- I think that the person didn't understand the nature of a free licence. The first deletion request took place within a week of the edit of the picture. It is a wonderful image, but I am wondering if we do the project justice by keeping this image. (Please note, I am not at this time voting delete, but rather I think that this should be discussed.). - I have decided to vote Delete on this image. But it should be made clear to the uploader that releasing a file under a free licence is in fact not revocable. What that implies is that if somebody were to decide to use that file anywhere on the Web they would be completely free to do that. If somebody would wish to use it in an article on any Wikimedia project they should open an undeletion request, and such a request should be granted. The file may have been released under a free licence as a mistake, but since this mistake wasn't rectified for such a long time, there's nobody to blame for that besides the copyright holder. Lastly, if the person who has removed the watermark will vote keep, arguing that it took effort to remove the watermark, I will reverse my vote. Sinnamon Girl (talk) 17:20, 27 April 2013 (UTC)

- Neutral Two first closures were totally legitimate. But I looked at Category:Zahlé and we have quite a lot of panoramic views there, included one valued image. Therefore deletion of ZahlePanoramicView.jpg is not a big loss to us. And, actually, this is not a good file: it seems very distorted in middle. Taivo (talk) 10:45, 27 April 2013 (UTC)
- Delete I removed the watermark from this image some time back at the request of another editor posted in the Graphics Workshop as watermarked images are not permitted on Wikipedia. the uploader vandalized the page with a unacceptable likeness of the artist. A more appropriate photo was already submitted and in use. 5 other images of the subject exist in the commons that are acceptable. This one is an example of harrassment, and is a visual & casual slander of the integrity of the artist. - Comment This looks as though you intended to raise some images for deletion rather than a Commons page. From the nomination, I have no idea what images you refer to, why these might be a problem, or who the uploader is. From the appearance of your complaint, you might be better off writing to OTRS if you believe a set of images on Commons are harassment, or you can re-raise a more appropriate deletion request on one of the images and provide links to the others in that request. This image is in fact free license, per Commons:Currency#Finland which while equivocal, is usually interpreted here as being that national sides of their Euro coins are available under a free license. The image was uploaded from Flickr, where is CC-BY, but there is not information about it original author. The uploader of the original image to Flick says in her web site that "My main sources are museums, comercial archives, state archives, personal collections, librarys and art gallerys around the world". - Amitie 10g, the vandal used it rampantly for duplicates of the ro:Antena 3 article (in order to mock it), which represents different Romanian channel, as you can see in that logo. The vandal at our Wiki uses to create a lot of fake logos for Romanian TV channes, and after he realised that all his logos will be deleted, he started migrating to commons. Image information lists Alex Jones (the subject of the photo) as the author, and says it was (taken by (h)is own crew.) It claims a fair use rational, and then also states that the image is non-copyrighted (Fair Use non-Copywrited.) The image source is listed as “Source=Alex Jones at Ottawa Bilderberg 2006” which means?, so no usable source is given. The account that uploaded the image is IrFactor, an account that was blocked in April of 2009, so there is no way to get additional information. It appears that the image was grabbed from one of Alex Jones’ websites in 2008 and that it was then and still is under legal copyright. There is no indication that IrFactor owned the rights to the photo, and/or was in a position to wave the copyright. Makes no sense at all, especially considering not all uploads of the user were copyvio. I'd suggest using {{Unblock}} but that doesn't make much sense if the user doesn't even remember the password. - Comment The page Utilitarian objects protected by copyright suggests that utilitarian objects are protected by copyright in the Netherlands, so if that is the source country, then it is probably protected by copyright regardless of whether it is utilitarian or not. The photo was taken in Belgium, but the duck seems to be filled with air. It should be fairly easy to transport the duck between the Netherlands and Belgium if you remove the air, so the source country might be the Netherlands, given the country of the designer. - Canoe1967, no. We use {{Copyvio}} only for obvious cases. Our rules explicitly forbid putting a {{Copyvio}} on an image that has gone through a DR, as that casts a serious doubt over whether the copyvio is obvious. - By the way, there's an implicit question above as to which laws might apply -- the country of origin of the object or the country in which the object was when the photograph was made. I think I can safely say that we always use the country in which the photograph was made -- see for example, Category:Alexander Calder American sculptor, American fabrication, but the only images we have are from countries that have FOP for sculpture. Or, even more to the point, Category:Non-Violence (sculpture), where we have kept the Knotted Gun sculpture in FOP countries and deleted the same work in the USA (see Commons:Deletion requests/UN Art Collection).

- If FOP applies in the country of photography, then Commons doesn't seem to care about the copyright status of the underlying work in the source country. I'm not sure if this approach is correct. In principle, this means that you can upload an image of any artistic work, such as a book cover or a film poster. Just bring the work to China, put it in a public place outdoors and then you can upload a photo of it as {{FoP-China}}. If the work is too big to bring to China (e.g. Atomium), instead bring a photo to China, and take a photo of the photo. There's no need to bother about getting any permission from the photographer since {{FoP-China}} doesn't require that. --Stefan4 (talk) 17:34, 12 January 2013 (UTC)

- No, Stefan,that won't work. Taking an infringing copy to an FOP country leaves you with a DW of an infringement. We've faced this issue with several cartoon characters that were photographed in FOP countries where it was clear that the objects photographed were not authorized by the copyright holder.
- I'm not saying that our policy with Calder's work in Germany or the Knotted Gun is correct, just that it is what we do. I don't think anyone knows what a US judge would do if a Commons image of a Calder work in Germany was challenged by Calder's heirs. My guess is that the judge would honor the German rule, because that's the logical thing to do -- if Calder had wanted to avoid the problem, it could have been dealt with in the sales contract. Others will disagree.
- @User:Canoe1967 -- I don't utility is an issue at all -- as I have said now three times, I can't imagine a court calling this giant rubber duckie a utilitarian object.
