- On the UN website, it says:

- That seems to me that they are indeed in the public domain. Why would there even be a license template named {{UN map}} if they were not?

- Hi Oompahloompah2016, can you explain what you mean? Category:UN maps has many such similar maps. The original source of this map is the Supplement to a Survey of Palestine (Jerusalem: Government Printer, June 1947); see File:Survey of Palestine 1946.jpg, which is public domain under the UK's Open Government Licence. It was subsequently published as United Nations map no. 93(b) in August 1950, which is this version.

- Don't delete. I see no merit in this deletion request, which ignores the general licence on UN maps. (Since it is not modified there is no need to remove the logo.) Historical maps are not "obsolete" either, they are historical, and there is no relevant issue regarding this map. Final, though it isn't actually needed here, Oncenawhile is correct that this is a map produced by the British government and as such is beyond doubt in the public domain under UK Crown Copyright law. - With respect to COM:PENIS: We don't need 14 images of this same person's genitals from a variety of angles. All are pretty low quality, badly photographed (most have focus problems), provide no context other than a shot of the groin or anogenital region, aggressive/confrontational framing. Additionally, most of these were spammed to a variety of categories, and use extremely common or meaningless file names, suggesting this uploader's intention in uploading the image was not to aid Commons' educational mission.
- With respect to COM:PRP: This user was blocked for repetitive uploading of copyrighted images despite warnings. His entire catalog of uploads is tainted by this. Many of these images lack EXIF data, and some have false or strangely incorrect EXIF data. One, for instance, has Google listed in "software used". Another claims to have been taken by an EOS 1100D, but the information box says 1970, and the image was uploaded via Android.

I don't doubt that she has access to these photos but only Marek can license them for re-use. Some of these files were previously tagged as copyvios but that was removed with various reasonings but none that answer the question of whether Marek has licensed them.

Ils ont été spécialement réduits pour être utilisés sur Internet, ce qui fait penser qu'ils sont une violation de droits d'auteurs. - MediaWiki and the GPL is not attributed.
- Texts of screenshotted articles are not specifically attributed, or the the description is not precise enough.
- Authors and licenses of the included images are not provided.
Not every image has all of these problems. Some use a "Wikipedia uses CC-BY-SA 3.0, MediaWiki is GPL" tag; this is OK, but it would be better to provide a (preferably perma-) link to the article, and this doesn't work at all when a screenshot include an image. I have literally reviewed all of this user's uploads, so I will admit in advance I may have made a few mistakes.

- Delete/Copy to WP - Looking at other images of this cover I see that the background should probably be flat white, but I agree with Cdang that the text was probably drawn by hand. I had resized the image in an attempt to save it from being deleted, but I realized since that even fair-use isn't allowed on Commons. The most that we could possibly achieve by potentially flouting copyright law would be to have an image that's just over twice the size, but still with very little detail. As per Jcb's suggestion at the end of this discussion, I'm starting this new request as I think that the decision to keep the image was made in error. There is no freedom of panorama for interior spaces in Germany and this also applies to public interior spaces. To quote from German Wikipedia's very thorough article on the subject, as I already did on Jcb's talk page: "Nicht von der Schrankenbestimmung erfasst sind nach einhelliger Auffassung des Schrifttums Aufnahmen und Darstellungen von Werken in Innenräumen auch von öffentlichen Gebäuden wie Museen, öffentlichen Sammlungen, Kirchen oder Behörden" seems to be pretty clear to me (and it's truly comprehensively referenced with legal literature). My attempt at translating into English: "According to the unanimous view in literature, the limitation [of copyright, i.e. FoP] doesn't apply to works in interior spaces of public buildings such as museums, public collections, churches, or civil services". Deleting this image would also follow existing practice on Commons with deletion decisions such as in Commons:Deletion requests/Interior of Elbphilharmonie. As far as I can see, it's nearly universally accepted that there's no FoP for interior spaces in Germany, with just places of traffic such as railway stations or airports being the subject of some debate (not applicable here, and even then the majority of legal commentaries apparently denies FoP for railway station halls etc.) Pinging also Pajz, our FoP expert. If you consider the design of the interior wall a part of the building itself, section 59 of the German Copyright Act would be inapplicable in first place, see subsection 1, 2nd sentence: "In the case of buildings, this authorisation shall only extend to the exterior view." If you don't, it is inapplicable because works inside interior rooms of buildings are not covered under section 59, even if the building stands open to the public, because the work is not located "in public roads and ways or public squares". See de:Panoramafreiheit#Kriterium „öffentlich“, para 4, and Vogel in Schricker/Loewenheim, Urheberrecht, 4th ed. 2010, § 59 rec. 7: "This [i.e., section 59] covers the facade of a building as a whole and in detail, or an artistically designed gate to a garden, not however the rear of a house and its interior rooms (entry halls, staircases, ballrooms, interior courtyards, etc.), irrespective of whether the houses are private or publicly accessible public buildings (theaters, court houses, administrative buildings, etc.), or works inside interior rooms, such as a sculpture in the entry hall of a university, or a wall painting in the lobby of a theater." - @Goldchinese: (I'm writing in English as Commons' lingua franca, for the benefit of readers and potential discussion participants who don't speak German) - Yes, there are several pictures of modern interiors in Category:Interiors of opera houses in Germany that should probably be deleted as well. Not all of them, of course: Category:Interior of Markgräfliches Opernhaus shows Baroque, 18th century interiors which aren't protected by copyright. Files such as File:Bundesarchiv Bild 183-75965-0001, Leipzig, Opernhaus, Probe Franz Konwitschny.jpg are also most likely fine - focussing on a person, not on the architecture or other elements of art. We will have to discuss and probably delete quite a few of them in due time, but there are many special circumstances to consider. For example, the Bundesarchiv (German Federal Archives) photos may be a special case, as the cooperation agreement with Wikimedia Germany asserts that the Federal Archives owns sufficient rights to be able to grant a free license. On the other hand, we had to delete some Bundesarchiv photos nevertheless, as it turned out that in some cases there were oversights (e.g. photos of newspapers). Anyway, there have already been many deletions of similar cases, see Category:German FOP cases/deleted (and that category contains only a selection, often requests aren't categorized after deletion). Matter of fact the camera was not even a Nikon and the photo was shot at the Marathon in Tempe AZ for PF Changs in 2008-2009. They are SPECIFICALLY included in the "simple photographs" chapter (articles 87-92). For the record, not the nom's responsability, but the current wording of the template is quite misleading as the Italian law never says "the simple photography must not have artistic merit or reflections of photographer creativity or personality" (something, if we were in WP, I would call an original research) and particularly Art. 2, § 7 do not talk about "work of photographic ART" but about a more neutral "photographic works" ("opere fotografiche" in Italian). The Italian law is also extremely precise in what should be considered a simple photograph and what is a photographic work: Art. 2, § 7 expressely refers to articles 87-92 (ai sensi delle norme del Capo V del Titolo II, "Diritti relativi alle fotografie" i.e. "Rights related to photographs"), and namely in the article 87 includes film screenshot. - Files on Commons must be free in both the United States and the source country. You have used two templates: {{PD-Italy}} for the Italian part, and {{PD-1996}} for the United States part. Unfortunately, {{PD-1996}} does not apply here.
- {{PD-1996}} has two requirements:
- The work must have fallen out of copyright in the United States for some reason before 1996. This film had a valid copyright notice, so it didn't fall out of copyright in the United States before 1996. See Commons:Subsisting copyright.
- The work must be in the public domain in the source country on 1 January 1996. The screenshot was in the public domain on this date, but the film as a whole was not. To make it more complicated, Italian law and United States law define 'work' differently. Under Italian law, the film is a work but the individual screenshots are not works. Under United States law, the entire film including its screenshots constitutes a work. See COM:URAA.
- Since United States law seems to be heavily dependent on the word 'work', and since this word is defined differently in the United States and Italy, I'm not sure exactly how United States law handles screenshots like this or whether United States law says that requirement #2 is satisfied or not. - Comment, last time I nominated a PD-Italy for deletion, Commons:Deletion requests/File:Corleone 1978.png and Commons:Deletion requests/File:Amori miei 1978.jpg, two open-and-shut cases where URAA clearly applied without ambiguity about which is the "work" subjected to copyright protection (both the film works and the relevant film frames were copyrighted in the source country on 1 January 1996), to my surprise the closer kept the images as "WMF policy is that we do not enforce URAA", citing in his talk page Commons:Massive restoration of deleted images by the URAA as the background for his decision. There are similar outcomes scattered here and there, some of them in Category:URAA-related deletion requests/kept, eg. Commons:Deletion requests/File:Patrick Abercrombie, 1945.png where the affected file was kept citing Legal/Wikimedia Server Location and Free Knowledge as background. - not sure if this should be deleted I requested this video from the American Chemical Society, got a license release, and uploaded it. There are some community concerns about the logo in it. I nominated this for deletion to get community opinion and set a precedent. I raised this issue at Commons pump and other places linked to that page. Different people gave different opinions about whether logos can appear in videos.
- Videos contain all sorts of imagery. This one contains a non-free logo of the video's creator at the end. The file was licensed and uploaded with the understanding that the logo at the end was Commons:De minimis, and could be allowed in the file despite being non-free content. I indicated at the time of upload that the logo was non-free.

- Delete It is seven seconds, and I've altered the link above to show them. The five-second clip makes the logo less prominent -- it is the initial couple of seconds when it is very much "in your face". See this article and this pdf. Clearly the defence of de minimis in a video relies on the copyright material being incidental and in the background. If this logo was out-of-focus and on the wall behind the guy being filmed, for example. But here the logo is deliberately included and the entire purpose of that segment is to display the logo clearly to the viewer so they acknowledge the work of the ACS. That's the purpose of the logo and the purpose of its inclusion in this video. Therefore this copyright work cannot be said to be de minimis. The video must be deleted and replaced with one that does not include the logo animation (my understanding of copyright violations is that it is not good enough to simply upload a new version while retaining the infringing material in an old version). It says, "Courts generally agree that the showing of the copyrighted work on video is not 'de minimus'". I am not sure if that means that every second of a video should be considered independently for the purposes of de minimus. With images in Commons, if a copyrighted work is less than 5% of the total image (or any arbitrary small amount), then I think that could contribute to a de minimis rationale that the Commons community might accept. I am not aware of any comparable discussion in video. The paper does present the amount of time that a copyrighted work is present in a video as a contributing factor for determining fair use. This makes me wonder about "fair use" in Commons - often it is said that fair use is not allowed, but de minimis" is a sort of fair use, right? - No, de minimis is not "a sort of fair use". The former is literally that "the law does not concern itself with trifles". Fair use concerns the circumstances of the usage (commentary, newspaper report, etc) of a normally copyright work, and the usage is certainly not incidental or minor. I don't think the 5% figure appears anywhere in law or policy. The papers mention the short duration that the work is featured, but I don't think making the total film longer (and thus smaller percentage) would have any factor in copyright -- it is just making the point that the usage is a tiny part of the whole. Nobody says 5% is ok but 6% is not. Ultimately, it is all down to some judge to decide, and really takes legal experts to anticipate any ruling. With this video, it isn't the length of time that is relevant, it is the fact that the sequence consists of nothing but the logo expanding to fill the screen and animate. - Colin I do not know how to articulate the difference between fair use and de minimis, but I interpret the paper you presented to say that there is a spectrum of judgement from one to another. The paper seems to suggest that when remixers wish to incidentally include copyrighted works in a new work, then de minimis is a great rationale when it works, but fair use is a level of use beyond de minimis that might serve the same purpose, and beyond that a need for licensing might happen. The paper seems to say that if a copyrighted work is in the background of a video, and it is not clear, and not prominent, then it could be de minimis use. If the video were made differently and the copyrighted work in the background were more prominent for more time in a clearer more prominent way, then there is some line that is crossed that could either be infringement or fair use. The paper you shared seems to say that there can be doubt whether a remixer is using a copyrighted work on a de minimis rationale or a fair use rationale.
- The 5% is arbitrary. Copyright judges on Wikimedia Commons often say something like, "this copyright image is only a small part of the new work, so it is de minimis..." I think that 5% is a good approximation of how Commons judges decide these things but as you say, no one articulates the rules which are supposed to be unspoken. I have never seen a copyrighted image fill 20% of a Commons upload and be judged as de minimis, so I think the real percentage is lower than that, and 5% seems like a fair guess to me based on the examples at Commons:De minimis taking up about 5% of the total image space.
- It seems like you are saying that every frame in a video is considered independently for copyright. I am not sure about that - at the frame level of videos all sorts of copyrighted works might be seen and I think that level of scrutiny has never been intended. The paper you presented describes right of display and things like time, prominence, and clarity are among the factors considered for infringement. Logos like this one are always going to have the highest possible prominence and clarity anywhere that works are traditionally signed. I am just not sure what amount of scrutiny should be applied to videos. There is not a precedent on Commons of taking note that if a video is uploaded, then the copyrightable elements are noted. Maybe there can be no de minimis in video, and maybe either Commons allows fair use in video or it does not. The example in the paper talks about a quilt in the background of a video which has fair use of a quilt. Right now, I am not sure if Commons would allow that. - There isn't a "difference" between "fair use" and "de minimis" any more than there is a difference between apples and income tax. They are different concepts yet both nouns. You know, there's a pretty good encyclopaedia on the internet if you aren't sure what something means. I forget what's it's called :-). You are taking completely the wrong approach in thinking 20% this or 5% that. It just absolutely doesn't work that way. Take an example. A man loves a woman and they decide to get married. What's the threshold? 50% love, 85% love, or just that they love each other a lot. Stop trying to deconstruct this into numbers or analyse it -- there are no rules only judgements. It certainly isn't just about how much space a subject takes up in an image or time in a video. I'm not saying "every frame in a video is considered independently for copyright". The logo sequence was deliberately crafted, animated and inserted into the video in order for the viewer to be fully aware of the branding. It's hard to think of a less "de minimis" use of a copyright element than this. There is no "Fair use in a Commons file". Bluerasberry, I'm beginning to wonder if you are trolling this discussion, as this is like wack-a-mole where one weird idea is answered only for an even weirder one to be suggested or proposed. Ultimately, Commons is not an educational resource on the law, and I am not a lawyer. And, in any case is anything but clear that this procedure was performed by VenezuelaTuya in the first place, for example, the bulk of the information from that site is actually from the Diccionario de Historia de Venezuela by Fundación Polar.
