Upload was first sourced to tollywoodblog.in plus a blog as alleged author. After I had tagged it with missing-permission, the uploader suddenly claimed it as own work. However, the image obviously comes from a gallery at http://www.tollywoodblog.in/2012/01/tapsee-in-transparent-saree-at-shadow.html. This website is not under a free license, but says in its disclaimer "Some images contained in tollywoodblog.in have been obtained from various internet sources. The copyright of these pictures belongs to their original publisher / photographer."[1] -- Túrelio (talk) 18:13, 24 October 2012 (UTC)

This file was initially tagged by Mithril as no permission. This because the source links through the "ecorights"-logo to here (version as of 5 Apr 2005), which explicitly contradicts the PD-claim and does not release rights for commercial reuse. I think therefore that this image should be deleted. Lymantria (talk) 09:07, 24 October 2012 (UTC)

I think this SVG file is a redrawn image of this image (with the only difference being the colour of the tongue) and as such a copyright violation. Eleassar (t/p) 20:44, 24 October 2012 (UTC)
- I withdraw my nomination The image was published in this official document and is as such free for usage. Po svojem namenu se taka dela ne razlikujejo od uradnih besedil, zato je treba šteti, da tudi zanje velja izjema od avtorskopravnega varstva.29" This translates as: "Although the law based on the example of the Berne Convention discusses only official texts, in the frame of official jurisdictions other categories of authored works also often appear as parts of the official text, its annex or independently (e.g. urban planning maps in spatial files; drawings of traffic signs; drawings of the national coat-of-arms, of municipal coats of arms [emphasis mine], of flags and the music of the national anthem; sketches and plans from the patent file after the official publication of the patent). In its purpose these works do not differ from official texts, therefore it should be regarded that they are exempt of copyright law too.29"

Unclear source information. Likely not the uploader's own work. Looks as it was scanned out of a e.g. book High Contrast (talk) 19:46, 24 October 2012 (UTC)
- It's a derivative of a US Patent of 1905–1907, so before the retouching it was in PD. That's why I considered the file as own work. Ain92 (talk) 19:51, 24 October 2012 (UTC)
- You are right but giving as source "own work" is definately not true. The image is in the public domain but you claim a CC license on it just for having rotated it.
Let's keep it short: please just add all relevant information to the file description and we can close this disc. here. Regards, High Contrast (talk) 19:57, 24 October 2012 (UTC)- I added link to the patent. Do you want me to change the license? Ain92 (talk) 19:29, 25 October 2012 (UTC)
- Yes, that would be correct. You can use this template {{PD-US-patent}} - this one should fit. Regards, High Contrast (talk) 19:02, 26 October 2012 (UTC)

As usually, Freedom-of-panorama exemption requires permanent installation in the public, which is evidently not the case with this sculpture on wheels. Thereby, the photo violates the copyright of the sculptor. -- Túrelio (talk) 08:39, 24 October 2012 (UTC)
- I am not sure. The wheeles are probably there so that the sculptures can be on display daytime only. If intended to be used in this way until scrapped, they probably can be regarded as permanently installed. --LPfi (talk) 10:18, 24 October 2012 (UTC)

- Because until recently, all of us (myself included) were being incredibly stupid. See w:Template talk:FoP-USonly#RFC: Does US FoP apply to foreign works? for the recent discussion that green-lighted worldwide FoP on the English Wikipedia. There's a lot of things none of us thought about. Take, for example, the photos of German statues on Commons. Again by lex loci protectionis, they may be copyrightable in the US. Right now the typical approach is to just turn a blind eye to US FoP when it's unfavorable to us, but sooner or later we've got to do something about it. -- King of ♥ ♦ ♣ ♠ 07:02, 27 October 2012 (UTC)

See Special:PermanentLink/81565860#File:Stanley Theatre Heritage Plaque.jpg: the OTRS permission is only from the photographer but not from the writer of the text. Canadian FOP only applies to artistic works, but this is a literary work. Stefan4 (talk) 13:53, 24 October 2012 (UTC)
- Comment What if we "clouded out" the text part--you know, so it becomes too fuzzy to read? If people could still see the upper part, with "Stanley Theatre" (and the architect's name?) written under it, it would still be somewhat useful as an image, without infringing on any literary rights. Or crop the bottom of the picture off? --Moisejp (talk) 01:54, 25 October 2012 (UTC)
- The problem is that you only can take photos of artistic works if they are works of artistic craftsmanship. While a metallic plaque probably counts as a work of artistic craftsmanship, the art drawn on the plaque does not. Thus, you would have to remove the logo too. --Stefan4 (talk) 12:36, 25 October 2012 (UTC)
- Because the logo is copyrighted, I presume? Could you please direct me to where all of these rules and distinctions are specified? Thanks. --Moisejp (talk) 15:01, 25 October 2012 (UTC)
- The link COM:FOP#Canada actually does include (if you scroll up) "Sometimes, a literary work is a part of a sculpture or is presented on a publicly accessible plaque. It is usually understood that the particular presentation of the work falls under the panorama freedom." Where does it say that this is not true in Canada? --Moisejp (talk) 03:34, 26 October 2012 (UTC)
- That is just a generic section which applies to some countries but not to all countries, without further specifying which countries it applies to. Some more specific text from the COM:FOP#Canada section: "The freedom provided by the quoted section does not apply to typical two-dimensional works such as paintings, murals, advertising hoardings, maps, posters or signs." This is a sign, so FOP does not apply in Canada. --Stefan4 (talk) 12:36, 26 October 2012 (UTC)

- Some people here: Commons:Deletion_requests/Files_in_Category:Plaques_in_Vancouver are arguing that such Heritage in Vancouver plaques are 3D. I'd agree that it could be considered 3D. Also, you're changing your arguments. Here Commons:Deletion_requests/Files_in_Category:Plaques_in_Vancouver you wrote "2D or 3D doesn't matter since it's text." Now you're saying that 2D vs 3D is an issue. --Moisejp (talk) 14:12, 26 October 2012 (UTC)
- It doesn't matter so much whether it is 2D or 3D. It only matters if it is a work of artistic craftsmanship or not. A 2D work is usually not a work of artistic craftsmanship, and a 3D work is usually a work of artistic craftsmanship, but there are exceptions. Signs are specifically listed as not being works of artistic craftsmanship. A work of artistic craftsmanship has to have two features: it must be artistic, and it must be a work of craftsmanship. In what way is the text artistic? According to en:craftsmanship, a work of craftsmanship is an "item[] that may be functional or strictly decorative, including furniture, sculpture, clothing, jewellery, household items and tools or even machines such as the handmade devices of a watchmaker". In which way is the text an "item that may be functional or strictly decorative"? --Stefan4 (talk) 14:44, 26 October 2012 (UTC)
- Keep. I don't think any evidence has been presented so far that clearly and unequivocally shows that this plaque, which by some people's judgment can be considered 3D, falls under the Canadian standards of what must be deleted. --Moisejp (talk) 14:19, 26 October 2012 (UTC)
- According to COM:FOP#Canada, "The freedom provided by the quoted section does not apply to typical two-dimensional works such as paintings, murals, advertising hoardings, maps, posters or signs." In which way is this not a sign? --Stefan4 (talk) 14:44, 26 October 2012 (UTC)
Deleted: The text is certainly a problem. The rest of the plaque is almost certainly a problem, but that issue is moot because the plaque falls out of scope if the text is blurred. . Jim . . . . Jameslwoodward (talk to me) 23:49, 2 December 2012 (UTC)

- Delete Just because it's Brutalism (architectural style) doesn't mean that it's not ineligible for copyright. The architect made deliberate artistic choices in the extruded windows, the bar windows, and the placement of extruded and indented pieces. Industrial design only works in cases where an object is entirely the result of the necessities of its creation (i.e. an unadorned water tower would usually make the cut because the functions of the tower, rather than artistic choice, dictated its design). In this case, there is clear (if, in my opinion, kind of 'meh') artistry. Sven Manguard Wha? 13:55, 28 October 2012 (UTC)

- I've sent an e-mail to Pr. Ron Blakey to ask for a confirmation in either way, let's just wait for his opinion if any. Michelet-密是力 (talk) 05:49, 26 October 2012 (UTC)
- You can see Mr Blakey's stand on his own website at the bottom of the page (http://cpgeosystems.com/globaltext2.html): "All maps are copyright to me, Ron Blakey, and may bu used, with citation to Ron Blakey, NAU Geology, for educational, non-profit, non-commercial purposes. For commercial uses, please contact me." It's made clear there that the maps are NOT freely available for commercial use, and thus they shouldn't be in the Commons. Also, I contacted Blakey by email about this, and he confirms his displeasure. It seems the guy who uploaded these maps back in 2008 didn't realize that Wiki Commons files are all automatically labelled as being free for all purposes, and Blakey was misled to believe his wishes would be honored.Kurzon (talk) 06:46, 26 October 2012 (UTC)
- The statement on the website is clear enough, so that no answer <=> deletion, of course. But he may want to make an exception for this set of pictures, and allow them to be published under a free license, who knows? And - When was your e-mail contact ? What was the OTRS ticket exactly for ? There is no need to hurry, especially if it can lead to allowing the use of such beautiful pictures. So - let's just wait for his opinion if any, knowing that his silence will obviously lead to suppression. Michelet-密是力 (talk) 19:01, 26 October 2012 (UTC)
- Answer copied from OTRS requests :
- ":The release took place in April 2008 as can be seen from the previous deletion requests. The actual release explicitly licensed the Global Paleogeographic Views of Earth History under CC-BY-SA-3.0 with no link to any specific webpage. KTC (talk) 22:16, 26 October 2012 (UTC)"
- Seems to be OK, then. Michelet-密是力 (talk) 14:45, 28 October 2012 (UTC)

Info I never started a DR for File:SilurianGlobal.jpg which was uploaded by User:36ophiuchi, that was added by User:Kurzon. A DR for this file can be found at Commons:Deletion requests/Files by 36ophiuchi. Please don't change my edits again. NNW (talk) 16:51, 28 October 2012 (UTC)
- I received an answer from Dr Ron Blakey, saying "Yes, please delete my files from "Commons"." I understand that all files uploaded after the original OTRS (April 2008) should be deleted. This leaves out the File:SilurianGlobal.jpg. Michelet-密是力 (talk) 07:51, 30 October 2012 (UTC)
- Sounds reasonable. That means that the files of Commons:Deletion requests/Files uploaded by Sdiillla and both File:Cretaceous-PaleogeneGlobal.jpg and File:Eocene50myaGlobal.JPG have to be deleted, too. The Animated GIFs in Category:Maps of past tectonic plates are all made with data which was uploaded by User:36ophiuchi. NNW (talk) 10:46, 30 October 2012 (UTC)
- @ NNW : Can you list the corresponding GIFs that should be added to the deletion request ? Michelet-密是力 (talk) 19:46, 30 October 2012 (UTC)
- A little misunderstanding: the GIFs are all okay. All original files for them have got the April 2008 OTRS ticket. But File:600 Ma Late Precambrian - South Polar view.jpg and File:Early Ediacaran Global.jpg have to be added to the deletion list. This adds to 15 files:
- File:LateOrdovicianGlobal.jpg
- File:EarlyJurassicGlobal.jpg
- File:MiddleJurassicGlobal.jpg

- File:EarlyDevonianGlobal.jpg

Several files uploaded by 36ophiuchi were deleted now, see e.g. Commons:Deletion requests/File:LatePermianGlobal.jpg. Following this decision Commons:Deletion requests/Files by 36ophiuchi has to be reviewed, too, and all these files have to be deleted. Additionally all derivative works made of these:
- File:TectonicReconstructionGlobal.gif
- File:TectonicReconstructionGlobal2.gif
- File:TectonicReconstructionGlobal3.gif
- File:TectonicReconstructionGlobalthumb.gif
- File:Baltica-Laurentia Caradoc DE.svg

- File:Baltica-Laurentia Caradoc NL.svg
- File:ContinentalDriftGlobe 90E.gif

- File:ContinentalDrift600MY.gif
Done all files uploaded after April 2008 have been deleted, but for the file File:Eocene50myaGlobal.JPG which was uploaded in May 2008. The Baltica-Laurentia Caradoc series seems to be derived from files covered by the original OTRS. Michelet-密是力 (talk) 06:38, 15 November 2012 (UTC)
- See also : Commons:Deletion requests/Files by 36ophiuchi (apparently covered by an OTRS ticket)
- See also : Commons:Deletion requests/Files uploaded by Sdiillla (previously refused, the OTRS tiket antedates the upload).
- Ron Blakey has transmitted an (non-specific) OTRS ticket in 2008 allowing existing uploads, but has since expressed (non-specifically) that the uploaded files challenged under "deletion request" (when challenged in the meantime) should indeed be deleted. The minimal interpretation is that all files uploaded after 2008 are not encompassed in the OTRS ticket, and should be deleted. Further clarification may be added if/when available. Michelet-密是力 (talk) 18:48, 15 November 2012 (UTC)
- Done restored the "TectonicReconstructionGlobal" series, based on files uploaded before 2009. Michelet-密是力 (talk) 21:53, 16 November 2012 (UTC)
- Delete As I said at Commons:Deletion requests/File:LateJurassicGlobal.jpg, of which User:Micheletb is well aware, I think the OTRS message is fake. Blakey is a professor at Northern Arizona University and has an e-mail address at nau.edu. The OTRS message in question came from a German ISP that allows anonymous accounts. The first uploader of the Blakey images is German. At one point, the message misspells his nickname as "Rob".
- This account, User:Pretesm, has been blocked for abuse of multiple accounts -- it is a sockpuppet of Rolandhelper, a well known puppet master and abuser of our rules. Pretesm's stay on Commons lasted only five days (10-August to 15-August 2012). We have no reason to believe anything he says.
- I think that without an explicit OTRS license from Professor Blakey, sent from his e-mail at nau.edu, we must delete all of the files related to his work. COM:PRP requires us to delete files where there is a significant doubt about their freedom. Given the facts here, and the ease with which we should be able to get permission from Blakey, if he wishes to give it, we must say that there is more than significant doubt here. . Jim . . . . - Too hasty - Ron Blakey just sent me a mail saying that after our discussion, he allows all files at http://cpgeosystems.com/mollglobe.html to be released with a GFDL / CC-By-SA license. I'm forwarding that to the OTRS and ask him to confirm the authorization on his side. A matter of days, probably. Michelet-密是力 (talk) 20:55, 17 November 2012 (UTC)
- Shouldn't it be published under CC-BY-NC-SA? Blakey does not wanted his maps to be exploited commercially.Kurzon (talk) 22:21, 28 November 2012 (UTC)

Maps by Ron Blakey can only be used for non-commercial use, see here at the bottom of the page. The OTRS ticket is an older ticket and most likely not for these files

Holy sh*t, am I getting it right??? You want to delete a photo of a steam locomotive (JZ 28-006 in Divaca.jpg) because a few bricks of the station's building can be visible in the background????? --Ajznponar (talk) 14:28, 29 October 2012 (UTC)
- It's hard to say that the building was not an object of photographer's interest as well. The locomotive is also depicted in File:Divaca-steam_locomotive_JZ_28-006.jpg and File:Divaca_train_station-steam_locomotive_JZ_28-006.jpg, where the building is much less visible. Can you please express your opinion on whether to delete this image or not? And if not, why do you think it does not violate copyrights. Alternatively, you may also upload a crop that shows less of the station. --Eleassar (t/p) 14:31, 29 October 2012 (UTC)
- I withdraw my nomination for File:JZ 28-006 in Divaca.jpg. It would be a shame to delete such a good photo of the locomotive for a few bricks. --Eleassar (t/p) 00:09, 18 November 2012 (UTC)

Without photographer information, it is impossible to know if these works are free under the Netherlands' 70 years pma copyright. Additionally, works created before 1978 and first published between 3/2/1989 and 12/31/2002 are copyrighted in the US until at least 12/31/2047. Works on Commons must be free in both the source country and the United States. Unless there is some evidence or reason to believe these images had prior publication, we must treat them as copyrighted works and delete them.

- there are pictures here that date back to the 19th century. Don't be so rash as to delete them all. File:Wateringen en Kwintsheul, Toen&Nu - 006.jpg even dates back to the middle ages as per being a photograph of a 2D work of art. I was very diligent in selecting the photographs in the book that were old enough to be published--Vera (talk) 14:57, 24 October 2012 (UTC)
- Under the absurdity that is US copyright law the age of the photographs doesn't matter, only whether they had been published previously. If they were not published until the 1993 book, they are copyrighted in the US until at least 12/31/2047. Dura lex sed lex. Is there any evidence or reason to believe these were previously published? cmadler (talk) 15:03, 24 October 2012 (UTC)
- As to File:Wateringen en Kwintsheul, Toen&Nu - 006.jpg, I think the rules about PD 2D art only apply to straight-ahead photos showing only the 2D work (it specifically excludes cases where a frame is visible); in this case it looks like it's an angled photo including much of the surrounding area also, so it's not strictly a "slavish reproduction" of the original work. cmadler (talk) 15:09, 24 October 2012 (UTC)

File:Wateringen en Kwintsheul, Toen&Nu - 006.jpg is a drawing on a cilinder, so by definition the camera can't be straight ahead of its subject. Pretty much all these pictures come from the local archive (Westlandse Bond). Is donating the pictures a form of publication? --Vera (talk) 15:47, 24 October 2012 (UTC)
- I could probably get OTRS verification from the St. Jan church, if the institution can be considered the copyright holder of the pictures of the church the preceded it. --Vera (talk) 17:09, 28 October 2012 (UTC)
- The copyright holder would have originally been the photographer, and if a photographer is deceased, would usually be the photographer's heir(s). It's always possible that the photographer left them to the church, but that would be a fairly unusual case. As to the postcards, etc., publication prior to 1923 makes them PD in the US, but depending on when the photographer/illustrator died, they may still be copyrighted in the Netherlands. cmadler (talk) 20:02, 29 October 2012 (UTC)

- Per COM:COA, we need to show that this coat of arms a) has a concept that has fallen into the public domain or is in it regardless by declaration of law, and b) that this specific drawing of that concept is in the public domain. So far, I don't see the uploader has done either, although I'd be happy to be proven wrong. Magog the Ogre (talk) (contribs) 03:22, 24 October 2012 (UTC)
