This photograph was taken from a journal article ([1]) which is distributed under the {{Cc-by-4.0}} license (not the {{Cc-by-sa-4.0}} license the file was uploaded with). If you look at the article PDF (from which the file was most likely taken), you will see (Figure 3, p. 1165) that there is a photographer named (Sabine Suhr), and that the photograph was not taken by the author(s) of the article, but is credited to “LAKD M-V, Landesarchäologie”. So it is a photo of a German state institution. Unlike some other illustrations in that journal article, which are explicitly stated to be under a CC license, this one is just credited to the LAKD. I've looked at the LAKD web site, and I didn't see any indication that their works are under any kind of free license. Per German copyright, they are also not in the public domain, but regularly copyrighted, and the photo is also obviously recent and not so old that some kind of PD-old could apply.

So we have to ask ourselves: Does the CC license under which the article is distributed automatically also include any illustrations which the article uses, including those by third parties like this one? Did the photograph's author (or rights holder, which is most likely the LAKD) agree to put the photo under this CC license?

Since we don't have any evidence (at all) confirming that the author/rights holder of the photo did agree to such a CC licensing, we should, per the precautionary principle, assume that they did not, and delete the file. Rosenzweig τ 09:19, 28 September 2023 (UTC)[reply]

Similar case as in Commons:Deletion requests/File:Peckatel 1.jpg: This drawing was taken from a journal article ([2]) which is distributed under the {{Cc-by-4.0}} license (not the {{Cc-by-sa-4.0}} license the file was uploaded with). If you look at the article PDF (from which the file was most likely taken), you will see (Figure 6, p. 1169) that the drawing is not the work of the author(s) of that journal article, but credited to a 2008 publication in the journal de:Acta Praehistorica et Archaeologica. That journal is online here (the specific volume the drawing was taken from is here, the article PDF is here). The (recent, not old) drawing is credited to Antje Hasford. I don't see any indication anywhere that the Acta Praehistorica et Archaeologica journal, the article from it or the drawing taken from that article is under any kind of free license.


So (again) we have to ask ourselves: Does the CC license under which the article is distributed automatically also include any illustrations which the article uses, including those by third parties like this one? Did the drawings's author (or rights holder) agree to put the photo under this CC license?

There is no commercial freedom of panorama in South Korea. The statue was unveiled in 1966. Presumed anonymous work since no artist is named. But even then, although the statue may fall public domain in South Korea very soon, its U.S. copyright courtesy of COM:URAA copyright restoration will last until January 1, 2062, 95+1 years after the publication or public display. Therefore, do not undelete/restore this image file until 2062. U.S. copyright can be ignored only if South Korea has commercial freedom of panorama (that is, the fourth condition at Article 35(2) has been removed): see {{Not-free-US-FOP}} for the information. There is no commercial freedom of panorama in South Korea. The statue was unveiled "during the 70th anniversary of the Korean independence or the 116th anniversary of the founding of the Korean Railways" (per a photo here). It is unlikely that the sculptor died for more than 70 years. Copyright expires in South Korea 70 years after artist's death, or 70 years after the public display of the artwork if the artist is unknown. Speaking of nomination, at least one of her photos File:Malashenok.jpg is not "one's own work" because it is the work of Minsk Oblast Cadet Academy (https://vk.com/albums-36124964?z=photo-36124964_457251822%2Fphotos-36124964) and therefore likely cannot be distributed under the CC license. With this in mind, I've created a Wikidata item for Dornelles at d:Q123996297 which meets Wikidata's notability criteria point 2, and the image is now COM:INUSE. Per [12], these photos of Claus von Stauffenberg (two slightly different photos, but obviously from the same photo session) were taken in 1934 when he was a cavalry officer in Bamberg. They don't name a photographer, so the photos might be in the PD as anonymous in Germany, though by German law, the author does not need to be credited, just to be known, so the photographer might be named somewhere, and then those photos are protected for 70 years pma in Germany.

1934 photos were definitely still protected by copyright in Germany on the URAA date in 1996, so the US copyright for those, until the end of 2029, was restored, and the files should be deleted. They can be restored in 2030. One file was previously kept in Commons:Deletion requests/Files uploaded by Madelgarius, but that was just a procedural keep without prejudice to renomination, and two of the files are a stamp and a crop of that stamp, but as we have known for over 10 years now, German stamps are not official works and not in the PD, at least not as official works.

It is not a "mere allegation". I explained in detail above why the URAA does apply. If this were a French photograph from 1934, we could say that it (perhaps, if it was indeed anonymous) was not affected by the URAA because France had a copyright term of 50 years + several years of wartime extensions on the URAA date in 1996 (en:Wikipedia:Non-US copyrights). But Germany already had 70 years on that date. That's the kind of research which one needs to do (and which I did) to determine the applicability of the URAA. Due to the nature of US copyrights, this photograph most likely wasn't even copyrighted in the US at the time, so there was nothing to "confiscate". There was a copyright treaty in effect between Germany and the US, but any German author / rights holder would have needed to register a copyright just like their US counterparts. A search for Stauffenberg at the Catalogs of Copyright Entries at IA does turn up a couple of books by another person from that same family, but no photographs. Per [13] (section Copyrights, Trademarks, and Patents), “only selected copyrights and trademarks were vested, [but] "all patents of nationals of enemy and enemy-occupied countries" were vested”. Vesting being what this process was called in the WW II era. Hitler's Mein Kampf was among the works which had their copyright vested, along with works by a number of European authors and composers, many of them French or Italian. The claim that "the Office of Alien Property Custodian confiscated German Reich copyrights in the USA" (or rather vested than confiscated) is true for works like Mein Kampf of Friedrich Beilstein's Handbuch der organischen Chemie, but as can be read in the linked article, this certainly does not apply to all German works as implied. Per en:Wikipedia:Non-US copyrights#Wartime copyrights, “Any copyrights that were "ever owned or administered by the Alien Property Custodian" were not restored if the restored copyright would be held by "a government or an instrumentality thereof".” There is no indication that the copyright of these photographs were held by government. And per en:Wikipedia:Non-US copyrights#Germany, “A number of German cases indicate that the copyright in images or graphic works remains with the author, even if the works were produced for official use.[DEauthorship] All of these German copyrights were extended in period to 70 years pma before the date of restoration, and so the US copyrights have been restored.” --Rosenzweig τ 07:36, 13 October 2023 (UTC)[reply]

The source of the image is the Philippine News Agency and it is using {{PD-PhilippinesGov}} as license. The template basically says works by the government are in the public domain unless otherwise noted. The T&C of the news agency is quite explicit:

All contents of this site are protected by Philippines copyright laws under Republic Act No. 8293, known as the Intellectual Property (IP) Code of the Philippines, and may not be reproduced, distributed, altered, published or broadcast for commercial use without prior permission from PNA and its mother unit, the News and Information Bureau (NIB).

That is redistribution, derivatives and comercial use are not allowed, not fulfilling Common's licensing requirements.

 Delete, Philippine News Agency's copyright claims are already troubling enough. See Commons:Deletion requests/File:Jessie Lacuna 2020.jpg. I actually sent two emails to them for clarification about the possible conflict between their TOU and the copyright law (that categorically states all government works have no subsisting copyright) – one in November 2021 and the other in July 2023. Seems to me that this should go to Commons:Volunteer Response Team/Noticeboard, not a DR. It is perfectly possible that the photographer granted a license that includes permission for the subject of the photo to be credited rather than the photographer himself.
