[edit]Unfortunately, I believe this was (totally unintentional) flickrwashing. Eric Fischer uses CC-BY for all his flickr uploads, many of which are his own photos; however, this set was not. On here, he commented No, I wasn't born yet. I bought them from somebody on eBay and trusted their annotation of the date.

- It's quite an old photo (probably early 50s?) circulated in many places online. What copyright term is relevant here? https://www.copyright.gov/title17/92chap3.html says "Any copyright, in the first term of which is subsisting on January 1, 1978, shall endure for 28 years from the date it was originally secured." So any copyright would have expired unless we have evidence it was extended. I also don't think it's being enforced due to its multiple uses. This is a great photo. I wish we can keep it, but in order to do that we need at least a statement that this is Mayan art from some museum, and not something that is created today. Since this is the same picture is published on Pedersen's homepage it is very probable that he owns the picture, eighter has taken the picture himself (selfie) or knows who took the picture. - For w:en:Copyright to apply it is usually required that the photo is a creative work. I doubt this would be considered a creative work. The photographer always owns photos he or she has taken whether it is a creative work or not. The most obvious difference is that if it is a creative work it is protected for longer than if it is just any old photo. Так, вы удалили фото Б. Абдрахманова - ветерана войны, общественного деятеля, дяди моего мужа. Фото было снято моим супругом и тоже нигде не публиковалось. ːВ связи с тем, что фотоаппарат был настроен неверно (снимала я еще 20 лет назад, на пленочном фотоаппарате), снимок получился с неправильным ракурсом, и я обработала его на paint, обрезав ненужный фон, возможно, поэтому у вас возникли вопросы к фотографии. There's basically no such thing as a sound recording in the US that's so old it's PD; https://www.copyright.gov/music-modernization/pre1972-soundrecordings/ says this will leave copyright in 2031, if it was published in 1930. Prosfilaes (talk) 22:15, 30 January 2020 (UTC)
- Technically, sound recordings before 1972 are still subject to common law. They *can* be PD via common law, which is a more common sense definition than any specific term, but it's nearly impossible to define (and can differ by state). Commercial song recordings are rarely if ever PD that way, if they are still being sold by (or under license of) the original recording company. Come 2021 (i.e. less than a year), this will fall under federal copyright and the common law copyright will (at long last) be extinguished, and it will be more predictably PD based on date of publication. This one lasts until 2031 though, and it will be a federal copyright thing as of next year. Tough to delete something that has been uploaded for 14 years without complaint, but technically it will have a federal copyright for a while. Carl Lindberg (talk) 22:35, 30 January 2020 (UTC)
- From what I understand, if it is true that (1) the recording was published in 1930 and (2) any underlying works (such as a musical composition) are out of copyright and (3) the recording was not subject to any restoration process that would generate a new copyright, then it might be possible to categorize the deletion request under "Undelete in 2031". --Gazebo (talk) 07:43, 31 January 2020 (UTC)
