The head of Anastasia Meshcheryakova is the main object of this image. As described in Commons:Country specific consent requirements#Russian Federation it requires consent from appropriate person for publication. - This photo may not be subject to the requirements of the legislation on the consent of the person depicted, since this person had died before this photo was taken. - Photographs may be deleted on courtesy grounds on Wikimedia Commons. However, this image is currently in use on several Wikipedias which makes it far less likely to be a deletion candidate solely on a courtesy rationale. As suggested above, a case for removal would be much stronger were there a request from a relative (second party, rather than third parties) and were there legal precedent for the source country on, say, grounds of expectations of privacy. --Fæ (talk) 15:10, 18 January 2019 (UTC)

Kept: Deletion requires a basis in policy, which has not been provided. To the contrary: Commons:Country specific consent requirements is a "part of the guideline Photographs of identifiable people," which is itself a "sub-guildline" of Commons:Non-copyright restrictions (for example: "The legal rights of the subjects constitute non-copyright restrictions on use of images" (COM:IDENT) and "laws related to [...] personality rights [...] are entirely independent from the copyright status of the work" (COM:NCR)). Per NCR: "Commons considers non-copyright restrictions to be matters for photographers/uploaders or reusers and are not grounds for deletion of works from Commons." The exception is "personality/privacy laws which do not allow photographs of identifiable people which were made in a private place, unless the depicted person gives permission." This photograph (or video still) was not taken in a private place and, indeed, there otherwise would have been no reasonable expectation of privacy. - To aid the discussion, I've numbered the above images. Some of these images must be deleted, per FOP in Russia. But, some of the images would not have to be deleted as the statue is de minimis to the entire image. #2, #7, #16, #17, #21 may qualify for that. Delete for all the others. [edit]Originally came to attention at VP and discussion User_talk:Lupus_in_Saxonia#Bilder_ohne_Erlaubnis_zur_Veröffentlichung_-??_Fragliche_Sichtweise_eines_Wiki_Users!! where there is a gallery of pictures that should be added to this DR.
There are many photographs which have no obvious educational value per SCOPE and many photographs of women from behind in public, which appear to be an issue for intrusion per IDENT.
This in no way is a criticism of the photographer's interest in publishing photographs of events and public places, just observing that some have these issues.

- Agree there is a worrying pattern. I am unsure if these were taken to prove a point, or whether there was a deliberate intent to be creepy. My nomination statement was mild, but if someone else has specific evidence that has this falls on the creepy side rather than being innocent, it may be worth discussing at ANU and request some more formal answers from the uploader. In the light of new laws about upskirting and the law in Germany, Commons should be seen to take any assertion with evidence as a properly assessed case. --Fæ (talk) 16:19, 9 May 2019 (UTC)

Anyhow these women look pretty anonymised and are not easily recognizable, however if German law is more stricter than these images might not be hosted on Wikimedia Commons if the country of upload is the Federal Republic of Germany as files on Wikimedia Commons are supposed to be legally free in both the United States of America and the country of upload. I fear they are all way out of scope, I don't see the educational point. The file name and the description says only "(female) student at the students' food court – roast (meat) with fresh vegetables – image number" in German, so there is not even an explanation for this series. I suggest to delete them all. - Delete: I’m usually all for keeping stuff, based on a very wide understanding of scope, and I certainly take a dim view on courtesy (and other) deletions where personality rights are argued over photos with staged poses and/or not unflattering shots. This whole lot, tho, is in my opinion wholly unredeamable, tainted with the shadow of a creepy peeping Tom the likes of which Commons should want to distance itself as far as possible. Delete it all — for even those photos which are acceptable in isolation can still be traced back to those which are readily identifiable to the unaware “model(s)”, with possible unpleasant effect in terms of online harassment and stalking (see how this slideshow moves from food plate and utensils to unauthorized chest shot). - And, unfortunately, there is another problem with that. Isn’t it that the copyright of text and figures go over to the publisher of the paper (i.e. Elsevier Ltd in this case)? If so, Lucinda Backwell would’t have the right to publish that picture under a CC license even if she truly were the photographer, because she isn’t the copyright holder anymore. - @Wyatt Tyrone Smith: If the picture would appear just ‘somewhere in the internet’, it would suffice to follow the instructions given at the OTRS page, point 2, case 2: “I am the copyright owner but my file has been previously published without a free license on a medium I can't alter.”
- However, I am afraid that the case is somewhat more complicated. In the copyright notes at elsevier.com it says that when an author publishes an accepted manuscript as a subscription article (i.e. a non-open-access article) he/she “transfer[s] copyright to the publisher [i.e. Elsevier Ltd] as part of a journal publishing agreement” and that he/she retains the right to “share their article for Personal Use, Internal Institutional Use and Scholarly Sharing purposes, with a DOI link to the version of record on ScienceDirect (and with the Creative Commons CC-BY-NC-ND license for author manuscript versions).” (underscorings by me) ‘The article’ here probably does not only refer to the printed or electronic version(s) of the published article proper, but also to “any tables, illustrations or other material submitted for publication as part of the manuscript” (see Elsevier sample publishing agreement, “Assignment of copyright”). Since the article that contains the picture in question is a subscription article, the Elsevier copyright rules may apply here, i.e. Lucinda Blackwell probably has her copyright which she originally held in that picture transferred to Elsevier Ltd and she only retains the right to use it for non-commercial purposes (CC-BY-NC-ND license) which is not in accordance with the rules of Wikimedia Commons that demand publishing under at least one license that (also) grants third-party commercial use (e.g. CC-BY license).
- So IMHO it might be best to let this deletion request go its way and to upload a different picture of the Heelbo bonebed, i.e. one that was not part of the submission of the manuscript of the article “Holocene large mammal mass death assemblage from South Africa” in Quaternary International or any other article that was not published under a “free” license (e.g. CC-BY license). The author of this photography is well known. His name was Piotr Barącz an he published this and other Rubinstein photos in magazine "Polska" and at two personal exhibitions of Rubinstein photos. He died in 1991 and his son has got all rights for his father's photos. Photo agency East News is thet only place represented this collection worldwide. We've got the original Barącz's photographic films from Rubinstein visit in Warsaw in 1960. - I'd just like to point out that not a single one of those is a real SVG file.
