This file was initially tagged by Pixelati as Speedy (SD) and the most recent rationale was: G7. Too old for G7, and in use. Pixelati: any reason for the deletion? —Mdaniels5757 (talk • contribs) 01:45, 15 April 2023 (UTC)
- This picture wasn't taken by me. It was taken by a distant relative and I just uploaded it when I was still young, not thinking much about it. So, it's an obvious copyright violation. Thanks, Pixelati (talk) 17:34, 15 April 2023 (UTC)

ANSI standards are not PD, and this artwork would necessarily derive from the standard. ShakespeareFan00 (talk) 13:59, 15 April 2023 (UTC)
- Keep ANSI Z535-compliant symbols are not derivative works of the ANSI Z535, for the same reason that browsers aren't derivative works of RFC 1945, and child car seats aren't derivative works of ISO 13216. Snowmanonahoe (talk) 23:35, 15 April 2023 (UTC)

Terrible quality, and a possible copyright violation. A.Savin 00:04, 15 April 2023 (UTC)
- Comment Uploaded in 2004 and stated to be from before 2002, so what makes it suspect in terms of copyright? Otherwise, is it of any historical interest? I would call it very small but marginally usable and wouldn't fight for it to be kept, but I'm also not sure it needs to be deleted. -- Ikan Kekek (talk) 00:35, 16 April 2023 (UTC)
- Neutral COM:INUSE on dewiki, and uploaded in 2004 so it might explain why the low-quality image is like that. But the uploader, Vkem, does have a short history of copyvios on another WMF project.

Copyright violation, see Commons:Copyright_rules_by_territory/Netherlands#Stamps. Copyright on stamps of the Netherlands expires only 70 years after publication (on January 1st of the next year). This stamp was issued in 1975, so more than 22 years to go. JopkeB (talk) 08:28, 15 April 2023 (UTC)

Note: It does not mean a bit that the Nationaal Archief published these photos with a valid licence. That licence is only for the photograph/photographer, not for the design of the stamps. --JopkeB (talk) 09:37, 15 April 2023 (UTC)
- Even for works in a collage it is necessary to have permission from the copyright owner, see for instance https://www.bno.nl/blog/faq-22/mag-ik-zomaar-andermans-werk-gebruiken-voor-mijn-collage-896 (BNO is a professional organization -beroepsorganisatie- of designers in the Netherlands). The collage itself may be copyrighted by the maker, but even then it is possible to violate the copyrights of the maker of -in this case- stamps.
- If one stamp is copyrighted, a whole sheet of stamps will be copyrighted too. Moreover: Commons requires a licence that gives permission to (among others) make cropped versions, cutouts. Someone can make a cropped version with only one stamp and then there will be copyright violation for sure.
- I left out here photos with de-minimis stamps. So I consider all images of stamps mentioned here not as de-minimis.
- The press has more rights than Commons, see Auteurswet art. 15.1, so a press release does NOT imply licensing may be asssumed here.

Deleted: "I know the photographer of this picture personally and he gave me the pictures" is not sufficient proof of a free license as required by Commons, the photographer must explicitly agree to release the pictures under a free license; also, as it's an interior view of a modern work of architecture and freedom of panorama does not apply to interior spaces in Switzerland, the architect or rights owner must also agree, and this must be documented via the Volunteer Response Team, see the link by CoffeeEngineer. --Gestumblindi (talk) 14:31, 30 July 2023 (UTC)

A clear derivative of this 1932 photograph, making it too new for the licensing tag claimed. As additional proof the date of 1890 is incorrect, the bridge in the background is the George Washington Bridge, which was built in the period between 1927 and 1931. I cannot find enough information about prior publication or the author's date of death to indicate that this could potentially fall into the public domain, so this would seem to fall under COM:PCP (FWIW, the place holding the scan where this image apparently originated from is selling the rights to the image, so yes, there is potential harm from us having this possibly non-free image up). This could be undeleted in 2028. Hog Farm (talk) 19:52, 15 April 2023 (UTC)

Also this:
--Gnom (talk) 08:46, 15 April 2023 (UTC)
- Image 78 and 79 clearly show a person who is clearly agreeing to the picture. There are millions of pictures with circumstantial Beiwerk in the background on Commons, if we delete all of them, there is nothing left. This would require a much larger scale decision. --Ailura (talk) 09:22, 15 April 2023 (UTC)
- And Mark Benecke does not belong in this group request. The uploader claims that the image was given away "for free", this may be verified, but it's a different case. --Ailura (talk) 09:26, 15 April 2023 (UTC)
- I am sorry, but Ines Korth (the author depicted in images 078 and 079) does not hold the rights to the images visible in the background – they are held by the respective publishing houses (Carlsen and Schwarzer Turm). Also, under German copyright law, these images do not pass the threshold for Beiwerk (de minimis).
- For the Mark Benecke image, we have no reason to believe that the author (Steff Murschetz) released his work under a Creative Commons license. Gnom (talk) 15:35, 15 April 2023 (UTC)
- --Ailura (talk) 18:10, 15 April 2023 (UTC)

Hi @Mattbuck: , Have you seen [ https://commons.wikimedia.org/w/index.php?title=Commons_talk:Freedom_of_panorama&oldid=256272743 my edit on this very subject]? I have been trying to understand why the English have so much difficulty with a simple French law? Probably because the French do too- and it is not that simple. The law seems to be moving, based on developments of case law. WP is erring on the side of caution when it makes a bland statement stating there is no FOP- and we need to use the American concept of DM in whether to allow or not allow an image.
- Firstly an error of translation- this viaduc is a civil engineering work Ouvrage d'Art not a Work of Art.
- The draughtsman or his employer holds copyright on the 2D drawings, and the concept if it is original and has never been used before. He does not hold copyright on any concept that is a concept because it is a good technical solution (or a design inspired as the only technical solution to a project, his copyright is on the ćreative decisions he has taken within group of technical possibilities. The onus of proof lies on the designer to convince a court that he holds a copyright that has been breached.
- If it accepted that the draughtsman has designed something truly original then photographs are not permitted of that work in its entirity or photographs of the entirity of the actual section of the work that was deemed to be creative. Photographs of parts of the work that have been used before on other structures can be used.
- Au Millau, all of it has been done before- conceivably the only artistic decision that can be copyrighted is the relative heights and number of the pylons and their shape above the bridge deck. Below the deck, the deck, each individual pylon the play of light caused by a parabolic curve are all common engineering solutions so cannot be copyrighted. If copyright was ever claimed the architect, would still have to prove that there were other viable engineering solutions and his solution was more than a consequence of engineering necessity.
- To prevent publication, there is another test that must be fulfilled and it is not DM- more the question could the desired photograph have been taken without including the civil engineering structure. This gives us virtually the same freedom as FOP.
I apologise for not giving you references for all the case law/ It is essential to read the judgements in French- as American synopses miss all the nuances. So lets look at all the beautiful photographs and make some comments:
- File:2005 MillauViaduc0409.JPG- mine- borderline-I claim the view could not have been taken without including the bridge
- File:Approaching the Millau Viaduct, A75, Aveyron, France, 2008 - Flickr - PhillipC.jpg-same as above
- File:Millau (10).JPG-engineering detail
- File:Millau (19).JPG-photo of bridge not exhibiting creative element
- File:Millau bridge struts (3843357484).jpg engineering detail
- File:Millau Bridges.jpg the view could not have been taken without including the bridge- then not sufficient is included
- File:Millau Bridges2.jpg the view could not have been taken without including the bridge- then not sufficient is included
- File:Millau Viaduct 1 - panoramio.jpg-hard to defend
- File:Millau Viaduct overall view.jpg-hard to defend
- File:Viaduc Millau 01.jpg-hard to defend
The Case law is growing, and I think we should reflect it in our decisions- ann then revisit other deletions File:Millau7641.JPG and File:2005 MillauPéage0416.JPG which quotes the Commons:Deletion requests/Files in Category:Gare Lorraine TGV deletions and reversions. --ClemRutter (talk) 00:14, 29 August 2017 (UTC)
- @ClemRutter: Actually I would like to read the judgements (or at least an article about them in the French press) to make my mind on these ones. - It appears that the implementor of Architect Lord Norman Foster's copyright holder-ship (the management) has placed some authentic restrictions over any forms of reuses of images of this bridge: [2] Perhaps night scenes of the bridge (which I haven't yet nominated) might need to be deleted too. [edit]Per the CEVM's house rules on usages of any visual representations, even drawings are not allowed if they will be reused commercially (without permission from CEVM who acts as the "guardian" of architect Norman Foster's copyright). This means graphical renderings of this bridge are not OK per their rules in relation to French copyright law. Furthermore, no freedom of panorama in France.

[edit]5 images of the viaduct at night, and 4 images of the viaduct at the "borderline of foreground and background". No FOP in France, the bridge's management is aggressive in protecting Architect Norman Foster's copyright over the bridge, and see the above nominations. While the 4 images are borderline between foreground and background, the main intent of those images are the viaduct itself (as evidenced by their file titles). COM:Project scope/Precautionary principle applies for this case.

- Comment My very limited understanding was that photos which don't have the copyrighted structure as their primary focus, but merely in the background as some of these do, are legal. But I couldn't name or quote the relevant law. Anyone else with more expertise?--ThunderingTyphoons! (talk) 10:18, 11 January 2022 (UTC)

- The photo file: 00 0238 Millau - Viaduc de Millau.jpg shows the city of Millau from the location east of the city on the "Route du Causse Noir". From this direction of view of the city, the “Viaduc de Millau” inevitably appears in an image field to capture the entire city area. The intention was not to record the viaduct, but the cityscape. I doubt whether there is a violation of copyright in this case. Sincerely, W. Bulach W. Bulach (talk) 13:42, 11 January 2022 (UTC)
- Taking a precautionary approach, I do question whether in image File:00 0238 Millau - Viaduc de Millau.jpg the bridge is unintentional and simply background. Compositionally the bridge's location in the image follows the rule of thirds and contains the entire bridge length. The image could also be cropped (at the bridge deck) without deleting the image of the city. As noted in the nomination a cautionary stance is necessary as the copyright holder has expressly stated that royalties are required for commerical images.--Labattblueboy (talk) 05:35, 12 January 2022 (UTC)
- Bonjour.

Sorry, just now - maybe too late - I realized that I should give my statement about deletion request of my file. "Driving on the Viaduc de Millau.jpg" at this place. Actually I put it at my Discussion side as follows:
Hello user Labattblueboy, thank you for the check on my file "Driving ...". Yet I oppose the result in form of the deletion request. As you can see in in the version history of the file, there was a deletion request in February 2021 that finally got cancelled by User:Racconish with his remarkː "On second thought, I think my deletion was excessive. Just leave the file as it is and good luck for the challenge". I had argumented that the topic of the picture was not the construction of the bridge itself but the impression of driving on a bridge towards the dark clouds of a thunderstorm contrasted by the cables high lighted by the sun. The name of the bridge is just mentioned to tell the location where the picture was taken. Best regards Foeniz (Diskussion) 14:56, 11 January 2022 (UTC)
I do hope this stil may have any influence on the decision process. Best regardsFoeniz (talk) 20:57, 24 January 2022 (UTC)
If it would help, I would not mind to change the file name to "Driving on a cable-stayed bridge".Foeniz (talk) 16:44, 25 January 2022 (UTC)
- File:Driving on the Viaduc de Millau.jpg is a lovely photo. That said, the bridge is not a de minimis feature in the photo. I understand the intent but there is no indication that bridge's copyright holders would consider this image being in the public domain.--Labattblueboy (talk) 23:07, 25 January 2022 (UTC)

File:AVEYRON.Viaduc de Millau-1-cliche Jean Weber.jpg is definitely not OK; File:Millau Viaduct (42509428741).jpg is a bunch of extraneous people sitting in front of the bridge, also not OK; I think File:Rob Bell by the Milau Viaduct in the South of France.jpg may be OK because he is the subject, but that's open to question. - Delete all photos but Keep one. File:Rob Bell by the Milau Viaduct in the South of France.jpg can simply be censored by cropping the whole bridge away and turning it into a portrait picture. Reference to this discussion is encouraged on the file description page so that no one will wrongfully nominate it (there is a tendency that once cropped, the indications of his selfie action will disappear along with the bridge). For others, I do not see those as passing de minimis. File:Tallest Bridge. (6744815357).jpg may be a close call but I'm uncomfortable at having a 50/50 photo (50% main subject, 50% de minimis) that may lead to Wikimedia being slapped with French lawsuits from CEVM, the management who is Architect Foster's beneficiary of his property rights over the public landmark he designed. Note the descriptions and title suggesting the bridge as the real intent of the photo. JWilz12345 (Talk|Contrib's.) 03:12, 29 April 2023 (UTC)

On the left side, there is (inverted) text that says "Aufnahme v. ...". According to Google Translate, "Aufnahme" probably means photo. It looks like it says "E Volz Driver", what looks to be a name, so this work probably isn't anonymous and {{PD-anon-70-EU}} doesn't apply. Though we do need to find the date of the alleged author. --Matr1x-101Pinging me doesn't hurt! {user - talk? - useless contributions} 11:35, 15 April 2023 (UTC)
- Could also be "Velz". And its "Drvar", a town in Bosnia. But I assume this won't help a lot. -- Herbert Ortner (talk) 11:36, 16 April 2023 (UTC)
- @Herbert Ortner: The point is, this photo is probably not anonymous, whatever the name is, so {{PD-anon-70-EU}} probably won't apply. --Matr1x-101Pinging me doesn't hurt! {user - talk? - useless contributions} 08:07, 6 May 2023 (UTC)
Weak keep We have established that the photographer is a certain E. Volz or Velz from Drvar, so the "anonymous" rationales don't work, but it seems to be a postcard, and then point c) from {{PD-Yugoslavia}} could be applicable, which doesn't require anonymity and, apparently, would also work if the date of the photographer's death is unknown, as long as it was published before 1966 - which seems very likely for this postcard with German text (so, rather before 1918 even). But even though the postcard mentions Drvar, it's unclear whether it was also published there or elsewhere. If published in present-day Austria, I think there would be no applicable PD rationale (there's only the invalid PD-Austria-1932). Still, public domain seems quite likely. Leaving for the next admin to decide... Gestumblindi (talk) 19:10, 1 August 2023 (UTC)
Kept: If I'm reading PD-Yugoslavia correctly, the death date doesn't matter if it was published before 1966, and we can say for sure this was. —holly {chat} 20:09, 18 September 2023 (UTC)
Files in Category:F. F. E. Yeo-Thomas
[edit]These are photos of a bust of British agent en:F. F. E. Yeo-Thomas, located inside the town hall of the XVIth arrondissement of Paris, France. Apparently the bust was installed there in 2001 as a present of the UK ambassador in France at the time [5].
I could not find either the name of the sculptor or the year the bust was created. It's unlikely that this bust is really a truly anonymous work, and as Yeo-Thomas was not really known in public before 1947, the year of creation is most likely less than 70 years ago, perhaps even as late as 2001 (working from some older photos or similar, because Yeo-Thomas died in 1964).
Which means the bust is most likely still protected by copyright. It is on display inside a public building, but the French version of freedom of panorama is for outside works only and not acceptable for Wikimedia Commons anyway because it specifically forbids commercial use.
So the files should be deleted per the precautionary principle. They can principally be restored 70 years after the death of the sculptor (unless the bust would still be protected in the US because of the URAA at that point). But since we don't know who the sculptor is and 2001 is the only year we have so far, they can be restored in 2122 with {{PD-old-assumed}}, subject to change if the name of the sculptor or the year the bust was created become known.
Rosenzweig τ 12:45, 15 April 2023 (UTC)
- Keep Since we have an image of the text accompanying the bust, and the text does not name the sculptor, it should be kept until a creator has been named. We usually don't delete based on hypothetical speculation that a creator may be named in the future. When that occurs and it is under an active copyright, then it should be deleted. The precautionary principle requires "significant doubt". --RAN (talk) 04:59, 17 April 2023 (UTC)
- There IS significant doubt, see above. That the label on the plinth does not name a sculptor does not mean that we can treat this as an anoymous work. Also, we don't even know if the bust is at least 70 years old (all we have is the year 2001), which would be another requirement for us to be able to treat it as an anonymous work in the PD. --Rosenzweig τ 05:48, 17 April 2023 (UTC)

Firstly, no author information is given in the source, so there's no way to tell that PD-old applies. Secondly, there's caption on the photo in the source so who knows if this is even the correct person. —howcheng {chat} 00:15, 15 April 2023 (UTC)
- Keep It meets "PD-US-not renewed". If you have evidence it is the wrong person, present it here. --RAN (talk) 21:48, 15 April 2023 (UTC)
- It only qualifies as PD-US-not renewed if someone has searched the copyright catalog for the renewal and failed to find it, but there's no author nor even a year of publication (the year 1940 seems to have been created by the uploader). The version in the Wayback Machine near the upload date does not have this information either.
- I don't have evidence it's the wrong person, but I don't have evidence it's the right person either. I went through the entire source site and there is not a single photo that identifies Nicholson. The only possible clue is that the filename is
smnic.jpg
if one assumes that the "s" is his first initial and "nic" are the first three letters of his last time, but then where does the "m" come from? It's possible that this is indeed the same individual as in File:Seth B. Nicholson sits at his spectroscope.jpg, but the only thing I can say for sure is that both show Caucasian men with glasses, as the angle of the other photo makes it impossible to see his facial features.
- In short, there are too many unknowns here for this to be kept. —howcheng {chat} 22:38, 17 April 2023 (UTC)

Keep This argument has happened dozens if not hundreds of times and is basically a fancier way of saying “I don’t like this because it’s sexual” since human sexuality is definitely in scope. The quality is poor, but the video is the only one on commons specifically depicting gay anal sex (that isn’t a gif anyway), which would mean it can be kept due to lack of better media on the subject. The Commonwealth flag is protected by copyright according to w:File:Commonwealth Flag 2013.svg, and these images portray it as the central subject of the image, whence it can't be considered COM:DM. (As per "It may be relevant how the image is described or classified: it will be difficult to argue de minimis if the photograph is described as illustrating "an advertising poster" and is placed within the category Advertising posters", it may be worth considering deletion of Category:Flag of the Commonwealth of Nations altogether.)

- Comment The copyright status is unclear. As the Commonwealth of Nations is an inter-governmental organisation and its logotype was created in London in 1972,[6] the logo should normally fall under UK Crown Copyright#United Kingdom in accordance with the Copyright Act 1956 – the work certainly counts as artistic work made by or under the direction or control of Her Majesty or a government department. Per COM:CROWN, Crown Copyright has a term of 50 years, so the logo should be out of copyright sometime in 2022.
- However, copyright notices are there all over the Commonwealth website. Whether they are based on individual legal analysis, or they simply follow a standard industry practice, or the website design was updated before 2022, remains unclear.
- — kashmīrī 06:44, 6 June 2023 (UTC)
- @Kashmiri The flag was updated in 2013, so only the original flag might be public domain. According to CRW Flags, the original flag was designed in 1976, so the 1976 flag can certainly be undeleted in 2027. However, the 2013 flag can't be transferred to Commons until 2064. - Copyright period counts from creation date, not from any "adoption date".
- The 2013 version was a slightly updated design: the globe shape rotated to match the obliquity of the ecliptic, reduced number of rays, and a new colour scheme (assuming the old design had any colour scheme at all, which I doubt). Whether there was anything creative about it, or any meaningful sweat of the brow, is debatable. — kashmīrī 16:12, 9 July 2023 (UTC)
