Files from Ticket #2024052210003759

All those files have to be restored, as there's no copyright involved (old architecture) or it's no "art" (eg organ console). The deleting admin "krd" knew that, as I had wrote him (besides that everyone can see that at one glance). The permission itself by the author is there since weeks. --Subbass1 (talk) 07:11, 24 June 2024 (UTC)

Apparently no permission was confirmed within one month after it was received, hence the deletion (which is quasi-automatic after that time). This looks like there was a problem with the permission. Someone with access to Ticket:2024052210003759 might want to have a look. --Rosenzweig τ 13:32, 24 June 2024 (UTC)
could someone finally take care of this? Thanks, --Subbass1 (talk) 16:35, 28 June 2024 (UTC)
I think, COM:VRTN is a better venue to resolve VRT permission related problems. VRT volunteers are unlikely to read this page. Ankry (talk) 10:12, 1 July 2024 (UTC)
I also did that weeks ago:
https://commons.wikimedia.org/wiki/Commons:Volunteer_Response_Team/Noticeboard#ticket:2024052210003759_2 --Subbass1 (talk) 10:30, 1 July 2024 (UTC)

Not done: per the answers at the VRT noticeboard, there are apparently still some VRT problems here, and right now apparently no VRT volunteer is working on it. Without a VRT permission, those files won't be undeleted. If and when the VRT problems are sorted and a suitable permission is accepted, the VRT volunteer should request the undeletion of the files. --Rosenzweig τ 11:51, 3 July 2024 (UTC)

Oppose There has never been a file with the name above on Commons. You have no deleted files, so I cannot see the file with the problem. Please correct the file name or tell us who uploaded it.

The description you give tells me that in order to restore the file to Commons, the actual holder of the copyright for the screen must send a free license using VRT. This would be the camera operator or, if the operator was employed under a work for hire agreement, the event organizer who hired the camera operator. .     Jim . . . Template:PD-Italy

<<The country of origin of this photograph is Italy. It is in the public domain there because its copyright term has expired. According to Law for the Protection of Copyright and Neighbouring Rights n.633, 22 April 1941 and later revisions, images of people or of aspects, elements and facts of natural or social life, obtained with photographic process or with an analogue one, including reproductions of figurative art and film frames of film stocks (Art. 87) are protected for a period of 20 years from creation (Art. 92). This provision shall not apply to photographs of writings, documents, business papers, material objects, technical drawings and similar products (Art. 87). Italian law makes an important distinction between "works of photographic art" and "simple photographs" (Art. 2, § 7). Photographs that are "intellectual work with creative characteristics" are protected for 70 years after the author's death (Art. 32 bis), whereas simple photographs are protected for a period of 20 years from creation.>> Cats' photos (talk) 16:03, 3 July 2024 (UTC)
Oppose They were taken after the United States entered the Berne Convention, so they are still copyrighted there. Günther Frager (talk) 16:09, 3 July 2024 (UTC)
According to Berne Convention:
<<It shall be a matter for legislation in the countries of the Union to determine the term of protection of photographic works and that of works of applied art in so far as they are protected as artistic works; however, this term shall last at least until the end of a period of twenty-five years from the making of such a work.>>

So, the status of copyrighted photo cannot be derived by being published in 1996. The photo has public domain status in front of both international and Italian law.

If the photo is from after 1989, simultaneous publication in the U.S. would not change anything. The U.S. term would be 70pma, or 95 years from publication if anonymous or a work for hire. Sziasztok,

Szeretném a segítségeteket kérni, feltöltöttem ma a Kisscsi profilommal az alábbi fotót - https://commons.wikimedia.org/wiki/File:Haraszti_Péter_portré.jpg

A kép nem licenszhez kötött, a fotós Stiglincz Gábor hivatásos fotós, aki átadta ügynökségünknek a képeket. A teljes méretű fájl nálunk van, megvásároltuk a használatát. Szeretnénk segítséget kérni, hogyan tudjuk az engedélyt megkapni. A fotós Stiglincz Gábor már feltöltötte a képet a honlapjára a referencia fotók közé, szeretnénk beállítani a képnek CC-BY-SA-4.0 licencű kép státuszt, mint engedéllyel felhastznált mű.

Köszönöm előre is, Dóri — Preceding unsigned comment added by Kisscsi (talk • contribs) 10:14, 4 July 2024‎ (UTC)

Hi everyone, I'm writing here in order to ask for the undeletion of File:Palazzo di Governo.jpg, deleted after this DR in 2013. The image should depict the Government's Palace of Taranto. As already explained in this DR last year, the building was commissioned by the Province of Taranto to en:Armando Brasini (for details see here). The construction of the building was completed in 1934, therefore the palace fell under Template:PD-ItalyGov in 1955. It's a building built way before 1990, so no issue with US copyright.--Friniate (talk) 10:29, 4 July 2024 (UTC)

This is China, not Japan, in China this character no copyright-protected, see: COM:FOP China メイド理世 (talk) 06:28, 5 July 2024 (UTC)

Also, Chinese Animation is copyright-protected. メイド理世 (talk) 06:34, 5 July 2024 (UTC)
you can add {{FoP-China}}. メイド理世 (talk) 06:41, 5 July 2024 (UTC)
Leaning to  Oppose @メイド理世, this may be identical to the issue at the VPC, COM:VPC#Belgian FOP and heavy retouching, in which D. Benjamin Miller argued that in terms of cases like a comic/cartoon/animated character from a country with no FoP for artworks (France and Japan for example) is "displayed in public" in a country with complete FoP (like Belgium or China), using the test as provided by the U.S. Copyright Office, the country where the work has the most association is the source country. The source country of w:en:Bocchi the Rock! is Japan: the comic's first run (2017) was in Japan, and its first publisher is a Japanese firm in Tokyo, so the restrictive Japanese FoP law – not OK for Commons – applies, not the user-friendly Chinese FoP, even if the work is publicly exposed in China as a public artwork. A derivative work of a copyrighted character originating from Japan, not China. JWilz12345 (Talk|Contrib's.) 06:45, 5 July 2024 (UTC)
See also COM:VPC#Copyrighted characters from no-FoP states displayed as murals et cetera in yes-FoP states. JWilz12345 (Talk|Contrib's.) 06:56, 5 July 2024 (UTC)
Strong oppose, to begin with, I cannot understand your English. This is a character from Japanese Animation, not Chinese one. And saying someone in China is not copyright-protected is just like you took a photo of micky mouse in China, and said to Disney "Look, they are not protected". Are you sure this is right??
Also @JWilz12345, your opinion is right. Lemonaka (talk) 08:48, 5 July 2024 (UTC)
@Lemonaka it is not my opinion per se. I applied the opinion from D. Benjamin Miller regarding a similar case concerning a Belgian mural that shows copyrighted French characters. See the linked discussions. JWilz12345 (Talk|Contrib's.) 09:02, 5 July 2024 (UTC)
China doesn't have a FOP for 2D-artwork... Lemonaka (talk) 09:03, 5 July 2024 (UTC)

Oppose Aside from the fact that as a practical matter Chinese case law does not allow FoP for 2D works, if it could be shown that the display was done with the consent of the copyright holder then I think we could keep it. However, this fails on both counts. .     Jim . . . (Jameslwoodward) (talk to me) 13:35, 5 July 2024 (UTC)

Please undelete this file. It is my own work, I uploaded it myself and released it under cc-zero. I indicated it as such during the upload. I then got a notification that license info was missing so I indicated the same again. But apparently that was still not enough because the file was deleted. I don't know what I did wrong. Please make this system more user friendly. I'm quite IT savvy (I work in IT support) but apparently could not figure out how to do it properly. Mx.Alba (talk) 19:52, 6 July 2024 (UTC)

Support Files with a proper license can not be speedy deleted for not having a license. Thuresson (talk) 21:29, 6 July 2024 (UTC)
The file was not speedy deleted. It was tagged with no permission and deleted after a week. @Iwaqarhashmi: what was your rationale to tag that file?. Günther Frager (talk) 21:34, 6 July 2024 (UTC)
Tagged it because no permission from the person in the photo. Best, Waqar💬 06:41, 7 July 2024 (UTC)
Is that even necessary in a public situation? Do all portraits on Commons have a formal declaration by the person on the photo? Laurier (talk) 07:42, 7 July 2024 (UTC) - PS: this permission is NOT necessary in The Netherlands, see Commons:Country specific consent requirements and Commons:Country specific consent requirements#Netherlands. Laurier (talk) 08:43, 7 July 2024 (UTC)
Okay so how does one indicate permission from the person in the photo? Why was I notified of "no license info" while that was not the reason for deletion?
I am a personal acquaintance of the person in the photo. She asked me to use this photo on her Wikipedia page. Mx.Alba (talk) 08:08, 7 July 2024 (UTC)
It looks like the file was restored... Thanks! Could I still get answers to my questions, though?
1) I uploaded the file using the guided process, indicating that it was my own work and that I released it under cc-zero. Was this or was this not the correct process to follow? If not, what other process should I have followed?
2) @Iwaqarhashmi tagged the file for deletion, citing "missing license info", which came with an explainer on how to add proper license info, for example that it is an own work and released under cc-zero license. This confused me, because that was exactly what I had done. I edited the file's metadata to specify yet again that it is own work and released under cc-zero, and asked Waqar for pointers, but they did not respond to me, so I presumed that everything was now in order. Did Waqar use the correct process to tag the file for deletion? If not, what should they have done? Did I respond correctly to the file being tagged for deletion? If not, what should I have done differently?
3) I was surprised by the fact that the file was then deleted anyway, and even more surprised when Waqar disclosed in this discussion that they marked the file for deletion because of "no permission from the person in the photo". Until that point, I had not seen any indication that that could have been an issue, nor did I see any obvious way to indicate such consent, otherwise I would have of course specified that I am a personal acquaintance of the person in the photo and that she had asked me to upload this photo onto her Wikipedia page[1]. Was there a way for me to indicate the object's consent? If so, how?

This file and some others that I uploaded years ago with the regular PD Italy license were deleted. I am truly shocked because there are thousands of files with this license on Commons and I do not understand why after several years a user, who has been registered on Wikipedia for only a year, has proceeded with a mass deletion. --Kasper2006 (talk) 22:24, 6 July 2024 (UTC)

Oppose I tagged the file for speedy deletion. The rationale is simple. The photo was created in 1990. That is, a year after the US entered in the Berne Convention, an agreement to grant automatically copyright to works published in member states. That means that a photo published in Italy is automatically copyrighted in the US. The copyright protection in Italy for simple photos is 20 years, while in the US is 70 years pma. As the US doesn't apply the shorter term rule, this photo is still copyrighted. The image fails with the requirement of our licensing policy that requires images to be in the public domain of its country of origin (Italy here) and the United States. Using {{PD-Italy}} ensure that the image satisfy the first requirement, but not the second one. The image also had the template {{Not-PD-US-URAA}}, but it has two problems (1) it can only be used in files uploaded before March 1, 2012 (2) It should have its US copyright restored by URAA. Both criteria are not met because the file was uploaded in 2021 and its copyright was not restored by URAA. The latter is simply because it was always copyrighted in the US due to Berne Convention. All in all, any photo created in Italy after March 1, 1989 requires a free license from the copyright holder. I have already explained it in their talk page. Günther Frager (talk) 22:51, 6 July 2024 (UTC)
Ok, now it's clear. Sorry, but I was told that adding {{Not-PD-US-URAA}} to {{PD-Italia}} made it OK to upload to Commons. Everything seemed to be fine for years and years, then you came along and found a bug. Allow me a little ironic comment, from today the world will be a safer place --Kasper2006 (talk) 06:55, 7 July 2024 (UTC)

Images of the interior of Firenze Santa Maria Novella railway station

Hi everyone. I'm writing here in order to ask for the undeletion of

All these images depict the interiors of Firenze Santa Maria Novella railway station, and have been deleted after this DR in 2013. The complete renovation of en:Firenze Santa Maria Novella railway station was designed by a group of architects guided by en:Giovanni Michelucci, who won a public call for bids made by the Ministry for Communications (see here). The renovation of the building ended in 1935. Therefore, the work fell under Template:PD-ItalyGov in 1956, way before 1990, so no issue with US copyright. The copyright warning in the category should be removed accordingly.--Friniate (talk) 11:10, 7 July 2024 (UTC)

[2] If you look at the very bottom, it states that although it is in Korean, secondary processing is possible, and logo cropping requires that you leave the source. YeBoy371 (talk) 15:07, 7 July 2024 (UTC)

{{O}} I do not think that the comment in Korean can be considered a valid license by the actual copyright holder. Also, there is nothing about commercial reuse there while commercial reuse should be permitted explicitly. Ankry (talk) 17:19, 7 July 2024 (UTC)

(I am a foreigner who is weak in English, so I used a translator, so some grammar may be wrong.) YeBoy371 (talk) 01:01, 8 July 2024 (UTC)

Oppose The site given above is not the named source, http://www.xn--4k0b046bfra.com/328, which does not open. The site above has a CC-BY icon all by itself in the lower right but also an explicit copyright notice, including All Rights Reserved at the bottom. Since it is not at all clear what the CC-BY icon applies to, I think we must apply COM:PCP. .     Jim . . . (Jameslwoodward) (talk to me) 14:04, 8 July 2024 (UTC)

A copyright notice and "All Rights Reserved" mean nothing other than copyright exists -- does not preclude, nor is inconsistent with, a CC license. They are often boilerplate in website design templates. The license appears associated with the post itself, as it's in the same line as the comments button. Similar for other photos posts on that site. The watermarks in the images appear to be the same as the site header, so it would seem they were published for that site. The archived version of the original source is the exact same web design, and same post with the same license, so it may have just been a renamed website or something like that. I think I'd have to go  Keep with the CC-BY license applying to the photos but not the site. Carl Lindberg (talk) 11:47, 9 July 2024 (UTC)

A File:Grammar_Nazi_Icon.svg are used in articles in several projects: cs.wiki, ru.wiki, ru.wikinews, uk.wiki and wikidata. Another file is used on many userpages, including enwiki's, as userbox, and, for example, on ukwiki's wikiproject "Literacy". See discussion on initial page, its talk page and admin's talk page. I'll repeat: "hate symbol" just isn't a reason to delete images, Commons contains and should contain megatons of files containing hate symbols, from Nazi propaganda to Russian military "Z" symbol, to reflect and document the reality around us. MBH 13:07, 10 July 2024 (UTC)

Support I can't see a reason to delete. Maybe rename, if we don't want to use the term "grammar Nazi", but not delete. en: Grammar Nazi is the article title on en-wiki, but Commons could perhaps use a more neutral term. But deleting something over the name should never happen, and clearly the concept itself is in scope, and if people want to label themselves that way in a user box, fine. Carl Lindberg (talk) 14:40, 10 July 2024 (UTC)

✓ Done: The requestor is correct that this was in use, and so I have restored. Added nazi symbol disclaimer since this is clearly derived from the Nazi Germany flag. As someone with a Jewish ancestor, and who has Polish ancestry, I find this completely reprehensible as a work, but I won't overrule Wikipedias on this matter. --Abzeronow (talk) 16:48, 11 July 2024 (UTC)

Images of the Heating plant and main controls cabin in Florence

Hi everyone. I'm writing here on order to ask for the undeletion of the following images:

All these images were deleted after this DR in 2013. They all depict the en:Heating plant and main controls cabin, Florence, a building designed by en:Angiolo Mazzoni. As I've already pointed out in four previous UDRs (see here, here, here and here) Mazzoni at that time worked as an engineer at the Ministry for Communication, and in this capacity he designed a lot of railway and post office-related buildings, as this one, a technical facility for the en: Firenze Santa Maria Novella railway station (see here for more informations). It's therefore a work for hire according the italian law (it'd be so even according the US law), since it was commissioned and paid by the public administration. The building was finished in 1934. Therefore, it fell under Template:PD-ItalyGov in 1955. It's a building built before 1990, so no issue with US copyright.--Friniate (talk) 16:19, 10 July 2024 (UTC)

The file Gyro is a mouse.gif‬ was unjustly deleted due to a misunderstanding of the source of that gif. I recorded this gif myself, to use on a YouTube video, here. later I made a text version of the video on Reddit (here) where I used the original recordings and editing to create gifs for the text version.

The user HilariousCow on X (previously known as Twitter), saved one of my gifs and posted it on his account (here). At the time he even credited me and my work, here. After talking to him about the deletion request, he promptly reiterated that this gif was mine: here.

and I still have the original unedited recording on my hard drive.

  • The subject seems to be a manuscript, not a printed book, so I do not think it can be considered published. However, it can be considered {{PD-old-assumed}} per above. I see no rationale to use {{PD-Japan-organization}}: is there anything here that has been published prior to 1967? Images of Palazzo Minerva

Hi everyone. I'm writing here in order to ask for the undeletion of two images:

They both depict Palazzo Minerva, a building in en:Minerbio, at that time seat of the local fascist party, and now movie theater and theater. They were both deleted after this DR in 2015. As it can be read here, the project of the building was commissioned to the architect Gian Luigi Giordani by the local podestà (the mayor), and its construction was paid by the municipality and the local fascist party (it's uninimportant for us since the copyright law considers the fascist party as if it was part of the public administration). The original construction was finished in 1934. Therefore, the building fell into Template:PD-ItalyGov in 1955. It was built way before 1990 so no issue with US copyright. The copyright warning that is now present in Category:Palazzo Minerva, già Casa del Fascio (Minerbio) should be removed accordingly.--Friniate (talk) 21:46, 16 July 2024 (UTC)

I am writing to request the undeletion of the file "File:Statue of King Sejong (4273003660).jpg" on the following grounds:

  • Implicit Permission for This Specific Derivative Work: The South Korean government owns both the statue[1][2][3] and photograph. By releasing the photograph of the statue under the CC BY-SA 2.0 license, it has granted implicit permission to itself for this specific derivative work (the photograph). This permission covers the commercial use of this particular image, not necessarily the statue in general.
  • Explicit License of the Photograph: The CC BY-SA 2.0 license explicitly allows for commercial use of the photograph. Since the government controls both the statue and the photograph, the release of the photograph under this license implies consent for its commercial use, specifically for this image.
  • Redundancy of FoP Argument: Given that the government has the authority to license both the photograph and the statue, and has chosen to do so for this specific image, the need for Freedom of Panorama provisions is sidestepped. The implicit permissions granted for this derivative work should suffice to meet Wikimedia Commons’ licensing requirements.

In light that FoP was the original grounds for deletion, which does not apply when a specific derivative license has been obtained, I respectfully request the undeletion of the file "File:Statue of King Sejong (4273003660).jpg" The permissions implied by the South Korean government for this specific photograph should allow for its inclusion on Wikimedia Commons under the specified license. It is one of the few photos released by the government that has the commercial use provision.

Many thanks,

--Nonabelian (talk) 21:48, 2 July 2024 (UTC)

Can't access the third article, but from the reading of the two articles by Korea Times, these talk about the government building the statue. There is no mention of anything that states the sculptor has waived his copyright on the sculpture. Though I will ping to Korean-speaking users here for added comments @Explicit and Ox1997cow: . JWilz12345 (Talk|Contrib's.) 00:49, 3 July 2024 (UTC)
@Nonabelian you must provide a proof that a contract existed between the government and the sculptor that mandated the latter to waive all of his copyrights. Article 24-2(1) of the copyright law states (with emphasis): A work produced as part of official duties and already made public by the State or a local government, or a work of which the author's economic right is owned in its entirety by the State or a local government under a contract, may be used without permission. It is the uploader's responsibility (per COM:EVIDENCE) to provide a copy of such contract; in this case, between the government and the sculptor. JWilz12345 ('|Contrib's.) 02:14, 3 July 2024 (UTC)
@JWilz12345. Thanks for responding. The sculptor is Kim Young-won[4] and has explicitly transferred the copyright of the King Sejong statue to the Seoul Metropolitan Government.[5] This transfer includes all rights to control the reproduction and commercial use of the statue. The transfer contract is documented by local news sources and the current licensing agency.[6][7] I hope this helps. Nonabelian (talk) 06:58, 3 July 2024 (UTC)
@Nonabelian there's a problem. The public monument does not appear to be in public domain, even under government ownership. In the fifth source you presented, a part states (translated to English): "The city announced on the 4th that it had decided to entrust the management of the copyrights of the two statues to the Korea Database Agency (KDB), an organization under the Ministry of Culture, Sports and Tourism. Accordingly, in the future, if you wish to use the two statues for commercial purposes or to take pictures of works for sale, you must consult with KDB and obtain permission to use them. There are no restrictions on personal commemorative photos.
More parts of the article explain the rationale of having the need to secure permission for commercial uses of the images of the public monument: donation of the proceeds collected from the users. In effect, I doubt it is "legally safe" to restore images of this copyrighted public monument, at least this Flickr import from KOREA.NET Flickr page, allegedly the "official page of the Republic of Korea". Are the administrators behind KOREA.NET Flickr uploader the same as the people within the current copyright holder, the Korea Database Agency (KDB), or the Ministry of Culture, Sports and Tourism? Did KOREA.NET had the legal licensing authorization from KDB or the ministry? The sources you provided are convincing but opened more questions.
It has been normal for many freely-licensed Korean government images to incorporate copyrighted buildings and monuments, to the extent contradicting with the original licensing contracts and with their very own copyright law itself that prohibits commercial uses of their public monuments under copyright protection. JWilz12345 (Talk|Contrib's.) 07:16, 3 July 2024 (UTC)
@JWilz12345 Thanks once more for continuing to look at this. The Flickr account, KOREA.NET, is run by the Korean Culture and Information Service (KOCIS) of the Ministry of Culture, Sports and Tourism.[8][9] Similarly, as you point out, the Korea Database Agency (KDB) is also an organization under the Ministry of Culture, Sports and Tourism.[5] i.e. both the specific derivative photo and the licensing of the statue in general are run by the same branch of the Korean government. I hope this will suffice to show there is no issue with this particular photo. Nonabelian (talk) 08:06, 3 July 2024 (UTC)
@Nonabelian as you said, KDB is under the Ministry of Culture. But similarly, KOREA.NET is under KOCIS of the same ministry. It seems both KDB and KOCIS are different "sub-agencies" or branches under the ministry, yet sources claim the sole licensing holder for the monument is KDB. Does the licensing right of KDB extends to KOCIS? JWilz12345 (Talk|Contrib's.) 09:11, 3 July 2024 (UTC)
@JWilz12345: I believe it does, yes. Licensing was managed by KDB via their 'Public Copyright Creative Resource Project' (ALRIGHT) system.[10] However, in 2013 the 'Public Copyright Creative Resource Project' was transferred from the KDB (of the Ministry of Culture, Sports and Tourism) to the Korea Culture Information Service Agency (of the Ministry of Culture, Sports and Tourism). Consequently, the public copyright trust management services previously provided by KDB were terminated.[11] I don't think this should matter however: the Ministry of Culture, Sports and Tourism, which controls all of the departments we are talking about here, looks to have special privileges for issuing licenses for public copyrighted works under Article 2-2 and 105 of the Copyright Act. This alignment of government departments, ministries and statute indicates consistency in the authorization process. If the Ministry of Culture, Sports and Tourism issues a photo under CC BY-SA 2.0 of a statue for which it also manages the copyright for, it is legally permissible to use. Nonabelian (talk) 14:31, 3 July 2024 (UTC)
@Nonabelian there is one more problem here. The KOCIS image was uploaded to Flickr in 2010, during the time when KDB was the sole copyright license holder. The copyright license holder-ship was transferred to the Ministry itself three years later. Is the licensing by KOCIS valid, even if they were not the license holder way back in 2010 (upload date), just because of being a sister "sub-agency" of the Ministry?
And final question, will that free license from KOCIS be honored in Korean and U.S. courts? Suppose a U.S. user manufactured T-shirts bearing prints of the monument, using this Flickr import as the basis. Then the Ministry files a complaint in a U.S. court, claiming they used the monument without licensing permission; the re-user claims they used this Flickr image under a commercial CC license. As per {{Not-free-US-FOP}}, in most cases only sculptural monuments from countries with valid, commercial FoP can be hosted here, but this warning tag is highly-encouraged as the U.S. does not provide any FoP for such works, and U.S. courts may lean to U.S. laws instead of Korean or other foreign laws for decisions concerning sculptural monuments. It is more of a legal risk if the country does not provide commercial FoP in the first place. JWilz12345 (Talk|Contrib's.) 22:29, 3 July 2024 (UTC)
@JWilz12345: I appreciate you being willing to volunteer more time on this request. Here are my current thoughts on the points you’ve raised, which I hope adequately address any remaining concerns.

Timeline

  • January 14, 2010: The Flickr photo was uploaded by the Korean Culture and Information Service (KOCIS), under the Ministry of Culture, Sports and Tourism (MCST), and initially licensed under CC BY-NC-ND 2.0 (viewable on the license history on Flickr). This is a non-commercial license consistent with Article 35 of the Copyright Act.
  • May 26, 2011: The Seoul Metropolitan Government acquired full copyright interest in the statue, with the original sculptor waiving his rights.[7] Photos can now be freely licensed as per Article 24-2 of the Copyright Act, covering public works and has no commercial use restrictions.
  • December 4, 2011: The statue was registered with the Korean Copyright Commission, transferring copyright management to the Korea Database Agency (KDB) also under the MCST[5][6][7] per Article 105. Given this, Article 24-2 §1.4 applies, now restricting free images without permission, but §3 still allows state/local governments to continue to license images freely for any necessary purposes, ensuring continuity for the Flickr photo.
  • July 1, 2013: Copyright duties for public works were transferred from KDB to another department of MCST, under Article 105.[11] MCST's statutory authority under Article 2-2 ensures it is entitled to do this.
  • March 20, 2014: KOCIS of the MCST changed the Flickr photo's license to CC BY-SA 2.0, a free license that allows commercial use, as it is entitled to do so under Article 24-2 §3. This would be consistent with its stated aim to promote Korea to the widest possible foreign audience (Article 24-2 §2).

As previously noted, I don’t believe the specifics of the departments within MCST are crucial. MCST’s overarching statutory authority has ensured a consistent and legally sound licensing continuity. In any case, state and local government branches have the statutory authority to issue a free photo of a copyrighted public work as per Article 24-2 §3.

Potential Future Disputes

Now let’s turn our attention to your example of the US-based T-Shirt manufacturer who prints the photo for sale in the US.

  • Jurisdiction and Creative Commons Licenses: To my knowledge, Creative Commons licenses do not specify a specific jurisdiction for dispute resolution. Both Korea and the US are members of international agreements like the Berne Convention, WTO, WIPO, and have signed the KORUS FTA, which should provide a comprehensive framework for copyright disputes. Both countries have independent judiciaries from their governments.
  • Hosting and Legal Framework: Flickr, where the photo is hosted, operates under US jurisdiction, and its terms of service state that disputes will be arbitrated under California law. This means any issues related to the photo’s licensing on Flickr would likely be subject to US legal principles and arbitration processes.
  • MCST’s Role as Licensing Authority: The Ministry of Culture, Sports, and Tourism (MCST) re-uploaded the photo to Flickr under a CC BY-SA 2.0 license, which allows for commercial use. Given that MCST controlled the copyright at this point and has explicitly licensed the photo under these terms, the license is legally binding and irrevocable under Creative Commons guidelines. Notably, this specific license applies only to the photograph, not the statue in general (it does not rely on FoP in any way), and doing this is within MCST’s authority under Article 24-2 §3 of the Korean Copyright Act.
  • Dispute Outcomes: Courts in both Korea and the US are likely to uphold the terms of the Creative Commons license, acknowledging the good faith in which the license was granted. Should MCST attempt to rescind the license or claim a mistake, courts in both Korea and the US would likely reject such claims, reinforcing the irrevocability of the Creative Commons license once granted.
  • Departmental Consistency: Despite the previously mentioned administrative changes in which department manages the copyright, MCST has retained overarching authority to issue licenses for public copyrighted works throughout, ensuring consistency in this licensing process.
  • Practical Implications: If a dispute arose, courts would likely defer to the terms of the Creative Commons license and the principles of the Berne Convention, ensuring the photo’s continued use under the CC BY-SA 2.0 license. This would mean that any commercial use by the US-based T-Shirt manufacturer is legally permissible.

Conclusion

In conclusion, the combined effect of international agreements, the irrevocable nature of Creative Commons licenses, and the administrative consistency within the Ministry of Culture, Sports and Tourism supports the argument that the photo is legally usable under its current license. Courts in both Korea and the US jurisdictions would likely enforce this.

  • Final Point on {{Not-free-US-FOP}} - If I have understood correctly, this is used when a photo has been obtained by FoP of a copyrighted work? FoP is an exemption to obtaining a license and has not been used here. The photo is a specific, properly licensed, separate derivative work (a photo) that is owned and controlled by the same organization that controls the copyright for the statue. Thus, no FoP claim is needed for the derivative work in question here. Nonabelian (talk) 14:36, 4 July 2024 (UTC)
@Nonabelian I'll wait for the response of the two Korean-speaking users that I pinged above (one of them, Explicit, is an admin here). JWilz12345 (Talk|Contrib's.) 15:32, 4 July 2024 (UTC)
@JWilz12345: Seems sensible. I'll look to tidy up the referencing here if I get a spare moment. Nonabelian (talk) 20:47, 4 July 2024 (UTC)

Images of Palazzo dei Ricevimenti e dei Congressi

Hi everyone. I'm writing here in order to ask for the undeletion of the following images:

The first two were deleted in 2013 after this DR, whereas the others were deleted in 2012 after this, this, this and this DR. They all depict en:Palazzo dei Congressi, which was commissioned to en:Adalberto Libera by the EUR entity, which at that time was a public entity part of the state administration (see here for more informations). The construction of the building was finished in 1954. Therefore it fell under Template:PD-ItalyGov in 1975. It's a building built before 1990, so no issue with US copyright.--Friniate (talk) 21:54, 19 July 2024 (UTC)

This File was a Photo of Historic Military General Leonid Stupnytskyi with no reason and for no purpose. The Photo was most likely dated from the 1910s to the 1940s and was a Photo of one of the Lead figures during the Era of the Ukrainian People's Republic. I could not find a reason for its deletion, another Photo of him was also Deleted. I request that this be undeleted because there was no reason for it to be deleted in the first place. It is a Historical photo of a Military General whose Deletion was uncalled for. It has no copyright issues so then whats the issue?

--Gubusman (talk) 07:50, 20 July 2024 (UTC)

Oppose The claim that Gubusman was the photographer is plainly incorrect. There is no information in the upload to allow us to determine the image's copyright status. His dates are 1892-1944, so it is unlikely that the image was taken before 1920. Any Ukraine image made after 1929 is still under copyright in the USA. .     Jim . . . Hi there! I'm the owner of the photo which was uploaded, I have taken this photo at a Hotel where I ran into the guy Cairo, i asked him if i could take a photo of him for my vault and he agreed to do so.

From my understanding, even if If he uploads the picture to his social media I'm still the copyrighted owner and have permission to upload my own work.

It's being using for the Artist Wikipedia page, after I discovered this guy is big through a Google search I knew immediately that he needs a Wikipedia page for people like me searching for him.

If you can't undelete my file could you please explain how I can reupload in a proper way? Thank you LuvkyStar (talk) 07:59, 21 July 2024 (UTC)

Hello, i'm writing this Undeletion appeal because i've got an notifcation about an logo game i uploaded on this website, a logo game i'm talking about is for an gacha chibi game called "Gacha Club". I understand that it could've somehow break the copyright violation, however i come to appeal to atleast find out if i can replace the Logo from Google Play Store into a Windows version.

Logo that was listed for deletion is this File:Gacha_Club_Logo.webp and the logo is displayed on this page.

I hope there's atleast someone from administration who could help me since it was my first time uploading an image to WikiMedia. — Preceding unsigned comment added by FILipKOSOfficial (talk • contribs) 18:41, 21 July 2024‎ (UTC)

Oppose File is not yet deleted. Even if it were, there is no evidence the image was released under CC-BY as stated in the file. It doesn't matter if the file was taken from Google Play Store, Windows App Store, or the the game itself. Günther Frager (talk) 18:57, 21 July 2024 (UTC)
The game that uses this logo is free on all platforms, should i contact the main developer to find out if the image can be used or if it was released under CC-BY? FILipKOSOfficial (talk) 19:01, 21 July 2024 (UTC)
@FILipKOSOfficial: Free of charge doesn't mean the authors license it under a free-license. You can contact the copyright holders and ask them to send an explicit permission to COM:VRT. Günther Frager (talk) 19:06, 21 July 2024 (UTC)
(Edit conflict) When we say ‘free’, it doesn’t mean free of charge but of restrictions. So, the price tag of the game doesn’t matter. The logo can be hosted here in Commons if a free license (such as CC BY) can be obtained; otherwise the logo can be uploaded separately to each wiki according to their fair use policies. Unfortunately, the Simple English Wikipedia outright rejects such usage. So, yes, if you want to use the logo in simple:Gacha Club, you have to get a free license from the copyright holder. I can only wish good luck. --Geohakkeri (talk) 19:25, 21 July 2024 (UTC)

Reason: Apparently I failed to check the result well enough when transferring this file from enWS to Commons. The file was tagged with PD-author-release on enWS, but it seems whatever FileExporter translated that to on Commons (I can't see the deleted revisions) was insufficient. The PDF is also available from The Albert Einstein Foundation at aeinstein.org/s/FDTD-English.pdf (and several other languages, see aeinstein.org/digital-library), and on p. 2 you find the author release: "All material appearing in this publication is in the public domain".

This file was deleted by error and needs to be undeleted. The user who decided to delete it (@Gbawden) based his decision on the fact that he found the photo on a media website :

https://www.rtbf.be/article/solayman-laqdim-officiellement-designe-nouveau-delegue-general-aux-droits-de-l-enfant-11138929

In fact, this photo was taken from a photoshoot (made by Sylvain Reygaerts, which is prestented as the copyright holder in the RTBF article), but it was ordered and paid by Solayman Laqdim himself. And the rights to this picture are granted to him. Gbawden is mentionning this article as a "reason" to justify a violation. But actually, this photo was used by the media RTBF because Solayman Laqdim gave the photo and also gave the permission to use it. Sylvain Reygaerts is the author of the photograph, but not the actual copyright holder.

I uploaded the photo myself on wikimedia commons, at the instance of Solayman Laqdim (copyright holder) in the context of my work at the "Délégué général aux droits de l'enfant", a public service of the french community of Belgium. This photo was an important part of the article concerning the "Délégué général aux droits de l'enfant", who is a public figure in Belgium, and should be undeleted as soon as possible. — Preceding unsigned comment added by Webmaster DGDE (talk • contribs) 09:30, 23 July 2024‎ (UTC)

@Webmaster DGDE You need to provide confirmation that Reygaerts is giving Commons the rights to use this photo for any purpose via COM:VRT - without this permission we cannot host it here Gbawden (talk) 09:37, 23 July 2024 (UTC)

Someone deleted the Coat of Arms of the City of Augsburg, Germany. This image is used on 1000+ pages on Commons alone, and it was used on a lot of wikis until CommonsDelinker went on a deleting spree and removed them all. This is currently causing quite a bit of a ruckus, so please restore the image and revert the CommonsDelinker deletions. -- 2A02:908:122:55C0:468A:5BFF:FECC:62BA 10:39, 22 July 2024 (UTC)

Comment The problem is apparently that the original file File:DEU Augsburg COA.svg was moved to File:DEU Augsburg stylized COA.svg and shortly afterwards a new version was uploaded. This new version was a duplicated and was deleted because of that. I created a file redirect that probably won't stop Commons Delinker, but it would help in case its actions are reverted. All Welcome Rotonda images

All images:

The above-mentioned files were deleted through Commons:Deletion requests/Files in Category:Welcome Rotonda, on the no-FoP claim. However, being in 1948, this structure meets {{PD-Philippines-FoP work}} as a pre-1972 work. There is no evidence of its registration (as most registrations during the period were for literary and audio-visual works, very rare for public art). Another proof that it existed before 1972: this old 1960 image in a Manila nostalgia-related Facebook group. JWilz12345 (Talk|Contrib's.) 01:08, 23 July 2024 (UTC)

Also, it does not contain any sculptural-like elements, just a structure with combined monolithic and arch properties. So unlikely to be granted protection by registration before 1972 as it is not a sculpture. JWilz12345 (Talk|Contrib's.) 01:33, 23 July 2024 (UTC)

Oppose Owning a paper copy of a photograph rarely allows you to freely license its use. That right for almost all photos found in family archives belongs to the photographer or his heirs. Since the subject was born in 1948 and is obviously an adult, this photo has a copyright in the country of origin and also in the USA. I checked the file's original reason for being deleted and it does not claim any reasons to why it was deleted (https://commons.wikimedia.org/wiki/File:Benediktgrondal.jpg). This picture is a picture of an Icelandic prime minister and the only Icelandic prime minister to not have a picture on Wikipedia. So it would be really nice if this would be put back up, as all of the other PM's of Iceland have pictures imported from Commons, with no problem seemingly, exepect for Sir. Gröndal's picture. So i would like to politely ask you to put it back up.

File:Afsaneh-Salari-scaled.jpg was deleted a few weeks back per Commons:Deletion requests/File:Afsaneh-Salari-scaled.jpg. The same image was subsequently uploaded locally to English Wikipedia as en:File:Afsaneh-Salari-scaled.jpg under an acceptable CC license based on the discussion at en:User talk:Mr.izadpanah#File permission problem with File:Afsaneh-Salari-scaled.jpg. It appears that a free license declaration has been added to the photo's source website. If this is sufficient enough for Commons, then perhaps this file could be restored to allow the local file to be deleted per en:WP:F8. For reference, I didn't ask the deleting Commons admin about this at User talk:Minorax#Commons:Deletion requests/File:Afsaneh-Salari-scaled.jpg last week, but they might just be busy with other stuff and haven't had the time to respond. -- Marchjuly (talk) 00:58, 17 July 2024 (UTC)

Oppose There is no author listed at the named site, so the CC-BY license is not valid because a user cannot give the required credit. It also appears without a free license in a variety of other places. .     Jim . . . (Jameslwoodward) (talk to me) 13:08, 17 July 2024 (UTC)

@Jameslwoodward: Thank you for taking a look at this. I've let the uploader of the image know about this on their English Wikipedia user talk page, and suggested they comment here if they want to try to clarify things. If this file can't be restored for the issues you laid out above, then the English Wikipedia local file probably needs to be deleted. -- Marchjuly (talk) 04:32, 18 July 2024 (UTC)
Marchjuly, I am not expert on WP:EN rules, but I would not assume that the image must be removed there. Check the Fair Use rules. .     Jim . . . (Jameslwoodward) (talk to me) 18:57, 18 July 2024 (UTC)
This wouldn't be allowed to be used as non-free content on English Wikipedia because the subject of the photo is living and non-free photos of living people are pretty much never allowed except under certain conditions, none of which could apply here. I will suggest to the uploader that they try to get the copyright holder to email their COM:CONSENT to VRT. Would you still be opposed to the file being restored if VRT is able to verify its licensing? -- Marchjuly (talk) 21:04, 18 July 2024 (UTC)
Ah, yes -- now that you mention it, I remember that rule. Sorry for the distraction. And, yes, of course, if VRT gets a valid license, the volunteer there will either restore it or if they are not an Admin, bring it here to be restored. .     Jim . . . (Jameslwoodward) (talk to me) 14:03, 19 July 2024 (UTC)

So, I found this image on the website of the Embassy of India, Washington D C, USA and tried to upload it onto Wikicommons. Then I got a warning that the same file had been deleted several times because of no license. I assumed GODL-India applied to this file because the embassy is plainly a subordinate of the central Government of India.
I have found a lot of controversy about this template and I am hoping someone could provide an explanation here as to whether or not it is accepted to import photos from these Government of India websites. 源義信 (talk) 14:53, 18 July 2024 (UTC)

This contents of this website may not be reproduced partially or fully, without due permission from Embassy of India, Washington DC. Günther Frager (talk) 20:56, 18 July 2024 (UTC)
Thank you but I don't think this would help, since there seems to be something unclear about whether documents created by the government of India are accepted here.
If you please, refer to Template:GODL-India and the related discussions:

Following the mandate of the National Data Sharing and Accessibility Policy (NDSAP) of Government of India that applies to all shareable non-sensitive data available either in digital or analog forms but generated using public funds by various agencies of the Government of India, and subject to the conditions listed under section 4 and 7 of this document, all "user" are provided a worldwide, royalty-free, non-exclusive license to use, adapt, publish (either in original, or in adapted and/or derivative forms), translate, display, add value, and create derivative works (including products and services), for all lawful commercial and non-commercial purposes, and for the duration of existence of such rights over the data or information.

源義信 (talk) 01:01, 19 July 2024 (UTC)

The focus in this photo is very clearly on the cosplay, not the plushie itself--Trade (talk) 23:28, 16 July 2024 (UTC)

Restore I agree with Trade on this one. The Squirrel Conspiracy (talk) 02:53, 17 July 2024 (UTC)

Oppose I agree that the plushies are de minimis, but the two masked characters in the center of the image have copyrights -- the masks remove the costumes from being utilitarian. .     Jim . . . (Jameslwoodward) (talk to me) 13:10, 17 July 2024 (UTC)

I agree with Jim, but I think censoring out the masks would still make it a useful photograph so I'd  Support a censored version. Abzeronow (talk) 20:40, 18 July 2024 (UTC)

Oppose The usual copyright holder of a photo is usually not the person that has a copy, but the photographer. If Evans Akere is the actual copyright holder, then he needs to send an explicit permission to COM:VRT. Günther Frager (talk) 20:53, 27 July 2024 (UTC)

There are two issues with this file:
  1. (scope issue) You need to provide information which exactly wiki page it is intended to be used on.
  2. (copyright issue) Only full resolution images (which this one is not) with complete metadata in EXIF can be uploaded as Own work. For any other image we need a link to a free license on its source page or a free license permission via email as described in VRT.

Work by the federal government. No copyrightable elements. Anything else but the quote itself is PD-simple--Trade (talk) 12:17, 14 July 2024 (UTC)

Contains a Twitter disclaimer that the tweet breaks the site rules, and Twitter is not owned nor was ever owned by the federal government. Abzeronow (talk) 17:29, 14 July 2024 (UTC)
Do you believe that the disclaimer is above threshold of originality in the US? @Jmabel: --Trade (talk) 17:31, 16 July 2024 (UTC)
I honestly have no idea, and quite frankly would rather stay out of this. - Jmabel ! talk 21:03, 16 July 2024 (UTC)

Oppose Trump's remark is more political than presidential, so it could be argued that it does not fall under the exemption for works created by Federal employees in the course of their Federal duties. However, that question is moot, because the two sentences written by Twitter clearly have a copyright belonging to Twitter. .     Jim . . . (Jameslwoodward) (talk to me) 12:50, 15 July 2024 (UTC)

  • Trump's tweet may be in the public domain (as most of his tweets during his presidency) but as Jim says the Twitter one is doubtfully PD. Maybe a compromise would be to restore only Trump's tweet? Bedivere (talk) 13:04, 15 July 2024 (UTC)
Yeah, I'd be OK with just restoring Trump's tweet. The circumstances of Twitter disclaiming the tweet can be paraphrased in the description. Abzeronow (talk) 16:18, 15 July 2024 (UTC)
It's debatable if such a short and generic disclaimer somehow gets to benefit from copyright protection Trade (talk) 22:28, 16 July 2024 (UTC)

Oppose It's from his personal account. The office of the President has its own account. The Squirrel Conspiracy (talk) 17:06, 15 July 2024 (UTC)

DOJ said in 2017 that tweets from that account were official presidential statements. https://www.abajournal.com/news/article/government_says_trumps_tweets_are_official_presidential_statements This year, SCOTUS also ruled that officials use of social media could be state actions: https://www.nbcnews.com/politics/supreme-court/supreme-court-outlines-officials-can-sued-blocking-people-social-media-rcna135128 So it's not clear cut if this was a personal statement or a presidential one. Abzeronow (talk) 17:22, 15 July 2024 (UTC)
That is correct. These tweets are in the public domain as the work of an employee of the Executive Office of the President of the US, made as part of his duties. Also, as a work of the US federal government, these tweets are in the public domain. Bedivere (talk) 17:34, 15 July 2024 (UTC)
As I noted above, I don't think it is clear that Trump's remarks are PD. While anything he does acting as President certainly is PD, things he does as a candidate for office --in this case his running for reelection in 2020 -- are personal and not PD. This looks to me more political than presidential. Note that the SCOTUS decision says they "could be state actions", not that they always are state actions. .     Jim . . . (Jameslwoodward) (talk to me) 18:33, 15 July 2024 (UTC)
Yes, but at the time of the posting he was still a president, and if you check their tweets all over his presidency, they are very much alike that one. That's why I'm inclined to consider this one PD. Bedivere (talk) 18:39, 15 July 2024 (UTC)

Not done: stale request, no consensus to undelete. --Abzeronow (talk) 17:12, 30 July 2024 (UTC)

Works for hire by Adalberto Libera

Hi everyone. I'm writing here in order to ask for the undeletion of the two following images:

They were both deleted in 2013 after this DR. The first one depicts the Palazzo della Regione Autonoma Trentino-Alto Adige, which was commissioned by the Region Trentino-Alto Adige to en:Adalberto Libera in 1954 (see here for more information). Its construction ended in 1965, and therefore it fell under Template:PD-ItalyGov in 1986. For the second one I suspect that some mish-up happened. From the name of the file I'd guess that it's depicted the it:Edificio postale di Roma Nomentano. But this building was not designed by Libera, but by it:Gioacchino Luigi Mellucci e it:Mario dell'Arco. The post office designed by Libera is the it:Edificio postale di Roma (via Marmorata). Anyway, it doesn't make a lot of difference in terms of copyright. Both post offices are in Rome and were commissioned by the Ministry for Communications (see here and here). They were both ended in 1935, and therefore they both fell under Template:PD-ItalyGov in 1956. All the aforementioned buildings are buildings built before 1990, so no issue with US copyright.--Friniate (talk) 20:04, 27 July 2024 (UTC)
