- Comment. It seem that the uploader was correct in his description that this illustration is anonymous. It was published without a name of author and it seems that its author is unknown. That is the definition of anonymous. Another user changed the description page yesterday [1] to attribute the illustration to Starace and he linked to an article as his source, but that source explains that this particular illustration, which illustrates the cover of the first book in the series, is unsigned and is of a very different style than the illustrations of the other books in the series, which are signed by Starace. Here is the exact quote from the article: «Cette première couverture, qui n’est pas signée, est d’un style très différent de celles de Starace. Il est très probable qu’elle ne soit pas de lui.» [2] (translation: «This first cover, which is unsigned, is of a very different style than those by Starace. It is very probable that it is not by him.») If the author of this illustration is unknown, then Commons should not speculate to attribute it. The objective fact is that the illustration was published without a name. Anonymous works published in 1911 would have entered the public domain in France in 1971 (51 y. pp + 9 y. ext.) and could be PD-1923 in the U.S. Although the tag PD-old should not have been used with an anonymous work, the file could probably have the tags PD-1923 and Anonymous-EU (which is not explicit in cases like this, but good enough). -- Asclepias (talk) 20:03, 1 February 2015 (UTC)
- I agree this is a quality source. The quoted footnote actually contradicts the text of the same article which says the opposite : "Gino Starace reprend ici à son compte des codes visuels efficaces, et ne laisse nulle place à la polysémie, la multiplicité vagabonde de la lecture de l’image". The same writer, Annabel Audureau, confirms her attribution to Starace in her book Fantômas: un mythe moderne au croisement des arts : "c'est le premier février 1911, en reprenant la structure d'une affiche publicitaire créée pour les pilules Pink que Gino Starace va immortaliser la silhouette d'un des plus célèbres bandits masqués, Fantômas"(p.37). I nominated for deletion following another article, by Bérengère Vachonfrance-Levet, also published by Belphegor according to which : "L’illustrateur-maison de l’éditeur Fayard, Gino Starace, avait illustré la première de couverture du roman en s’inspirant d’une affiche publicitaire anonyme vantant une boite de pilules (Pink) qui avait retenu l’attention de Pierre Souvestre et Marcel Allain. Il avait remplacé la boîte de pilules par un poignard sanguinolent et fait disparaître les pilules lâchées sur Paris." [3]. The illustration is also attributed to Starace in this article of the New York Times: "This was the cover drawn by Gino Starace for the 1911 edition of “Fantômas,”". - Hello. (First, sorry for my bad english.) I uploaded this work, indeed. ;-)
Most "Fantômas scholars" told that Starace is not the author of this painting. In fact, Annabel Audureau's book does make for pleasant reading but it's not always error-free ; in his chapter "Fantômas et la critique" (in Le Rocambole. Bulletin des amis du roman populaire, n° 54, "Fantômas centenaire", spring 2011, p.24), Alfu says : "Ce livre d'Annabel Audureau reste une pièce importante dans le dispositif, encore une fois fort modeste, de la critique fantômassienne. Un sacré bémol toutefois : le manque de rigueur dans le traitement des informations de seconde main. Car la recopie de ces informations n'est pas toujours exempte d'erreurs ou d'approximations et, souvent les références sont absentes. Je prendrais l'exemple de ce qui est dit à propos de Gino Starace. Rappelons que le brillant artiste italien n'est pas l'auteur de la première couverture du roman, qui représente un Fantômas lupinien, bien loin des silhouettes qu'il propose par la suite.".

And I must have keep somewhere the words used by Marcel Allain himself (in Noël Arnaud, Francis Lacassin et Jean Tortel, Entretiens sur la paralittérature. - Not only Alfu. Above all, Francis Lacassin introduces the same nuance about the Fantômas covers. In fact, Lacassin is historically the first specialist to claim that Starace is not the author of the cover n°1 because Marcel Allain told directly this anecdote to the public of the Centre culturel international of Cerisy-la-Salle (september 1967). Therefore, Lacassin is the only Fantômas scholar to quote his source, unlike Annabel Audureau and Bérengère Vachonfrance-Levet. Regards. Montmorency1

Plausible, indeed, because Starace was a very important artist of the collection "Le Livre Populaire" at Fayard. But he was not the only one ! There was Georges Conrad, for example. A fortiori, all Gino Starace's covers (and even posters) contain his signature according to Alfu, Patrice Caillot and François Ducos. It's clearly visible in their book about Starace : only the first Fantômas cover doesn't contain Starace's signature. We can assume that Gino didn't want to sign a painting which was not of his making... but then again, a conjecture (maybe a relevant one, we don't know ;-)) ! Regards. Montmorency1

- Non, no, it was crystal clear, don't worry ! ;-) Starace was without doubt a pillar of the collection "Le Livre populaire" as Alfu, Caillot and Ducos also told us. But Gino didn't paint all the covers : for example, he didn't illustrate the literary works of Gustave Aimard, Louis Noir or Pierre Sales published in the same collection (Alfu et alii). Whether the first Fantômas cover was a Starace's painting (strangely not signed ?) although not an original pictorial composition or whether it was the work of some anonymous artist (in order to touch up the above-mentioned details) is anyone's guess, for now. But upon reflection : Annabel Audureau contradicts herself ; Bérengère Vachonfrance-Levet does not quote her sources (as The New York Times) ; lastly, Robin Walz is right about Allain & Starace routine but he doesn't tell specifically the same rule applies to the first cover. So I'm agree with Asclepias : "Commons should not speculate to attribute it. The objective fact is that the illustration was published without a name". Regards. Montmorency1

Walz does not assert anything about the first cover specifically, The New York Times journalist is hardly an acknowledged expert and Audureau rectifies herself her assertion in her article ! (Please note that Audureau's first work is one of Vachonfrance-Levet's source, and Vachonfrance-Levet herself is a "young researcher" [5]) Finally, four french popular literature specialists (which three are Starace's biographers) and Alfredo Castelli (Fantomas. Un secolo di terrore, 2011) told this illustration is not related with Gino.
Therefore we have an anonymous painting, unsigned (unlike the usual procedure of Gino) and not credited at the time (1911). That's a fact, and no legitimate authentication allows to express strong doubts about that. Anything more is simply speculation. In sum, I don't think PCP applies. Regards. Audureau changed her statement in her note ; Vachonfrance-Levet and the journalist Dave Kehr merely assert that Starace's the author, they never give reasons.
I don't want also to do unflattering generalizations about Dave Kehr of the New York Times : I mean to say he's a movie critic and not a popular literature specialist. ;-) Regards. - Here is another one, Richard Abel in "The thrills of grande peur: crime series and serials in the belle epoque", The Velvet Trap, Spring 1996 : "The public fascination with these novels was due, in part, to the paradoxical figure of Fantomas himself, as apache, anarchist, and bourgeois gentleman, captured vividly in the first book cover illustration by Gino Starace: a gigantic masked man in formal dress literally brooding over Paris, with one foot testing the strength of a bridge on the Seine and his right hand clenching a barely concealed dagger". - Hello. I did some digging around as to what I should do, and I've today emailed the people who gave me the picture telling them to send an email based on the template at https://commons.wikimedia.org/wiki/Commons:Email_templates to permissions-commons@wikimedia.org .
- One ambiguity I wasn't sure how to deal with is when someone (a) has a license to use an image, and (b) modifies the image by cropping. Is it "own work"? I think maybe under copyright law, the modifier has a license for the original image and copyright for the modified image, the original image merely being an input into the process. A collage would be an interesting case too. Just of theoretical interest, but in writing the instructions, since they're trying to be very careful, maybe some explanation of what to do in such cases would be useful. What you observe is the retrospective effect of the French template fr:Modèle:Infobox Biographie2 which fetches all its data, including the image, from Wikidata. While the uploader is the credible copyright owner of the photographs, there is no freedom of panorama in Italy and a multimedia installation would be considered creative works protected by copyright.

- It's not a multimedia installation, it's a reproduction of posters that are in that museum. The place inside the museum are free and could be photographed and the photos are published everywhere. Moreover, nowhere it's written around the museum that photos are forbidden.

- @Fliv Thank you for disclosing your relationship with the museum. A couple of things:
- The question isn't whether photographs are allowed. It's that the photograph shows a collection of artwork that may (or may not) be protected by copyright. Of course people are free to take photographs. But the point of Commons is to publish copyright-free content.
- I think one can reasonably argue that the way the posters are presented could be considered a work of art in itself.
- And I think the wall and floor projection in File:Proiezione_manifesti.jpg would definitely be considered a multimedia presentation.
- Now, all these questions could be resolved if the museum's public affairs representative or some other official at the museum declared that the exhibits are not protected by copyright, and anyone is free to publish and use the images for commercial purposes. I would support deletion. The image appears to derive from silkimperialcrown.com site, who's blog entry is a bit of a giveaway, as is its Whois entry and the 'donate to us' link, and lack of any 'About' information. The site has all the hallmarks of a hoax, using Wikipedia as backup for ridiculously priced gift posters on an unidentifiable website or no known address. It looks like the site's owner, an Igor Vrabel in Houston claims to be a "Cultural Investigator at RICA" (Russian Institute Cultural Affairs) which doesn't appear to exist, but they are linked to www.1896coronation.com and elsewhere lists themselves as an "art and design worker" in New York State. This person may claim to live here, although another more upmarket addresses for them can also found quite easily. Nothing about this website rings true. They also promote this nonsense on Twitter. [edit]All of these works are labeled as own work, but the paintings are being used on w:it:Adriana Darù as examples of her work, and the Ballerinas appear to be signed by her. Adriana Darù. As can be seen from the Italian Wikipedia/Wikidata/the uploader's user page, the painter died in 1997. So we need VRTS for these. The photograph of the Madonna is (presumably) own work, but of a presumably copyrighted statue, the Ritratto Daru photo is probably old enough (1922-1923) (PD-Italy/PD-US-expired, if we assume it was taken in Italy and published at some reasonably early point.) The last photo is possibly PD-Italy--except there's a painting in the picture?--but quite probably not PD-US, and no evidence is included as to date or photographer.

Now there are two possibilities: 1- for my part, I would tend to propose to correct it and make it exact based on the academic sources Grosser Atlas zur Weltgeschichte, Westermann 1985, ISBN 3-14-100919-8, Putzger historischer Weltatlas, Cornelsen 1990, ISBN 3-464-00176-8 and Történelmi atlasz, Hungarian academy 1991, ISBN 963-351-422-3. But when I clean, complete or correct images or maps, I am sometimes reverted, and the stains or mistakes are restored on behalf of WP:CROP ([8]); 2- delete this map, but it's really too bad to get to delete documents because some contributors are opposed to their improvement (they call it "manipulations"). --Claude Zygiel (talk) 11:25, 3 January 2022 (UTC)
- Hi @Claude Zygiel: . Many users react like "what the hell do you mean?!?! Here are the sources" style, so thanks for your kindness :) THe thing is, the Internet is full of maps of the Ottoman Empire, and most of them are totally wrong. Even this one, not all of Azerbaijan got lost in sudden in 1735 for example. The thing is, those maps should be created and uploaded with references. And I don't think the uploader created their "own work", they copied this obvious print-book scan from a Facebook post. - This is the official Barcelona Dragons logo, it's an original logo. You can see it in https://www.barcelona-dragons.com. This logo is used in all the language versions in Wikipedia, like the other teams' logos from European League of Football (ELF). The reason that you shows is not applicable.

Now, have I really created these flags? For the most part, no. They are either split flags (used for galleries to display more than one flag in one box (I am fairly new with galleries so if there is some CSS displaying item that I can use to create the same effect, I will consider using.)) or flags made by other people which I have recreated in higher quality. Failed trademark attempt does not influence copyright status as far as I know. In particular, withdrawing trademark application does not release logo into a public domain.
And if it is ineligible for copyright it should be {{PD-shape}}, not PD-User - if it is eligible for copyright then it is a derivative work. If ineligible for copyright then "released into the public domain by its author, Cbuckley" is misleading and makes no sense. Or is it referring to source code of SVG? - Regarding the copyright of the SVG code itself, see Help:SVG#Copyright. Since this SVG seem to have been written by the user who put the {{PD-User}} template on the file I'd say that it is PD code-wise at least. Even if the user would've wanted to claim copyright on the SVG code I think that it wouldn't be above the threshold of originality anyway, but I'm no lawyer so what do I know. - That is not a valid argument. Copyright holders do not have to dictate anything, that is not how a copyright works. It is inherent until waived. Nor do they have to be the ones who set the laws for copyright protections to apply. By your logic, only a government can ever hold a copyright. No. The copyright law of the recognized Afghan government applies to works created in Afghanistan by anyone. The point of Commons is to be a repository of media freely released by its creators, and we do not stray from that purpose. Files can be uploaded as fair use on Wikipedia. - Again, the purpose of Commons is to host content that is intended to be freely used by its creators. What we are legally allowed to host is a different thing (fair use content would likely be allowed legally but it is not the purpose of this site). Deleted: per nomination. The fact that the image consists of heavily used symbols does not mean this image has achieved a new copyright. I think it does show a creative act and it is copyrighted. Therefore the image must be deleted. --Ellywa (talk) 20:55, 22 May 2022 (UTC)
