In licence section;
"This image was originally posted to Flickr by Kurdishstruggle at https://www.flickr.com/photos/131986175@N03/40873768331/. It was reviewed on 18 Mart 2018 by FlickreviewR 2 and was confirmed to be licensed under the terms of the cc-by-2.0."
That account Kurdishstruggle not posted them. User Mohamadrsk may copy from another "Kurdishstruggle" image for free licence I think. For expampe this, this, or this. All posted from Kurdishstruggle are CC 2.0. But This image link (Turkish Army Captured Afrin 04.jpg) posted by "Türk Silahlı Kuvvetleri" and not have free licence. We can see "All rights reserved".  Keep for both lists (and undelete those already deleted on this basis). There is no problem with these files' licenses. They are under perfectly free licenses. The licenses are apparently being very strictly enforced, but going down any route of "we only host files whose copyright holders are not too strict about enforcing their copyright" would be a very fundamental redefinition of what Commons does and does not host. We regularly (and rightly) keep hosting files whose copyright holder is no longer distributing them under a free license (e.g. changing the license on Flickr to "all rights reserved"). It is likely that many such copyright holders, since they no longer want their files to be reused, will also very strictly enforce their licenses. It's the whole point of accepting only irrevocable licenses that we don't care about how nice the copyright holder might (now or at a future point) want to be about enforcement. So either we should delete all of these files if we worry about copyright holders not being nice about enforcement, or we should keep these files too. Tokfo (talk) 20:21, 21 March 2018 (UTC)[reply]
I understand your reasoning, but this is in no way a typical case, because it appears that the uploader explicitly uploaded the images here in order to encourage misuse of them by innocent parties, in order to extort money from them using their own website http://www.plaghunter.com/en/. The way that after being blocked, the user has seemingly paid editors to add photos to high-trafficked WP articles e.g. [3] [4] makes this especially clear. But isn't the whole deal of CC licenses to be redistributed in a manner specified by the author? For all legal purposes these images are all irrevocably released under free licenses so why delete them? I don't want any re-users to ever be harmed by anything they wish to use from Wikimedia Commons, but can Marco actually win any lawsuit? You can't claim that the images you legally stated are free are suddenly unfree, is there any evidence that it was in fact the person of Marco Verch and not an impersonator making all these threats? I can see someone claiming to be a photographer and demanding money and then banning the photographer would ban an additional victim. Still sounds a bit odd to me that Flickr does allow his images to stay online, with open license, but a good faith usage of such a picture on this site would be met with legal action. I wonder: who would he sue? Me? Wikimedia? Did he ever actually sue someone? Under what law does he think he would stand a chance? Would he really risk having to pay the legal fees of Wikimedia as a defending party? Please understand that people put quite some effort into finding an acceptable picture and uploading it with all details filled in properly, which is cumbersome enough, and that it's quite disappointing to suddenly see it deleted even when you've done everything right. I feel WP/wikimedia editors should be protected from such disappointment. Well if that's the German law and discussions on the German site led to the conclusion that nothing can be done about it, i guess we'll have to accept this situation. At least now it's clear what's going on for anyone who lands on this page. I didn't use the flickr tool, because i didn't know of it's existence. Again i don't have experience. Next time, I'll just try to make a picture myself and hope that process goes smoother.  "On appeal, the Ninth Circuit Court of Appeals found in favour of the defendant, Arriba Soft. In reaching its decision, the court utilized the statutory four-factor analysis. First, it found the purpose of creating the thumbnail images as previews to be sufficiently transformative, noting that they were not meant to be viewed at high resolution as the original artwork was. Second, the photographs had already been published, diminishing the significance of their nature as creative works. Third, although normally making a "full" replication of a copyrighted work may appear to violate copyright, here it was found to be reasonable and necessary in light of the intended use. Lastly, the court found that the market for the original photographs would not be substantially diminished by the creation of the thumbnails. To the contrary, the thumbnail searches could increase the exposure of the originals."
 "In June 2011, Judge Philip Pro of the District of Nevada ruled in Righthaven v. Hoehn that the posting of an entire editorial article from the Las Vegas Review Journal in a comment as part of an online discussion was unarguably fair use. @Tajotep: The film (which is an Italy-Spain coproduction) was entirely shot in Andalucía, Spain (as many spaghetti westerns), so "not created" in Italy as the template PD-Italy states. El póster fue la imagen o cartel público de la Feria MadridArt'18 que tuvo lugar en Madrid en febrero de 2018. Este póster se regalaba y también se podía adquirir por unos 15-20 euros. En mi caso me lo regalaron al hacer una compra en la feria.
Yo he realizado una fotografía a dicho póster y después he realizado algunos ajustes para cuadrarla y quitar los bordes blancos.
Es un póster público y la fotografía ha sido realizada por mí.

The photo "The Lac of Desire" is made to a poster of the painting of the same title by the painter Okuda San Miguel. The poster was the public image or poster of the Feria MadridArt'18 that took place in Madrid in February 2018. This poster was given away and could also be purchased for 15-20 euros. In my case they gave it to me when making a purchase at the fair.
I have taken a photograph of that poster and then I have made some adjustments to square it and remove the white edges.
It is a public poster and the photography has been done by me.

Ok. Now, the image on Commons is indeed identical to the highest resolution of the image on Flickr. However, the username of the uploader on Commons AhmedAli17 is rather similar to the username on Flickr Ali Ahmed. So, it's quite possible that they are the same person. Túrelio I have a strong suspicion that the Wikimedia user is nto the real Ali Ahmed but only trying to ape their identity. There are 2 reasons behind it, (1) The uploaded image does not have the correct metadata which makes me believe that the Wikimedia user copied the image from flickr rather than upload a real image (2) the Wikimedia user has only uploaded 2 images (both CR Ahmed Ali, and the second one also seems to be a CR violation) and not uploaded all the other images on their flickr account.  Keep:

  • Licensing: The uploader has claimed to be the person shown in the photograph and also insisted to own the necessary rights and gave permission. (file talk:Dannykangoo.jpg) The fact that this person appears to be a fitness model and knows somebody who is able to make professional photographs is no reason to assume dubious authorship. We should assume good faith and keep it.
  • Project scope: As a user image uploaded by someone who didn't violate any policies, didn't do anything what would exploit our ressources or misuses Wikipedia for self-promotion such an image is clearly in scope. (This account has uploaded two personal images which is acceptable.) Either this image is used on the user page or not it has to be kept. We can't just delete every single personal file of any new user. If we act this way we scare away potential contributors. This person may never become a "power" user but might provide some valuable contributions in the future. No source URL provided to confirm authenticity. Unless the uploader is in fact Underwood herself (which I highly doubt), the "own work" claim is false and the risk of keeping around a fake signature just isn't worth it. SNUGGUMS (talk) 23:37, 21 March 2018 (UTC)[reply]

I must've misread the file or confused it with some other upload for "own work", my bad on that, but it either way still is suspicious how no URL containing this signature is provided and there's no evidence indicating the uploader is in fact Underwood. A great shame to flag these for potential deletion as clearly a lot of work has been put into them over the years, and they'd be very useful to the project if permissible, but per recent pump threads here and here, consensus seems to be that these are derivative works, being modified versions of original artworks and photographs, and cannot be freely licenced and reused solely as User:Stephencdickson's "own work".

Example: File:Pastel portrait of Sir William Gray by Stephen C Dickson (after Alan Sutherland).jpg is derived from this 1977 portrait. I haven't tracked down sources for all images, but checking many of the files below at random, a Google image search for the subject's name turns up an original portrait which was its derivation.

The user hasn't explained their working process in detail, but it appears to involve printing a digital image onto paper, and applying pastel and pencil over the top to cover most of the original detail, while retaining the same artistic depiction, before scanning it back in. It sounds as if the creator may have been acting on bad advice from others that an editing process such as this would remove any copyright and allow the final result to be freely CC-licenced.

 Delete If the source is under a copyright, these are copyright violations. If the source is in the public domain, there isn't copyright issue, but there isn't any point of not using the picture. What does not make sense in deletion is that these are largely 19th c people and the original images are non-copyright or copyright expired. This to me should be self-evident. My intention is to fill gaps on Wikimedia/pedia and to improve the quality of available images. My image of John Primrose Ure is based on a 5cm high blurry photo in the Glasgow Herald and whilst it has reappeared in more modern sources (notably without copyright issues raised) my own work whilst necessarily "derivative" (otherwise being pointless) is my own grey pastel work and my own intellectual property. If you were to do an electronic analysis you will find it different in almost all respects from the original but (as I am a reasonable artist) reasonably recognisable. The nature of the creation and lack of copyright on the originals makes this whole issue quite bizarre. I am at least glad that some see that this is a LOT of effort and it would be heart-breaking to remove it. Short of creating a video to show how I create each (which would be a long video) I do not how to prove these are my own works and "derivation" is deliberately minimised whilst trying to keep a meaningful likeness. Ironically the John Primrose Ure image which began the whole debate I consider one of my artistic best... which is perhaps a lesson in itself... If the pastel images were more remote from source (and less identifiable) they would then (by the theories above from complainants) be more acceptable. Can somebody with a better understanding of copyright than me give some guidance for which source images are and aren't public domain here?   •  Keep ones based on PD sources,  Delete ones where the source is still under copyright. I think these are in scope, if the licensing is OK, even if the PD original would be better on the Wikipedia articles. Determining PD status can be difficult for works from the late 1800s and on. The John Primrose Ure image... is almost certainly PD-1923 for the U.S. side of things, and it may be PD-UK-unknown, but as it is likely an early 1900s photo we may need to know the source and if a photographer was mentioned in the original publications. The Malcolm X photo is possible due to U.S. formalities but we would need to know its publication history. File:Dr Henry Marshall by Stephen C Dickson, after Daniel Macnee.jpg should be fine -- that artist died in 1882. I think those that are OK regarding copyright are likely in scope: where the original photo is poorly reproduced (low resolution, nth-generation rescreen, or the like), a redrawing might well be superior as an illustration of the subject, per Prosfilaes.   • Comment - I can't be objective here, as I requested the uploader to do some of these portraits (after coming across some of his earlier work). See the discussion here. I was made aware (through a ping) of the two recent discussions here and here. I am not convinced that the approach taken by Stephencdickson does actually breach the underlying copyright (if you look closely at the examples, the changes are actually quite substantive). The only way to 100% test this would be if one of the holders of the copyright to the original photographs did take some sort of action. I think that would be unlikely to occur (except in the case of the painting where the artist is still alive). I can understand, though, that Commons takes a very conservative approach to avoid the risk of any infringements. It is likely that a lot of these images will be deleted, but can I please make a plea for those participating in this discussion to try and work with and encourage Stephencdickson to try again and see if it is possible to come up with a style that is acceptable? It is incredibly rare to find someone willing to do artistic renderings of people, and this should be encouraged and guided, rather than discouraged (I hope people participating here can see that this deletion discussion is likely to have a discouraging effect).

"You are encouraged to create a portrait in the medium of your choice and then upload it to Wikimedia Commons under a compatible license. @Carcharoth: : Commons_talk:Copyright_rules_by_subject_matter#Drawings has a couple examples which were kept, plus some further discussion and links. This court case also has a very good discussion about what constitutes expression in photographs, and derivative works of them. That case was between two photographs, where the second was ruled to be a derivative work of the first (shown at the end of the PDF). Many of the principles will still hold when it comes to drawings of photos. The Artists' welcome page mentions the need to avoid derivative works, but does not get into the detail needed. I don't mean to criticize the art, I just find it disconcerting or jarring to come across a Victorian-age persona represented by a clearly anachronistic, artistic representation. Sure, but that is a decision made by the editors on the projects. Commons tries to have as many options as possible -- so to me, if the drawings are fine copyright-wise, we should keep them. But that does not mean that someone can't upload the PD source image and switch to that on the Wikipedia article. That is part of why identifying the source can help. Maybe someone writes a Wikibook at some point though and likes the drawing style for their particular purpose, especially if consistent for a series of people, and so uses those instead. Commons should be about giving more options. Also, I think a few of these were made from very small source thumbnail photos, so the larger drawing may still be better than the low-resolution source photo. Comment - I came across John Sturgeon Mackay today, at the very end of a massive trawl to discover the connection between Sir Henry Savile (he of the Savilian Professorships at Oxford) and Euclid's Elements. Mackay's article on Euclid in 1911 Encyc. Britt. finally made the link clear, and I wanted to find out who JMS was. I was immediately struck by the quality of the artwork, and I very hope that some sort of compromise can be reached.
