies von berechtigten Personen möglich ist, reicht aus, um es zu personenbezogenen Daten zu machen. Schließlich geht es nicht nur um die Halterabfrage. Mir geht es mit dem Löschantrag auch insbesondere darum, dass Fahrzeuge innerhalb eines militärischen Sicherheitsbereichs abgelichtet wurden, in dem ein Film- und Fotografierverbot herrscht. Zwar wurde vermutlich von außen in die Liegenschaft hinein fotografiert, aber das öffentliche Zurschaustellen von Kfz-Kennzeichen von Personen, die offensichtlich in einer staatlichen Sicherheitsbehörde tätig sind, halte ich für bedenklich.--Asperatus (talk) 07:04, 27 March 2020 (UTC)[reply]
Dann müssten die Leute aber jedesmal, wenn sie in den Bereich einfahren, ihre Kennzeichen abdecken, denn man kann ja offensichtlich von außen ungehindert den Parkplatz einsehen. This is the supposed to be the pronunciation of "email", an obsolete word meaning "enamel", not "electronic message". Unfortunately, the pronunciation is inaccurate as the stress should be on the second syllable, not the first ("eh-MAIL", not "EH-mail"). The correct pronunciation is at "File:LL-Q1860 (eng)-Vealhurl-email2.wav". It is thus not realistically useful for any educational purpose.
