Deleted: I requested restoration because the purported source from the copyvio nomination is an entirely different image. Even ignoring the different colouration, the horizontal crack at the bottom, for example, is quite flat in the Commons version, but has a clear upwards slope to the left in the fineartamerica.com version. The images are unambiguously taken from different angles. However, I've now found a matching image here in April 2019 (or even here in May 2016), before Commons upload on May 2019; accordingly, COM:OTRS permission is required. This redirect should be deleted. The year mentioned here is incorrect. The Dapoorie viaduct was opened in 1858. The Khandala-Poona railway line was opened in 1858. The viaduct falls in this section. This image shows a passenger train on the viaduct which means the viaduct was opened to services at time when image was taken. Hence the image is from either 1858 or later. So a move request was raised and the file was moved to correct name. Despite Commons upload on 02.2009, it is not credible to believe the company sourced images from the Commons for its official product page. Indeed, username Xgsdev is clearly a permutation of XGS Developer/Delevopment (Xtreme Games LLC is the company XGS AVR 8-Bit Development System is the product), and is name blocked on en.wiki for that reason. This is a quintessential example of requiring COM:OTRS permission to enure Xgsdev is authorized to license on behalf of the company, and not, for example, a merely an employee or fan of the product. Similarly, that a purportedly notable person (w:André LaMothe) would source the profile image used on their company's official site from the Commons is significantly doubtful. Yet, unless the addition was editorially inaccurate, this is transparently a good thing for the projects as a whole, and only bruises the self esteem of the proponents of non-scope. Per the author's Wikipedia page, en:George Wilberforce Kakoma, the Government asked the people to submit their own national anthems. That seems like "at the direction of" to me. Per the template, PD-Uganda kicks in 50 years after the first publication for Government works. - Examining further, I find a cropped copy of File:سوله شرکت بهروش، شمس آباد.jpg on http://www.hollow-section.com/en/galleryen/souleen#behravesh-rail. Research with TinEye and Google Image searches, shows the same photograph in use on different websites, but in all cases the version that was uploaded to Commons remains the highest resolution version that can be discovered. This supports a good faith presumption that the uploader had access to original images, and probably was the photographer or has a more likely claim to copyright than the websites with lower resolution or cropped versions. - Delete - We are not beholden to mere time--even if we were, File:سوله شرکت پارسیان گرافیت.jpg, uploaded 03.2014, was here in 06.2013--and are, in fact, allowed to use common sense related to other measures. All of these images appear on the structural steel manufacturer's official project page. That a corporation would go to the Commons to source images of its own projects, for use on its official site and in official brochures is significantly doubtful. Indeed, the uploader's addition of File:HSS Soule 3200px.jpg on 3. September 2013 was immediately followed by the addition of a link to fooladmachine.com, indicating their contemporaneous knowledge of that source. The purported invocation of good faith above is contrary to the actual policy. We commonly encounter, for example, employees of firms uploading company images under the (mistaken) belief that their mere employment allows them to license on the firm's behalf, that free (gratis) promotional images are the same as libre, etc. They are absolutely acting in good faith, but that intent is not relevant to copyright (as the policy devotes a whole section to explain). - Delete - File:ConXL-13.png and File:اتصال ConXL.jpg were uploaded 31. October 2012 and appeared here on 8. November 2012. It is not believable that a structural steel manufacturer 1) decided to source images for its official site from the Commons, 2) decided to copy the style to make more of its own, related images ([3],[4]) and 3) just so happened to do all of that merely a week after their posting to the Commons. - The argument IMHO makes no sense. A structural steel manufacturer could decide to source images from a Lllidon’s work – Lllidon could take such commission, or might be the manufacturer’s employee. - Agree that the rationale here is bizarre. In all past cases I can recall where an uploader releases files on Commons and files of a lower resolution later appear on other websites, this is a clear reason to presume that the Commons uploads predate any release elsewhere. To make the bad faith presumption that the uploader/photographer/designer was acting unlawfully by taking action in advance of the use of their photographs or graphics elsewhere, would need more evidence to stick here on Commons than suspicions and allegations without evidence. Once released on Commons, later releases on different licenses on other sites, do not invalidate the original release.

Secondly, all the facts that the image is of low resolution, no EXIF, that the uploader has no other contribution amount to significant doubt about the freedom of this image, and per official policy COM:PRP such files should be deleted. - That's what I suspected: that the professors provided their regular "own" images (which remains to be proved since they are not the photographers) to the Moscow State University, which placed them under a CC though they have not the right to do so. - Dear colleague! Most of the photographs in question are amateurish, which leads to the conviction that the rights to it belong to the person who is depicted in the photograph and allows its public distribution. - @VLu: В рассматриваемой нами теме речь идёт о публикации фотографий персоналий (не художественных изображений) и этом случае помимо авторского права фотографа имеются права персоналии на защиту своего изображения. Суть данного права состоит в том, что никто не вправе обнародовать и использовать изображение (фотографию), на которых изображена персоналия без её согласия. В случае изображений с сайтов МГУ подобное согласие было получено с высокой вероятностью в отличие от сайтов, ссылки на которые приведены коллегой Patrick Rogel. No information about artist or publication date, only that it is from a Swedish newspaper. The artist is in fact w:sv:Hjalmar Eneroth (1869-1964) who at the time of publication worked as illustrator for the Swedish daily Svenska Dagbladet. - @Alexis Jazz: I don’t think any of them fall under FOP, which covers works that are permanently installed. The first one looks like a temporary backdrop (it would be covered by Hungary’s FOP, which is pretty much the same), the second is a carpet that’s placed on the side of the field and the last two are spray-painted on the grass. If you put your carpet on a field for 6+ years with no set end date, that's permanent. No need to nail it down. Street paintings, ice, sand, or snow sculptures rarely last more than a few days or weeks. - @Ytoyoda: That's the question. Anyone can also buy a ticket for a museum or movie theater, but in most countries (iirc the UK was a possible exception) those don't count as public places. Partly because those are indoors, maybe theme parks are a better example. I wouldn't put too much weight on whether this particular photo was taken from a restricted spot: the artwork in question can be photographed from several non-restricted areas. If the artwork in question can be photographed from a public place, I'd say it won't matter if you decide to photograph it from another place. For example: if you take a picture of a statue using a drone, I'd say FoP applies to that, assuming you can also take a picture of it from the ground in a public place. But this is my interpretation. - Yes, of course it is a "derivative work of a copyrighted element", that's why I needed (and had) a permission to take there pictures. To answer an other question: This was a design element in the stadium, not a screen.
