Again I am asking to delete the picture and / or put the one I downloaded. It is a bad picture. How long can it take ? I've been discussing about it with the french administrators for 2 weeks. Please delete the picture.

  • Taking a quick look at this image and comparing with File:T.Schaffauser.jpg shows this image is higher resolution, shows the subject's whole face and appears to be of him speaking publicly. I actually rather like the photo it is intimate and shows him speaking with some passion as a gay activist, he actually looks like quite a nice attractive Croydon lad in this shot to my eyes, so I find it hard to accept that this is unacceptably bad to be of potential educational use, or that this is intrusive or misrepresents the subject. Unless there are other reasons presented, such as objections by Schaffauser himself that may warrant a courtesy deletion, I would stick to  Keep. I'm afraid that French Wikipedia admins have no special authority for this project, though a few have trusted roles here too. If there is a reason you would like to raise non-publicly for deleting this photo, please do email in to permissions-commons@wikimedia.org and an OTRS volunteer like myself can discuss this with you off-line. -- (talk) 12:16, 31 December 2013 (UTC)[reply]
    Hi (and happy new year!): I'm the french admin (sorry for my english) who talked with ‎the user FeeStival and I want to add that I only said him to do a deletion request on Commons (because he wanted to delete the picture on the article on fr.wikipedia). As the user who uploaded this photograph, I would very strongly support , and  Keep. I cannot accept it is "a very bad picture", and consider that it is better than the new one for illustrating what the subject looks like. But there is surely no problem in keeping both pictures on Wikimedia Commons: many subjects are illustrated by several images giving different views of the subject. Perhaps User:FeeStival is confusing Wikimedia Commons with the French Wikipedia! --Ross Burgess (talk) 16:59, 31 December 2013 (UTC)[reply]

  • Keep Although nominating this case I am in opposition. I made the nominated because the question of status of WWI memorials in France remains rather ambiguous in terms of copyright status. It would appear this monument is subject to French FOP but the clear intent of this monument, it being on both land donated to the Commonwealth War Graves Commission by France, is that Crown copyright would apply. There are no shortage of publications in France that have employed the image of this memorial so I see a pure FOP claim in this case as suspect.   • Keep. Thanks to Labattblueboy for notifying me of this discussion. I took part in one of the earlier discussions relating to the Vimy memorial images. I feared back then that issues would keep cropping up with these WWI memorial images in France (does Belgium have similar FOP rules or is that different). Anyway, there are some people who know far more about French law than I do, and I've asked if they will comment here. What I want to add is something about the history. The memorials were mostly erected between 1923 and 1938 by the Imperial War Graves Commission, an organisation established by Imperial Charter in 1917. They directly employed architects and sculptors to work on the cemeteries and memorials, so they are presumably works-for-hire if that makes any difference. In all cases it has been 70+ years since the memorials were erected, but in many cases not 70+ years since the architects and sculptors died (but close to 70 years in some cases - I really hope we won't get situations where images will be deleted and then undeleted a few years later providing anyone remembers to request undeletion). The other aspect of the history is the granting of the land in perpetuity. This was explicitly done under French laws which it is possible to go and read. Rather than compare this to arguments made previously about embassy lands, I think the situation here is different. I hope this can be resolved sensibly, as I don't think any of those who created these memorials would have dreamed that theoretical arguments over copyright would take place as is happening here. Put to one side for a moment the legalistic arguments, and think for a moment about why they were creating the memorials and what was and is still being commemorated, in perpetuity.     • Noting here that the commissioning authority would have been the Imperial War Graves Commission (as it was then known) - India was then the British Raj and a personal possession of the crown and treated differently to the independent Dominions (South Africa, Canada, Australia, New Zealand and Newfoundland). As far as the relationship between the Commission and France goes, it is important to realise that the Commission had (and as far as I know still has) a special place in French law as the authority that deals with its cemeteries and memorials - the technical term, as used in French law, is 'regularly constituted authority'. This was established by a French law (the land expropriation bill) that passed the chambers of the French government and became law on 29 December 1915. It was introduced into the Chamber of Deputies by Millerand, the French Minister for War. One of the decrees provided for a sepulture perpetuelle. The language used by the politicians speaking in its favour included exhortations for France to "adopt as her child and to honour ... every soldier who has fallen on her soil for justice and the freedom of the nations" - quoted from p.12 of The Unending Vigil (Longworth, 1967). Now, that is clearly emotionally laden language, used in the midst of the war, but it does indicate the spirit in which the land was granted, and if that spirit is still alive today then I doubt there is any risk of a challenge (whether under freedom of panorama or other considerations) to photographs of war memorials in France. Deleted: Several comments. First, the special ownership of the land is not relevant. Even embassies are subject to local law in copyright matters -- we have a solid opinion on that. I can't image that this memorial has a higher status than an embassy. Second, while the memorial may be the property of the UK government, that does not change its copyright status. It is possible -- unlikely, but still possible -- that the UK government owns the copyright. If so, it could release it into PD worldwide, but absent knowing that that was the case, we must assume that the sculptor or his heirs own the copyright. .     Jim . . . .   • Keep - having read up on all this a bit more, I think there is a very good chance that all war memorials in France (and Belgium) are actually in the public domain (though I have seen other opinions that they are 'unpublished'). Some serious effort should be put into establishing whether that is the case or not. It would be good to get clarification on a per country basis on whether war memorials are a special case or not. I do also have a question that I hope some of the regulars at Commons will be able to answer. In this case, the life of author + 70 years terms ends on 9 September 2015. Deleted: Paul Cret was working in the US from 1907. It is very unusual for a US commission for works of art to transfer copyright to the government. It is very unlikely that the copyright is not held by Cret's heirs -- certainly way beyond our standard of "significant doubt". I see no reason why a war memorial should be a special case -- there is no extraterritoriality for copyright. Even if there were, US law also does not have FOP for this. This will be PD on 1/1/2016 (note that in almost all countries the 70 years is counted from the January 1 following the death of the creator. .     Jim . . . . The amateur offensive caricature of emeritus Pope Benedict as a Nazi is neither kind nor notable. My understanding of that close is that it was explained as "sexual harassment of an editor". So while it's an utterly terrible decision, my interpretation of it is going to stick to what it actually says - namely, that if ex-Pope Benedict doesn't like this picture, he's going to have to sit his ass down at a terminal and sign up for a free account first and THEN the morality enforcers can complain about how we're harassing him by allowing a copy of this. I know of a good reason why the Pope would be treated with less courtesy than Jimmy Wales...Jimmy has actually touched the hand of God, whereas the Pope is merely our makers earthly representative.   • This statue was erected in 1998 and the sculptor/designer is still living. Is it acceptable to contact them in cases like this and ask what the situation is as regards photographic rights? I did that once several years ago and it can get awkward to explain how Commons works. Most living artists, understandably, want to retain some degree of control over reuse of depictions of their artistic creations, and that tends to mean use on Commons is not permitted unless they explicitly allow it. Both images cite the same source (http://malacanang.gov.ph/presidents/fifth-republic/benigno-aquino-iii/) and neither claims any sort of retouching by commons editors. The image I see displayed there matches this nominated image rather than the proposed replacement, and I don't see links to any alternative or collections of images. Is there something I'm missing? There was no retouching done by commons users (afaik). I think File:PNoy Official Portrait 11x13.75.jpg is the original image and this one is a cropped version uploaded on the government website.   •  Comment one could argue that creating and filling out this form doesn't require much creativity, so it might be below the TOO ({{PD-Scan|PD-ineligible}}). Apart from that, there appears to be a personality rights issue: This is a "note to the file" that someone has been accused of bilking (leo says that's the word for Zechprellerei, meaning not paying the bill at a pub or restaurant) and the police has filed charges.
