Because I found out that the way I made it (copy from a Google Map on a blanc layer) is still considered as derivative work. So it is not permitted to be used in wikipedia. Hoverfish (talk) 00:01, 6 May 2011 (UTC)[reply]

  •  Keep. Per Feist v. Rural, "information alone without a minimum of original creativity cannot be protected by copyright." Since Google Maps attempts to catalog all public geographic data, which itself is not copyrightable, making a derivative of that would not be subject to Google's copyright. The only copyright Google holds on Google Maps is the specific manner in which the information is presented, which you clearly did not copy. -- King of 04:16, 6 May 2011 (UTC)[reply]

Architectural rendering of existing building, most likely copyrighted Beyond My Ken (talk) 17:27, 6 May 2011 (UTC)[reply]

Why would you delete a file that was uploaded by its copyright owner? It's clearly the Museum, and no one has asked you to remove it. Why are you arbitrarily choosing to remove files? The Ukrainian Museum can be reached at info@ukrainianmuseum.org. Since there is no clearly visible method for adding to any kind of discussion about this image, please be good enough to get in touch with me via email. The Ukrainian Museum is the only institution that owns the image.
I see you found how to comment here, that's great. Let me try to explain some things.

First off, this is not the English Wikipedia, this is Wikimedia Commons, which is a different site with somewhat different rules. On en.wiki, you can upload copyrighted images under (very strict) "fair use" policies, but here, copyrighted images can only be uploaded if their use is released in specific ways by the copyright owner. In order for this to happen, some proof has to be offered that the uploader is the copyright owner -- although your user name is "Ukrainianmuseum", that is no proof. I could right now go and make the user ID "Moma NYC", but that wouldn't be proof that I was actually a representative of MoMA. So, step #1 is that you need to prove that you are a bona fide representative of the Ukrainian Museum. After that is done, you must release some of the rights to the picture in a way that's consistent with the Commons' upload policies. You don't have to give up the copyright, but you do have to allow re-use, although you can specify how the image is to be attributed.

The place to go to get all this started is here, just click on this link and follow the directions there. The process may take a while, but in the end, if you're able to provide the neeeded information, the image will be able to stay here. Best, Beyond My Ken (talk) 18:52, 6 May 2011 (UTC)[reply]

Deleted: It is very unlikely that the Museum owns the copyright to this rendering. The copyright is almost certainly owned by the architect, but in any case, we do not have permission to use it.      Jim . . . . Jameslwoodward (talk to me) 00:30, 18 May 2011 (UTC)[reply]

Picture from 1926, if the uploader should be the photographer, he must have an age over 100 years. Not really believable. The combine "Author = Uploader" cannot be correct. Permission needed, because too young for exceptions. Quedel (talk) 17:37, 6 May 2011 (UTC)[reply]

If you read the source website, photographer name Maurice Branger is mentioned. According to http://www.yellowkorner.com/artistes/147/Maurice-Louis-Branger.aspx he was born in 1874 and died in 1950. Teofilo (talk) 18:20, 6 May 2011 (UTC)[reply]

Question raised on Wikipedia as to whether this file has been published before 1923; request that it be deleted while copyright status is determined. ScottyBerg (talk) 21:43, 6 May 2011 (UTC)[reply]

Keep: An independent 3rd party news source uses the image saying its from 1903 thus no copyright issue. Best, Mifter (talk) 23:47, 6 May 2011 (UTC)[reply]
Mifter has misread that story. It refers to an event in 1903, but puts no date on the image. Fences and windows (talk) 02:36, 7 May 2011 (UTC)[reply]
There's really no question about the date of the image, as the Chinese Theater closed in 1911 and became a rescue mission. I've found some sources indicating it closed in 1910. ScottyBerg (talk) 12:10, 7 May 2011 (UTC)[reply]
When it was closed isn't the issue; when the image was published is. I think it is very likely this is a pre-1923 publication, but I can't know this for sure. It's possible this image laid in wait for years before being published, perhaps on a historic places type of postcard. Huntster (t @ c) 00:16, 9 May 2011 (UTC)[reply]
That independent news source also included a photo credit which reads "courtesy of www.arcadiapublishing.com, from 'Manhattan's Chinatown' (2008)", so it is a poor example to choose. Delicious carbuncle (talk) 02:52, 9 May 2011 (UTC)[reply]
Keep; I would have thought this a typical case of "I own the physical media so I own the copyright" confusion, were it not for the fact that the purported complainant is a publisher and — one would expect — is quite familiar with copyright statute. Coren (talk) 14:30, 7 May 2011 (UTC)[reply]
Delete: The date of publication is unknown and there is a claim of copyright violation. Unless we are sure of the status of this image, it should be deleted. Delicious carbuncle (talk) 02:52, 9 May 2011 (UTC)[reply]
However you want to handle it is fine with me. I nominated it for deletion to clarify its legal status when objections were raised. I found another PD photo of the same building on the LOC website and have uploaded it. However, this is a better picture, so if it's legal it should be kept. Art. 81 Ustawy o prawie autorskim i prawach pokrewnych. Robert Niedźwiedzki (talk) 13:26, 6 May 2011 (UTC)[reply]

Z uszanowaniem --Robert Niedźwiedzki (talk) 11:39, 10 May 2011 (UTC)[reply]

ASDFGHJ (talk · contribs), en.wp ASDFGH, uploaded other city skyline photos stolen from the internet, retouched and with false claims of "own work" to Commons and Wikipedia. I refer to File:Nanchang_Skyline_2006.jpg, File:Qingdao_Skyline_2008.jpg, en:File:Chongqing at night.jpg - that’s the photo I identified as bloody obvious copyright violations.

For example the May 4 2009 uploads are from 3(4) different cameras. That’s the first time I became aware of him, already at May 4 2009 File:Busan Skyline.JPG was widely spread on the internet.

I later searched for his uploads in December 2009, using new image search engines - and using Baidu imageseach - I found more evidences or hints that can explain possible copyright violations.

Decorating lists like en:List_of_cities_in_China with beatiful pictures is not a justification to steal photos, to break the law or to violate policies of Wikipedias. Having beautiful photos of cities is nice, having beautiful stolen photos is not the project goal of Wikipedia or Wikimedia Commons, in such cases no image is better.

ASDFGH(J) may explain what drives him to upload a mixture of photos he possibly created himself and photos grabbed from the web. Obviously, and likely he know this himself because he does good work in many parts of Wikipedia, that the stolen photos are the worst vandalism one can do: they give us the impression that we have a good photo of a city so that other people dont see a reason to upload their self-created good photos, but in fact we only have this stolen trash and in the end we have nothing. Please, ASDFGH(J) revise youre uploads!

List of files, without claim that I caught all photos:

No date of death of the author. No reason to believe he is already more than 70 years dead. Date of production about 1920 - but this is not sufficient. Date is too young to assume author is dead more than 70 years. → inapplicable license. Saibo (Δ) 17:28, 6 May 2011 (UTC) edited. --Saibo (Δ) 01:42, 9 May 2011 (UTC)[reply]

--Berginspektor (talk) 08:03, 8 May 2011 (UTC)[reply]

Viele Grüße --Saibo (Δ) 01:42, 9 May 2011 (UTC)[reply]

Bist Du Dir da so sicher? Berginspektor--Berginspektor (talk) 09:10, 10 May 2011 (UTC)[reply]

Alles klar.
Viele Grüße --Saibo (Δ) 22:50, 10 May 2011 (UTC)[reply]

As already stated above but knowingly ignored by Jcb: We have no evidence that the author's name (the original photographer) was not published in conjunction with the image within 70 years of its original publication. Saibo (Δ) 02:46, 12 June 2011 (UTC)[reply]

  •  Comment (largely copy&pasting what i've written elsewhere) we cannot simply assume something to be an anonymous work just because it appears somewhat plausible -- there are, in fact, myriads of ways the creator may use to identify herself -- with the result that in case someone gets sued after publication of the image, she has to prove to have done really extensive research on the author's name (see Katzenberger in Schricker/Loewenheim, UrhR, 4th ed., § 66, 10). authors, for instance, do have the explicit right to determine whether or not they want to be named at all (§ 13 urhg) - in many cases, they are not named simply because it's very difficult to do that technically or because it is not typical for their line of business ("Branchenübung") (think about industrial design or the advertisement industry). but that does not mean such works are automatically not protected 70 years p.m.a., see § 66 (2) urhg: "An die Identifizierbarkeit des Urhebers [sind] [...] keine hohen Anforderungen zu stellen, so dass einem Dritten, der sich auf die verkürzte Schutzdauer [...] berufen will, durchaus ein beträchtlicher Ermittlungsaufwand zuzumuten ist" (Katzenberger ibid.; translation). and that is exactly why the uploading process for anonymous works on dewiki is so complicated. for instance, if the postcard included the name of the company publishing it, you have to contact them etc. —Pill (talk) 00:11, 16 June 2011 (UTC) (@Berginspektor, hier eine automatisch generierte Übersetzung)[reply]

Deleted. No research has been demonstrated. Just the fact, that the image does not have the author's name on it, is not sufficient for Anonymous-EU. As has been stated several times: Thorough research has to be done. I can't see any evidence of that here. -- ChrisiPK (Talk|Contribs) 13:36, 27 July 2011 (UTC)[reply]

Lots of issues here: questionable authorship claims (own work for files supposedly sourced from Youtube and Fareham Solicitors), project scope concerns (a basketball player dressed in a cape, a screenshot of a video of a man in a purple t-shirt, multiple photos of a dog categorised and described as a solicitor), and spamming (several of the file descriptions and supposed source pages are just blatant advertising).
