Although the company is dated 1784, the date of creation/publication of the logo is not clear. On en.wiki the logo is being used under fair-use claims and even the unused previous versions have been deleted. See en:File:Svyturys_logo.jpg. The present file on Commons is unused and should be deleted as per COM:PRP. Also, the file certainly has wrong license here on Commons and file description says, it has been taken from Facebook by a new uploader who is perhaps not so well-versed with copyright laws. Some doubts whether the Flickr-user is really the photographer, as the image likely dates to the late 1990ies (band was active until 1997), whereas it is labelled to be from May 2013 and was uploaded to Flickr only 4 days before upload to Commons. Eventually Flickr user (who has Flickr-uploaded 3 more images from the band) should be contacted for clarification. Túrelio (talk) 10:01, 7 May 2013 (UTC)

- Keep I missed and converted this to a DR instead of removing the template :) The user who tagged this speedy thinks it clearly surpasses the threshold of originality –moogsi (blah) 11:56, 7 May 2013 (UTC)

- In fact it seems that the threshold of originality is very high in US and other lands - by comparison with Belgium or France for example... Maybe there should be a new {{PD-shape-US}} or the like? Anyway for the moment I will remove the deletion template. — François [Discussion] 13:06, 7 May 2013 (UTC)
- It's a very difficult issue. There is a tendency on Commons to apply U.S. standards to logos regardless of their origin. As you say, it is relatively high in the U.S., but really {{PD-textlogo}} is meant to be applied with respect to local laws. Unfortunately it's unclear to us where the threshold of originality for a logo is in many countries. In some cases it's low enough to practically not be there at at all. I'll leave this open for now –moogsi (blah) 15:24, 7 May 2013 (UTC)
- Keep Circles and Text are {{PD-ineligible}}. {{PD-textlogo}} and/or {{PD-shape}} would be apply... -- Perhelion (talk) 10:59, 8 May 2013 (UTC)
- Keep I uploaded that file and we are using it in many pages since Lua is a technology used by Wikimedia now. Lua is an open source project and the spirit of the license is CC, but probably at the time they created the logo such license didn't exist or they were not aware of it. I actually emailed them asking for relicensing but got no response. I tried...--Qgil (talk) 16:21, 8 May 2013 (UTC)
Kept: The nomination is withdrawn and there's no arguments in favour. It can be said that the license is in fact a reassertion of the moral rights that they already have with respect to the logo, and don't affect the copyright status. –moogsi (blah) 16:31, 8 May 2013 (UTC)

It's a pity there is not more focus by some on progressing Lithuania to allowing FOP so that the great work of the artists, sculptors and creators of the country can be more widely appreciated and presented to the rest of the world in essentially a non-commercial environment. It is relatively much easier to delete someone's work from this forum than to create it in the first place, and in some of the photos nominated the work in question (eg Vilnius Landmarks 103.jpg) is not the primary focus of the image or the work is essentially in shadow so not a challenge to artistic content. From past experience it is probably a forlorn hope but reconsideration of the images included in the above list would be welcomed, not only by the photographers but by those interested on selflessly promoting the work of Lithuanian artists. --SM:!) Image states it was taken by an employee of the Smithsonian National Air and Space Museum. While some employees are federal workers, a number are contract workers or other civilian employees, and Smithsonian does not distinguish which is which when publishing images. Thus, it is not possible to tell if this image is without copyright (this also applies to the majority of other Smithsonian-created images we have). — Huntster (t @ c) 03:25, 7 May 2013 (UTC)

- Delete In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Derivative work of modern in Russia. Erected after 2006. No Panorama Freedom in Russia. A.Savin 10:54, 7 May 2013 (UTC)
- The photo shows Kostroma university's courtyard, not just the statue! Zinoviev's statue stands in place of public resort and isn't the basic object of this photo! The main object - the bench in the foreground! :) See Article 1276 of Part IV of Civil Code of the Russian Federation: "Free Use of Work Permanently Situated in Place of Public Resort. Reproduction, broadcasting to the air or via cable shall be allowed, without the author's or other copyrightholder consent or payment of royalties, of photographic work, work of architecture or visual art, that permanently standed in places of public resort, except where portrayal of the work by such method is the basic object of that reproduction, broadcasting to the air or via cable or where portrayal of the work is used in commercial purposes." --Almapater44 (talk) 11:35, 7 May 2013 (UTC)
- "...or where portrayal of the work is used in commercial purposes..." => freely licensed stuff must be eligible for commercial usage. Composition is imo way too centered and focused on the monument to apply de minimis here. --A.Savin 12:25, 7 May 2013 (UTC)

This is an election poster in Iraq. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in this case. Stefan4 (talk) 14:17, 7 May 2013 (UTC)

- Keep FoP and personality rights in India closely follows the UK, so I see nothing here to worry about. This is not candid photography, the ladies know they are being photographed and pose for the camera rather than looking away, glaring, or covering their faces. My experience of photographing relatives, friends and strangers in India (away from the tourist spots), was that people generally enjoy being photographed and will ask you to take a photograph as a memento. Surprisingly, at a funeral pyre I put my camera away out of respect for such a private event, and the relatives immediately asked if I would take photographs as a way of remembering their mother/grandmother. --Fæ (talk) 23:15, 7 May 2013 (UTC)

Clearly an invalid license. Cover would be a design of the Israeli government so a 2d scan would be a derivative image that cannot assign new license rights to the person doing the scan. Spartaz (talk) 16:19, 7 May 2013 (UTC)

This is absolutely uncorrectly licensed. The design of the page is a standard format incorporated in the 1954 convention on stateless persons and clearly does not belong to the uploader. I suspect this should be PD as the overall design belongs to the UN and I doubt that a national crest would qualify in its own. Spartaz (talk) 16:31, 7 May 2013 (UTC)

Surely not licensed correctly. The scanner does't acquire a license through a derivative copy. The format comes from the 1951 convention on refugees so probably belonmgs to the UN. The design of the cover belongs to the French government but i suspect its not unique enough to be licensable. ?PD or delete but not to keep the license here, Spartaz (talk) 16:39, 7 May 2013 (UTC)

- Oh, what a mess. While I find it likely that NASA produced File:GPN-2002-000184.png and File:Soviet ballistic missile development between 1946 and 1956.png, I simply can find no actual evidence of NASA producing any of them. What puts so much in doubt is that NASA is stated as the source of some of the Soviet-era photographs, which, given the secrecy of the Soviet program, has zero percent chance of being NASA-produced. They have really done themselves and the public a disservice by not specifying sources for their material, but it really has only been recently that they've cracked down on unsourced material on their sites. — Huntster (t @ c) 06:11, 8 May 2013 (UTC)

Reduntant. Almost similar picture with a bit more light is here. Kulmalukko (talk) 11:49, 7 May 2013 (UTC)
Keep Kulmalukko says that File:Himmelsrichtungen_(Blinky_Palermo)_190-9006_IMG.JPG has an additional interest because it has more light, and, I suppose, he thinks it's interesting to keep it because shows clearer some details that in File:Himmelsrichtungen (Blinky Palermo) 190-9004 IMG.JPG are lost or more difficult to be seen. This is the reason not to delete File:Himmelsrichtungen_(Blinky_Palermo)_190-9006_IMG.JPG and I agree with him in not deleting it.
However, the ambient was not clear. Light was scarce and File:Himmelsrichtungen_(Blinky_Palermo)_190-9006_IMG.JPG doesn't show its scarcity, because it's clearer than the room actually was. File:Himmelsrichtungen (Blinky Palermo) 190-9004 IMG.JPG is a good complement because it's darker and therefore it matches better what the place actually was.--Pere prlpz (talk) 12:18, 7 May 2013 (UTC)
According to the link, this entered the public domain in the source country in 1998. That is two years too late: it remains protected by copyright in the United States for 95 years since publication. Stefan4 (talk) 14:24, 7 May 2013 (UTC)
- Delete, but not for the reason given. The poster is actually still copyrighted in Switzerland. It is the work of Ernst Keiser (1894-1960).[5] However, it could be moved to the English Wikipedia, since it is PD-US-1923-abroad. (The poster was published 1920, not 1927 as the image description page claims.) Lupo 19:46, 8 May 2013 (UTC)

- So do I. However, the 1927 date came from some undetected vandalism that I have reverted now.[6] Lupo 11:20, 9 May 2013 (UTC)
- Just as an aside: if the author were unknown, it would have been published anonymously, and then it would have gone out of copyright in Switzerland at the end of 1950. See en:Copyright law of Switzerland. (Until 1955, Switzerland had a copyright term of 30y, then until 1993 50y, since then 70y, and all extensions applied only to works still copyrighted when the extensions ocurred.) But since the author is known, all that is moot here: the poster is copyrighted in Switzerland until the end of 2030. Lupo 19:46, 8 May 2013 (UTC)
- Feel free to add this information to w:WP:Non-U.S. copyrights. It affects the copyright status of many anonymous Swiss works in the United States and unless that Wikipedia page contains the correct information information, people may incorrectly try to delete a Swiss work as copyrighted in the United States. --Stefan4 (talk) 11:06, 9 May 2013 (UTC)
- w:WP:Non-U.S. copyrights already mentions the 50y term, which is sufficient for correct URAA-determination of copyrights. Granted, it only mentions 50y p.m.a., but that kind of implies for anonymous works 50y since publication, as that's the usual way to treat anonymous works in most countries having a p.m.a scheme. A cropped and downscaled version of this file is also available at [7], and the uploader seems to claim to be/represent the owner of that web site ("own work" given as source, but the web site owner "Liliputbahn im Prater GmbH" given as author). It is not entirely clear to me who copied from whom. Strange situation here, it would seem best if the company who owns that web site - if the uploader really represents them - sent an email to OTRS. darkweasel94 16:09, 7 May 2013 (UTC)
