User:Samuel Long BRD, the uploader of this file, has requested several times its deletion. We do not use the file. We have already quite a number of topless women images. There is no real need for this and even less need we have to make anyone suffer. Therefore I propose its deletion for "Violation of model rights + unused personal file" as suggested by the last admin who closed a DR on this file. Thanks for your comprehension. Kept: Per COM:INUSE: "The uploading of small numbers of images (e.g. of yourself) for use on a personal user page of Commons or another project is allowed as long as that user is or was an active participant on that project." L'original a été pris par moi-même en 1973. Je dispose de la diapositive originale. La basse résolution vient du fait que j'ai extrait une portion de l'image. Having looked at other discussions at commons.wikimedia.org/wiki/User_talk:Patrick_Rogel it appears that discussions are conducted in English. So here is my reply, in English, this time.
First let me explain the context of this photo and why I contributed it. I happened to find the person portraied to appear in some of my old slides that I recently scanned. Looking for her in Wikipedia, I found the infobox was asking if someone could contribute a photo. This file has been contributed for this purpose. Also, since that person has died in 1979 (as stated in WikiData) the only possible contributions are digital copies of analog photos or slides. Also they likely would come from people like me who discover photos in their archives.
So let me take one by one the reasons cited for the deletion request.
“False date”: please explain. I cannot answer to an unprecise assertion; I can only speculate. Is it that the date in the metadata does not correspond to the year in the legend? If so let’s consider that the metadata section in Commons describes the metadata as this: “This file contains additional information such as Exif metadata which may have been added by the digital camera, scanner, or software program used to create or digitize it.” (emphasis mine). So it is must be expected that the metadata contains a date and time different that the original analog photo of 1973. Anything other than that would actually be suspicious.
“low-re photo of photo”: actually it is a photo of a 35mm slide (Ektachrome I think), which is my own work in 1973. It was taken using a Nikon F with 43-86 Nikkor zoom. I own the original slide (and even still own the camera actually). The copy was made using the equipment in the metadata section (Nikon D5500 with AF-S Micro Nikkor 40mm lens). The low resolution is actually the analog grain and is due to cropping. However, the intended use if for the infobox, which calls for a small picture.

Kept: Uploader's detailed explanation is convincing. I have myself occasionally digitized images from my own slides or negatives, ending up with similar issues and image sizes - if one has to crop a small part of a digitized slide, artificially increasing the resolution doesn't lead to better image quality. This one is unfortunate. The United States Copyright Office initially ruled this uncopyrightable here, saying it was just below the line. The logo was then accordingly moved to Commons. It looks like American Airlines sent them a higher-resolution version of the logo, and based on that, the USCO changed their mind, and decided it was just above the line. They mention it is a thin protection, preventing for the most part just identical copying, but that is of course what we have here. So it would appear as though American Airlines has a valid registered copyright on this logo now (VA0002130520 for "American Airlines Flight Symbol"), meaning it is non-free. Kept: The picture has been taken at a trade fair open to journalists probably during a press conference/event [2], so it can be concluded that it has been taken in a public place. Although the German law requires consent even for pictures taken at public places (Commons:Country_specific_consent_requirements#Germany), it does not require it to be written. Accoring to Commons:Photographs_of_identifiable_people#Consent, "at the most basic level, a subject looking at the camera and smiling might normally be assumed to have given their consent to have their photograph taken." - Comment When using an image to illustrate something in that image, de minimis is no defence. That is true regardless of how unimportant the feature is for the image itself. This image seems to be an image of the Louvre. You cannot get a similar image of it without including the pyramid, so the presence of the latter is incidental. The problem is not in the photographer, but in that the pyramid was placed in this way. Can you get a monopoly on images of out of copyright architecture by placing your copyrighted work in front of them? I do not think that is the intention of the law. Remove the image from the pyramid articles (use a close up fair use image instead, where allowed), and be done. --LPfi (talk) 08:15, 25 March 2019 (UTC)

Also, in essence implies that for a given shot composition of the Louvre courtyard, there is a "maximum resolution" you can use before crossing from free licensing to non-commercial licensing which is disallowed on Wikimedia Commons. That is fairly ridiculous in my view. In any case, many of the files ultimately not deleted in previous deletion requests were saved because of the Terreaux case where when copyright works are an unavoidable element of a picture, and the picture is of a more general subject, then the picture is fine. Many of the surviving Louvre pyramid photographs were ultimately kept because they were images of the Louvre courtyard as whole and not specifically the pyramids. This picture is nearly identical to those examples... these include images that you yourself ultimately decided not to delete. - Keep, This photograph passes as commentary and critical review which is a copyright exception under South Africa's fair dealing regime as outlined in the South African Copyright Act of 1978 (section 12 (b) and (c) sentence 40-45, page 17. Most specifically section 12 (b) which states that "Copyright shall not be infringed..." "for the purposes of criticism or review of that work or of another work;" Fingers crossed this will not be a problem by the end of this year as the current Copyright Amendment Bill before the South African parliament changes the foundation of South African Copyright law from Fair Dealing to Fair Use and also has a Freedom of Panorama clause as well.--Discott (talk) 15:22, 25 March 2019 (UTC)

- Good question: it seems to be a typographic treatment and clip art. I'll leave it to the Commons mavens to decide. It's probably impossible to track down the copyright owner, but I can put out a call on Twitter to see if anyone knows who it is. It would be a shame to delete ephemera, like this recording an important historical event, when the copyright holder – who put up these posters in public expressly to be seen – is extremely unlikely to challenge the image on grounds of copyright violation. - Keep A quick Google search, or a simple Talk message to the new user, would have confirmed that the uploader and name in EXIF were the same person. Instead, all her uploads were tagged for speedy deletion, and the brand-new user received a stream of messages accusing her of copyright violation. She was also told on her talk page that all her photos were derivative works; she messaged me to say, as a professional photographer, she knows what a derivative work is. She also told this experience has been so bad she has sworn off Commons and will never upload another photo. - Comment I deleted the bear image, the bear which is indubitably the main subject and therefore is not de minimis. I'm neutral on the issue for the EXIFs, but note that "All Rights Reserved" in the EXIFs, and with a copyright holder name that don't matche the user name at first view, is a quite common reason for a deletion request, and dozen, if not hundred of similar cases have already been deleted here by many different administrators. - @MattesKoeln: Die ganzen Wikimedia-Projekte, sind darauf ausgelegt, dass man eigens erstellen Inhalt nicht löschen kann. Du veröffentlichst diese ja unter einer freien Lizenz. Ab dann sind sie für jeden nutzbar. Da kann man halt nicht sagen: "Hab's mir anders überlebt." Aber für den Fall, dass etwas eigentlich urheberrechtlich geschützt ist und fälschlicherweise hochgeladen wurde, kann man eben eine Löschung beantragen. Teilweise ist das sehr offensichtlich, wie hier. Aber viele Dinge fallen auch nach Jahrzehnten nicht auf. Bspw. gibt es in vielen Ländern keine Panoramafreiheit. Häufig sind dann eigens erstellte Bilder nicht frei, weil bspw. die Architektur geschützt ist. Question Although it's indeed a ZDF screenshot, what it shows is the Swiss entry document for one Chol Pak (supposedly an alias of Kim Jong-un when he attended school in Switzerland). Is that form protected by copyright at all? Its contents are a few data, simple and non-creative. But even if we could agree that the form itself isn't copyrighted, that would leave open the question whether the ZDF television channel's presentation of the excerpt (with the blurred background etc.) is original enough for copyright protection, I suppose. However, the description of the file explains (with links) that all of the pictures on the display boards were taken by Paul Anderson, who also took this picture. The only slight oddity is the top-right picture. It isn't precisely the same as File:Scout Moor Wind Farm Turbines 1,7,8 and 3 - geograph.org.uk - 760758.jpg, but looking closely one can see that that is a crop of the picture on the board (note the position of the turbine blades and the clouds). -- bjh21 (talk) 22:44, 24 March 2019 (UTC)

- Господа администраторы Wikimedia, которые наделены правом оставлять или удалять файлы, прошу вас выслушать следующие аргументы:
1. Сайт Syg.ma не запрещает размещение своих визуальных файлов на Wikimedia.
2. Сайт Syg.ma только просит, чтобы была ссылка на Syg.ma – и эта ссылка есть. Она есть вот в этих двух статьях Википедии: w:ru:Рыдкин, Юрий Анатольевич и w:be:Юрый Анатольевіч Рыдкін.
3. Публикация на Wikimedia файла «Врозь до самого конца» является – визуальной цитатой. По аналогии с цитатой из текста. Цитаты нигде не запрещены.
4. Если мы удалим этот файл, то испортим сразу две статьи, в которых данный файл задействован.
5. Содержание этих двух стаей требует от нас, чтобы данный файл находился в них. Данный файл является необходимым примером из произведений Юрия Анатольевича Рыдкина.
6. Если мы удалим этот файл, то лишим возможности читателей Википедии иметь быстрый и прямой доступ к произведению-фотоколлажу «Врозь до самого конца».
Господа администраторы Wikimedia, предлагаю оставить ОСТАВИТЬ файл «Врозь до самого конца». --Trebuson (talk) 11:09, 24 April 2019 (UTC)

- Уважаемый коллега, Patrick Rogel, благодарю за беседу и прошу Вас выслушать меня. Я помню, что пару лет назад на сайте Syg.ma были правила, которые разрешали копирование материалов при условии, что рядом будет указана ссылка на сайт Syg.ma. И эти ссылки в двух статьях есть!
Сейчас на сайте вообще нет никаких правил. Их там не существует. И если этих правил больше нет, то это может говорить только об одном – сайт Syg.ma приветствует копилефт.
Коллега, Patrick Rogel, но есть более важное обстоятельство – в нашем случае фотоколлаж «Врозь до самого конца» – не копирование, а визуальное цитирование! Как будто это текст. Цитирование разрешено везде.
Но самое главное – разве мы можем удалить файл «Врозь до самого конца» и испортить две статьи Википедии? Кто подумает о читателях Википедии?
Какой тогда выход? Ведь необходимость этого файла для статей в Википедии очевидна. Этот файл является примером из произведений Юрия Анатольевича Рыдкина.

- This seems like a too-restrictive interpretation of the Freedom of Panorama. This is the public storefront signage for the business, not a 2D creative artwork. By this reading of FoP all street photography that depicts storefronts and billboards would likewise be a copyright violation. For example, Category:Times_Square alone would contain a dozen violations, all similar in nature to this one. —Giantflightlessbirds (talk) 09:12, 24 March 2019 (UTC)
