What's your problem, The Photographer??? OF COURSE IT'S MY OWN JOB. Look at those pics: 1 and 2. They're screenshots of my own PC using Photoshop. I made the original. Why do u try to destroy my job? Last time, you deleted a file that I uploaded without any advice, in spite of I tried to explain that hasn't any rights and was a screenshot of my computer. But now, THE ORIGINAL PIC IS MINE. How can I move the text if the image wasnt mine? If you need more proofs, tell me what change do u want me to make and I'll do it.

This doesn't make sense to me. I understand that Minecraft is closed source so a general screenshot of landscape that was generated by the program or programmers would not be my work. But there are a huge number of photos of real buildings in the Wikimedia Commons. The person who took that photo of a building probably didn't build the building, they only took the photo. Isn't that "derivative" work? I made that Bitcoin icon myself with several hours of labor, and then I took the photos/screenshots. Two parts of the creative process were my own and that creative work would not exist without my significant efforts. Can the brick maker sue the architect for his "derivative" work? And then the architect sue the photographer for using their building in the photographic "derivative" work? All real buildings have copyrights, until they expire. In many countries, Commons photographs are permitted by laws which specifically exempt the photographs from being derivative works, see COM:FOP. However, that is a bad analogy. Think, instead, of drawings of real buildings, including both the architectural drawings used to construct them, renderings used to show them before construction, and post construction drawings. All of them have copyrights and you will not see them on Commons without a specific license from the creator.
The brick maker cannot sue because bricks aren't copyrighted, but the architect can sue a photographer in many countries (those with no FOP law) and can sue someone who copies his drawings in every country.
Copyright law is not stupid. If it were not for copyright laws, few people would go to the effort of writing books or creating sculptures, because they could not earn money for doing it. .     Jim . . . . (Jameslwoodward) (talk to me) 10:37, 1 October 2014 (UTC)[reply]

I agree that my analogy isn't perfect, but I think it's closer to accurate than yours James. Copies, or photos of architectural drawings would be more like copies or photos of computer code. No, sorry, you are wrong. As I noted above, there are explicit exemptions in some countries for photographs of actual buildings. Minecraft is not buildings. Your Disney block creation would be a sculpture. In any event, with limited exceptions which don't apply here, every created work has a copyright. While there are exceptions for actual buildings (and other things) in some countries, any other copy of such a work is a copyvio. Let's start from scratch. There is nothing international about this -- it is all US law and Commons rules. One of two things is true. Either:
  • You drew these completely from your own mind with no reference to anything on Minecraft, or
  • These are derived from or use images or parts of images from Minecraft.
In the first case, they are your personal creations and we do not keep personal art from non-notable artists, see COM:SCOPE.
In the second case, your images are derivative works of the copyrighted work of other people and therefore must be deleted as copyvios.

 Comment File:Skin de Diamantum576.jpg has a watermark from novaskin.me/wallpapers, a page that seems to provide a functionality where you can place your own player skin into a pre-made wallpaper. I've updated the page to show the Apache license, rather than the CC-own work claim. Checking the Feed the Beast modpack list the modpacks included in the screenshot are All Rights Reserved, which I would assume includes the logo too. It does not matter whether Mojang claim ownership or acknowledge the character, as this representation of it was made by modifying Minecraft textres. The Herobrine skin is clearly a derivative work of the Steve skin. Additonally, even if it were the sole authorship of the uploader on Gamepedia, the image is only licensed CC-BY-NC, which is not allowed on Wikimedia Commons. These photos are of a Minecraft Papercraft Chess board. The artwork on all the pieces is from the game Minecraft (by Mojang AB) and Pixel Papercraft may also arguably hold some copyright in the chess designs. These photos seem to exceed COM:DM, as the only purpose/value in the photos is to showcase the copyrighted artwork (i.e. blacking out the copyrighted parts would mean blocking out basically the entire photo). COM:DM Sweden would apply since Mojang AB is a Swedish company, and from the few examples listed on that page, it seems Sweden may have even stricter laws than the U.S., making it more likely these are not de minimis.

Possible copyvios. I do not trust this user as many of their images appears to be blatant copyvios from other website. I have nominated some for speedy deletion but decided to DRs these ones as they do not have Exif metadata. Considering that this user uploads images protected from other website here. I think we should delete all these images per COM:PRP. Comment This will take some work to sort out. While those logos aren't CC-BY-SA, at least some of them are in the public domain because they do not satisfy the threshold of originality required for copyright protection. File:Bloomberg TV.png, File:Google Maps.png and File:Google+ Logo.png are examples. Those should be tagged with {{PD-textlogo}}. I wonder whether those aren't duplicates of existing images, though. Both files are 404 at Flickr. "Infected Shadow" is Flickr member since 11.2008. Above files were already circulating in the Internet before that date. Hi Nidal Sabi, I don't have a probem if this newspaper remains on Commons, but the probelm is that there exits a copyright law which is protecting the author of the of the text and the photographer of the pictures. They can sue the Wikimedia, the association behind wikipedia and commons, and that can cost a lot of money. It would help us if you provide us more information where this newspaper was published and who are the authors and photographers. If you ask the newspaper and the photographers if we can upload this newspaper under a free license, like Creative Commons CC-BY-SA 4.0 (see here). If you don't get any permission from the newspaper it becomes very complicated and we have to check the protection periods. C'est bien possible, néanmoins que signifie FoP ? The UKGLF does not authorise the re-use of any personal data." In a case like this, it's not a non-copyright restriction situation. A non-copyright restriction situation would be when a licensor does offer a work under a free license, while considerations unrelated to that license may restrict the use of the work. The work would not be excluded from the license, but its use may be restricted by other considerations. It's not the case here. In the case of the OGL, personal data is excluded from the scope of that license itself. Puramyun31 I think you are conflating the terms of a licence that we consider free (and such a licence would permit any use by anyone for any purpose as far as the copyright-owner's rights are concerned) and the reasons why someone might wish to offer a copyright work under that licence. It seems that in general the UK government do not wish to offer images that contain identifiable people under the Open Government Licence. What their rationale for this is I'm not sure, but I don't think they are opposed to free-content projects, but probably more concerned with the wider possibilities for re-use mixed with personality rights that makes things a bit complicated. For example, just because a photograph of a person has a free licence, doesn't permit Apple to use that photo to endorse their next iPhone in an advert. It might be that they wish to prevent any potential for such misuse by simply disallowing their departments from offering the work under OGL in that case. Similarly, stock-photo agencies will not generally offer images of identifiable people without a model-release. This isn't something we can choose to ignore like some other non-copyright restrictions. It either has an OGL or it doesn't. Puramyun31, I'm speculating and no lawyer so may be talking out of my ass. Images of identifiable people are protected in the UK by personality rights law, and this is a separate thing from copyright (which is a right of the photographer/employer rather than the subject of the photo). Remember the OGL covers "information" not just photographs. So I think they are limiting the scope of the OGL so that departments don't accidentally release personal information (which may be restricted by various laws) under a licence that appears to permit more usage. If an identifiable photograph of a person is regarded as "personal data" by the UK Data Protection Act (which as noted above, they believe it does) then there are various rights UK citizens have about that data and how it is used. It is really quite restrictive and certainly means that government departments can't automatically give that "data" (photograph) away for anyone, anywhere to reuse for any purpose. It might be that the subject of the photo (such as a cabinet minister) can authorise the use of their photo under OGL in a way that appears to contradict the general exclusion, but I'm just guessing. What do you mean 'personal data' Colin? The Open Government Licence does not cover the use of personal data..these are official images of UK 'cabinet ministers', just go through every article of a sitting (or past) cabinet member and you will come across a similar type of images (white background) being used..we have been allowing this for a few years now..what has changed? the key part of Open Government Licence is the part i bolded..Here are 5 images added by Innotata

Stemoc, I'm trying to understand this licensing issue now that I've got involved in investigating it, and it's important as these images are used on Wikipedia for important articles, and are likely to be re-used by others too. Can you please AGF since your bad-faith assumptions of others and ad hominem comments have landed you at AN/U and will lead to a block. The presence of other images with possible problems is no defence and they will need investigating too. This particular image of IDS was taken from the Flickr page and that image is licensed CC BY-NC-ND 2.0 which is not suitable for Commons. You may have found a similar/smaller image on another website but that doesn't confer the licence onto this high-resolution image. We haven't got any legal advice that the OGL is transferable that way. The situation with CC licences was partially clarified by CC in their FAQ where they claim a CC licence covers the "work of copyright" regardless of resolution, but they point out that determining if two images found randomly on the internet are really the same "work of copyright" is a matter for a judge, not amateurs. When did i say the images Innotata added were copyvio? I was pointing out that those images are under OGL and Innotata labeled them as such and as linked above, this image is directly from gov.uk where it falls straight under OGLv3, i added a Higher Quality version of it from flickr and as per earlier, it doesn't matter what the licencing tag was used on flickr for this image, its an original image of a cabinet minister taken by a crown employee which puts it under OGL..same applies to the pic of David Cameron you were talking about on AN/U--Stemoc 11:38, 10 October 2015 (UTC)[reply]
You claimed you were being targeted, which implies you think these other images deserve scrutiny that only yours has got. Well those other images are being investigated too. I'm not clear which photo you are saying "is directly from gov.uk where it falls straight under OGLv3"? The IDS one? Please supply a link if that is the case. Please also supply the legal advice you are using which assumes that a thumbnail on a GOV.UK website authorises you to take a "Higher Quality version of it from flickr" (which is explicitly licensed CC BY-NC-ND 2.0) and assume the OGL applies to both. Please find a source for this claim or accept you are wrong. All such works fall under "Crown Copyright", not "OGL". The OGL is something that government departments have to explicitly and consciously offer specific works under. My current interpretation of the OGL is that it does not cover images such as this. It's an identifiable person and we have two good sources saying such images are considered "personal data" and so automatically excluded from the OGL. The fact that a thumbnail in present on the GOV.UK website and that website generally offers its contents under OGL does not mean that thumbnail is OGL. This is a common situation where a website generally offers material under one licence but there are exceptions for this, particularly for certain images. An example is Wikipedia where the content is generally under CC BY-SA 3.0 + GFDL but individual images may be a different CC or use FAL or be PD. Secondly, even if the thumbnail was offered under OGL, this doesn't automatically extend to all higher resolution or higher quality "versions" found elsewhere on the web. The fact that several government Flickr streams (that offer high-resolution versions) use NC and ND variants of CC licences would strongly indicate that when they explicitly publish images, they are quite specific that those images are not freely available for all purposes like OGL. -- Colin (talk) 12:51, 10 October 2015 (UTC)[reply]

Update. On reading the UKGLF I see in section 7 that there is an Controller's Offer. Sorry if this is something lots of other people are familiar with, but I'm just getting my head round it. The Controller of Her Majesty’s Stationery Office manages Crown copyright and Crown database rights. The document states that "the Controller offers information which is subject to Crown copyright and Crown database right, or to copyright or database right which has been assigned to or acquired by the Crown (Crown information), for use under the terms of the Open Government Licence." So this offer does appear to automatically place Crown Copyright works under OGL, and that looks very much like Stemoc's position. However, there are some important exclusions, as listed in section 7.2 of that document. The first important exclusion is "personal data", which we have two good sources say includes photographs of identifiable people. The second exclusion is information/media generated by departments who have a "delegation of authority", and a long list of these can be found here. For example, the MoD make it quite clear that they will explicitly state the licence/copyright situation of their photos and that one can't assume any default licence. The image above doesn't come from the MoD, which leaves us to decide if the "personal data" exclusion from OGL means we need to delete all the MP headshots that have been uploaded and tagged incorrectly. It certainly seems that whenever I look for a high-resolution image it has a ND/NC licence rather than an OGL licence against it. -- Colin (talk) 19:45, 10 October 2015 (UTC)[reply]


Kept: Copyright, and licenses given to copyrighted works, apply to the actual 'works' themselves, not to specific reproductions of them. Merely reproducing an identical image at a higher resolution involves no creativity, and thus does not create a new copyright claim. The same image is OGL licensed at www.gov.uk, as noted. The dispute about if the OGL is 'intended' to be applied to identifiable images is moot... the image 'was' licensed in that manner, and so is acceptable.
