Collage of 6 images, one of which was deleted per Commons:Deletion_requests/File:Vulva_5b.png. Free licensend image must be substituted or collage is not free. Image in fairly wide use. -- Infrogmation of New Orleans (talk) 20:29, 21 August 2021 (UTC)
- I've come from a notice at en-wiki and know little about how Commons works. However, I'd hate to have to debate over a new image at en-wiki. It's a bit odd to delete a whole image file because one of the components has to be removed, isn't it? Isn't there a way to find someone here who can remove or replace that part? -Crossroads- (talk) 04:20, 22 August 2021 (UTC)
- Welcome to Commons! Commons is for free licensed media only. A collage that contains a copyright violation cannot be free licensed. As to replacing the copyright problem portion, that was what I suggested, and Matinee71 seems to have already taken care of it. -- Infrogmation of New Orleans (talk) 15:19, 22 August 2021 (UTC)

- Delete: The subject of the photo en:Zubir Said died in 1987; so, there's no way this could've been taken on 2 November 2010 as the file's description states. The claim of "own work" is also questionable and would need to be verified by COM:VRT at the very least. This appears to be a misunderstanding of COM:L and COM:NETCOPYVIO by the uploader and an uncropped version of the same image can be found used by lots of websites and essentially the same image was uploaded locally to English Wikipedia as en:File:ZubirSaid.jpg under a non-free license. Being publically available doesn't automatically make something free from copyright protection; moreover, downloading a file from some website and then subsequently reuploading it to Commons doesn't make it one's "own work". -- Marchjuly (talk) 23:09, 22 August 2021 (UTC)
- Delete I have found the original source at National Archives of Singapore, the photo was taken, at least on behest of Ministry of Information and the Arts in 1967 (indicated as covering date in the listing). Per Commons:Copyright_rules_by_territory/Singapore#Government_works, the copyright held by the Singapore government is due to lapse only on 31 December 2037, 70 years after the calendar year of the photograph taken. Files uploaded by America4094 (talk · contribs)
[edit]Uploads are all claimed to be own work, but that claim looks to be dubious. Many of the uploads have been deleted as copyright violations. I am not the only editor thinking the claim of being the copyright holder is suspicious. User:PjotrMahh1 asked about the origins of some photos. User:Habitator terrae also asked about the provenance of the photos. No reply was ever made by the uploader. A misplaced message on the upoloader's user page accuses the uploader of claimming art work by Scott McBee as their own.
That accusation would appear to apply to File:S.S. America.jpg. Scott McBee's web iste has that same image as a sample of his work in the scroll of ocean liner images. Scott even confronted America4094 here [1]
File:Alferdoss Large.jpg uploaded in 2017 is a photo-edited version of an image posted on a web forum in 2012.
File:American Star 3.jpg uploaded in 2017 is cropped version of this image from 2011.
File:S.S. America in 1978.jpg has obviously been scanned from a magazine.

- File:America-53.jpg
- File:S.S. Italis at Genoa in late 1979.jpg
- File:SS America.jpg and
- File:SS America arriving at Southampton during the 1950s.jpg
Those images seem like the best to use in the article and there isn't a lot of free images of her here. The rest of the images can be deleted. As for America4094, he hasn't been active here since 2017 based on his contributions, so I suggest blocking him in case he tries to retaliate or something like that. Angelgreat (talk) 22:59, 21 August 2021 (UTC)
- @Angelgreat: What makes you think any of those images are actually the author's own work? -- Whpq (talk) 12:43, 22 August 2021 (UTC)
- @Whpq: I'm not, I'm just saying keep some of then as they're being used in the Wikipedia article. You already deleted the Olympic and Aquitania scrapping images on Wikipedia, but this is way more big. Unless there's more public domain equivalent images of the America here, some of the images needs to be kept for now. Angelgreat (talk) 13:22, 22 August 2021 (UTC)

- Although my intention is not to get into the discussion, it's true that it seems good to me that the images are deleted, since it is clear that they do not seem to be own works of the original uploader.
However, as for this image's case, I've added web links where the photograph also appears, to replace the "own work" template. Also, since the photograph was taken in Italy, I've replaced the uploader's license (which attributed him/her the authorship of the image) with the license-templates "PD-Italy" and "Not-PD-US-URAA" (the latter due to the fact that, in 1996 -the date of the restoration of copyright in the United States by the URAA- the image wasn't in the public domain in Italy yet because, in that moment, there hadn't passed 20 years from it's creation yet).
Obviously, I'm of the opinion to keep this image for erasure as well until otherwise determined. I hope to be of help and regards. — Preceding unsigned comment was added by 79.151.31.9 (talk) 15:21, 27 September 2021 (UTC)
- I'm actually in favor of keeping some of the images if we keep trying to find the true sources. And id the licenses are ok, they'll stay. Otherwise, they can go. Angelgreat (talk) 16:35, 13 October 2021 (UTC)
- Ok, so I dug a bit more and I was able to find some of the original sources and some info.
- 1. File:S.S. Italis at Genoa in late 1979.jpg , as well as the deleted files File:S.S. America.jpg and File:SS Australis.jpg come from [2]
- 2. File:American star 1994 large.jpg is a edited version of [3]
- 3. File:Alferdoss Large.jpg is a edited version of [4]
- 4. File:American star 1994 large.jpg and File:Alferdoss Large.jpg have the same type of photo edits.
- 5. File:America-29.jpg, File:America-27.jpg and File:Italis-2.jpg look like they were taken from a crt with a old camera.
It's quite clear that America4094 had edited the photos in a attempt to hid their origins. At this point, some of his edits were not enough to be reverse-search, but others like the ones he took with a camere in front of a crt are too poor quality. I think File:America-29.jpg, File:America-27.jpg and File:Italis-2.jpg should be deleted. Angelgreat (talk) 16:41, 14 October 2021 (UTC)
- Turns out File:SS-America-0-Large.jpg and File:SS America.jpg are edited versions of [5] and File:America-53.jpg is a colorized version of [6]]

These are derivative works of non-free pub signs. Freedom of panorama in the UK doesn't apply to graphic works like engravings. Since each sign is the main subject of its photograph, de minimis doesn't apply. They're all in the same style and look quite new, so I doubt any of them is old enough to be out of copyright. Given the hatching, I think even those that are derived from existing pictures will surpass the threshold of originality in their own right. --bjh21 (talk) 15:16, 21 August 2021 (UTC)
Deleted per nomination. The signs all seem to be inspired by much older images but are all quite recent. Multichill (talk) 18:31, 13 September 2021 (UTC)

Duplicate; better version exists: File:House on Haunted Hill.jpg 4nn1l2 (talk) 00:15, 21 August 2021 (UTC)
- KEEP. This file has more vivid colors and in not cropped and appears to be a photograph of an original artwork. The other supposedly "better" version has the bottom text cropped out and is therefore not a complete copy of the original artwork. The difference in colors indicate that the this "better" version may have been previously edited for color, tint or other attributes. This other version is not a duplicate, so it should be kept. --Ooligan (talk) 21:37, 21 August 2021 (UTC)

- Delete the file descriptions are confusing, but I can confirm the files are indeed 1997, but given that they are erroneously labelled as 19th century I can see somebody would think they're out of copyright. The Internet Archive license for these files is actually CC-BY-NC-SA 3.0, which means that they cannot be uploaded to commons anyway. Hemiauchenia (talk) 20:17, 21 August 2021 (UTC)

CC license of YouTube video does not apply to self recording by Steven Donziger that was included in KolectiVOZ Digital broadcast. William Graham (talk) 21:34, 21 August 2021 (UTC)
- Question Could you point me to guidelines or information that show this excludes the images from the CC licence? Not disputing this is true just new to this and would like to understand. The video is made up of two self recordings meaning that only the banners in the video would be covered by CC license if true. Vladimir.copic (talk) 22:25, 21 August 2021 (UTC)
- Keep unless someone can provide some evidence as to how this screenshot is not covered by the CC license. The content of the video is an interview conducted via videocall. This is no more a "self-recording" than an audio interview conducted over the phone is a self-recording. Happy to take advice on this. Vladimir.copic (talk) 23:42, 22 August 2021 (UTC)
- Keep per meta:Wikilegal/Copyright in Zoom Images. In the case of a live video feed, copyright belongs solely to the party who fixes the content in tangible form. -- King of ♥ ♦ ♣ ♠ 06:57, 1 October 2021 (UTC)
- Keep. I missed the Creative Commons tag in the description the first time I saw this video but it's definitely there. The most reasonable interpretation of this is that all parties who contributed to making the video, including Donziger, had no objections. Connor Behan (talk) 19:14, 1 October 2021 (UTC)

- Comment These need to be looked individually, as some such as File:Monument from afar (5334156462).jpg are clearly de minimis. russavia (talk) 11:43, 19 November 2013 (UTC)
- Not at all de minimis, considering that the title of the image is "monument from afar" and that the caption says "A view of the African Renaissance Monument from Ouakam. Wish the shot came out clearer. Next time." --Eleassar (t/p) 11:51, 19 November 2013 (UTC)
- I suggest the name the uploader chose for the image is not particularly relevant. Below I asked "What if File:African Renaissance Monument (5502494604).jpg had been named File:New construction in Senegal, with the African Renaissance Monument in the background -a.jpg?" My suggested alternate name is more accurate, and I suggest illustrates why our conclusions should not rely on the images' names. Geo Swan (talk) 16:27, 19 November 2013 (UTC)
- Comment I find FOP highly counter-intuitive. Some countries, like France, have troubling, idiosyncratic FOP rules. I am cutting and pasting the short Senegal section:
- There is no freedom of panorama in Senegal. In fact the Senegal's law is very similar to the french law. The Loi 2008-09 du 25 janvier 2008 sur le droit d’auteur et les droits voisins au Senegal, (article 46) (Archive) says that it not possible to reproduce an artwork if it's the main subject of the photo or it is for commercial purpose (source: Bureau Sénégalais du Droit d'Auteur).
» (Official link) (Archive)
- The question still on: does it apply to things before 2008?
- Heck! COM:FOP#Senegal says "Senegal's law is very similar to the french law."
- File:African Renaissance Monument (5538226284).jpg only shows the monument, but File:A Maersk truck driving in front of the African Renaissance Monument in Dakar, Senegal.jpg showed a truck in front of the monument -- the truck is larger than the monument. What if File:African Renaissance Monument (5502494604).jpg had been named File:New construction in Senegal, with the African Renaissance Monument in the background -a.jpg? I suggest that when we know there are images that comply with COM:FOP#Senegal, because the monument is just one element in a wider picture we should not be considering removing this category, because those compliant images belong in it. Further, I suggest our nominator could have saved the rest of us a lot of time. I suggest our nominator shouldn't have nominated the category, and everything in it -- since they recognized some of the images were FOP compliant. Rather I think they should have made a mass nomination of images that did not include those images they were sure were FOP compliant. Geo Swan (talk) 16:22, 19 November 2013 (UTC)
Good day Eleassar,
I regret to state that I understand too well what the fuss is about!
So the French law, or the Senegalese law, or the Yankee laws say that... but please realize that in the whole world laws are so numerous and so complex that, at any time, anyone can be reproached something!! I believe you may be staying in Slovenia. Did you country and society did not suffer enough of censorship during the communist rule? Would you really prefer to see it now replaced by United States dictatorship and thought control??
Judging at the continuous vanishing of images, the trend appears to move towards a Wikipedia with no picture at all! But make no mistake, when the images and pictures will be all gone, then the attack will be against the text, any form of free thinking text...
Now, to answer your remarks squarely: the "Projet de monument Renaissance" is mostly a photograph of a public poster describing the project while the monument itself is only shown by its basement and occupies only the top of the picture.
The "Renaissance africaine" is not really a picture of a work of art, but of workings, as a North-Korean company was then building this stalinian style and controversial monument. I also believe the picture marvelously describes the political situation then prevalent in Senegal: the family chief has no head while his partner and their child have theirs in full...
Finally I add what cannot be shown by the picture: that the whole group is not looking towards the North (former colonial powers) nor to the East (holy cities) but to the North-West: the all invading, overbearing and bankrupt United States...
Regards,
B.J. Noël
- Ad Geo Swan: thanks for having provided the excerpt of the relevant article from the copyright act.
- As to File:African Renaissance Monument (5502494604).jpg, what is relevant per COM:DM is whether the photographer's intent was to reproduce the monument or something else. Per the title in flickr ('monument from afar') and the description ('A view of the African Renaissance Monument from Ouakam. Wish the shot came out clearer. Next time.') the intent is clear, and there is no good reason to pretend it was something else.
- As to File:A Maersk truck driving in front of the African Renaissance Monument in Dakar, Senegal.jpg, the monument is clearly one of the two principal subjects. I don't object to cropping this image though. --Eleassar (t/p) 10:35, 20 November 2013 (UTC)
- Ad B.J. Noël: Thanks for your opinion, but the purpose of this page is not a political discussion about the scope of Commons and Wikipedia (you can try opening it elsewhere), but whether the nominated images are free or not.
- File:Projet de monument Renaissance.jpg - the poster itself is just as much copyrightable as the monument. There is no exception in the law for 2D works.
- File:Renaissance africaine.jpg - the photograph shows the majority of the copyrighted monument, and parts of author's works are copyrightable too. -Eleassar (t/p) 10:35, 20 November 2013 (UTC)
- In File:African Renaissance Monument (5502494604).jpg the intention might have been to take a photo of the monument, but the result is a photo of the city with the monument - probably a camera in a kite is difficult to point accurately. I don't see this image different from photos of the Louvre with its de minimis copyrighted pyramid.--Pere prlpz (talk) 11:16, 20 November 2013 (UTC)
- Per COM:DM, the intent is of the key importance in deciding whether a work is de minimis or not: "If the poster forms an essential part of the overall photographic composition, or if the photograph was taken deliberately to include the poster, there is likely to be copyright infringement, and it is no defence to say that the poster was 'just in the background'. If the existence of the poster was the reason the photograph was taken in the first place, copyright infringement cannot be avoided by additionally including within the frame more of the setting or the surrounding area." The prime difference between this image and the Louvre image is that whereas the Louvre image was taken primarily to depict the square and not the pyramid, this one has been taken to depict the monument. --Eleassar (t/p) 13:13, 20 November 2013 (UTC)
- Do you mean that if file name and description were "Buildings in Dakar" it would be OK to keep under de minimis? We can reupload it.--Pere prlpz (talk) 17:17, 20 November 2013 (UTC)
- I've been discussing the image as it stands at Flickr, where it originates from. --Eleassar (t/p) 18:20, 20 November 2013 (UTC)

Deleted: If you cropped out the truck in the first image, you would have a better photograph. If you cropped out the monument, you would have a picutre of a Maersk container at an angle -- not very useful. THe same argument can applied to the two or three images that include significant parts of the city -- the monument is still the center of interest. . Jim . . . . [edit]This statue was designed by architect Pierre Goudiaby and completed in 2010. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for a certain period of time after the death of the creator (be it the last-surviving architect, engineer, designer, sculptor, engraver, or painter). An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception Commons:Freedom of panorama (FoP). Sadly, Senegal has no Commons-acceptable FoP. Accordingly, reproductions of Senegalese architecture and sculptures by means of images are only permitted on noncommercial basis, conflicting with Commons:Licensing which states that all files must be freely usable by anyone in the world.

The part of the French/Senegalese law says "It is prohibited EXCEPT when the image is the center of the subject". Which it is. Key word: 'sauf". You folks are 180, i.e. not 100. The template says that this logo image consists of simple geometric shapes or text, but I doubt it is correct. Is the dome of the Capitol and the font used in the logo so simple? I think that needs to be discussed. Ldorfman (talk) 01:16, 21 August 2021 (UTC)

Although the composition is ostensibly in the public domain, the performance/recording is likely not in the public domain. The archive of the source website at the time does not indicate that the marching band of the University of California, Berkeley released their recording into the public domain, so the file should be deleted. According to its FAQ, IVAA (Indonesian Visual Art Archive) collections are licensed in CC BY-NC 2.0 (section "Sejauh apa arsip dari @rsipIVAA bisa saya gunakan?"), which violates COM:LICENSE. AnsyahF (talk) 02:08, 21 August 2021 (UTC)
Update: The author changed its license to {{PD-Art-100}} in Special:Diff/584742298. Still a copyright violation because in fact the painting was made in 1973 and didn't entered public domain yet as of 2021. AnsyahF (talk) 07:06, 31 August 2021 (UTC)

- Delete all - Images are a complete mish mash of EXIF data or lack of EXIF data. File:Zaragoza-destino-in.jpg is a stock photo from Shiutterstock. File:Monasterio de Piedra parque natural.jpg looks to be copied from Facebook. File:Rascacielos nuevo TORRE ZARAGOZA.jpg is an artists rendering of a skyscraper copied from here. Maybe some of these are own work but with everything being uploaded with the claim of own work, unless the uploader can state credibly which are indeed own work, then they all must go. -- Whpq (talk) 13:32, 21 August 2021 (UTC)

Unlikely to be own work. No EXIF, non-standart ratio of length and height. Brateevsky {talk} 18:17, 21 August 2021 (UTC)
- That's not a reason for suspicions. Any serious photographer often crops his photos, and EXIF is easily lost during re-savings in the process of editing. Keep. Sneeuwschaap (talk) 23:42, 23 August 2021 (UTC)

- If absence of metadata were a valid reason for deletion, such files would be nominated by bots. There is plenty of graphics editors and file formats, and they are not obliged to support EXIF. Save any file in png or bmp, and EXIF will be lost. Natural format for master copies made from raw files is by no means jpg. Sneeuwschaap (talk) 20:38, 24 August 2021 (UTC)

- Keep There has been a long discussion in the Village Pump to define this template, which comes from a large consensus. E.g. see Template talk:FoP-Italy. Since then (few months ago), no novel law has been approved in Italy which disregards the FoP template formulation. (besides, this delete request brings no valid reason for deletion) --Ruthven (msg) 19:19, 22 August 2021 (UTC)
- The problem is that @Racconish: don't agree with that consensus. --Liuxinyu970226 (talk) 23:01, 22 August 2021 (UTC)

Closed as Kept, no consensus to delete. (Note: This is not a judgement on whether the current version of the template is accurate.) -- Infrogmation of New Orleans (talk) 17:14, 31 October 2021 (UTC)
This VP discussion reaffirmed that there is actually no Commons-acceptable FoP for Italy. The template is misleading. For those building who falls below COM:TOO, {{Italy-MiBAC-disclaimer}} is already functioning A1Cafel (talk) 17:23, 30 May 2023 (UTC)

I didn't mean to put CC 1.0 but, usually there would be a watermark on an image but this one did not have a watermark. It is not copyright but probably incorrect license Username006 (talk) 05:46, 21 August 2021 (UTC)
Please see this discussion at my talk page here [7] in which it is postulated that "it is not copyrighted because there is no watermark". Andrewgprout (talk) 07:27, 21 August 2021 (UTC)
- the copyright of the image from [8] is covered at [9]. The photo has no copyright attribution, under the copyright information of the site it belongs to some one else and permission needs to be sought, regardless that the owner is unknown. Sciencefish (talk) 08:06, 21 August 2021 (UTC)
- @Sciencefish: I tried contacting them but their contact form just sends the query to my own e-mail. Also, the image just before the one I had uploaded has also been uploaded by another person. Username006 (talk) 12:45, 21 August 2021 (UTC)
- Comment It seems unlikely that this is not either a press photo or an accident investigation photo. If the latter, it will be Crown Copyright that will now have expired, however as it does not appear in the final report it seems this is the less likely option. As far as I can tell from reading the advice page about UK copyright, a non-crown copyright image would be copyrighted until at least 70 years after creation, which would be 2038 in this instance. Thryduulf (talk) 19:27, 21 August 2021 (UTC)
- Delete Unlikely this has anything to do with the BAAA-ACRO website, it was the image published on the front page of the London Times on 4 July 1968 and looking at the image quality it would appear to be a scan or screen grab of the image available in the Times archive . It is copyright of Times Newspapers Limited. MilborneOne (talk) 07:26, 25 September 2021 (UTC)

Most of the vinyl label may not be original enough for copyright, but it contains Mercury Records logo, which is kinda complex enough for copyright especially in the US. George Ho (talk) 06:33, 21 August 2021 (UTC); edited, 06:34, 21 August 2021 (UTC)
Kept There is already a {{Trademark}} notice, which covers the Mercury Records logo. Label is US printing from 1970 without copyright notice; {{PD-US no notice}} -- Infrogmation of New Orleans (talk) 17:20, 31 October 2021 (UTC)
The file is not a gamon from Nagai Kujira. The Maury family and Mr. Maury's gamons and archetypes aren't that big. The size is not that wide. It's a violation of copyright. Gameposo (talk) 17:04, 21 August 2021 (UTC)
Kept: no valid reason for deletion. I don't see any copyright (whose copyright?) violated here. If you have any problems with the content of the file, maybe modify it? It's an SVG file after all. --Rosenzweig τ 08:45, 21 February 2022 (UTC)
