[edit]This architecture was built in 2013 by HOK (Hellmuth, Obata + Kassabaum). In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for a certain period of time after the death of the creator (be it the last-surviving architect, engineer, designer, sculptor, engraver, or painter). An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception Commons:Freedom of panorama (FoP). Sadly, Azerbaijan has no Commons-applicable FoP. The country's copyright law should be amended to allow pictorial and videographic reproductions of copyrighted Azeri architecture and sculptures for commercial purposes, from T-shirt printing and postcards to commercial ads and commercial YouTube vlogs, without the need of authorization/permission from architects and other artists. One of the nominated files is a video, but 9/10's of the scene is focused on the towers. See also three of the deleted files at Commons:Deletion requests/File:Üç alov qüllələri.jpg.

British Freedom of panorama only covers 3D artworks (e.g. architecture and sculptures) and 2D works of artistic craftsmanship. 2D graphic arts, like murals, are not covered so. - The consensus was linked by me in the justification of the blockade, this one. As you can see, the four sysop who participated agreed with the sanction applied. In addition to them, five more publishers also agreed. The minimum period of 72 hours was respected and there was unanimous consensus.

- Keep The top two are undivided back postcards dating from 1907-1915 and are unquestionably {{PD-US-expired}}. Bottom right is linen (1930-1945) with no copyright marking and thus {{PD-US-no notice}}. Bottom left is white border (1915-1945); 99% of postcards from that era have no copyright marking, while the few that were copyright-marked were almost never renewed, so it's safe to also assume it's PD-US-no notice. These are simple scans, so {{PD-scan}} applies and there's no additional copyright there. I have updated the file page with the relevant dates and copyright tags. Several uploads were done during WLM 2019 in Italy, but the permission for the museum mentions: "immagini dei monumenti" (trans. Images of the monuments), not "images of the artworks hosted in the monuments". I reckon that this authorization is not sufficient to publish Soffici's artworks under a free license.

The buildings is "Scuderie Medicee" (second in the list), so if they listed separately the authorization is obviously for the artworks, which were donated to the municipality by Soffici itself. - As far as I remember they actually intended also the artworks since they got them as a donation, similarly to other situations, where we trust the local authorities when they say they can do so (I hope nobody make the comment when you say that the permission of the artist or the family is always necessary, you trust one part involved (who takes the responsibility) or you ask for 'both of them; you can go on both ways depending on how accurate you want to be but the idea that only the first one of these requirements is necessary to be sure about the rights is something some commons users think but it's not like that... rights can be given with the artworks, it depends on the situation, you can have something that protects you legally or be accurate, in this case it was intended to be the first scenario). At the time I was still trying to use the templates from WMI, now I use more precise versions if I got a clear feedback and of course we also do not include some of them if they are not sure. I have no time to ask the municipality right now for a more precise signed statement, especially with the pandemics they have more important things to do and maybe the people involved were also changed in the meantime. Considering that the images existed since circa two years with nobody having any issue, people could have simply asked and we could have fixed it I suppose, but if a direct deletion is started is mostly because it's not the fixing part that we are focused here, and I really have no energy now to be focused on that myself.--Alexmar983 (talk) 22:52, 22 November 2020 (UTC)
- @Sailko: A "painting" is not a "monument". The permission is clearly for the building (as all the other permissions in that document) and you were allowed to photograph it.
- @Alexmar983: You understand that we need a written permission for the artworks, otherwise anybody "can remember" that the permission was for <write here anything you like to photograph>. In this case I trust that the museum had the permission from the heirs, given its name (but it is not so clear from the museum description: no link with the family of the artist appears, so they could hold a permission for their catalogues only, unless proven otherwise). If you can have a precise statement from the Museum and/or the Municipality that they are the copyright holders of all the museums artworks, and that they authorise WLM to publish them with a Creative Commons license, we'll be happy to undelete them. Mind, we need this exact wording, so that they assume the legal responsability of declaring that they own the copyright, in case of dispute. --Ruthven (msg) 18:25, 27 November 2020 (UTC)

- @Alexmar983: You understand that if we wanted to "delete" without looking for a solution, I (or another admin) could have done that already (and also blocked Sailko, given that it's not his first problematic upload). If WLM wants to approve permissions (or WMI for what it matters), it has to abide to the same standards we follow on this project. This requires to the organisers to be precise and rigorous in verifying the obtained permissions. Clearly it hasn't be done in this specific case. I am sorry that it's not the right moment for you, but I reckon that's not the central point of this DR: we hope that a solution can come from the users writing here. --Ruthven (msg) 11:55, 28 November 2020 (UTC)
- I don't put it for the artworks. it was precise. For some artworks we do but in this case that's not what happened. I verify about the building (and I do it much more than WMI) and if the interior is fine I keep it, I cannot put "exterior" tag always, which we do in Tuscany much more than in other regions. For example this image is descriptive and a de minimis, and the museum is an historic building per se. Our list are getting so precise that we even put single items inside a building to focus on those and not the other ones... there were authorizations rewritten for this purpose. I have been asking for years for a more defined tag systems with no reply (in the huge framework of things to fix as well), you can ask every museum on the list and discover dozens who begged me to put this or that with me removing them (and you can see from the difference between lists and authorizations as well). I was criticized right this edition by a museum for forcing the insertion of the exterior tag in the list, that WMI instead did not put with no check.
- The more we are free, the more we can fix it for sure. So if you want to ask to an organizer ask WMI first. You had enough clues when you were a national WLM juror to see that they have not set up any standardized way to exclude the artworks and you should know by now since I have pointed it many times in WMI that this control is NOT done in almost all the other regions. But since you care here, that means I am finally morally authorized to fix this once for all. I will ignore the protest of the national organizers if they disagree with my choices, they had years to fix the issue. So i have no clue what you told them in private but thanks for telling me in public right now. They can't stop me because it's not fair for people to pay about the disfunctionality of the system. If you had done this in public inside WMI the problem would have been already fixed for all other regions where it can be much worse, since almost all towns are putting random museums everywhere right now (and I told them NOT to automatize the process also for this reason, ignored). I could keep track of it much better if I did not have to spend my whole time redrafting dozens of poorly written authorizations every year that we specifically ask WMI not to ask and collect...--Alexmar983 (talk) 02:11, 29 November 2020 (UTC)
- When Sailko insert something inside a museum whose interior is technically free, I mostly see during the voting procedure and ask later. It's not about "before", it's "after". At that point a range of options can occur. Even if they don't send me anything I certainly do not start a deletion if they still tell me they have the rights. Some museums tell me that "WMi does not ask me about that in their mails" and close the phone, it's "certified mail" and mine is just a phone call. Everybody cuts a corner. For them the concept expressed by Sailko (that the presence of a separate line for museums was enough) was sufficiently clear. I act if they clearly tell me they DON'T have the rights, or so does the artist themselves(and I know a few after some years). If they want to fix it later, they still can. In no way the list forces you to upload the images of what is inside, but still I cannot just put "exteriors" tag to avoid this at all, it depends. You saw how some artworks were free in any case, I could not skip that oppotunity as well. Also, what is the structure of the complex? is there a de minimis image that is possible? Are there internal spaces without the museusm? If it suggests to put artworks "directly" it is only because the architecture of the list as a whole is crappy, but we know it's crappy, you can find examples of me telling people (if they ask me) NOT to upload this or that complaining how crappy it is.
- Coming to this case, you can get some piece of paper to fix it but just not now. As a jurors of WLM you should know how complex the real process is if done correctly, I have been telling for years to WMI that "the send a mail and copy and paste in a list" is not enough, it takes a huge amount of preparation (one or two months per cultural institution, usually) sometimes scrolling the whole list of inventory and a one week deletion procedure is simply not enough time even if the museum agreed and even in normal time and even if you have a direct contact. I am still surpised I do it for fre and they don't really pay anybody to do it properly. From the practical point of view, it's just not possible. So delete them. When this COVID mess is over, if they can they will send the updated authorizations. You can delete all similar images uploaded from museums in WMI as well, and see that noone of them will be resolved in one week.--Alexmar983 (talk) 02:11, 29 November 2020 (UTC)
- @Alexmar983: You understand that if we wanted to "delete" without looking for a solution, I (or another admin) could have done that already (and also blocked Sailko, given that it's not his first problematic upload). If WLM wants to approve permissions (or WMI for what it matters), it has to abide to the same standards we follow on this project. This requires to the organisers to be precise and rigorous in verifying the obtained permissions. Clearly it hasn't be done in this specific case. - Delete - There might be many reasons for a mistake or a misunderstanding, but what is really clear is only that the authorization was released for "images of monuments"; this phrase has a concrete legal meaning, since the Scuderie Medicee are a properly called monument in themselves (with a story and an autonomous artistic value), independently from the artworks they contain. Reading what has been written, nothing can be found about Soffici's artworks. So we have to keep on what can be read into the document, and not on what we all think that they should have written into it: they didn't write it, and quod non est in actis non est in mundo (what is not in the acts, [legally] simply doesn't exist). Additionally, the countercheck says that what has been written has a legal meaning and makes sense even without Soffici's works. Btw, pcp explains what shouldn't be objected in these cases, and why.
@Ruthven: , the mere possession of the artworks doesn't necessarily imply that the copyright has been handed over, as well, not even in case of long-lasting possession; it seems unlikely that it hadn't, I thoroughly agree, yet we still need someone that (credibly) takes a (plausible) responsibility about it. To date, Soffici's artworks are 56 pma and if a speculation can be made, is that Soffici's heirs should hold the copyright, unless otherwise (credibly) explained. --g (talk) 02:14, 28 November 2020 (UTC)

So again, and I will always repeat it whenever possible: if you want to be legally covered, just one of the part should take responsibility, If you want to be precise you always need both of them. I have a sufficient archive of real life examples to prove that. Most of the time artists sign this or that and than the agents claim otherwise, they are quite clueless. Like, this year a municipality said that it owns the right of an artwork because of the contract, they were very clear. Still the artist apparently said otherwise, but he was probably not right, he just did not accept what he agreed years ago. Just to be sure, I did not put it in the list. So never think that asking only the artists tell you the whole story, every contract is different. So if you want to be precise you ask for both, which means that all images authorized by artist but NOT authorized by current owner if copy of the contract is not shown should be removed from Commons. (and some contracts are "classified" upon request...) This is excessive, and you ask what is needed to be be legally protected, and the reason why I remind this is not because they are in this case, but only because it took us years to make people understand this concept and cut the asymmetry of the interpretation, and I therefore remind it every time. - I was just pointing out a detail about the relationship between the author and the possessor, which is also a distinction between ownership and possession in the classical legal sense: sometimes the artwork can be detained by someone while the artist withholds his rights on it. This is why, when you need to investigate - and you usually don't need to - you better ask the author (or his heirs): whatever the author/heirs tell you, be it true or false, you have asked the most important ring of the chain, the starting one. In case he lies about it, it would be his own and sole responsibility, he will eventually explain it to those whom he handed over the copyright to, not to me, not to you: we will just say "the author told us", and that will be reasonably enough for us. Of course, when it is an institution that detains an artwork and tells you "we hold all the rights on it", there is no reason not to believe them: in case of claims we will just say "an institution told us, go and ask them, sue them and wish them bad luck, do whatever you like with them". And that would be reasonably enough for us.
But we've got far into theoretics, now, this case is instead, more simply, just another kind of incident: they told you something and they didn't write it. Everybody trusted them, because our attitude is not against anyone, because why should we distrust an institution; but when the moment comes to look at the permission, they didn't write it. We don't have a permission for Soffici's artworks. We have it for the monument. So this would be a correctly authorized shot: this is the monument. To have Soffici's artworks undeleted, instead, either the museum sends a better permission, or Soffici's heirs send OTRS their clearance. This file was initially tagged by Didym as no license (No license since). In Poland standard photos made for official documents a considered as a without original work, and by the law original work is prohibited. Deleted: Even if Encyklopedia Fantastyki were the original source of this photo, it appears that the CC-BA-SA-3.0 is for "Tekst udostępniany na licencji", ie. the text, not the included photo, but this doesn't matter for the PD claim. Deleted: Per nomination and prior linked discussion, the VRT ticket this template relied upon is invalid, and has not been able to be corrected in the nine months this DR has been open.
