Reasons for deletion request --ElshadK (talk) 16:53, 7 November 2019 (UTC) They are suspiciously blurry and seem to be screenshots taken from other people's videos on YouTube. I have been able to confirm this in the case of the two images listed. They are both taken from the following video see here at 0:15 and 8:50 respectively. The username of the YouTuber who uploaded them is similar (but not identical to the Commons uploader). It may be a case of stealing someone else's work and passing it off as "own work". In the case of the third file listed there is even a YouTube watermark in the bottom right corner.

See also this post at the Help Desk. It is listed as own work, but it does not appear that the uploader is claiming to be the person who painted the picture, but only the person who took the photo. This would therefore be a COM:DW of a 2007 work, which would remain copyrighted and non-free unless released under a suitable license. GMGtalk 16:35, 7 November 2019 (UTC)
- Delete per GreenMeansGo. Unless the uploader provides some evidence showing the painting itself (and not the photo uploaded to Commons) is published under a suitable license, we can't keep it here. The post at the help desk is another evidence showing this is in fact a derivative work of a non-free painting. Ahmadtalk 20:17, 7 November 2019 (UTC)

- Delete Regardless of scope issues, they are modern arts by a living author or old photos claimed to be selfies, so COM:OTRS is required for them. User warned not to reupload. They can be hosted here, once both: COM:SCOPE issues are resolved and an OTRS permission is send by the artist / protographer(s). Note: as they seem to be from Iran, no US copyright issues is likely present. I suggest speedying. Ankry (talk) 13:04, 3 February 2020 (UTC)

- Delete - I don't have any particular evidence, but the user's past behaviour, both here and on en.wp, suggests they do not understand the concept of copyright and free licensing. Deleted: I'm going to assume that 103.38.15.19 is the uploader, Kamalvengara, and was not logged in when filing this request due to lack of Commons experience (it's their only upload). We could be strict and require them to log in, but I don't think that's needed in this case. From looking at the uploader's limited contributions to Wikimedia projects, it's possible that this could be a good faith contribution that's resolvable through OTRS verification. What's revealed on the surface, however, is a different story. They uploaded this and File:Charles Wohlforth .jpg as their own work, yet the two are credited to separate photographers. Erik Hill worked as a newspaper photographer for many years, which further casts doubt on its status as free content. RadioKAOS (talk) 05:17, 7 November 2019 (UTC)

- Well it might simply take few days to get a reply from author User:Mascha2013 if she is fine because she is busy. I suspect however that you can simply add to the description she is the author, but now that you started a deletion procedure we might need OTRS? This sounds even more complicated. Whatever, I can speak to her properly probably only on Saturday to make her upload the original file here (which was my plan, a sufficient amount of days to have final revision before doing so). She will o.k, I was simply worried to be respectful of her work.--Alexmar983 (talk) 10:45, 7 November 2019 (UTC)
the file is here, she took care of some of the changes, except manly the logos. In any case now it can be listed a correctly derivative work. - Comment S_Kahn, the uploader, told nominator, on User talk:Jon Kolbert, that the individual in the images is an author.
- Nominator's response included the assertion the images: "...are not realistically useful for an educational purpose. The person is not considered notable by Wikipedia's standards and thus images of them would likely fall out of scope."
- If a wikipedia AFD discussion concludes an individual does not measure up to the wikipedia's inclusion standards, then we could say that individual was "not considered notable by Wikipedia's standards". But can this assertion be made, so definitively, if no one had ever tried to start an article on this individual? There are lots of potentially notable individuals, maybe tens of millions of individuals, who have never had anyone write about them. This is all covered in the english language wikipedia's wikidocument OTHERSTUFFEXISTS.
- A google book search does confirm at least one book by the individual depicted here - [3]. This book may be from a vanity press, and thus very likely unnotable, but even if, for the sake of argument, it was a book from a vanity press, surely a more helpful reply wouldn't have hurt? - S Kahn, there is already an OTRS ticket, from March, which implies you already sent an acceptable proof that you are your father's literary heir.
- I am very sorry this process has been so frustrating for you. This is not how we should treat generous literary heirs.
- I am not one of those trusted volunteeers entrusted to look at those OTRS tickets, but I strongly suspect you already proved your bona fides, in March.
- Cheers! Geo Swan (talk) 13:16, 7 December 2017 (UTC)

- Ask the copyright holder to send permission to COM:OTRS. They will be replied back with a ticket number. After they do so, tag the file with OTRS pending template. Masum Reza📞 09:20, 17 November 2019 (UTC)
Comment S Kahn: Not permission under Salman Aziz neither, even when permission should come from the photographer, not the subject. Besides, still exist the problem of notability. And, in that case, OTRS permission won't help. We only verify authorship and copyrights, but we don't grant notability to the subject. - Comment @Mlang.Finn: As I have already notified you, Commons:Essential information#Source requires to "provide at least a link to the web page (i.e., the url) on which the image or file is displayed (that is, not the web address of the file itself, but rather the web page containing the file)". - @Ruthven: It's a strange reversal of the official policy about evidence: it's up to the uploader to prove that the so-called license PD-Argentina is valid ("For photographic works, the duration of the right of ownership shall be 20 years from the date of first publication")... I prefer not to comment the last part. --Patrick Rogel (talk) 21:32, 7 November 2019 (UTC)
- @Patrick Rogel: So, you are nominating for deletion a photo from the '70s[4][5] because you are sure that it was published in 2019 for the first time? Do you have evidences of that? Otherwise, it's a violation of assuming good faith (something that every good wikimedian should assume) and a -as written above- an abusive DR. It should be useless to repeat that, but I do so: if you have no proof of that first publication in 2019, you're nominating files for deletion without really knowing why, a behaviour that is very close to vandalism... --Ruthven (msg) 08:00, 8 November 2019 (UTC)

- @Ruthven: : Keep as obvious as it sounds... my talk page is full of DR (like this) by user @Patrick Rogel: , who has been (IMO) abusively nominating files and doubting uploader's good faith, even when all files have a proper source indicated, and even when the sources themselves include dates of (previous) publication; most notably with images from El Gráfico official IG page, which compiles photos from the magazine's archive and (obviously) previously published on paper editions. – Fma12 (talk) 01:57, 9 November 2019 (UTC)
- @Fma12: Indeed your talk page is full of deleted images (Fma12 (talk · contributions · Statistics · Recent activity · block log · User rights log · uploads · Global account information) ) beginning back in 2014 and you are still (mis) or (ab) using PD-Argentina. - @Patrick Rogel: Of course I have "a lot" (really so many?) of deleted images (as you glady described), most of them first discussed on their respective deletion requests, but all of them uploaded in good faith for my part. When you have more than 66,500 edits since 2008, of course you may have commited mistakes. So your statement about my (ab)using of PD-AR-Photo template is absolutely falacious and tendentious, unless you have proof of such behaviour... Do you?

- I haven't uploaded only "PD-AR-Photos" but a lot of own work, including photographs, sports uniforms and railway maps, as you can see at my user page (which you have already done, besides). The question is: why should I report you? I'm talking about your "abusive" behaviour in some punctual DRs that involve me, I didn't refer to your "whole" activity in the project (which is not my business, either). - I uploaded the original PNG file. One could argue that the required threshold of originality is not achieved on this one. That is why only trade mark / naming rights apply. Also: Even, if there was some sort of copyright protection for the PNG file – wouldn't the SVG recreation be free then? What about the following files: 6, 7, 8. I am not very informed about copyright questions, but couldn't we find a similar solution as in the files mentioned above? --37.58.201.72 17:00, 8 November 2019 (UTC)
- @Élie Moitessier: I understand why but it looks like you've uploaded to the wrong place. The three images you've linked were self-drawings based on old coats of arms. So this is copyrighted unless it's extremely old, which I'm guessing it's not, since the original (File:Blason officiel Institution Notre-Dame Valenciennes et St Saulve.jpg) was deleted. Can you comment on the age of the original coat of arms? Magog the Ogre (talk) (contribs) 18:13, 8 November 2019 (UTC)

- my opinion is that if it is an historical coat of arms then there should be no problem to have it. but if the coat is in use by an university right now is must probably copyrighted, and still be fair use to use it as long as the image has been labeled correclty. in both cases i dont think it can be label as own work-LadyofHats (talk) 21:03, 9 November 2019 (UTC)
- I do not know the exact creation date of the original coat of arms. What I know is that the coat of arms consists of very old and classic coat of arms symbols, e.g. the lion of Flanders. This is by no means a new creation but a re-establishment of old elements. The lion of Flanders one can find e.g. in the coat of arms of the city of Valenciennes, the place where the school is located. --Élie Moitessier (talk) 13:27, 11 November 2019 (UTC)

This page contained some basic and unbiased reports from the wiki commons database of the use of sysop tools which raise concerns. These reports are referenced in an Oversight request and justify why questions were being raised about the administrator's compliance with policies which constrain and guide the correct use of sysop tools.
The page contained no subjective conclusions or analysis, being limited to reports of sysop actions.
This DR is created to provide a record of the reasoning for the speedy deletion and whether it is now always going to be an "inappropriate" use of userspace on Wikimedia Commons to include reports about all specific sysop actions, regardless of whether the questions raised are reasonable and unbiased.
Quoting the related AN discussion, "All those with sysop tools accept fair scrutiny and questions based on their actions using these tools per COM:Administrators. Deleting these minor reports on a page that only has interest to those reviewing the Oversight request actually has the potential to raise suspicions that the reports contained something problematic that needed to be hidden. That is not the case, there were relatively technical issues with the use of sysop tools but no private information, nor even the equivalent of trade secrets, just issues that should be subject to fair and fact-based questioning. Deleting the facts is unhelpful if our objective with fair scruitiny is to ensure questions remain non-subjective and we are not reduced to handing out trusted user status based only on community popularity rather than evidence." - @Christian Ferrer: as deleting admin. I am not sure why this page needed to be deleted at all, especially not why a speedy deletion was deemed necessary. This does not seem to fit the U3 criterium. Sebari – aka Srittau (talk) 13:12, 7 November 2019 (UTC)
- Delete. After 1989 withdraw his/her request for right, the page is simply out of scope. I don't think, that the page violates policies and I would not delete it speedily, but I don't like it to be restored, because ... it's just out of scope. Taivo (talk) 15:03, 7 November 2019 (UTC)
- I have several similar sandbox/bot pages where old database reports to illustrate discussions, now link to a specific revision in the page history because the page itself has been overwritten. We could do the same here, updating links in the Oversight request so they still work for anyone interested in reviewing the case, but the page is not "live" and so not searchable either. To do that, obviously, the page must be undeleted.
- Consider more generically, if someone has run for advanced rights and the discussion or questions relate to reports and that case fails, but then the next year they run for other advanced rights or even the same rights, then anyone diligently trying to understand the questions and issues from past requests should be able to see the original context and content. Deleting the content so that only administrators can review it, is actively denying non-administrators the ability to review factual and unbiased evidence which may inform their opinions or vote. --Fæ (talk) 15:18, 7 November 2019 (UTC)
Comment The page in question has been undeleted so that it can be fairly evaluated by all editors (not limited to admins) as a candidate for deletion. ~riley (talk) 16:40, 7 November 2019 (UTC)
- Keep, scope be damned — this is user space, and a sandbox to boot. -- Tuválkin ✉ ✇ 16:44, 7 November 2019 (UTC)
- Delete I don't see the point to have such a page targeted only about one specific administrator, or even about 2 or 3. Such pages if they concern all administrators I can understand, but if it's just about one person I think it is inappropriate and potentially unpleasant. It is clear and obvious to me that this page have to be deleted, and as an "ovious case" from my point of view then I speedy deleted it. If our community want to keep such a page then our community would be kind to do such pages for all administrators, and not a single page targeted and done, according to the goodwill of a single user. Christian Ferrer (talk) 17:17, 7 November 2019 (UTC)
- Fair and factual reporting of any administrator's recent sysop actions is not inappropriate to support this project's mission, nor is there any indication that this is "unpleasant"; database reports are literally the epitome of neutral facts.
- By the same complex logic would you delete the historical report about uploads of a certain type by a non-admin user as part of assessing copyright issues User:Faebot/SandboxT,
- or User:Faebot/SandboxJ which contains SQL to generate reports about an ex-administrator's deletions which was used to support an AN discussion in 2018,
- or perhaps User:Faebot/SandboxX in which the history contains a 6-year-old report supporting a de-Bureaucrat request for an ex-administrator to illustrate a potential canvassing problem?
- --Fæ (talk) 17:43, 7 November 2019 (UTC)
- Keep: I think that the information on this page would have been appropriate to put directly in Commons:Oversighters/Requests/1989, except that it would have been excessively verbose. Putting it on a user subpage instead shouldn't make it any less acceptable. We don't have many rules about what's allowed in user subpages, but I think COM:CSD#U3 sets a reasonable benchmark, specifically calling out advertising, nonsense, and personal attacks. This is none of those. Christian Ferrer doesn't see the point of this page, but I think that's irrelevant. The purpose of user subpages is to provide a home for things that other users won't see the point of. --bjh21 (talk) 18:45, 7 November 2019 (UTC)
- Keep because of a simple reason: The page contains facts without any comments. Same info can be retrieved by anyone querying the dbs. --Achim (talk) 08:34, 8 November 2019 (UTC)
- Keep per Achim. Masum Reza📞 08:53, 8 November 2019 (UTC)
- @Fæ and Christian Ferrer: I would like for us to collaborate on this and find a solution. Christian feels this should not be in the userspace, and Fae is recognizing that this provides a record tied into a request for oversight permissions. Can we move this page to Commons talk:Oversighters/Requests/1989? This would both retain the record and remove the page from the userspace. I know we won't agree on how this deletion was handled, but I think it's worth focusing on how we can move forward? ~riley (talk) 17:26, 8 November 2019 (UTC)
- If check and postpone public actions of users, included administrators, is of course allowed. Pages entirely dedicated to targeting the actions of one active user, especially pages in user namespace or in a user-like namespace is of course quite inappropriate IMO, and a potential source of problems, especially between the person concerned and the person holding the page. Nobody need that. If the content is kept, it is of course at a better place in the request or in the corresponding talk page. Thank you riley for trying to find a solution. And I remain convinced that if this kind of thing is necessary and relevant, then it should be done automatically for all administrators; and the argument that it's relevant because he made a request for advanced rights is rather wobbly, as I'm not sure that the prior candidates were entitled to the same thing, and that the following candidates will also be subject to the same thing), it will be apparently at the will of some person or within their availability. I suggest that, in case it is relevant for one candidate, then it is done each time for each following candidates for such advanced permission, otherwise 1/all the arguments above to keep the content under the pretexte it is relevant are wrong, 2/ it is quite unfair towards this specific candidate. I have no regrets about what I did but now do what you want, I agree. Christian Ferrer (talk) 18:18, 8 November 2019 (UTC)
- Christian Ferrer's defence of their actions above, and the earlier repeated refusals to examine their misuse of sysop tools in contravention of the deletion policy, should alarm everyone. Thank you for the suggestion, but let us allow this deletion request to itself follow the 7-day deletion process, and reach a credible conclusion rather than premature action which risks giving the appearance of conveniently burying something and accidentally side-stepping an open free discussion.
- Contributors must be free to neutrally list and discuss the sysop actions of any administrator in good faith on their talk pages and userspace, without the threat of character damaging allegations hanging over their heads that factual analysis may be presumed to be a personal attack against an administrator. This use of userspace and sandboxes is a normal way of conducting an analysis of all types, and has been since the start of this project. Over-indulging a faulty interpretation of policy, in this case, would undermine the most basic governance of the use of sysop privileges. Let's please avoid going to a dark place where analysis and scrutiny are only by covert direct messaging on IRC or anonymously off-wiki.
- I'm attending an early Christmas event, so have limited availability this weekend. Thanks --Fæ (talk) 18:54, 8 November 2019 (UTC)
- I think there is some confusion on the purpose of this discussion. This is a deletion request with the purpose being to establish if a page should be deleted, kept and/or moved. The focus is not to establish misuse or abuse of permissions by Christian Ferrer. If you would like to continue the discussion of Christian Ferrer's use of administrator permissions, please have that discussion on the Administator's noticeboard. There is no attempt to bury a discussion and any attempt that is viewed as side-stepping appropriate discussion is redirecting you to the appropriate area to hold that discussion. Now, getting back to the point of this discussion, if voting is in favour of keeping the page, are you also willing to allow the page to be moved out of your userspace and to Commons talk:Oversighters/Requests/1989? ~riley (talk) 22:48, 8 November 2019 (UTC)
- As stated, I think this DR should be allowed to follow the community agreed standard process, rather than closed after a day.
- Also stated above is what would be a suitable (keep) outcome as it has been done exactly this way before, to blank the sandbox page and swap to this existing link in the Oversight discussion. Amongst other benefits, the sandbox can be reused for something else later on and we are not creating odd talk pages for the sake of doing something. --Fæ (talk) 23:15, 8 November 2019 (UTC)
- To clarify, nobody stated or implied that this deletion request would be closed early or against the community agreed standard of process. I am going to invite you to assume good faith, especially considering I have already given you my word that this page will receive a fair and unbaised deletion process. This request will stay open a minimum of 7 days.
- My concern with you blanking the sandbox and us linking the history to the Oversight discussion, as opposed to adding to the talk page, is that you could speedy delete the page at any point down the road per CSD#U1. It is quite common for the talk pages to be used for reports, especially on enwiki (example) ~riley (talk) 01:45, 9 November 2019 (UTC)
- Not a scenario that will arise per CSD "If a page has survived a prior deletion discussion, it should not be speedy deleted except for newly discovered copyright violations."
- The worst that could happen would be a revdel, without touching the 6th November revision. --Fæ (talk) 02:37, 9 November 2019 (UTC)
