This is basically a mass deletion request.
All files contained in Category:User:esby/Cosplay_photo_without_model_release should be deleted.
Basically there is no model release associated with these photos, so they cannot be used commercially without the model agreement.
This is also specified on my Flickr profile since a lonnnnng time.
They were all imported from my Flickr account with the flickr uploader tool.

Kept: Esby reading of the law is not correct. While it is true that they cannot be used for commercial endorsements, that is not a copyright restriction. They can be used in a variety of other commercial uses, including, for example, bookson cosplay. If Esby's reading were correct, we could not keep any image of a person. .     Jim . . . . all files in Category:User:esby/Cosplay_photo_without_model_release are concerned. Most of them are unused files.

The images were taken in France, Commons Policy say that Consent is mandatory (see France case in Commons:Photographs_of_identifiable_people#Country_specific). Also see Commons:Deletion_policy#Photographs_of_identifiable_people as it is on the list of deletion reasons.
There is no consent for publication on Commons, it does not even exist, so the files in Category:User:esby/Cosplay_photo_without_model_release should be deleted.

  •  Keep all. That there is no consent of the models does not really matters. This is a non-copyright restriction with which the Commons is not concerned. It is the responsibility of those who want to reuse this pictures for a commercial purpose to obtain the necessary consent. The French law is stricter than most -- with limited exceptions which do not apply here, any use, commercial or not, of the image of a person in France is unlawful -- simply taking the photograph is unlawful. Therefore our hosting the images is actionable. That is certainly of concern.

First, I can not find where that guideline says that the consent for hosting such photos on Commons is mandatory. It only implies that it is desirable. Second, the photos were obviously taken with consent of the models, and I assume that they were published (i.e. made public) with consent of the models (by the same same person - Esby - who nominated them for deletion). Is it necessary for the Commons to have a specific consent for hosting images that have been already lawfully published elsewhere? That guideline is quite unclear with respect of this question. I would not delete these images (after all they have been here for 5 years without any problem) unless there is a specific complaint. Ruslik (talk) 17:07, 31 December 2014 (UTC)[reply]
The cited official guideline says:
"An image is unacceptable to Commons if it is illegal, or arguably illegal, in any one or more of: (a) the country in which the photograph was taken; (b) the country from which the image was uploaded; (c) the USA (where Commons images are stored)."
That seems pretty clear to me. French law makes it illegal to take images of identifiable people without their consent. While it may appear obvious to you that the person in the subject image consented, I don't think it passes our "beyond a significant doubt" standard and we certainly have no written evidence of consent. COM:PRP #5 speaks directly to your last sentence:
"...the following are against Commons' aims:
"5. The file is obviously common property. It can be found all over the internet and nobody has complained."

Just a note, it is not illegal to take photos of someone, you might ask for consent for taking the picture, which helps in getting the person attention but it is not enough for publication, consent for taking the photograph does not equal to consent for publishing (or using) the photograph somewhere. Such consent has to be written, specific (naming the usage for example) and restricted in time, which is not really compatible to Commons expected usage of the medias... As I said there is no written consent, there is tolerance that such photos will be published on my (personal) websites (tolerance as understanding that's usually how cosplay photographers proceeds in France), but I don't think Commons is to be considered as my 'website'... Most photographs were changed of licence when i discovered those rogue flickr imports, a few hundred were left, due to issues affecting the flickr organiser when 10k photos (or more) needs be selected... Esby, I don't understand:

At the official guideline cited above, we are told:
"Taking a picture of a person in a public space: Requires consent"
If the law says you need consent to take a picture of someone, then taking a picture without consent breaks the law and is therefore illegal. If it is not illegal to take photos of someone without consent, then our summary of the French law is incorrect and should be changed. .     Jim . . . . My two cents, you are probably right here, in my opinion, the issue is that you cannot really forbid to take a photograph, the 'right to take a photograph' does not intervene much here, at least in a public place, since the issue really comes into play when the photograph is actually published, at least it's the theory. Our guideline are probably ok there. After some thinking, since we deal with published pictures it does not really matter for us at Commons, I believe the important point is that you cannot transform a 'there was consent for taking the photograph' (understand he/she was posing) into a 'there was consent for publication' since there is nothing written. Some countries have strict laws where consent is mandatory to take photos of people. In such cases, copyright is not going to initiated if we fire the shutter without consent. Consent to publish and consent to use commercially are different. If we need consent to publish, such works are only suitable for private uses where no publishing is carried out. If consent is required for commercial use, but other uses are allowed; we can host such works with a {{Personality}} warning. Jee 02:48, 2 January 2015 (UTC)[reply]

Visiting the source site reveals that the given link is not a permanent URL, but searching the catalog for "Atlas Missile 10D" gives the catalog record. No author is given, and there is no indication that this is actually a NASA photo. It does not appear to be contained in the NASA archives, which I have been consulting extensively in the last few days for photos from the Mercury Program. Images from a batch upload (I looked though more than 5500 images before i had to stop). Some are in my opinion of very personal nature. Images from holidays, travels, family. They are maybe under a free license and for flickr they are maybe OK. For Commons they are in my opinion not OK. And a lot of images fom the family pets. Hundrets of alwys the same images mostly of cats. The most images of the batch upload are OK - but these images here in my opinion out of scope. We are not the provider of private Webspace. The images are not of educational use and again - some of them are not usable because they are simoply of private nature.

@Túrelio: I disgaree with File:How deep? (5225572713).jpg as it can be used to illustrate winter clothing. File:Holly (2539660018).jpg could be used to illustrate that breed of cocker spaniel. File:Negotiations (927097342).jpg can be used to illustrate en:2007 Royal Mail industrial disputes. Is there any evidence of consent of the depicted in File:Negotiations (927097342).jpg? In my country, such an image used (beyond mere news reporting of a recent event) without consent of the depicted could become quite costly for any re-user. Not sure, how it's in the UK.
About File:Holly (2539660018).jpg: sure, though we have enough images of the same dog already. However, here the dog-image is "spoiled" by the background. --Túrelio (talk) 07:20, 16 April 2014 (UTC)[reply]
File:Holly (2539660018).jpg is one of only two photos we have of this breed of dog with people; there's no issue with that photo, its high resolution, reasonably good quality, so we should host it for people to use as they see fit. Those images, all uploaded by the same person have different problems. Some are clear print screens, others contain suspicious watermarks and others have EXIF data that indicates that those files are indeed copyright violations because they are credited to somebody else. Also, it would be pretty unique if one person took all those images. At file File:Bob de Vries.jpg the uploader even admits that he has taken the image from twitter, no evidence of permission here. And another image, already nominated here looks like a scan. It is very unlikely that the uploader is the real copyright holder of all those images and the PCP should apply.

Without any info about authors, those photos are too recent to be kept at Commons, the autors could well have lived beyond 1943, which would mean the images are still protected. There are two pictures of the pictured person on that website, but are obviously taken with a much better camera and from a different angle.   • This portrait photo is made in order of J. Wiersma around 1945 for a membership card from a resistance movement. He died 1979 and as oldest son, in the Dutch Portrait Law it is possible for me to use this portrait photo, I am allowed to duplicate it and place it in publications when the name of the original photographer is know, I have to mention him, but I don't know his name. Portrait Law, article 19 and 20. When you talk about the fact that the photo is not older than 70 years. I had a talk with the legal department at my work. They say that I have the right to publicize this Photo. (what's in a name: to make it public!!!)They also mention that de photo is almost 70 years old, its not an artistic photo, its not a photo picturing someone famous, its not an commercial article, how likely is it that the copyright holder will react and claims this Photo.     • Hang on. You both seem to be talking about the surviving relatives of the man in the picture, whereas the law obviously refers to the photographer's (i.e. the copyright holder's) heirs. The photographer may still be alive (he could be 90), and when he dies his wife and/or children will probably own the copyright and we'll have to wait for another 70 years before the work becomes available in the public domain. Who owns the physical picture — the piece of paper — is totally irrelevant. So you either have to find the photographer, or his heirs, or wait for another 90 years to be on the safe side. Alternatively, you could mention on the page that everything possible has been done to trace the legal copyright owners, but that they couldn't be found, and that they can get in touch if they feel injustice has been done to them. This is a public domain image (not all images on Gallica are, I agree) as it is stated. Just click on Informations détaillées (on the right) [4], or on the title and there you can read Droits : Domaine public. Actually, that's not the issue. Gallica has some recent works which rights were release by the copyright holder (ex: Category:Mahabharata by Peter Brook, Category:Roger Pic). So the issue is "Is it probable that Marcel Germon release the right of this work?" We usually trust Gallica on this matter. I changed the license to match the claim by Gallica. That is, unfortunately, the classic question with Gallica, who doesn't provide a rationale for the copyright status in the notices. Sometimes, it is possible to figure out a rationale, based on the number of years, to conclude to PD-old or PD-anonymous-EU, for example. Or when documentary evidence is found for PD-author, as in the case of Roger Pic. But in the absence of explanation, the users of Gallica are left to guess if the public domain mention might be plausible or if it is a mistake. Some cases may look too implausible to be kept on Commons per the precautionary principle. In other cases, where we can't find a documented explanation but where the PD mention might be plausible, some files are tagged with PD-BNF. The images of the Mutzig advertisements are from the collection of nine images of the Strasbourg Library, where the acquisition history or explanation of copyrights doesn't seem to be provided. Why Gallica reproduces only two of the nine images and tags those two images as PD is not known. It could be speculated that perhaps Germon released his rights to those two images, but if there is no source telling so, it would be only unsourced speculation, and that should not be enough for Commons to state PD-author as if it were proven. In this situation where it is unclear, if Commons decides to keep the file, it would be better to use the more cautious and non-committal tag PD-BNF, which basically carries the idea that we don't know why the BNF tagged it as PD, although it is possible that reasons exist for it to be more plausible than not. -- Asclepias (talk) 22:21, 20 December 2014 (UTC)[reply]
