[edit]Promotional spam for program extensions of the en:Magento software. While the main software of course is in scope these third party extensions / plugins surely are not. Due to the nature of the user edits this is not just advertising but spamming:
- user also manipulates the Wikidata entry of the main software to promote (his) extensions: 1
- user ads spam weblinks to Wikidata entries which are not related to the subject: 1 (done at least five times)
- misuse of user namespace to place his business contact information: User:Haonguyenvan195
- just uses Wikipedia / Wikimedia / Wikidata for self-promotion no edits not related to Magenta
It takes quite some time to overlook his global edits and reverte or delete them. No indication that the user has other intentions. Therefore I have also requested blocking of this user on Commons:Administrators' noticeboard/User problems which should best done be globally.

[edit]Though 5(2) of the German copyright act appears to apply, based on newspaper reuse being based on German officials making the photograph available as a handout, later interpretation of 5(2) appears to include a proscription against derivatives. It would be helpful if an official English translation could be provided as a link, and any existing past discussion about the application of 5(2) on Commons, or a past legal case which clarified how 5(2) is enforced or legally interpreted.
PS The first publication was by Steffen Seibert in his official capacity as the head of the German Federal Press Office ref. Seibert stated Das Foto stammt von Jesco Denzel, einem der offiziellen Fotografen der Bundesregierung. ref

- @Fæ: This photo is clearly copyrighted. The German Amtliches Werk isn't even slightly comparebable to the US PD-gov legislation and does not include publicity shots like this.

The copyright section of the pic was linked by Martin, so now you have to prove, that it's not relevant. You have to prove, that your imho baseless assertion has any base at all. Keep in mind that I created this DR because I am revisiting my understanding of the relevant copyright law based on the evidence and sources. - You uploaded this unambiguously copyrighted image and you put the completely bogus and unsourced {{PD-GermanGov}} tag in the license field. You should never have uploaded an absolutely clear copyrighted pic here, and should never ever have appropriated it as PD without any valid reason. - Until you can prove without any reasonable doubt that it is not copyrighted (something that is proven without any reasonable doubt in this thread), all you say is just blabber. Why did you upload this clearly copyrighted image at all? Like Martin says beneath this: Ther is no such thing as PD for current photographs in Germany, unless the author gives it explicitly. Es gibt einen absolut klaren Urheberrechtsfall, wie und was der Telegraph gezahlt hat ist unerheblich, amerikanisches Recht ist ebenso irrelevant, es gibt bislang keinerlei Hinweis auf die Möglichkeit der Gemeinfreiheit, die Du selbstherrlich proklamiert hast beim Hochladen. Ich habe bislang noch überhaupt kein Argument von Dir gehört, warum das keine Urheberrechtsverletzung sein sollte. Gleichzeitig versuchst Du auf der Dateiseite möglichenden unwissenden NachnutzerInnen vorzugaukeln, es gäbe ggf. eine Möglichkeit der legalen Nutzung des Bildes. Das muss unbedingt unterbleiben. Wir dürfen hier auf Commons nicht den Eindruck erwecken, wir würden zu bewuster Urheberrechtsverletzung animieren. Es kann bei solchen Bildern gar keine zu große und abschreckende Warnung geben, solange sie noch nicht gelöscht sind (was hoffentlich in den nächsten Minuten geschehen wird). Sorry User:Fæ, but uploading an image, just to open a DR seriously isn't the way we should handle stuff like this. I you yourself had doubts about the copyright status of this image, you should have discussed these doubts before uploading thist image. Since the image is all over the web, there was no need to upload the image just to start a discussion. Anyhow: If Amtliches Werk would cover Photos, there would be a lot of photos like this – but there aren't any. Vielleicht sollten wir die Diskussion hier auf Deutsch führen, es geht schließlich um ein Bild eines deutschen Fotografen, dass den deutschen Urheberrecht unterliegt, wer also nicht der deutschen Sprache mächtig ist, kann hier sowieso nicht viel zu sagen. Damit würde auch deutlich, dass irgendwelche imaginierten Analogien zum amerikanischen Copyright in Bezug auf Regierungsbehörden schlicht nicht zutreffend, und Argumentationen in eine solche Richtung nur Strohmänner sind. - There are some similarities between Dutch and German. I recognize amtliche as ambtelijk. And ambt generally refers to a position appointed by government (see wikt:Amt#German). So this means "The same is true for other governmental works"

Delete (§5 UrhG) "Amtliche Werke" are official proclamat ions, laws, etc. Other documents (like photographs) are not consideres amtliche Werke according to German law. Sebari – aka Srittau (talk) 13:56, 10 June 2018 (UTC)

The relevant text of Ch.5(2) at https://www.gesetze-im-internet.de/urhg/__5.html appears to be "(2) Das gleiche gilt für andere amtliche Werke, die im amtlichen Interesse zur allgemeinen Kenntnisnahme veröffentlicht worden sind, mit der Einschränkung, daß die Bestimmungen über Änderungsverbot und Quellenangabe in § 62 Abs. 1 bis 3 und § 63 Abs. 1 und 2 entsprechend anzuwenden sind." I will note I have seen 5 different angles of this moment in time; 1 from the German team, one from Macrons team, one from Contes team from Italy, one from someone from the US delegation (unsure if its a US gov employee or someone in the press core at this time) and one I don't know who took it. Speedily deleted as obvious copyvio. German case law in regard to § 5 Abs. 2 UrhG is very restrictive. According to BGH 02.07.1987, Az.: I ZR 232/85 we know that maps created by the ordnance surveys (Landesvermessungsämter) are not considered as amtliches Werk. Likewise we know that stamps that were issued by the government and published in official announcements are not covered thanks to LG Berlin, Urteil vom 27. März 2012, Az. 15 O 377/11. This was a case where we at Commons were too optimistic in this regard with the consequence that we had to review uploads of German stamps. The German government provides through the office of the Bundesbildstelle access to its database of photographs but requires reproduction fees. Official press photos which were taken by photographers on behalf of the German government (as in this case) were never considered to be subject to § 5 Abs. 2 UrhG. Moreover, even if § 5 Abs. 2 UrhG would apply we would have the explicit restriction of § 62 Abs. 1 UrhG, i.e. modifications are not permitted. - I don't quite understand why this image is being considered separately from the others here, since the situation in the same. All the images depict paintings by en:Ottavio Baussano on the it:Palazzo di Città (Asti). As I explained in the UDR though, it's highly likely that they fell into Template:PD-ItalyGov in 1956: first of all, because the palace is property and main seat of the Municipality of Asti; secondly, because from this snippet we can read some excerpt from a document of the municipal administration: "having seen the estimate brought by the decorator Ottavio Baussano, we authorize the implementation of this work by the aforementioned painter, who has already showed his ability by decorating other rooms of the Civic Palace", "Ottavio Baussano commits himself to realize the decoration of the ceiling as per the attached sketch". Unfortunately I can't read the complete page, but I think that the snippet alone tells us that the work was a public commission. As I said, I was open to leave the decision to the closing admin, but what doesn't make sense is to consider this image separately from the other 6, since the situation is exactly the same.--Friniate (talk) 10:15, 18 August 2024 (UTC)

- Neither being the logo of political party nor being found on an official website automatically means the logo falls within in the public domain. The party's official website claims "© 2018 Web oficial de la Federación de Los Verdes. España", which seems to apply to applies to all content found on the website. You changed the licensing to {{PD-textlogo}} and {{PD-shape}} with this edit, but those licenses have nothing to do with being given "permission" to upload the file with respect to Commons. Those licenses relate to whether the logo itself is considered original enough to be protected by copyright. While I think this would probably would be considered to be PD per COM:TOO#United States, what matters is the TOO of the country of origin, i.e., Spain. There's nothing in COM:TOO about Spain and if its TOO is anything like COM:TOO#United Kingdom, then this would clearly not be PD. In addition, there's nothing in COM:CRT#Spain about logos of political parties and their copyright status. What makes you think this would be PD in Spain? - At first glance, I gathered that the website where those public domain images are available for download actually use a variety of different sources that we can only presume are in the public domain. If the website where the download takes place says they are in the public domain, are we responsible for escalating the issue and asking that website if they've cleared everything through the photographer? The main thing that should matter to our Commons volunteers is the actual license that accompanies the upload, and if the uploader has licensed their work properly. We should not be copyright investigators beyond the information provided to us. If I'm mistaken, then please show me in our policies where it provides such instruction. As for the stamp image, according to the information provided at :File:Stamp of Azerbaijan 297.jpg, the image is in the public domain. You are well aware of that, so why are you still debating it? This appears in my opinion to be out of COM:SCOPE as it is badly photoshopped. Please note the lightning which was obviously added for the dramatic effect. Most of the picture with exception of the tower was blurred, the outer frame darkened. I do not see how this is realistically useful for an educational purpose (except for demonstrating bad photoshopping but this does not mean that we should keep all of them.) - Fraglich ist an der Stelle, ob die Bearbeitung die Schöpfungshöhe erreicht. Nach der hier herrschenden Ansicht stellt die ledigliche Photographie/-kopie eines gemeinfreien Originalwerkes – dies ist es, das Siegel, aufgrund des Ablaufs der Schutzfrist ja in jedem Fall – kein Werk dar, das die Schöpfungshöhe erreicht. Insoweit lässt sich analysieren, was konkret der Beitrag wäre, der in der Vektorisierung von „Christianeum.sig3.jpg“ (bzw. der Digitalisierung und Vektorisierung des Originals i. Allg.) die Schöpfungshöhe erreichen müsste. Einzelne Punkte zu setzen, Schrift zu schreiben und in eine .svg zu packen, erreicht sicherlich noch nicht die Schöpfungshöhe. Die konkrete Anordnung der Bildobjekte zu einem Gesamtbild macht ist jedoch das, was bereits im Original liegt. Insofern stellt die Vektorisierung des gemeinfreien Originalwerkes kein eigenes Werk dar, das die Schöpfungshöhe erreicht. Dementsprechend ist auch die vektorisierte Datei gemeinfrei.
- Lieber Luke, mir wäre es allerdings lieber, wenn wir an dieser Stelle nicht im Disput enden würden und Du solidarisch mit der Christaneums-Wikipediaseite Dich mit der Nutzung des Bildes nachträglich einverstanden erklärtest. Darüber würden sich viele Menschen freuen, die zum Wikimedia-Projekt beitragen oder Wikipedia-Artikel lesen.

- (en français, ce sera plus simple) parce qu'il est banni, l'importateur du fichier ne peut pas répondre directement et je ne pense pas que l'on puisse croire l'IP sur parole (d'autant plus que celle-ci a déjà affirmée ne pas être CC). En tout cas, il faudrait des informations claires et précises, cela peut effectivement se faire par exemple par OTRS, ou par un tiers de confiance. Certes Commons ne se préoccupe qu'à la marge du droit à l'image (Commons:Non-copyright restrictions), mais cela reste une bonne pratique fortement conseillée que d'indiquer le consentement des personnes (Commons:Photographs of identifiable people).

- Autant que je sache c'est ainsi que la photo a été prise. Je ne sais pas comment l'indiquer ni même si c'est nécessaire. L'auteur est conformément renseigné et c'est ce qui est obligatoire. Peu importe ensuite de savoir si le photographe et le sujet sont la même personne d'autant qu'elle est difficilement reconnaissable et que COM:IDENT n'a que peut de portée ici. Je pense enfin que l'on a déjà passé trop de temps sur ce cas à discuter du sexe des anges alors même que les uploads quotidiens pullulent de copyvios évidents et/ou d'images outrancières, violentes et incontestablement éloignées de COM:EDUSE.
