Derivative work copyright violation: this image depicts a copyrighted work of art in public space that is not covered by the freedom of panorama in the United States, which is only limited to architecture only (and not other works like statues, sculptures, or murals like this). The artist, Parris Stancell, is apparently still alive (at least as of 2018). A COM:OTRS authorization correspondence from the artist is required if he agrees this image of his work to be licensed under commercial CC licensing.
Note that the American de minimis concept is far more restricted (triviality instead of incidental inclusion), which means this mural is not DM as it is not trivial to the whole depiction of the image.

Due to Japanese copyright law as it stands today, this means infringement of the copyright of the artist who created the artwork, and per Commons:Project scope/Precautionary principle this situation is best avoided. The exploitation for post card is permitted in countries like UK and Germany due to applicable freedom of panorama. However, in Japan this FOP only extends to regular and/or average buildings, like Tokyo Metropolitan Government building and Tokyo Skytree. Any depictions of other works (e.g. statues and sculptures created by still-living or recently-dead artists) are only allowed to be exploited for noncommercial purposes. Per policies and in compliance with the mission of providing free educational media that can be used by anyone for any purpose, noncommercial is not allowed here. Though existing jurisprudence in courts worldwide tend to be mixed: some tend to follow the copyright law of the country of origin, while others like the U.S. tend to apply their own copyright law over foreign 3D public works (U.S. has no FOP for such works, however, and unfortunately Gundam is "not a building" in the eyes of U.S. FOP). But for the copyright holder of that Gundam artwork I'm not sure if either Bandai Namco or the person who designed them owns the copyright (or, if the person who designed these was actually working for Bandai Namco, I'm not sure however). @Erasmus Sydney: for old Japanese sculptures they should be fine. For new sculptures, however, you may launch deletion requests by yourself (just choose the "Nominate for deletion" on the left), but you need to provide information on who designed the new sculptures and when these were unveiled or created in your deletion request. If you have user rights to do so, you may want to activate Visual File Change to do a batch nomination (but that's a very powerful tool and shouldn't be abused). For statement, I think it's Gundam who needs to send a statement explicitly allowing your images of their work to be made and released under the CC license that you chose for your images. This is quite a complex work and there's no source or other information provided to verify this has been released as licensed or that the uploader is the copyright holder. The account that uploaded this only has a few edits and all of them are related to this file, but there's nothing to on the account user page which allows verification that the uploader and the artist are the same person. So, it seems at the very least that this should require COM:VRT verification or copyright ownership. I thought about tagging the file with {{Npd}} and notifying the uploader, but decided a DR was probably a better approach to take this time around. I have not had a reply from the artist. IMO Teeernteexperte's edits are disruptive vandalism. I'd revert them but then a potential copyvio would show up on my upload list, so I'd rather some admin did that. The artist has not replied. I think it is sensible to assume, that the artist is OK with his image being available on commons. BUT: Decade-long policy of Commons is just the opposite! No permission from the artist - no image at commons. If Fae hat not started a DR, but added the permission missing template to the image it would have been deleted in early July! The DR for the other depictions of the mural was started AFTER this DR and it was enacted in July! There is no objective to not delete this image at once. Actually the deletion of the image might trigger the artist to finally send a permission (that happened with one of "my" files that was deleted than restored). An undeletion is always possible if new information becomes available. Even the other images of the mural may be undeleted in such a case. @Colin: you could notify the artist, that the other fotos of his mural have been deleted and that this last one will very soon also be deleted, it may show him the urgency of a reply. --C.Suthorn (talk) 20:50, 21 August 2021 (UTC)[reply]
I'm not minded to email the artist further. I got no reply to my first email, so out of politeness I'm not going to press the matter. Stinglehammer indicates other communications, leading to an OTRS pending tag. Melissa Highton, as the photographer, has been in contact with the artist (per their blog post about the presidential gift). So that channel seems more appropriate, though their comment above seems to indicate they aren't fussed.
The mural portrait itself is a derivative work of (old) photographs of someone who the blog post says was one of the most photographed people of his time. The Wikipedia article is not short of images. So the value of the mural is as street art, and not as a rare portrait of Douglass for the internet. The photograph of the mural, which we have here, was a presidential gift, and has plenty artistic merit itself, though I wish we had a higher resolution version. It is a shame if UK law does not permit free use of it, but the same is true of many great photos and we just have to deal with it. Delete The mural hasn't been released by its artist under a free license; if that happens then it can be re-uploaded. In fact Ross updated it recently to include information about Douglass and due to its local fame it has become a popular spot for instagrammers. "The risk is low" is not the way commons works. If you are in contact with Ross Blair and a request for permission has been sent (by Stinglehammer) and received by Blair, but no permissin sent by Blair to OTRS, than the file needs to be deleted. [I had DRs for some of "my" images with the copyright owner agreeing to the publication but not sending a permission to OTRS. The files were deleted - than the owner sent permision, the files got restored - much work that wouldn't have beeen needed if the copyright owner had just answered the permission request. Or may I in future answer DRs with user:Melissa Highton assured that there is low risk?] (another point: If Blair in the end gives permission: Will it be for specifically this and only this foto? Or also for the fotos already deleted? What about future fotos? C.Suthorn, your comments and mocking tone are not helpful. That fact that you are even asking if permission is only for this photo suggests you don't understand what is necessary. Ross has to consider more than just allowing Wikipedia to display his mural in this photo, but instead freely licence his mural for anyone to reproduce in any form on any platform. The conversation I've had with him has been about this photo specifically. As I say, I've alerted him again to the need to do this release to satisfy Wikimedia rules. He and I have copies of the images we can use to tell the story of what happened with the Biden gift, so it may be that we end up with this image taken off wikipedia. To deny DF maps protection simply because they are expressed in symbols is to potentially suggest that all 2D level maps are unprotectable in and of themselves - which is too powerful a statement
Very different from Rimworld - sprites are definitely not the same as symbols, because the building blocks of the map are copyrighted for one case and not the other. RNG maps are not inherently copyrightable; only renderings of them are, if rendered using copyrightable graphics. I would venture that if I had a data file of a SimCity 3000 city I built myself on a software-generated map, it would not be a copyvio to upload it, as it is only storing the locations of things and not the artwork required to render it. A potential factor: The game's world is generated through procedural generation on every run, so in terms of this being a map of "artistic creation" of the author, that is of some question. Keep In my opinion, the specific choice of colors and symbols is below COM:TOO. So it hinges on how much of an influence the creator of the game has on the final algorithmic output. I think the desire to "create a rational geographic world from procedural generation" reflects more of an idea than an expression of an idea; you have cyan on one side, and then a green island surrounded by a dark blue sea. If this coat of arms is correct, it should be under {{PD-UA-exempt}} license, but it has no source and seems not to be detected by tineye or google images prior to uploading here. No description of coat of arms of this settlement is easy found either, so it can be supposed, that it is false. At least, I cannot find similar (or any other) images.
