- Delete per COM:PCP. Uploader has been adding lots of photos with copyright issues which include fair use logos and stadium photos taken from other websites. This photo in particular has an obovious watermark at the bottom. [edit]If all of these are actually "own work" as claimed, including both what is on the phone and the image behind the phone, then they are out of scope as personal art. If,on the other hand, they are copied from commercial ads or if the uploader does not own the copyright to the images, both on and behind the phones, then they are copyvios. Either way we cannot keep them. Note also that the listed author is not the same as the uploader.

- Subsequent to this nomination, I received an upset system email from the uploader Snollen63, and an experienced editor on en:wiki has reduced the article to fit project scope. Thus this image would appear to be within COM:SCOPE due to subject notability, however this image needs COM:OTRS because we have to verify that the identity of the uploader matches the writer as claimed. A specific reason this needs to be asked is that the other user who created the page, also seems to be the writer himself, see https://en.wikipedia.org/wiki/Special:Contributions/Mikeallen63. So either we have two people and an issue of who is who or one person with two accounts - and either one or neither of those two could be the author himself. Thus this needs to be resolved by the COM:OTRS system.
- The text of the letter calls into question the ownership of the image. This is not a "vanity" photo. It is the only photo of the person under his own copyright that Wikipedia would accept, and it had to be uploaded several times. I don't see why a simple head shot of the person should be deleted. The same goes for the other photo on this page. It was the only photo dealing with Nollen's musical career--under his own copyright--that Wikipedia would accept. You people nitpick beyond belief. It was sent through the wiki system, so the sender is verified as Snollen63.
- I see some big questions created by this note. First, does the uploader realize that Wikimedia Commons - where this discussion is taking place - is not "Wikipedia"? They are two different projects with different guidelines. As for the image itself: "Of the person" implies it is not "of myself", as claimed by title and license. That the pictures have been repeatedly uploaded is also a red-flag; they wouldn't have been removed if the licenses were ok. "Simple head shot" implies lack of understanding of copyright rules, and the reference "Nollen's musical career" shows distance between the correspondent and the subject. The image is of who was born in 1871 meaning that he would be 42 years old in 1923, he looks significantly older than 42 years old. So the claim that it is in public domain is questionable. Aber zu dieser Datei: warum soll es sich um ein amtliches Werk, welches zu öffentlichem Interesse veröffentlicht ist, handeln? Wenn man es sehr weit auslegt, wäre es ein amtliches Werk höchstens nach Nr. 2 des §5 UrhG, das wiederum hier nicht möglich ist. Außerdem ist es hier ein Bericht eines Unfalls, keine Anweisung oder ähnliches zur Gefahrenabwehr. Denn, wie das Urteil aussagt, wäre eine Ausnahme nur gegeben, wenn eine „rasche und umfassende Information der Allgemeinheit erforderlich [ist]“, das ist aber bei einem Bericht nicht der Fall. Außerdem erfasse lt. dem von dir zitierten Urteil Az. I ZR 185/03 BGH dieser Bericht weder normative noch rechtliche Regelungen, was aber eine der Voraussetzungen für die Annahme eines amtlichen Werkes wäre („Eine amtliche Bekanntmachung setzt einen regelnden Inhalt voraus; sie erfasst nicht jede informatorische Äußerung eines Amtes [...] Vielmehr sollten amtliche Bekanntmachungen nur dann gemeinfrei sein, wenn sie ebenso wie die sonst aufgezählten Werke eine normative oder einzelfallbezogene rechtliche Regelung enthalten.“) Die Hinweise am Ende des Berichtes sind nur Hinweise, aber weder Anordnungen, noch Gesetze oder Erlasse. Damit fehlt jeglicher regulierender Inhalt.

- Die Untersuchungen einer Eisenbahn-Unfalluntersuchungsstelle wie die EBA sind von den rechtlichen Verfahren getrennt und werden auch davon unabhängig geführt. Die Empfehlungen können an Eisenbahnverkehrsunternehmungen, Eisenbahninfrastrukturunternehmungen oder auch an die Aufsichtsbehörde gerichtet sein. Diese Empfehlungen sind bedeutend mehr als eine informatorische Äußerung einer Behörde, denn sie führen zu einer Weiterentwicklung von Vorgängen und Prozessen im Eisenbahnverkehr. Obwohl diese Empfehlungen im juristischen Sinn rechtlich nicht bindend sind, werden sie von den Beteiligten umgesetzt, weil sie ansonsten später bei einem Vorfall unter ähnlichen Umständen mit empfindlichen Strafen, harten Sanktionen durch die Aufsichtsbehörde und massiver öffentlicher Kritik rechnen müssen.
- Die Trennung und die Eigenheiten paralleler Untersuchungen im Schienenverkehr von Justizbehörden und Unfalluntersuchungsstelle ist für Uneingeweihte oft schwer verständlich, da man sie im Straßenverkehr nicht kennt. Dort kann strikt zwischen regulativen und informativen Tätigkeiten von Behörden getrennt werden. Die Sicherheitsempfehlungen einer Eisenbahn-Unfalluntersuchungsstelle gehen jedoch weit über die informative Tätigkeit einer Behörde hinaus. Sie sind amtliche Werke im Sinn des BGH-Gerichtsurteils vom 20. Juli 2006 zur Abwehr von Gefahren im Schienenverkehr. - Yes it is, in nl:Gebruiker:MoiraMoira/Handtekeningenkladblok and nl:Gebruiker:QWxx01/Reageerbuis/Handtekeningen (see their histories). The SVG files are rendered by MediaWiki as PNG files every time you see a page, but with better quality. Note I only reemplaced the lower quality files of the listed in Category:Aircraft icons obsoleted by SVG replacement. If you fear losing the raster version, remember that you can easily download the PNG version of each SVG file at any time and in any dimension you want. Flickr recently started allowing its users to mark their images as public domain, but some bot keeps tagging those images as no license. Why isn't the clear intention of the flickr contributor to put their image in the public domain always challenged.
If this bot is acting outside its mandate, it should be retired and retooled. If it is acting in accordance to a policy or guideline, then it should provide a link to a brief explanation as to why we aren't honoring the flickr contributor's clear intention.
