[edit]Very low resolution images that on their own might fall outside our scope due to their very small size limiting their educational use. However, per their usage on ru:Zombies Ate My Neighbors, they appear to be icons from a video game and thus would be copyrighted.

Fake logo for an organization with no legitimate educational use (and thus outside of project scope). The real logo is at [1]. This logo replaces their flame (which is presumably copyrighted) with a public domain flame. But that makes it not an actual organizational logo - just something Commons made up one day. B (talk) 16:55, 14 November 2018 (UTC)
- Keep: The file is currently in use on es:Acción Chaqueña. Commons policy is that files that are legitimately in use on another project are considered automatically of educational use even if they're inaccurate (see COM:INUSE and COM:NPOV). --bjh21 (talk) 17:53, 14 November 2018 (UTC)
- It is/was in use only because the uploader put it there. The image was uploaded today. It's not a real logo and shouldn't be in use. --B (talk) 19:00, 14 November 2018 (UTC)
- ... and now it isn't. As long as it stays unused, then obviously COM:INUSE doesn't apply. --bjh21 (talk) 19:03, 14 November 2018 (UTC)

- Keep: Per COM:INUSE and COM:NPOV. Also, not all flames are the same 1, 2. --Yilku1 (talk) 01:05, 15 November 2018 (UTC)
Kept: per discussion. --Magog the Ogre (talk) (contribs) 02:31, 14 December 2018 (UTC)
Not the organization logo. By keeping this file we are actively promoting false information, that's the exact opposite of our goals. The inuse argument is silly, it's like if I drew a picture of some other mouse, called it Mickey Mouse, and stuck it on the Mickey Mouse article. GRuban (talk) 00:17, 23 December 2018 (UTC)
- Delete as before. The Spanish Wikipedia does not accept images used under a claim of fair use, but that doesn't mean that making up a fake logo is a good idea. --B (talk) 02:34, 23 December 2018 (UTC)
- Keep: The file is still in use on es:Acción Chaqueña. It was removed by es:User:B and reinstated by es:User:Yilku1. Deletion on Commons should not be used to bypass the need for consensus on Spanish Wikipedia. --bjh21 (talk) 14:28, 23 December 2018 (UTC)
- But this isn't the Action Chaqueda logo! Isn't that the most important thing? --GRuban (talk) 04:34, 24 December 2018 (UTC)
- It's "realistically useful for an educational purpose" per COM:NOTUSED --Yilku1 (talk) 17:30, 25 December 2018 (UTC)
- Sheesh. Then we should at least rename it to "Feeble imitation of AC logo.png", and make as much clear in the description. But honestly, I think it should be deleted; we are not benefiting our users by making our own versions of logos. --GRuban (talk) 20:32, 26 December 2018 (UTC)
- You can, of course, request renaming of the file on Commons (see COM:FR). The file is already marked with {{Factual accuracy}}. --bjh21 (talk) 18:45, 27 December 2018 (UTC)

- @GRuban: The most important thing (in this case) is to serve the needs of Spanish Wikipedia. If there is a consensus on Spanish Wikipedia that this file is inappropriate for use on es:Acción Chaqueña, then it would probably be reasonable to delete it from Commons. The place to have that discussion is on Spanish Wikipedia, at es:Talk:Acción Chaqueña, not here. --bjh21 (talk) 18:45, 27 December 2018 (UTC)
- Please note that
- there is no such talk page. We could certainly create it, I guess, but
- the only people who have ever edited es:Acción Chaqueña are Yilku1, and B, who are already here. Is there such a thing as a Request for Comments on the Spanish Wikipedia?
- Meanwhile Commons:Deletion requests/File:Partido Colorado.png which is an almost exact parallel to this situation: an image, uploaded by Yilku1, who apparently made another political logo on their own, incorrectly, which was deleted for being incorrect. @Taivo: who deleted that file - could you please weigh in here? --GRuban (talk) 19:59, 27 December 2018 (UTC)

Deleted: The file is used and obviously in scope, but I'll delete it as copyright violation. The logo is complex and needs OTRS-permission from organization representative. The file has incorrect Pixabay license: source link is not into Pixabay and license review failed (source site is "Todos derechos reservados", which means "All rights reserved.") "License review failed" is enough for speedy deletion. Taivo (talk) 10:11, 28 December 2018 (UTC)
Suspicious flickr image - it was uploaded to Flickr the same day it was uploaded here and the flickr account has no other uploads. A statement of permission from the copyright holder would be needed to accept this. B (talk) 13:05, 23 December 2018 (UTC)
- @B: Hi! It's Bosioc himself who uploaded the image. He will send you a statement of permission in the following days. Best regards; Cartoon network freak (talk) 13:13, 23 December 2018 (UTC)
- Hi @Cartoon network freak: FYI, since the person depicted is also the person claiming to be the copyright holder, please note that in his email, he should specify how he became the copyright holder. Normally, the copyright holder is the photographer unless the photo is a work product taken by his employee or the copyright was transferred contractually. If the copyright was not transferred contractually, then he will need to have the photographer send in a statement of permission. --B (talk) 13:23, 23 December 2018 (UTC)
- @B: Will make sure that is being done. Cartoon network freak (talk) 13:28, 23 December 2018 (UTC)

This image is tagged as "all rights reserved" on Flickr. The commons uploader claimed to be the author of it and several years later, another user added the flickr link. But the camera of this upload matches none of the commons users' other uploads ... and matches all of the Flickr user's other uploads from this time period. There is no evidence that they are the same person and it is most likely a copyright violation. --B (talk) 00:21, 23 December 2018 (UTC)

These images were all uploaded by User:Civitas13 (that is me). I ask the deletion of the image (uploader request for courtesy deletion); in the following lines I will explain the reason of my request. Civitas13 (talk) 13:38, 23 December 2018 (UTC)
These image are a part of a set of images that I uploaded from Flickr a month ago and they are almost all the images that are contained in Category:2012 Austrian junior American football team tryout and are picture about the national team of American football of Austria. About a month ago I was making order if a lot of photos related to American football in Austria (categorizing them by match, by team, ...); almost all were uploaded from a Flickr account. Seeing that there were other images with free license from the same account I decided to upload some of other pictures from the same account, without reflecting enough. When I uploaded the images of which now I ask the deletion my intention was to categorize them by name of the people; however when I started the research of informations in order to categorize the photo I realized that I had made a mistake. In fact these images are about a preliminary selection of the national junior team; so most of the people of these image are not important sportmen (probably only a few of the passed the selection), even in the context of yuth sport. However, the fact that was a junior team means the probably most of these people may not be adult (at the time when the photo was taken) and this make me worries about privacy problem: in fact most jurisdictions have stricer rules about photo of not adult people (even if taken in pubblic).
When I realized this fact I asked and obtained the deletion of the images using the speedy deletion tag since it weren't yet passed 7 days of the upload (I can make a screenshot of the cronology page of my "special observed page" if necessary to prove that); since the upload was very big (> 700 images) and to tag more than 400 photos for "speedy deletion" it was a long process, I gave preference to the photo in which faces of people were well visible. So at the beginning I didn't ask the deletion of images in which people wear a football helmet and so the face was not completely visible. However nowdays, considering with more judgment and attention my uploads and having more time available, I thought on my uploads and I figured that I feel very uncomfortable to have left these images on Commons, because of privacy concerns. Probably some people will think that I am a lot paranoiac about this (considering that most of faces are not well visible because of the helmets) but sincerely I prefer to be rigid about this iusses. Note that even if for external people could be difficult to identify, people who know the subject can be able to do it (and so I prefer to be cautious -considering that it is possible to find full face image of the people watching on Flickr the files that I have already seedy deleted). In fact I have to admit that I made two mistake: the first when I uploaded the images and the second when I didn't ask for the speedy deletion of all in the first seven days. For these reason I ask the deletion. Since I know that we are outiside the "seven day period of grace for the uploader", I know that there is not obligation to delete the images and all depends on the courtesy of administrators and community consensus. However, considering the indication contained in Commons:Courtesy deletions I will make note that:
- The file was updated about 1 month ago and so, even, (as I alredy pointed out) I should have speedy deleted all the file at the beginning it is not passed such a long time from the upload.
- The events (tryout of a junior teams -so not all the people even became member of the national team-) is not a particular enciclopedic subject; making a reserch on the web about this specifical event I was not able to find specifical articles about it.
- Considering the not particular relevance of the event someone can still object that the image can be useful to show tryout of American football players; even if I have to admit that this is true I will make note the Commons have a lot a images of football training, usually of people who are adult, famous and compete at high-level. So for this use there are good substitutes.
- Quality level of the photo: to be sincere the quality of the photo is good, even I think the they will not be considered "quality images".
- None of this files is in use on a Wikimedia Project (at the time of the starting of deletion request); the only usage is in gallery made by bot (Images about ballsport, images about Vienna, ...).
- Consider my concern about privacy.
I hope that considering these elements my courtesy deletion request will be satisfied; I will gladly appreciate this gesture even if I know that there is no obligation to satisfy my request and the files involved are a lot (about 250) and I should have had more careful about my usage of Flickr images. --Civitas13 (talk) 13:38, 23 December 2018 (UTC)

I attended Arcand's TEDx Presentation and took this image with my own camera Canon EOS 70D along with several hundred other images that day. I had posted this image on my Facebook page and I gave Arcand permission to use it. Why are you marking my own work for deletion? I do not have a history of intentional copyright violation. Patrick!
Thank you for withdrawing your nomination of deleting my image. I'm fairly new on Wikipedia and Wikimedia Commons and have to learn the rules and there are lots of them and sometimes it can become real frustrating especially when your own images get marked for deletion.
To make it clear. All images that I have used on Wikipedia, I had permission to use by the owner, but both the owner and I were not familiar with all of the rules in uploading those two other images and how to provide the required permissions. As you can see, those were the very first two images I uploaded. I don't blatantly take an image an upload without an owner's permission. New people like myself have a learning curve and the seasoned editors like yourself take a lot for granted and assume newbie's know everything.
Sorry for the inconvenience.

- Well, I Read you joined Wikipedia five (!) years ago... but it's never too late to learn about our policies and I'm glad you finaly comply with them.
By the way and since you have been able to modify Kimberly Arcand & Megan Watzke's Facebook page, you should reread this warning about conflicts of interest and declare it. Kind regards, --Patrick Rogel (talk) 20:38, 22 December 2018 (UTC)
Patrick!
Kimberly Arcand & Megan Watzke's Facebook page is in the public domain and anyone can make a public comment without logging into Kimberly Arcand & Megan Watzke's Facebook account. I added the Wikimedia Commons license as you instructed me to do, but only as a public comment. I'm unable to *modify* as you stated to their original post of my image since I do not have their login credentials for their Facebook account. Hence there's no conflict of interest.
Also, as far as The Mars Generation page on Wikipedia, I am not a part of this organization, I have never met any of the members of the organization, I am not paid or compensated by The Mars Generation in anyway and only write about references to this organization that I find online which I cite or provide links from reputable sources. I have never cut and paste any copyrighted material - My contributions are my own. I have never added any links to my online presence to any Wikipedia or Wikimedia Commons page. I had edited comments added by other contributors that I did not know was or could have been copyrighted or suspected of being copyrighted material. A wiki editor had then accused me of having a COI because I had edited the possibly copyrighted material that I did not add to this page.
BTW, I might have signed up on Wikipedia 5-years ago to make monetary contributions to this organization, but if you check my history, last year was the first year I created a page spending a small percentage of days contributing and not the entire year. Since then I've only experienced a lot of unnecessary stress and frustration with this whole process. I'm seriously considering deleting my account and providing no further contributions...I wasted this whole day on these issues with you. As a disabled 20+ year USAF vet and unable to work, I thought being a contributor to Wikipedia and Commons would be good for me. Evidently, I was wrong.
Good day

Tracykarin (talk) 19:28, 23 December 2018 (UTC)
- Comment: It's the same event but the Commons photo is not the same photo as the one in the facebook page linked by the deletion nominator. Unless the Commons photo was previously published, the principle of assuming good faith would stand. It was published in a flickr stream, there, where it is tagged as all rights reserved, without mention of a free license. Considering that the username of the Commons account and the username of the flickr account suggest that they may be owned by the same person, the situation would be easily clarified if that person added a CC-by-sa license to the page of this photo on flickr, or if she mentioned her Wikimedia account in her flickr user page. -- Asclepias (talk) 03:01, 24 December 2018 (UTC)

Patrick and Jeff!
- Comment: I took over 200 images at the TEXx Providence Event where Arcand was one of the presenters in 2016. I spent plenty of wasted time today reviewing my images on my NAS and my Flickr account and changed the rights on my image that I uploaded to my Flickr account from *all rights reserved* to one of the Commons Licenses that Flickr provides as option to select - Attribution-ShareAlike 2.0 Generic (CC BY-SA 2.0). Since Flickr does not provide the most recent updated version of the Wikimedia Commons License Version 4.0, I added in the comment section of my image that this image falls under the updated 4.0 version of aforementioned license to match the license I selected on Wikimedia Commons when I uploaded my Arcand TEDx Providence image.
Here is a link to my own work, my image of Kim Arcand at TEDx Providence on my Flickr account. This is the same image I uploaded to Wikimedia Commons. I have created an album for these photos so there are new links to this image below:
for those that they Flickr accounts

Patrick and Jeff, you have caused me to spent countless wasted hours with back and forth comments causing me unneeded stress, anxiety and frustration arguing over my own work. This ordeal has become a fiasco especially when Patrick the deletion nominator mistakenly identified my image on Arcand's Facebook page as the same image I uploaded to Wikimedia Commons.
Patrick would you please remove the deletion nomination tag for my image!
Thank you Asclepias and Victuallers for your assistance in this matter.
Tracykarin (talk) 18:24, 24 December 2018 (UTC)
- Keep. Although flickr does not seem to display the date of upload of the photos, it can be reasonably assumed from the context that it was the first publication. The changes and the comment recently added to the flickr page of the photo settle the matter and are evidence that the flickr user and the Commons user are the same person. -- Asclepias (talk) 21:30, 24 December 2018 (UTC)

- Comment: Patrick Rogel and Jeff G. - Thank you for your apologies and I would also like to apologize to the both of you for causing unnecessary drama. I'm going through a learning curve and your comments along with Asclepias and Victuallers assistance have helped me considerably in understanding Wikimedia Commons rules. I was just so perplexed after using the simple upload wizard, reading and responding appropriately to each and every question, but only afterwards finding my own work was tagged for deletion, I just couldn't understand why? During my 20+ year tenure in the USAF when an issue occurred we worked as a team to resolve it. Afterwards we'd say *Lessons Learned* and move on! This image of simple geometry is ineligible for copyright and therefore in the public domain, because it consists entirely of information that is common property and contains no original authorship. |
- Keep imho below COM:TO. --Steinsplitter (talk) 18:35, 23 December 2018 (UTC)
- Delete I have already indicated here some elements on the complexity and originality of the combination of the geometric elements in this logo. Of course, I agree it is composed of simple geometric shapes. But per Atari Games Corp. v. Oman and similar decisions "simple shapes, when selected or combined in a distinctive manner indicating some ingenuity [are entitled to] copyright protection" [9]. In other words, simple shapes are not protectable individually, but can be protected as a whole. See e.g. Glasscraft Door I LP v. Seybro Door & Weathership Co. Inc. : "a work comprising uncopyrightable elements may, through original organization and presentation, be protected by copyright law." According to section 906.1 of the US Copyright Office, a work is entitled to copyright if "author's use of [simple] shapes results in a work that, as a whole, is sufficiently creative" [10]. In general, the Copyright Office has a more restrictive approach than courts. Therefore, it is important to point out that Google's filing for protection of its Chrome logo has not been refused [11]. — Racconish 💬 19:42, 23 December 2018 (UTC)
- When you say "has not been refused", do you mean a copyright application is pending or that none has been submitted? If it is pending, I certainly think we should delete it unless/until it is refused. If Google has submitted no application, I would probably still lean delete - copyright wouldn't prohibit someone from making a very similar logo from scratch (trademark would, of course, but that's a different story). But for "actual copying", there needs only be a modicum of creativity to be a bar to that. And I think this logo is probably going to qualify. --B (talk) 00:10, 24 December 2018 (UTC)
- B, apologies for not being clear enough. There are two US filings.

Colors claimed: "The color(s) green, red, blue, yellow and gray is/are claimed as a feature of the mark." [12]
- US serial number 85463991, pending ("accepted by the

- The basic reference here is Feist Publications, Inc., v. Rural Telephone Service Co. according to which "the sine qua non of copyright is originality. To qualify for copyright protection, a work must be original to the author. [...] Original, as the term is used in copyright, means only that the work was independently created by the author (as opposed to copied from other works), and that it possesses at least some minimal degree of creativity." The key point for copyright protection is not the nature of the graphic elements of the logo but the overall effect. My understanding of the US case law is that the appreciation of the originality of a logo composed of geometric shapes is essentially relying on two criteria, the number of elements and their arrangement (see meta:Wikilegal/Copyright threshold of originality for logos#Copyrightability under American law). I therefore suggest these are the aspects to focus on, instead of merely rejecting the copyrightability of such a logo because of the nature of its components. — Racconish 💬 13:01, 24 December 2018 (UTC)
- I know that, see also the cases cited in Commons:Threshold_of_originality#United_States. I cannot give legal advice, but i see no issue with hosting it here on commons because it is (likely) covered by COM:TO. It is always a case by case issue. --Steinsplitter (talk) 13:16, 24 December 2018 (UTC)
- There you go! In such an uncertain situation, I think we should apply COM:PCP instead of claiming that the geometric nature of the components is sufficient to exclude copyrightability. — Racconish 💬 13:34, 24 December 2018 (UTC)
- To apply COM:PCP we need a significant doubt that the image is copyrighted. Not just any doubt. The significant doubt may be that a court decided that an image of similar complexity is copyrightable. I did not found a positive court decision with a so simple image be copyrighted, however. - Keep as the source now shows CC BY-SA 3.0; the version number on the file page just needs updating and the spurious GFDL removed.—Odysseus1479 (talk) 19:34, 26 December 2018 (UTC)

This file was initially tagged by Moumou82 as Copyvio (copyvio) and the most recent rationale was: copyrighted logo Hedwig in Washington (mail?) 20:21, 23 December 2018 (UTC)
- Seems below TOO to me. @Fry1989: Am I missing something here? --Hedwig in Washington (mail?) 20:22, 23 December 2018 (UTC)
- It doesn't look anything special to me. Maybe the C/A monogram, but I doubt it. Fry1989 eh? 23:56, 23 December 2018 (UTC)
- Club Africain has publish an official statement in March 4th, 2018 inviting the media to use the official version of the club logo, since there was multiple unofficial versions of Club Africain's logo. Since March 2018, the club logo is "officialized" and unified. Any version besides the one showed in the photo isn't official. Now about my contribution: Club Africain logo is under the public domain. What I have done here is taken the official version of the logo and vectorizing it to create a High quality image that respect the official club request. --Feroukb (talk) 01:48, 24 December 2018 (UTC)

Looks strongly like an official US Military image and not own work of the uploader as claimed. We sould need a proper source. JuTa 09:11, 23 December 2018 (UTC)

- @Yewtharaptor: sorry, the licence I see there, CC BY-ND 3.0, is not sufficiently free. Commons requires permission to modify & remix, which is denied by the “No Derivative” condition. I would have to say Delete unless or until the source page shows a free licence (a CC BY-SA, for example, as on the file page) or permission is sent to OTRS for verification. Disclosure: I was directed here from a posting by the uploader on my Talk.—Odysseus1479 (talk) 20:32, 25 December 2018 (UTC)
- Keep as the source licence appears to have been updated now. The licence on the file page needs correction, though: it says v4.0 while the original is v3.0.—Odysseus1479 (talk) 19:22, 26 December 2018 (UTC)
