Keep Regardless of the nominator’s standing or supposed motives, a problem with the crescent shape (which I gather from Google Translate is the issue) is not cause for deletion. Keep As for the issues with the design, this was what I was sent from their Embassy in Tokyo, Japan, by Japanese vexillologist Nozomi Kariyasu. I drew the design based off of this document, which was a radical change from the March 2017 proposed law to what eventually was adopted late of 2017. - And I will gladly work with all parties to get this design right. I still think my issue is, along with others, is what was the legal source or point where the design got changed from the 15/70/15 to what their Embassy in Japan sent us. I personally have not found that legal point yet and I am not having much luck pointing to where it happened, though I remembered this just now. The PD-template, which was used to tag this image, states "any work done entirely by an artificial intelligence or computer algorithm". However, the head of Plato cannot be invented by an AI on its own. So, without any information whether a verified PD-old source was used, the validity of that template seems to be questionable. I also want to add that the template doesn't say "entirely". And that I used Photoshop to make it completely black and white and then colorize it to a pale color. I would like to discuss also this. The "entirely" here doesn't make sense, because all AI creations are stochastic. They are evidently "inspired" (read as copied if you want) in images that may be under copyright or not, but the creation is always new. You don't get two "Plato"'s with the same prompt twice. Even me, I got 12 differnt ones till I get to this that was satisfactory for me. So the word "entirely" will never apply to the creation by the AI itself. I would read it as "with no further human intervention". If the image was created by an AI and a human added letters, features or whatever... then it isn't "entirely" done by an algorithm, that is what the license covers. Based on the image and on Theklan's claims, I see up to three possible Copyright claims:

The hypothetical original image of some bearded marble statue used by the AI. A superficial check via GoogleImages/TinEye doesn't yield me such an original. Looking closer, I kinda doubt the DR's claim: there are incongruities in the "sculpture", see for example where the beard and the neck connect. It seems to me as if it's an AI-made generic redrawing of a marble statue. AI's are that good by now. And let's not forget that even IF there is an original photo, PD-old might still be applicable. For this whole point, I see the burden of proof by the DR-requestor: please show us the supposed original, instead of just alluding that the original might hypothetically exist.
The "creative process" of fitting a VR device onto the marble head of a statue was done by the AI (on the uploader's request) and doesn't fall under copyright.
Theklan themselves claims to have fixed colors in post, and that they were the person who requested the image from the AI, triggering the creative process in the first place. When Theklan uploaded the image afterwards, they deliberately waived CR claims of their own.

General comment

Who the original author is do not matter. What is important is to know who the copyright holder is. There could be more than one copyright holder as the original author might have given the rights to more than one person. Therefore, about the images published by Tasnim or Mehr news agencies in the photo section of their site:

Keep if Tasnim / Mehr is credited (even if also published elswhere with another watermark)
Keep if the photographer is credited (even if also published elswhere with another watermark)
Delete if another agency is credited
undelete images that didn't need to be deleted

For images credit "received", I am not sure about who is the right holder. Maybe we can keep the ones only published by one agency and delete those that were also published by non-free agencies.

According to the Exif data the photo was made on 11 Aug. 2014 (which is only an indication, but could be correct). Fazel Gomar still has this photo on Flickr under a different account, "joined 2015", but now under a different license "all rights reserved" - photo uploaded 5 Jan. 2015. Yea its a bit confusing so lemme explain it. Once i've uploaded the photo to Flicker (about 2015) but I didn't know that 1)the file includes these EXIF data and the exact location tag 2)my photo can be indexed by Google, Wikimedia or any media directories and anyone can find it (and also find these EXIF data including my living city) just by searching my name!! 3)Someone uploaded it to an Unsplash profile with a creative commons license. So as the owner, I reported the file and requested Unsplash to remove the photo and they removed the file and the fake profile as well. More info about the file on my Flicker account: It will be removed soon. I don't think the photos are the same . The ISNA photo has watermark in left and down side , but the contribution to Wikipedia does not have the sign "ISNA" . More than that the metadata shows the contributed image is the original ( like more megapixels and ... ) . If the original photo belongs to the photographer and he?she himself had published it in one media outlet , that does not means he can not publish it elsewhere ( including Wikipedia ) . The uploader confirms above that this photo is obtained from ISNA, but falsely says that the website is in public domain (Footer: "© 2022 Iranian Students' News Agency. All rights reserved"). ISNA photo's metadata also indicates that it was taken with a Canon EOSD60 camera, so we can be sure that this is a cropped version of ISNA photo. We have no proof that Hassan Ghareeb is the copyright holder (he took this photo for ISNA, so it is reasonable to think ISNA owns the right), that would be the case if they send an email to Commons and declare that this photo is free. Then I read the "License to Twitch," and maybe I'm missing something in the legal language, but it looks like it gives Twitch and anyone the company specifically decides to license: "an unrestricted, worldwide, irrevocable, fully sub-licenseable, nonexclusive, and royalty-free right to: (a) use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (including without limitation for promoting and redistributing part or all of the Twitch Services (and derivative works thereof) in any form, format, media, or media channels now known or later developed or discovered; and (b) use the name, identity, likeness, and voice (or other biographical information) that you submit in connection with such User Content." It is however originally a Spanish photo, published here in 1931 and credited to Alfonso, that is es:Alfonso Sánchez García, who died in 1953. So its source country is Spain. It is a studio portrait, so not a "simple" photograph, and {{PD-Spain-photo}} does not apply. The photograph is therefore still protected in Spain until the end of 2033 (80 years pma for authors who died before 7 December 1987), and the file should be deleted. This seems to be a screenshot from https://www.youtube.com/watch?v=mQusj6tD97w which credits the "National Park Service's webcams" and links to https://video-monitoring.com/construction/olympic/, which states "Copyright © 2013 Erdman Video Systems, Inc. in collaboration with the National Park Service". This suggests that the video was set up or taken by Erdman Video Systems whom themselves (or their employees) would own the copyright. (If it were taken by an employee of the National Park Service, {{PD-USGov-NPS}} might apply.) Iran's threshold of originality is extremely low, stating that Paintings, pictures, drawings, designs, decorative writings, geographical maps or any decorative and imaginative work produced in any simple or complex manner are protected by copyright. This photograph contains two copies of the same simple design on the monitors on the right, while it contains a simple geographical map in the monitor on the top left. The image is left almost meaningless if there were to be a simple crop to remove all the monitors, as this would leave only a sliver down the center of the image. This photograph is intended to show a command and control system, not the image in the monitors (they can be turned off and still this image is meaningful). So, with the monitors blurred this image will be OK if that is the problem, although I don't see any reason to consider a map of Iran protected (Iranian law clearly says maps are protected only if they are "ابتکاری" or "innovative", per Article 2, note 5) or an abstract computer wallpaper should be considered an artwork originated from Iran (it could have been obtained from anywhere). I'm relying on the English Translation of the Iranian copyright laws deposited with WIPO, which specifies that geographical maps ... produced in any simple or complex manner are copyrightable. It is very strange that the word "ابتکاری" in the original Persian text is absent in English translation. Also, the phrase "simple or complex manner" seems to be a translation of "به صورت ساده یا ترکیبی", I think the word 'complex' refers to a collage (derivative work), not a sophisticated work (though a sophisticated work is also copyrighted). This user first received a block warning a few weeks ago and I have today blocked the user for 1 week. Two press photos from AFP and ITAR-TASS from the 1990s have been speedy deleted. All the user's uploads from July 2 and July 3 are photos of photos displaying various Russian politicians of the 1980s, 1990s and 2000s. Some also of Nikita Chrusjtjov and Leonid Brezhnev. Unfortunately, Sinergise (the company that provides Geopedia) cannot legally license work by GURS as CC. The CC license can only apply to the work created by Synergise. Delete, for now, per TadejM and COM:PRP, as there seems to be just too much uncertainty about licensing and the provenance of individual parts of this compilation. The data by GURS can't be freely licensed by the company Sinergise since that would be license washing. One can only license the content for which they hold copyright. That means that only the website itself is CC, but not the maps provided by the GURS. The air photos could be free for lack of creativity, whereas the photos of monuments are not free as they belong to their respective uploaders (it's a semi-participatory project). In the best case, that would mean that files

are currently out of the licensing scope of Commons.

The photos of the partisan monuments within the layer Partizanski spomeniki on Geopedia are by default licenced CC 4.0, because we the participants of the project have chosen this licence among the others when creating the layer. Whoever uploads his photos into this layer, is aware his photos are not copyrighted. Photos in other Geopedia layers (Kozjak geopedija2.jpg) are mine and separately uploaded on Wikimedia Commons, e. g. File:Grad Kozjak3.JPG. There is an explicit information at the bottom of the information page of the layer Partizanski spomeniki at Geopedia, that the text and photos we contribute are published per default under the CC licenece and thus in public domain. The copyright notice does not refer neither to these photos that were contributed by third parties (users of the portal) nor the data that is attributed to GURS. No translation of the notice is required but an explicit permission of the photographers needs to be provided. Some of the files in question contain an OTRS ticket from the time, maps haven't been free yet. Tere are no third party contributers of the photos embeded (with one exception: File:Geopedia vnosno polje2.jpg - feel free to delete it). The main element of these pictures is the user-contributed content (which is distributed under the CC license). The map data is there only to demonstrate how to use the Geopedia GUI as the images are used in the wikibooks:sl:Nova pisarija textbook (see for instance #Zemljevidi) and as such de minimis. You have partially misunderstood me. It matters where the images are used not to clarify the copyright issue, but to make sure that the entry on Wikibooks stays complete. Commons is not just another online repository of free images, but is there to support an enrich other Wikimedia wikis. Before possible deletion, the image material should be transferred there if permissible under the terms of fair use. I'm stressing this out since I remember the consequences of your previous activity (mass deletion nominations under your previous nickname) and the damage it created to the local community, because this aspect was not taken into consideration and no one felt responsible/had time to transfer image material before deletion.

For the files above, I would still argue that de minimis applies: "Copyrighted map is identifiable and an unavoidable part of the image subject, but is not essential to the subject (blacking it out would not make the file useless)." Here it does matter to look at how the file is used. For instance, File:Geopedia vnosno polje2.jpg shows how to add/edit a (new) entry on Geopedia. But since this is a border case and any other map layer could be shown with the same result, I would suggest the author to upload another version of the images with OSM layer activated instead of other (possibly non-free) layers when possible. Only in rare cases, where purpose of the image is to show how specific functions work with a non-free layer, the images should be transferred to local wikis where fair use is permissible.

But first of all, we should make sure which the GURS layers are licensed how, since the footer of the webpage shown in the images indeed explicitly says that the ortophoto layer is licenced with CC licence. --Miha (talk) 19:09, 3 November 2022 (UTC)[reply]

@Miha, I'm not sure that the CC licensing also applies to the maps since they have not been produced by the Geodetic Administration itself but by the Geodetic Institute, which has a copyright symbol (©) on its website.[9] It is therefore unlikely that the maps have been CC licensed. Well, in this case it is best to clarify the situation with GURS and GIS. The evidence that this is work by GIS – by linking above to the GIS site where this is explicitly stated.
The evidence that GIS materials are copyrighted – this is also clearly stated on their site.

Now the onus is on you or whoever wants to keep the images to provide the evidence that GIS has agreed to transfer the copyright to GURS and put it in the public domain.

Re spending time on thoughtless proposals, reporting spurious images here is very targeted and only a part of my work on Commons (my contributions are publicly visible).
