The photo was taken from a video that has a free license. However, it contains several other pictures, including profesional photos and selfies. It is unlikely that the person that created the video owns the copyright of those images. Günther Frager (talk) 17:06, 18 July 2023 (UTC)

An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Jordan.

- Delete. Photographer Jean-Pierre Bonnotte was with the French photo agency Gamma and he specialized in photos of celebrities [2]. Gamma photos were published in France and worldwide. The source of the Commons copy is a twitter post, which provides no publication reference. There is no evidence that this Bonnotte/Gamma photo, by a French photographer taken for a French photo agency, was first published exclusively in Argentina and it is very unlikely. This goes significantly beyond the case cited in COM:TOO Andean Community about the Saturn-based logo. This logo includes quite a number of graphical elements, the fingers of the first, the handle of the torch and the unusual shape of the flame. - I have replaced the tag with the Moldovan tag, since the image is kept in the Moldovan state archive, and since the applicable law regards all such works produced in Soviet times as Moldovan-made; the law also specifies that the production of an anonymous work counts for its release into the public domain, fifty years after said production (publication apparently counts only in determining that they are of Moldovan origin, but the year of production is counted for them not being in copyright). - @猫猫的日记本：我的观点还是我最初在被裁剪的照片中的观点一样，即如果阁下认为地图是艺术作品，则应按照平面美术作品的标准处理；如果认为地图不是艺术作品，则不适用著作权法第24条第1款第10项。其次，我确实提到“很难找到有人把这种景区的地图拿来商用”，但还请您注意这句话是在为解释找不到相关实务案例。然而维基共享资源要求图片能够以任何目的使用（非著作权的限制除外），包括商业目的。“没有人会把这张照片拿去商用”不是合理的理由。

If you think "artistic works" do not include maps, then this photo cannot be kept too. - Question "a": If it were a work of a U.S. employee in the course of employment, the embassy would not credit the copyright to Lacombe and the photo would not be watermarked with a copyright to him. - User:Asclepias. Years ago, when I first came across the flickr-ID for US diplomats in Canada, all the images were improperly licensed, as non-free. This is pretty common. Many higher-level public affairs officials delegate the management of web pages and flickr-IDs to very junior individuals, who are completely ignorant of intellectual property rights issues. This was the first one I encountered, however. I went through a long process where I explained that images taken by Federal employees, in performance of their duties, were public domain, and that it was inappropriate to distribute them under non-free licensing.
- They eventually agreed to release their images under a free license, cc-sa IIRC. Flickr didn't have provision for cc0 or public domain mark 12-15 years ago.
- There was some discussion over how they would distinguish between images they took and so-called courtesy images. Sorry, it was so long ago I don't remember what they said.
- How many flickr-IDs are run by US Federal employees, uploading {{PD-USGov}} images? I dunno. It wouldn't surprise me if it were over 10,000. The bad news is that about half of them are run by very junior poorly educated individuals who mark all those {{PD-USGov}} images as "all rights reserved", who will not bend, and say, essentially, "I do what Sarge tells me to do, not what pointy-headed liberal know-it-alls tell me to do."
- I am not going to make a big deal over these images. But I must warn you, in the strongest possible terms, that your answer to "question a" is, IMO, wildly incorrect.
- While there may be exceptions, you should assume that the individuals who manage websites, or flickr IDs, are extremely junior people. If they are in the military, they are supposed to be high-school graduates. And that includes people who barely graduated high-school. You and I may have an understanding of intellectual property rights issues. But lots of genuinely smart, well-educated people, probably most smart people, are absolutely clueless about IP rights.
- While there are exceptions, most Federal employees who manage websites, or flickr IDs - it sounds mean to say this - should be assumed to be dumb as a bag or hammers.
- You will routinely see images that are clearly public domain, because they were clearly the work of a military photographer, described as a "courtesy" image, for completely bogus reasons.
- Sometimes some aging veteran, or the descendant of a veteran, will have in their possession the last known copy of a PD photograph, of the ship they sailed on, or whatever.
Of course that veteran doesn't own the IP rights to that image, just because they possess the last known physical copy. So, there is no legal requirement to credit them, when their last known copy of the image is re-published.
But old veterans also aren't obliged to turn over their treasured photos, so they can be reproduced and republished.
As a result, routinely, those clearly PD photos are credited "image courtesy Joe Bloggs, PfC (retired)", because someone decided crediting Joe Bloggs was the cheapest way to get Joe Bloggs to allow that last known copy of that clearly PD image to be reproduced.
- Other times that junior person, managing a website, or a flickr-ID, dumb as a bag of hammers, will put "courtesy image" on a PD image, because it was taken by an employee of a different Federal agency than the one he or she works for. They see this totally unnecessary gesture as a way of one friendly USN rating offering a tip of the hat to their opposite number at the USCG, USAF, or even the National Park Service.
- Of course these unnecessary credits confuse people. And I have engaged in many discussions where someone challenged whether a clearly {{PD-USGov}} image could really be in the public domain, when its source website listed it as a "courtesy image".
- Sometimes some aging veteran, or the descendant of a veteran, will have in their possession the last known copy of a PD photograph, of the ship they sailed on, or whatever.
- If you or I were experienced flickr users we would know how to maintain hundreds of flickr albums, where most of them contained PD images, and should be released using cc0, while marking the few albums we uploaded that do not contain PD images under a different license. If you are not a flickr user let me assure you, this is trivial, if you know what you are doing. But, remember, dumb as a bag of hammers, lots of individuals who were assigned to manage a flickr-ID never acquired this expertise, or don't understand the dozen or so flickr license choices.
- With regard to your answer to "question b" - if we could count on the employees of US government, who manage official websites or flickr-IDs, being (1) intelligent individuals; (2) who understood and respected intellectual property rights, I'd agree that when the image's EXIF data, or image description, stated or implied it was not PD, we should trust that.
However, due to the "dumb as a bag of hammers" factor, I think it can be a mistake to simply delete such images based on the precautionary principle.
Due to the dumb as a bag of hammers factor, we will find images, where a US Federal employee has taken photos, when they were on-duty, with their personal cell-phone, which marked the photo copyright Joe Bloggs. I would not hesitate one second to argue that such images were clearly {{PD-USGov}}. Further, due to the dumb as a bag of hammers factor, some Joe Bloggs may very well explicitly claim copyright, in the image description, for images that a re clearly {{PD-USGov}}.
- Some years ago I came across an image of some USCG ratings, on the deck of a Point Class cutter, while it was stationed in Vietnam. One of the ratings would later be recognized as a hero, who would later have a Sentinel Class cutter named after him.
There was no doubt, in my mind, that this was a {{PD-USGov}} image. Everyone was in uniform. They had recently been underfire, and they all looked tense, keyed-up. However, the photo came from the personal collection of one of the sailors, and was credited something like "Image courtesy of Joe Bloggs, Boatswain's mate (retired)".
I don't care if Joe Bloggs used his personal Kodak Instamatic to take that photo. They were all in uniform and all clearly on duty.
If there had been a discussion, that concluded the image wasn't PD, I still would have tried to use it in the article about that rating, as it showed the little boat he had piloted when he earned his medal, and got the citation that triggered naming a cutter after him. If a discussion ruled it wasn't PD, I would have argued it was one of the rare non-free images that merited use on en.wiki.
- Asclepias, I know you have participated in discussions where another contributor has argued for the deletion of images, using the Precautionary Principle, that advanced that principle to bizarre and laughable extremes. I know this because I encountered you there making very valid counter-arguments. Sanity checking should be performed, prior to the use of any arguments based on the precautionary principle.
- With regard to these particular images... The U.S. Embassy and Consulates in Canada flickr ID has published some uniquely valuable images. Sometimes US diplomats travel to remote bases, or remote communities, and take photos there. While Canadian officials also travel to those places, and take photos, none of those photos are under a free license. Anyhow, the images we are discussing here are not among those irreplaceably valuable images.
- Normally, I'd go back to the flickr pages for these images, and leave a note, seeking clarification over the actual copyright status. However, the images we are discussing here are no longer on flickr.

- Patrick Lacombe is a photographer who has been taking photos for the Montréal Fire Department (Sécurite Incendie de Montréal - SIM), as evidenced in the credits in the annual reports of SIM, e.g. [5], [6] (credits are on the last page of each report). The flickr photos nominated in the present DR are stamped with the big evident logo of the Montréal Fire Department (SIM) and watermarked with Lacombe's copyright. There is no reason to think that those photos are anything other than what they obviously and explicitly say that they are: photos taken by Lacombe as part of one of his contracts for the Montréal Fire Department and on which the photographer kept his copyright in this case. At the limit, one might quibble about the exact clauses of this contract between the photographer and the Fire Department, but that would not change the conclusion. There is nothing at all that can allow to speculate that those photos might have been works of an employee of the US gov. It's clear that they are not. The main point in your comment is one principle: junior staffers tasked with flick accounts often don't know or don't care about the copyright status and tag the photos erroneously. The logical conclusion is that when a flickr tag on a photo on such a flick account looks dubious and unsupported and is in direct contradiction with all other known information about the photo, then the mistake is more likely in that inconsistent tag placed by a staffer than in the specific information provided by the people who actually care and know their own works. Which is my point. What we have here looks like such a case of a staffer who automatically and carelessly applied the same flick tag to everything in the flickr album, without considering the actual status of the photos. You mention another DR where a user was ignoring the facts of the case. The purpose of DRs is not to try to delete files at all costs, but neither is it to try to keep files at all costs. If this is non-free as I suspect, the logo can be uploaded to English Wikipedia as fair use. English Wikipedia is a different project with different rules.

The file is stated to be from GMA Sports, which is the sports division of the Philippines' leading media broadcasting company, GMA Network Inc. I have not been able to find an explicit statement of GMA's copyright policy, but it would be very unusual for such a company to release its material under such a free license as is claimed, and I think without evidence of such licensing we cannot assume it is freely available. - Where is that button? jk I simply was not aware the route with mentioned duplicate tag and thought I had to convince. Plus i dont mind very similar duplicates, such as version numbers of a good quality print. It's all about unacceptable lack of visual quality here. Uploader did the 'duplicate' the same day as this one. Mentioning some kind of dance; there is ten more of these same issues in cat Danse_Macabre. Very easy to spot, but not even worth the time of finding their superior duplicates. So I prefer to agree generally that they are pretty useless and annoying and can be deleted without having to prove of each file that there is already a better equivalent available (or will be soon enough). - Errors have not been corrected. Clicking on Accession number link takes you to museum page showing correct image. FBulfin (talk) 08:36, 19 July 2023 (UTC)
