Upload was first sourced to tollywoodblog.in plus a blog as alleged author. After I had tagged it with missing-permission, the uploader suddenly claimed it as own work. However, the image obviously comes from a gallery at http://www.tollywoodblog.in/2012/01/tapsee-in-transparent-saree-at-shadow.html. This website is not under a free license, but says in its disclaimer "Some images contained in tollywoodblog.in have been obtained from various internet sources. This file was initially tagged by Mithril as no permission. This because the source links through the "ecorights"-logo to here (version as of 5 Apr 2005), which explicitly contradicts the PD-claim and does not release rights for commercial reuse. The uploader is probably neither Dan Krashin nor Anthony Munoz – at least he can't be both. There is no evidence that the photographers gave their permission to use the pictures under a free license. Because until recently, all of us (myself included) were being incredibly stupid. See w:Template talk:FoP-USonly#RFC: Does US FoP apply to foreign works? for the recent discussion that green-lighted worldwide FoP on the English Wikipedia. There's a lot of things none of us thought about. Take, for example, the photos of German statues on Commons. Again by lex loci protectionis, they may be copyrightable in the US. Comment What if we "clouded out" the text part--you know, so it becomes too fuzzy to read? If people could still see the upper part, with "Stanley Theatre" (and the architect's name?) written under it, it would still be somewhat useful as an image, without infringing on any literary rights. The problem is that you only can take photos of artistic works if they are works of artistic craftsmanship. While a metallic plaque probably counts as a work of artistic craftsmanship, the art drawn on the plaque does not. The link COM:FOP#Canada actually does include (if you scroll up) "Sometimes, a literary work is a part of a sculpture or is presented on a publicly accessible plaque. It is usually understood that the particular presentation of the work falls under the panorama freedom." That is just a generic section which applies to some countries but not to all countries, without further specifying which countries it applies to. Some more specific text from the COM:FOP#Canada section: "The freedom provided by the quoted section does not apply to typical two-dimensional works such as paintings, murals, advertising hoardings, maps, posters or signs." A 2D work is usually not a work of artistic craftsmanship, and a 3D work is usually a work of artistic craftsmanship, but there are exceptions. Signs are specifically listed as not being works of artistic craftsmanship. A work of artistic craftsmanship has to have two features: it must be artistic, and it must be a work of craftsmanship. In what way is the text artistic? According to en:craftsmanship, a work of craftsmanship is an "item[] that may be functional or strictly decorative, including furniture, sculpture, clothing, jewellery, household items and tools or even machines such as the handmade devices of a watchmaker". You can see Mr Blakey's stand on his own website at the bottom of the page (http://cpgeosystems.com/globaltext2.html): "All maps are copyright to me, Ron Blakey, and may bu used, with citation to Ron Blakey, NAU Geology, for educational, non-profit, non-commercial purposes. For commercial uses, please contact me." It's made clear there that the maps are NOT freely available for commercial use, and thus they shouldn't be in the Commons. Also, I contacted Blakey by email about this, and he confirms his displeasure. It seems the guy who uploaded these maps back in 2008 didn't realize that Wiki Commons files are all automatically labelled as being free for all purposes, and Blakey was misled to believe his wishes would be honored.Kurzon (talk) 06:46, 26 October 2012 (UTC)[reply]
The statement on the website is clear enough, so that no answer <=> deletion, of course. But he may want to make an exception for this set of pictures, and allow them to be published under a free license, who knows? And - When was your e-mail contact ? What was the OTRS ticket exactly for ? There is no need to hurry, especially if it can lead to allowing the use of such beautiful pictures. Sounds reasonable. That means that the files of Commons:Deletion requests/Files uploaded by Sdiillla and both File:Cretaceous-PaleogeneGlobal.jpg and File:Eocene50myaGlobal.JPG have to be deleted, too. A little misunderstanding: the GIFs are all okay. All original files for them have got the April 2008 OTRS ticket. But File:600 Ma Late Precambrian - South Polar view.jpg and File:Early Ediacaran Global.jpg have to be added to the deletion list. This adds to 15 files:

Ron Blakey has transmitted an (non-specific) OTRS ticket in 2008 allowing existing uploads, but has since expressed (non-specifically) that the uploaded files challenged under "deletion request" (when challenged in the meantime) should indeed be deleted. Blakey is a professor at Northern Arizona University and has an e-mail address at nau.edu. The OTRS message in question came from a German ISP that allows anonymous accounts. The first uploader of the Blakey images is German. At one point, the message misspells his nickname as "Rob".
This account, User:Pretesm, has been blocked for abuse of multiple accounts -- it is a sockpuppet of Rolandhelper, a well known puppet master and abuser of our rules. Pretesm's stay on Commons lasted only five days (10-August to 15-August 2012). We have no reason to believe anything he says.
I think that without an explicit OTRS license from Professor Blakey, sent from his e-mail at nau.edu, we must delete all of the files related to his work. COM:PRP requires us to delete files where there is a significant doubt about their freedom. Given the facts here, and the ease with which we should be able to get permission from Blakey, if he wishes to give it, we must say that there is more than significant doubt here. .     Jim . . . . It's hard to say that the building was not an object of photographer's interest as well. The locomotive is also depicted in File:Divaca-steam_locomotive_JZ_28-006.jpg and File:Divaca_train_station-steam_locomotive_JZ_28-006.jpg, where the building is much less visible. Can you please express your opinion on whether to delete this image or not? And if not, why do you think it does not violate copyrights. Without photographer information, it is impossible to know if these works are free under the Netherlands' 70 years pma copyright. Additionally, works created before 1978 and first published between 3/2/1989 and 12/31/2002 are copyrighted in the US until at least 12/31/2047. Works on Commons must be free in both the source country and the United States. Unless there is some evidence or reason to believe these images had prior publication, we must treat them as copyrighted works and delete them.

there are pictures here that date back to the 19th century. Don't be so rash as to delete them all. Under the absurdity that is US copyright law the age of the photographs doesn't matter, only whether they had been published previously. If they were not published until the 1993 book, they are copyrighted in the US until at least 12/31/2047. Dura lex sed lex. The copyright holder would have originally been the photographer, and if a photographer is deceased, would usually be the photographer's heir(s). It's always possible that the photographer left them to the church, but that would be a fairly unusual case.
