- Keep I have no doubt that Mrs. Mohr irrevocably grants worldwide distribution/exploitation rights etc. to her husband Mr. Mohr. As a non-profit encyclopedia-like platform we are exempt from § 74 Ⅶ → § 18c 2 UrhG (mandatory obligation to obtain permission from the author, i. e. Mrs. Mohr), cf. final sentence of 18c UrhG. The use of {{Own}} is indeed inappropriate though. ‑‑ Kays (T | C) 02:03, 16 January 2023 (UTC)
- Weak keep As an admin, I can confirm that the image that was originally discussed and deleted in May is completely different, so the previous deletion discussion can be disregarded for this case. However, the approach is at least unusual. Per User:FkMohr/Tui, he's uploading images taken by his wife Supakon Mohr, with her permission, and there is a whole category for these images: Category:Files by User:FkMohr/Supakon. In this regard, this image apparently isn't different from the others in the category. I would agre with Kays that there is probably "no doubt that Mrs. Mohr irrevocably grants worldwide distribution/exploitation rights etc. to her husband Mr. Mohr", but maybe a permission sent to VRT (Commons:Support-Team), covering all uploaded works by Mrs. Mohr, would be a good idea to settle the matter once and for all? Gestumblindi (talk) 20:13, 27 January 2023 (UTC)
Deleted: per nomination - While it is likely that the wife has, indeed, granted the permission orally, marriages do break up and we must be sure of her permission. 'We retrieved it from AP, who retrieved it from 'Russian Defense Ministry press service' ' - er... what? If 'Russian Defense blah blah blah' means eng.mil.ru (All content on this site is licensed under Creative Commons Attribution 4.0 - bottom of their page), then it would be an easy Keep, although we should take the photo from them directly, rather than The Times. This is specifically a copyrighted artwork (1) from Oriolo's Felix the Cat Productions Inc. ("Trademark and © Felix the Cat Producions"). Only Pat Sullivan's Version (designed by Otto Messemer, Raoul Barre, or Bill Nolan) from the 1920s to the 1930s is public domain, not Oriolo's version. — Preceding unsigned comment added by Bacromisee (talk • contribs) 22:51, 18 April 2022 (UTC)
- Can you show us them side by side so we can make a determination. We host a dozen images and they all look the same to me. --RAN (talk) 01:05, 19 April 2022 (UTC)
- Starting with the Pat Sullivan Felix, it is a LOT different than the modern one. It has a square body, square head, and square tail, and teeth. It resembles more of a actual cat rather than an anthropomorphic one.
- File:First felix.gif — Preceding unsigned comment added by Bacromisee (talk • contribs) 02:44, 19 April 2022 (UTC)
- File:Felix Cat-Haha (transp sharp).png
- Then, the Otto Messmer/Bill Nolan/whatever has whiskers, stubby legs, body and feet, wide eyes and body, but tiny pupils
- File:Felix VF-31 logo.svg
- File:Felix the Cat, by Raoul Barré.gif
- The modern copyrighted version has longer legs, no whiskers, a pear shape body, larger pupils, and a stubby tail.
- Now do you see the difference? Bacromisee (talk) 02:41, 19 April 2022 (UTC)
- Delete per nomintation. Yes, this is clearly the late 1950s/early 1960s redesigned Felix, not the original 1910s/1920s design. Felix the Cat History. Statement of it being PD assumes it is an earlier design, which it is clearly not. Should be assumed to still be under copyright unless evidence can be shown that *this* particular version of Felix (c. 1960 Joe Oriolo design for Trans Lux) has fallen into public domain for some reason. (Image in currently in use in multiple projects; I suggest before deletion one of images of earlier Felix design be substituted, perhaps File:Felix_Laff_clean.svg or a couple other possibilities in the category.) -- Infrogmation of New Orleans (talk) 15:49, 19 April 2022 (UTC)

This is a user-generated imaginary flag which never was used officialy, thus it has absolutely no historical value. Consequently, this file violates the COM:NOTHOST rule. -- Pofka (talk) 20:57, 19 April 2022 (UTC)
- Keep We are not a government project. Therefore, it does not matter to us whether it is an official flag or an unofficial one. --Лобачев Владимир (talk) 11:50, 20 April 2022 (UTC)
- Keep COM:NOTHOST provides a clear explanation of what is this rule about Wikimedia Commons is not a place to store your vacation photo collection. And historical national flag of Belarusians (be-tarask:Бел-чырвона-белы сьцяг) combined with the one of historical Belarusian emblems (be-tarask:Калюмны) is not the case, since it is realistic and educationally useful. --Kazimier Lachnovič (talk) 14:03, 20 April 2022 (UTC)
- This is not a place to upload user-generated fake flags without any historical significance and usage. It is as important as it would be with Teletubbies instead of the Columns of Gediminas. This flag is completely imaginary, so it clearly violates "all media must be realistically useful for an educational purpose" (COM:NOTHOST). -- Pofka (talk) 17:23, 4 May 2022 (UTC)
- There are many fictional flags on Wikimedia Commons. For example, Lithuanian Battle of Grunwald flag 1410, where the geometry is taken from Teutonic Order unit banners, the Pahonia rider is taken from jagiello's tombstone of 1435, and the colors of the rider are taken from coat of arms of the modern Republic of Lithuania 1991. --Лобачев Владимир (talk) 10:09, 11 May 2022 (UTC)

- Comment I don't understand how a fake national flag could be useful. Could someone please explain? -- Ikan Kekek (talk) 19:28, 23 July 2022 (UTC)
- There is no any "fake" in this flag, because it combines historical national flag of Belarusians (be-tarask:Бел-чырвона-белы сьцяг) with the one of historical Belarusian emblems (be-tarask:Калюмны). For now this image is used by two articles in the Ukrainian Wikipedia, which in my opinion is quite enough to close this request. In any case there are many images uploaded in the Wikimedia Commons for design purposes only, which are not used anywhere and are waiting to be applied. --Kazimier Lachnovič (talk) 20:39, 23 July 2022 (UTC)
- The Russian Wikipedia also uses this image.--Лобачев Владимир (talk) 21:24, 23 July 2022 (UTC)

- Made a version in .svg format: File:Belarusian flag with Columns of Gediminas.svg. --Лобачев Владимир (talk) 13:40, 24 July 2022 (UTC)
- Keep There's zero consensus that "fake" flags shouldn't be hosted on Commons. If the nominator really wants them deleted they should do an RfC about it. Although I doubt it would pass, but whatever. Ignoring the wider consensus by repeatedly nominating flags for deletion is just beating a dead horse at this point though. --Adamant1 (talk) 19:47, 5 August 2022 (UTC)

There's a possible issue with the SVG Ugochimobi (talk) 15:28, 19 April 2022 (UTC)
- The issue was that the SVG contains nothing but an embedded PNG image and the image data was in an "href" attribute, but the SVG renderer requires it to be in an "xlink:href" attribute instead. It's an extremely common problem here in the Wikimedia Commons. TilmannR (talk) 17:37, 19 April 2022 (UTC)

- Delete pictures fall into few categories: A) some appear to be street photos from the 1920s-1940s; B) some appear to be portrait photos from the 1920s-1940s; C) some appear to be works of art displayed either in public or in a museum or in a book, photographred recently; D) some appear to be street photos taken recently. I believe only D can be reasonably licensed as "own work", andt I can hardly see how A, B and C could be tagged this way. The uploader undermined his/her credibility by providing false "own work" tag for A, B and C, which casts doubt also as to the D category. — Preceding unsigned comment added by Hh1718 (talk • contribs) 16:24, 28 June 2022 (UTC)

Deleted: almost all of them, kept only a few. Many of these files show artworks by named artists, and most of them died less than 70 or 80 years ago (these are Spanish works, and Spain has 80 years pma for artists who died before 7 December 1987) or are alive. These files can be restored 70/80 years after the death of the respective author or 120 years after creation with {{PD-old-assumed}} if we have a clear date. Of the photos, many are portraits by named and notable photographers. These are protected for 70/80 years pma because {{PD-Spain-photo}} with a 25 years term of protection only applies to simple photographs, which these are not. (And no, I don't subscribe to the theory that basically every photo is simple with the sole exception of highly artistic ones.) I kept a few pre-1971 photos with {{PD-Spain-photo}} (and assumed {{PD-1996}}). Freedom of panorama didn't really help with all the posters and "street" artwork because either they were clearly not permanently in a public place or it was unclear if they were actually outside. Both are necessary for Spanish FOP to apply.
I've noted those I've kept in the list with kept:, the rest was deleted for the various reasons listed. --Rosenzweig τ 18:31, 15 September 2022 (UTC). --Rosenzweig τ 18:31, 15 September 2022 (UTC)

The file is a scan of a Botswanan newspaper published on 1980-07-14. Per COM:Botswana, collective works last for 50 years after publication, which means that the newspaper itself won't enter local public domain after 2030. The period also certainly exceeds the URAA restoration date of 1996-01-01, which means the file is neither within Botswanan and American public domain. The file is therefore copyrighted, and may be unfree unless permission is given. 廣九直通車 (talk) 07:00, 19 April 2022 (UTC)
- Also listing the cropped image of File:1980, Founding President of Botswana() (cropped).jpg at here.廣九直通車 (talk) 07:01, 19 April 2022 (UTC)
- Keep PD-Botswana is PD after 25 years, while the entire newspaper issue is a collective work, this is one page of one article by one person, and the image is the work of a single person. Text: There is no evidence that more than one person wrote the paragraph of text. Image: I have never seen two people with their finger on a camera shutter at the same time. --RAN (talk) 12:21, 19 April 2022 (UTC)
- @Richard Arthur Norton (1958- ): But as the author and photographer (if not taken from stock photography companies) are affiliated with the newspaper press, it is quite likely that the newspaper press ultimately holds the copyright of the newspaper as published. Therefore the standard for collective copyright (50 years from publication) should be adopted. Moreover, even if the file entered public domain after 25 years (i.e. 1980+25=2005), it still passes the URAA date of 1996-01-01. As a file uploaded in 2017, this violates COM:L#Interaction of US and non-US copyright law (as per what noted on Template:Not-PD-US-URAA), regards.廣九直通車 (talk) 12:43, 20 April 2022 (UTC)
- Except Botswana was not a signatory to the URAA agreement, all signatories had boilerplate text added to their templates years ago explaining the rule. The Commons:precautionary principle explicitly states not to use speculation like "it is quite likely" as a reason for deletion, you must present "significant doubt", you can speculate about any image stored at Commons that several people could have had their finger on the shutter simultaneously, and it represents a collective work, and both people need to release the image under a creative commons license. As to the text, once again, the entire issue is a collective work, not a single paragraph of anonymous text. You can speculate for every book, that the listed author was not the real author, and a ghost-writer was used. We house over 100,000 anonymous text based news articles in which we assume there is one author. --RAN (talk) 17:25, 20 April 2022 (UTC)
- Thank you for your helpful explanation, and I think I misunderstood the meaning of "collective work". Nevertheless I think you erred in the period of copyright protection. Neither the newspaper article nor the image is a work of applied art (defined as "an artistic creation with utilitarian functions or incorporated in a useful article [...]")—see {{PD-Botswana}} and section 2 of the Botswanan Copyright and Neighbouring Rights Act, 2000. For ordinary works, they enter the local public domain after 50 pma. So the article will not enter Botswanan public domain before 2030 (1980+50=2030). The same is for the image, unless there is evidence that it is taken before 1980.
This point is irrelevant to URAA and relates solely to local copyright law, so this should be quite a solid reason for doubting the file's public domain status, regards.廣九直通車 (talk) 06:07, 21 April 2022 (UTC) - Just a sidenote, Botswana is a member of the WTO, so it must have ratified the Marrakesh Agreement (which establishes the WTO and in which relates to the American URAA).廣九直通車 (talk) 06:09, 21 April 2022 (UTC)

Deleted: COM:Botswana is pma + 50 (create + 25 is solely for applied art, which this absolutely is not). Even if the photographer died immediately upon taking the picture, this would not be PD in Botswana until 01.01.2031 (1980+50+1). --Эlcobbola talk 16:48, 22 September 2022 (UTC)
This is a "cropped" foto of a computer screen that has already been published online, at least on March 5. [11]. Here is full foto: [12]. Moreover, the source indicated under this "photo" on Commons says that it was published on March 25. At a minimum, it is required а permission from VRT. Now it is look like foto was just taken from web and cut. It seem to be a type of license laundering Commons:License_laundering. Kursant504 (talk) 08:35, 19 April 2022 (UTC)
- Your source says that the photo comes from Telegram post of the Governor of Sumy Oblast, and it is obviously a frame from a video surveillance camera. Videos of automatic cameras are not copyrightable. Sneeuwschaap (talk) 22:29, 26 April 2022 (UTC)
- So it is mean that it is not free and was published earlier. Even automatic camera has owner and for me is obviously that it's owner has all copyrights to it's videos. If sityation is another - "armyinform" may apply with a letter to VRT and get a special permission from it for this frame. Kursant504 (talk) 01:34, 27 April 2022 (UTC)
- What is "obviously", does not matter here, automatic camera images are regarded as copyright free. Your constant attempts to delete war-related images which don't come from Russian Ministry of Defence with no valid reasons deserve administrators' attention. Sneeuwschaap (talk) 22:13, 4 May 2022 (UTC)
- Even if you will read it:Commons:Copyright_rules_by_subject_matter#Surveillance_camera_footage, you will see that commons does not have an exact position about automatic camera, because judicial precedents are different and have a different outcome. And there are no examples from Ukraine. So I think that this is a copyright infringement. Not to the topic: I will be very happy if it is decided that such videos are not protected by copyright in Ukraine, because then it will be possible to use a huge number of beautiful videos from automatic cameras that record strikes on the territory of Ukraine. But now I didn't think that it is possible. Kursant504 (talk) 10:03, 5 May 2022 (UTC)

- Keep Per Commons:Deletion requests/File:Destruction of Russian tanks by Ukrainian troops in Mariupol (1).jpg, Commons:Deletion requests/File:Destruction of Russian tanks by Ukrainian troops in Mariupol (2).jpg and Commons:Deletion requests/File:Destruction of Russian tanks by Ukrainian troops in Mariupol (4).jpg, the "reasons" provided by Anahoret are irrelevant and invalid.
As said previously, what tank is, be it a T-80 or other soviet era, it is irrelevant, but as you asked it is not an T-64, T-72 or T-90, but an T-80, per wheels configuration, as can be seen in other image of the same original link. The cause of destruction is stated to be made by an en:NLAW. Well, what caused, for certain, was a penetration made by an anti-tank weapon as this image clearly shows some of the pretty well documented fatal flaws of the soviet\russian tanks, like the inexistance of blast doors and blow-out panels between the tank ammo and the crew compartments, the problems with the autoloaders and ammo carousels that, when a tank is penetrated, makes the ammo to cook of, the turret to fly far from the chassis and the tank armour bursting like a ballon (as this image show the tank ripped apart and the armour twisted from the inside out).
Also, again we have Kursant504, uploader of putinist propagand imagery from the russian MOD all about this putinist war of agressions, as can be seen by his uploads and frequent deletion requester of images of putinist crimes like the Massacre of Bucha and others under clearly wrong and untrue reasons, tries again to delete images taken and uploaded by the ukranian state organizations, under the cover of "concerns" with unexisting copyright violations, with the same modus operandi.
He nows argues that an image being taken by an ukrainian servicemen during his official dutties (an soldier in active war zone and under martial law is always discharging his official duties) and them this images being published by the official pages of the Armed Forces of Ukraine "It is mean nothing. If you want to say that since the photo was taken by a serviceman, the Ministry of Defense of Ukraine has the right to dispose of these materials, then you are wrong. That's not how it works. ". Really? In what you base your assumptions? In what ukrainian law, regulation or statute you base your bold claims???
Them why the contradiction with your vivid assertions to the contrary, about image uploaded by you, where is the case of an image taken by a soviet military photograph during WW2 and the same image being published by the Russia Ministry of Defense website, you said that "The photographer was a war correspondent of the "Krasnaya Zvezda" newspaper and serves in the Soviet army. Taking these photos was his job, his duties in military service. And the results of his work belong to the Soviet army (as a newspaper owner) and now to its legal successor - the Ministry of Defense of Russia (as the current owner of the newspaper). 1) Why Mil.ru can't use them as they want?". So when is the Russian MOD it can dispose of the copyright of soviet military photos, but the Ukrainian Armed Forces cannot dispose of the photos taken by the servicemen of Ukrainian Armed Forces during their active duty? What a flagrant contradiction you have here.
The Facebook link you mention if from the Facebook "Official page of the 93rd separate mechanized brigade "Cold Yar" of the Operational Command "East" of the Land Forces of the Armed Forces of Ukraine", fact that you conveniently "forgot" to mention that it is a official page of an active unit of the Armed Forces of Ukraine. You also forgot, in the links that you provided, to mention that the same images where published by the Facebook official page of the General Staff of the Armed Forces of Ukraine·
You also, conviniently, forgot to mention that the image clearly was sourced from the official website of the Inform agency of the Ministry of Defence of Ukraine ArmyInform, where it is clearly stated that "© 2022, Інформаційне агентство АрміяInform Матеріали на сайті розміщені на умовах ліцензії Creative Commons Attribution 4.0 International, якщо не вказано іншого." or "© 2022, ArmyInform News Agency The materials on the site are posted under the terms of the Creative Commons Attribution 4.0 International license, unless otherwise stated."
So you have that clearly say that this image was taken\released by the Ukranian Armed Forces, so there is clear provenance and authorship. Any similar arguments and zero solid proofs, as in other deletion requests, by the deletion requester are merely attempts to hide images of the putinist Z agression and how the dream of a quick, unopposed and triumphant victory were defeated. Tm (talk) 02:22, 27 April 2022 (UTC)
