"Own work" can't be right. The depicted person died in 1915. Per description, the photo was taken shortly before his death ("nahe an seinem Lebensende"). So, it's possible that the photo is already in the public domain, but we would need more information (name of the photographer, year of photographer's death - we also can't simply assume that it's an anonymous work just because the uploader didn't mention the photographer). - Keep "PD-EU-no author disclosure" When you scan, or even crop an existing image, you create a derivative copy, that is your own work. Commons only leaves room for one set of information, so people choose either info on the original or the derivative. As to whether it is truly anonymous, our Precautionary Principle demands "significant doubt" before deletion, so perhaps finding a version online attributed to a photographer would be sufficient for deletion. - No, by merely scanning an image, no new work and no derivative work is created, that's pretty standard copyright knowledge. Not only has Commons this longstanding policy based on US law, it's also clearly stated in EU law since 2021. It's all about the copyright protection of the original work - the uploader doesn't have a legal base to add a CC-BY-SA license; if it's PD, then it remains PD. But the question in this case is whether it is PD. And I strongly disagree with your assumption that "almost all images from this era are anonymous" because, in fact, the photographer was very often known in their time, and the original photographs often bear the name of the studio/photographer - it's just that this information often gets lost when reprinting or scanning an image, but that doesn't make the original work positively anonymous. The legal status of this image is contentious. Both Ukraine and the US are signatories to the Geneva Conventions. This binds them voluntarily by their own laws. A captive with prisoner of war status should not be humiliated or exposed to the public.
Therefore, according to both US and Ukraine law, the Ukraine government do not have the legal right to release this photo under any sort of license as long as this person has prisoner of war status.
This may qualify for speedy deletion as another version appears to have been deleted before Commons:Deletion requests/File:CapturedWagnerfighter2.png(apparently not)

- The {{Personality rights}} handles the former issue: anybody who wants to reuse the image is reminded to check their legal responsibilities in this regard. The statement on the status (a copyright licence) is there through the SSU template. If you want to argue that the Geneva Convention makes the licence statement invalid, then do that; the connection has been disputed, and no real arguments on the connection have been presented. - Keep. As Rslik and Borysk5 pointed out, the Geneva Convention is not binding to Wikimedia, and it was published by an official organ of the Ukrainian government. If you want to insist on the POW argument, be aware that Article 47 of the Geneva Convetion states that mercenaries aren't considered lawful combatants and thus have no rights as POWs and are to be treated as common criminals. - Ukraine declaring that man to be a POW does not give him the rights. He just has them. There is no way to revoke those rights unless and until he is convicted of a war crime or released. That is what the conventions say. Ukraine does not have the right to license a POWs exposure to the public, no matter what anybody says, not them, not him, I'm not even sure that Russia could find a way to have those rights revoked.

I had nominated this for deletion a few days ago due to potential copyright issues, but it was erroneously closed by an administrator as keep. So I'm re-nominating it for deletion. What this comes down to is that the source website says the copyright status is unknown. Although the photograph was taken by an employee of the New Zealand based photography studio Crown Studios. According to this document in Australia "a work created in the context of employment is owned by the employer." In fact most, if not all, modern western countries follow the same standard. So I assume it also apply to New Zealand they have extremely similar laws due being members of the Berne Convention. The only instance where the copyright is not owned by the employer is when it's explicitly stated by an agreement, which there isn't evidence of in this case. There is also zero evidence that there is an exception for employees of photography studios. Therefore, the employer of Crown Studios and copyright holder would be Frank Thompson, and he died in 2001. So this image is copyrighted until at least 2071. Thanks. - @Richard Arthur Norton: Can you link to where the long standing policy on images from this studio is? Because I've done a lot of research about it and I couldn't find one. Hell, even if you look through the deletion request archive for "Crown Studios" mine are the only ones that exist. I'm not sure how there can be a long standing policy about something that hasn't been discussed and has no images related to it nominated for deletion before. Another thing is that the whole "a work created in the context of employment is owned by the employer" is directly from a Commons legal packet. I doubt there would be a long standing policy that directly goes against Commons' own legal documents. Otherwise, we have to believe Commons' own documents can't be trusted or followed, which just seems weird. It seems like if the author becomes unknown, they do indeed magically lose copyright. I'm sure most works have a known author when they're created, so ought to be copyrighted for that creator's lifetime and then 50 years more, but if someone later investigates and "it is not possible for a person who wishes to ascertain the author’s identity by reasonable inquiry"[1], the work does indeed magically fall into the public doman. Per prior consensus stamps (or other payment documents) in Russia are non-eligible for copyright but only as a whole subject. When they are cropped, they become covered by copyright protection. In this case the image is cropped from an otherwise PD postal cover. To quote the law in Russia, "“This Russian official document, state symbol or sign (postage stamps, coins and banknotes mainly) may incorporate one or more works that can be copyrightable if separated from this document, symbol or sign." The sculpture was in Paris, but there is no freedom of panorama in France and the photo violates sculptor's copyright. The sculptor Paul Jouve died in 1973 and his works are protected with copyright until 2044 (70+1 years from death). If this is 1937 photo, then it is not own work. This is apparently a photo of an engineer by the name of Yu.M. Kulikov. There's no further description, there's no category, and it's not in use. The only somewhat notable person with the name of Yu(ri) Kulikov I could find was a soccer player, so apparently not him. So apparently this is a photo showing a person that is not notable, plus the photo looks badly manipulated somehow. So I think we should delete it. Rosenzweig τ 20:01, 3 June 2022 (UTC)

- Keep The SIRIS record does indeed state that Felix de Weldon owns the copyright and that the copyright statement is on the sculpture itself. Being copyrighted in 1954, the copyright would have expired in 1983 it would have required renewal at that time. In the Library of Congress copyright records for de Weldon, there are two entries for "Marines raising flag on IWO-JIMA", but neither of them were created 1982 or 1983 (one is in 1986 and the other is 1993), so {{PD-US-not renewed}} is probably applicable. howcheng {chat} 23:57, 27 July 2011 (UTC)

- That article only states that he visited the office in 1977, but for the sake of due diligence, I searched the 1977 records for "Felix Weldon" and found no results. I also tried "Iwo Jima" and there were no relevant results (besides, the statue wasn't even eligible for renewal yet). This 1954 sculpture is the work of Felix de Weldon, erected with a copyright notice burnished in gold. Per Commons:Copyright_rules_by_territory/United_States#Freedom_of_panorama, the US does not allow public sculptures from this date unless there is a specific release from the artist. This a privately funded sculpture, using private money, not a work of the US government. I don't see this picture at https://web.archive.org/web/20120617145446/http://dergiler.ankara.edu.tr/dergiler/45/788/10114.pdf .In any case, if this is a 1930 photo, this became PD in Turkey after the 1996 URAA restoration for anonymous works (1930+70=2000). If this work was solely published in Turkey in 1930, and since it didnt become PD before URAA, then it'd be 95 years of copyright. This makes it 2026 to become PD in the USA per Commons:Hirtle_chart. [edit]Not sure why this is tagged as PD-Poland when it was taken in Ankara, Turkey. While this is PD in Turkey for anonymous works (1938+70=2008), this is after the 1996 URAA year Commons:Copyright_rules_by_territory/Turkey. If this 1938 picture was solely published in Turkey, and since it was not PD before URAA, this wont be PD in the USA until 2034 per Commons:Hirtle_chart. Though Koncern Ilustrowany Kurier Codzienny is a Polish publishing house, the photo was taken in Ankara, Turkey. Therefore, that's why I said "Not sure why this is tagged as PD-Poland when it was taken in Ankara, Turkey". If we are supposed to use Commons:Copyright rules by territory/Poland instead, the same issue applies as Poland also has 70 years of copyright for anonymous works. - @MrLinkinPark333: It does not matter where the image was taken, but where it was first published. As indicated already (again, you really should check the descriptions before making blanket nominations), the image is anonymous and was published in/by Koncern Ilustrowany Kurier Codzienny in 1938. As per the rules applicable in Poland: "For anonymous or pseudonymous works copyright expires 70 years from date of first being made public". Unless I am mistaken, US copyright does not at all offer protection works with their copyright expired in their country of publication before 1996, and this appears to be the case of this particular item. - Note: If you should still find the concept of "country of publication as country of origin" elusive, please consider having a look over the images that have been uploaded on Commons by way of Gallica.fr: images that are taken in Romania, in Ireland, in Uganda, in Norway etc. by a French agency such as Agence Rol or Agence Meurisse are currently in the public domain by virtue of their copyright having expired in France. - Specifically, point number 3 under that section "Solely published abroad, without compliance with US formalities or republication in the US, and not in the public domain in its home country as of URAA date". This work became Public Domain in Poland in 2009. This is after the URAA year for Poland in 1996. Meaning, an additional copyright was added for the USA. Keep at least for File:Gigasports logo.png because it is a basic image of an orange globe. So I highly doubt it's copyrightable, whatever the threshold of originality is. This is the coat of arms of a municipality in Colombia, taken from [6]. Could be old, could be new, I don't know. Commons:Copyright rules by territory/Colombia does not really say anything about coats of arms. There is a clause that "In all cases where a literary, scientific or artistic work has as its owner a legal entity or an official body or any institution under government public law, the term of protection shall be deemed to be 70 years as from the date of publication." But we don't know when this was first published. Could it be in the PD for another reason? If it can't be determined that it is in the PD or under a free license, the files should be deleted per the precautionary principle.

- Keep Hello, the source website says its a faithful version of the Special Boarding Unit Insignia "a special finish that faithfully reproduces the "new emblem" of the Special Boarding Unit on the back." Secondly, wiki commons has many insignia of the Japan Self-Defense Forces. So if all those other insignia and badges are allowed then this one should be: licensed under the Government of Japan Standard Terms of Use (Ver.2.0).
