The deletion in question was justified by this reasoning: "From a meuseum [sic] administered by the State of Illinois (works not public domain), PD-US does not apply as made in 1990." However, the specific museum which is used to justify the file's deletion explicitly states "This image is considered to be in the public domain" under the file (see slide 3 of the photo gallery).

The reasoning for the deletion is therefore nonsensical if the non-public domain claim is explicitly contradicted by the source for said claim. --Srekcins (talk) 16:46, 30 October 2024 (UTC)

@Ayntmamiagaag: the license was changed to CC-BY-NC but it is not compatible with our license policy. The metadata states that Anssi Koskinen is the copyright holder, but the Flickr page is from the IFF. Did the photographer transferred the copyright to the IFF? Images of the Palazzo Uffici

Hi everyone, I'm writing here in order to ask for the undeletion of the following images:

They were all deleted in 2013 after this DR and they depict all the it:Palazzo degli Uffici (Roma), designed by it:Gaetano Minnucci and built between 1937 and 1939. As we can read here it was commissioned to Minnucci by the it:EUR (azienda), which at that time was still a public entity before its transformation into a society for profit in 2000. Therefore, the building fell into Template:PD-ItalyGov in 1960. It was built way before 1990, so no issue with US copyright.--Friniate (talk) 14:51, 1 November 2024 (UTC)

NIOSH has been conducting extensive research work, involving competent specialists from other organizations (by concluding contracts) since the foundation of this institute.

For example, the publication of the institute, posted on its website


DHHS (NIOSH) Publication Number 77-173 Occupational Exposure Sampling Strategy Manual

was created exclusively by those specialists who were not and did not become employees of NIOSH.

In connection with the deletion of the files, I contacted NIOSH with a question about whether the program posted on the institute's website, also developed FOR THE INSTITUTE UNDER CONTRACT, AND PAID FOR BY THE GOVERNMENT, is protected by copyright. That is, the government paid for their work not in the form of a salary, but under a contract. If one of the performers of the work (program "MultiVapor", DHHS (NIOSH) Publication No. 2010-124C, Gerry Odel Wood) also posted a copy of the work (paid for by the government) on his website, this does not change the fact that he performed the work paid for under the contract, performed in the interests of the institute, which is part of the U.S. Department of Health and Human Services, and is declared by NIOSH as its own publication - on the institute's website. Please read the response of the copyright specialists.

 Oppose Work performed by employees of the Federal government is free of copyright. Work performed under contract by persons who are employees of a contractor is not free of copyright unless (a) the employee has a written work for hire agreement in place with the employer (this is likely but not certain), (b) the contract explicitly calls for any copyrights to be transferred to the Federal government and (c) the Federal government chooses to make the work PD. For examples where (b) does not apply, see Category:Official presidential painted portraits in the White House. For an example where (c) does not apply, see the Sacagewea Dollar obverse, https://www.usmint.gov/news/image-library/circulating-coin-design-use-policy. None of these has been proven here.

Images of the Museo Nazionale della Magna Grecia

Hi everyone, I'm writing here in order to ask for the undeletion of the following images:

They all depict the building of en:Museo Nazionale della Magna Grecia. As we can read here (p. 125) the building was commissioned to en:Marcello Piacentini by the Municipality of Reggio Calabria. Its construction ended in 1941, therefore the building fell under Template:PD-ItalyGov in 1962. It ended way before 1990, so no issue with US copyright. The copyright warning now present in the category should be removed accordingly.--Friniate (talk) 11:24, 5 November 2024 (UTC)

I don't see any valid grounds for deletion here - it's a historical logo for an in-scope entity (and very clearly indicates that it's historic), and it appears to be simple enough for {{Textlogo}} to apply. This is a mistake -- another AI mistake it seems.

David Steinberg is the subject of the photograph. He is also the person who made the photograph! (He has been a professional photographer for several decades) He is also the wikicommons contributor who uploaded the digital file! I asked the photographer to upload an image through the wikicommons upload form so that I could use it for a wiki article I was (eventually) going to write.

Because I know how complicated the upload form was, I actually did a zoom call with him to help him sign up for wikicommons and guide him through the upload process. (If you don't believe me, message this user to confirm this! or go to the contact form on his photography site )

As far as I know, there is no wikicommons requirement that photographers give photos exclusively to wikicommons. (Indeed, that requirement would itself be a violation of the creative commons (CC) license. In fact, as the original upload can show, Steinberg clearly marked it with a CC license (and in fact, he was already familiar with CC licenses and his personal website also uses CC licenses.  Comment Actually, the copies on the Net are small thumbnails, while ours is 2,592 × 3,872 pixels and has EXIF data, so it is quite possible that they were copied from Commons. But as Jim said, only the author can give a license, so unless the uploader is the photographer, we need a permission via COM:VRT. @Idiotprogrammer2019: And I don't see any evidence that This Thing We Call Sex is under a free license. Images of the Casa del Fascio (Florence)

Hi everyone, I'm writing here in order to ask for the undeletion of the following images:

They all depict the it:Casa del Fascio (Firenze) and they were all deleted in 2013 after this DR. The building was commissioned to en:Raffaello Fagnoni by the local fascist party (see here, p. 50). The italian copyright law considers the fascist party as if it were part of the state administration. The construction of the building ended in 1940, thefore it fell under Template:PD-ItalyGov in 1961. The construction ended way before 1990, so no issue with US copyright.
Please restore also the Category:Casa del Fascio (Florence), deleted in the same year after this DR because it had been emptied of all its images.--Friniate (talk) 20:24, 12 November 2024 (UTC)

I would like to kindly request the restoration of some images that I uploaded to Commons from my main account, Macrobreed. I am no longer active on that account and now use this alternative account. The images are as follows:

These images were deleted for being out of scope. Please refer to Commons:Deletion requests/Files uploaded by Macrobreed for more details. I understand that some of the other images I uploaded may not meet Commons' scope. However, I added all images in good faith, either sourced from Flickr or created by myself, such as the image taken on World Stroke Day.

Regarding the two volunteer images, I believe they could contribute to sections related to Indian non-profits, volunteerism and children's education along with related categories.
As for the image clicked by me on World Stroke Day of Dr. Ritwiz Bihari, I noticed that there are relatively few images in the Commons category for World Stroke Day. I thought this image could help add to that, especially as it highlights an important aspect of stroke awareness in India. I hope it can serve as a useful contribution to the category.

The building was commissioned and paid by the Municipality of Milan (see here, p. 15), therefore it fell under Template:PD-ItalyGov in 1961. Personally, I'm seeing two issues:

Notability

It isn't clear if the subject is notable.

Copyright

Both were taken from the musician's Blogspot. The OTRS ticket was closed, but, again, the uploader is struggling with the process, so it's possible he did in fact take the photos as he suggests. The subject doesn't seem to have much press, so it seems unlikely to me that OP is yet another adoring fan making a false claim of ownership. Nonetheless, if we determine that the subject is notable, I can try to walk the uploader through the OTRS process.

I think image 1 complies with {{PD-text}}. It is pretty much the same text (with a total of three sentences), but slightly modified for each of the four text boxes. All the text does is describe what each plan contains, with no literary language. More complicated files have been kept for {{PD-text}}. See:

Image 2 should also comply with {{PD-text}}. The email is very short, with only a total of six sentences, and two headers, that describes the discontinuation of a subscription plan. If it's too complicated, I would like to ask whether I could upload a new version with the body blurred out, only keeping the title.

Country of origin is the US. Note the "canceled" spelling in image 2. The threshold of originality seems to be high for short phrases in the US. See [5], which says "Copyright laws disfavor protection for short phrases. Such claims are viewed with suspicion by the Copyright Office...", and that originality is not a matter of the number of words used, but rather "the uniqueness and value of the phrases as well as the way in which you (and the borrower) use them." Like I said, for image 1, it is pretty much the same text (with three sentences), but slightly changed for each of the four text boxes.
You can think of the text boxes as like "recipes" for making food. And recipes are not eligible for copyright according to the Copyright Office: "A mere listing of ingredients or contents, or a simple set of directions, is uncopyrightable"
It's like if someone wrote a cookbook containing a page with the ingredient lists for four different types of pizzas, with only slight changes in the ingredient list for each of the four pizzas.
And it doesn't matter how many ingredients are listed for each pizza, whether it's three, 30, or even 3,000. There is simply no copyright for listing items with no creative authorship.
Also, in the case that the body of the email in image 2 is judged to be copyrightable, I would like to ask whether I can upload a new version of image 2, but only with the title legible, and the body blurred. The Copyright Office also said that "Words and short phrases, such as names, titles, and slogans, are uncopyrightable..."
The Copyright Office also said that copyright is ineligible for "format" or "layout", so even the format of the email in image 2 is uncopyrightable.
All references to the Copyright Office's judgments mentioned above come from Circular 33: [6]
Complete sentences are not automatically copyrighted in the US, so we have to actually look at the sentences and ask ourselves if they are eligible for copyright.
I'm not sure if you have seen the Hillary Clinton example I posted earlier (Commons:Deletion_requests/File:Hillary_Clinton_2016_DNC_Speech.webm), but the following sentence was judged to be uncopyrightable:
"So it is with humility, determination and boundless confidence in America’s promise that I accept your nomination for president of the United States.”

Also, I think it's worth taking a look at Circular 33 for an example of a recipe that is uncopyrightable:

Paulina Neumann submits an application to register a recipe for caesar salad dressing. In the “Author Created” field, Neumann asserts a claim in “text.” The work consists of a list of eleven ingredients with the following instructions: “(1) puree anchovies, garlic, Dijon, egg yolks; (2) drizzle oil in gradually to emulsify; (3) add lemon, parmesan cheese, salt, pepper, Worcestershire and tabasco sauce.” The Office will refuse registration for this work, because the list of ingredients is uncopyrightable, and the instructional text contains an insufficient amount of creative authorship.

Welp, I showed an example of a set of 11 ingredients and 3 complete sentences that is explicitly denied copyright by the US Copyright Office. Thus, having multiple complete sentences is not enough to guarantee US copyright. If you think those three sentences in those textboxes are copyrightable, then I don't know what to say, especially considering that the 3-sentence-instruction is much longer and complicated. This is an official author photo, released by the author (me) under a CC BY-SA 4.0 Creative Commons Attribution-ShareAlike 4.0 International license. So there is no copyright violation, though perhaps some of you don't understand Creative Commons. Read up on CC before you try to delete it again for this reason.

Gbawden deleted it claiming a violation of rule F10, "Personal photos by non-contributors: Low-to-medium quality selfies and other personal images of or by users who have no constructive global contributions." This is a high quality photo, better lit and higher resolution than most author photos on Wikipedia. It shows the current appearance of a living and still working author, unlike the single low resolution badly lit 2 decade old photo still up on Wikimedia.

It seems to have been deleted because it was considered a derivative work. But actually, checking it from the Archive, it does not appear to be a derivative of any particular depiction of Ali. However, the iconographic detailing of the face often differs between images to present a variety of physiognomic traits all held to represent Imam Ali. Imam Ali is shown in part profile with lofty forehead and wide, a little oversized, eyes with large pupils. The high eyebrows accentuate the size of the eye. Ali avoids eye contact with the viewer and the gaze seems to be directed slightly upwards with the look of a far-sighted visionary, creating an almost dream-like appearance. The face is oval, and the cheekbones round. The lips are full rather than thin. Cheekbones and lips are partly covered by a dark, thick, well-trimmed beard.

This file should be undeleted unless a direct VRT ticket was received. It was used on several highly viewed Wikipedia articles (nearly 500,000 views in the last 2 weeks) under {{PD-textlogo}}. Earlier today, this was deleted by @User:Bedivere. I, the uploader of the photograph, never received any talk page notifications regarding speedy deletion, copyright violation, or deletion discussion. I received nothing and only noticed it in my watchlist. As such, I am wanting a VRT check done to ensure this was not a WMF-deletion. If no VRT ticket was ever received, I request this image be undeleted under PD-textlogo, especially since on the surface, it appears to be possibly an administrator error, given I received no communication whatsoever regarding it or the subsequent deletion. The texture of the sign is definitely copyrightable and you failed to provide proper licensing (which was corrected, somewhat, by another user) falsely claiming it to be a work of the US government. This is easily more complex than, say, w:File:Prince logo.svg. In any case, the texture is complex and the artwork has not been created by a US government agency (DOGE still does not exists as such). Respectfully Bedivere, I disagree, which is why I am requesting another administrator review this. It was originally uploaded under the wrong license, which was corrected by another users, which you correctly stated. However, the image itself contained only simple shapes, and therefore, qualifies under PD-textlogo. So, if you don’t mind, given the issue with the lack of notification even regarding it, and then the (very late) notification that “File:DOGE Logo as of November 14, 2024.jpg has been marked as a possible copyright violation” (Key word “possible”), gave absolutely no time for discussion. Basically, this was deleted by your own judgement without any chance for it to be discussed. As an administrator, you have that judgement duty, but given the errors in notification/timeline oddity here, I prefer another administrator to make their own separate judgement call here on whether this should have been speedy deleted (which is what you did solely) or if it should be discussed as a larger community discussion (like DR), or if it should be undeleted. I already gave my reasoning as well, I believe on why it should be undeleted. That said, I believe this was a bad speedy-deletion and should have been a DR. The website that the photo was taken from is dead and hasn't been archived and it's not hosted anywhere else. I have no other way of seeing this photograph. Among them, the poem "Air Defense Hood," which praises the enthusiasm of the Himeyuri student corps who participated in civil engineering work to build anti-aircraft gun positions, suggests that Okinawa was in a tense situation at the time in anticipation of the upcoming US military landing operation. The Himeyuri student corps, consisting of female students in their teens, lost many young lives in the harsh battlefield while singing "Farewell Song," written by second Lieutenant Ota. One is that Mr. Ota was a senior at my alma mater, but of course I was not able to meet him as he passed away in 1945. The exchange of trust and respect between Lieutenant Ota and the Himeyuri Student Corps, and the farewell song that was born from it, are miracles in the midst of war. Lili Marleen, sung by both friend and foe on the European front, is also a miracle song. I hope that people all over the world will know about the heart-to-heart exchange between Lieutenant Ota and the Himawari Student Corps. We were able to get permission from the file owner on the original site https://www.inaturalist.org/observations/252698081#activity_comment_5f70d8f2-3ae1-4bc9-babb-06d78161a725 to post the photo to wikipedia.
