- Keep {{PD-Italy}} is a clumsy summary of the Italian Copyright law. Let us consult the law itself [1]:
PART VI. FIELD OF APPLICATION OF THE LAW. Article 185: Subject to the provisions of Article 189, this Law shall apply to all works of Italian authors, wherever first published. (Mario De Biasi was an Italian photographer, so the law does apply to his works, but we need to proceed to Art. 189)
Article 189: The provisions of Article 185 shall apply to .. photographs .. if such works or products are created in Italy or may be
considered national works. In the absence of the conditions above mentioned, the provision of Articles 186, 187 and 188 shall be applicable to
such works, rights or products. (This photo was not created in Italy, and I'm not sure if it is a "national work", so proceed to Art. 186-188)
Articles 186-188 are unclear about this photo, but Art. 188 states that The duration of protection of a foreign work shall in no case exceed that enjoyed by the work in the State of which the foreign author is a national. (De Biasi is Italian, and I argue that this photo is a "simple photograph" and does not involve "photographic art". For the protection term we need to consult CHAPTER V. Rights in Photographs)

You argue that if their their works were 1st published outside Italy then the publisher may present an alternative copyright claim, and this is reflected in articles 186-189. Such claims can be submitted for any original image hosted on Commons, but they must be justified. Merely stating that there may be an alternative copyright claim is not sufficient for deletion. - Historical images on Commons are rare enough it's hard to find examples with Random file, but I actually think we do have publishing details for most of them, or they're old enough to be safely out of copyright. We are dealing with a photo taken in Switzerland of a French minister and applying a 20 year from creation copyright term; I think there's good reason not to grab it from Getty and assume it's PD without knowing where and preferably when it was first published.--Prosfilaes (talk) 06:19, 8 February 2018 (UTC)

As we have no information about when and where this photo was published first, we cannot simply apply {{PD-Italy}} without having proof of a publication in Italy. Even if the photographer was Italian, employed by an Italian magazine etc. we are not sure if this was published at all contemporarily. Many photographs go unpublished into the archives. The photo is an image grap from a copyrighted television broadcast. Look closely at the image detail to see the pixelation from the television. Although it was uploaded to Flickr under a "Public domain" declaration by Flickr user "Padd 50" that statement has no bearing on the rights of the original copyright holder. Delete per nomination. There is no exception for works of music from the usual copyright term of 50 years past the author's death. "Audiovisual works" as mentioned in {{PD-Botswana}} that are copyrighted depending on the date of their creation are movies but not songs and sheet music in general. Quite interesting to see the anthem as a national symbol getting deleted, while the COA of Botswana itself isn't getting deleted, even though the copyright expired in 2016 (or even longer, since maybe the creator of the COA died more than 1966, making the file still copyrighted), and the file went unnoticed being copyrighted for 7 years (COA created in 2009). Where is the fairness in this? Why is the national anthem musical sheet, which I make them myself, getting deleted?

- Coats of arms are special in terms of copyright because only the individual depictions made by specific artist are copyrighted, but the so-called blazon, i.e. the heraldic description, is traditionally public domain. So anyone can create their own rendition of a coat of arms from the blazon, i.e. why we have COA of Botswana drawn by a Commons user, and thousands of other recent coats of arms. As to the Botswana anthem being exempt from copyright, {{PD-Botswana}} limits government works to official texts, but musical compositions and other state symbols are not included in that list. Actually, the copyright law of Botswana grants the state a copyright to any work made under the control of the government, and works made on behalf of the government are still copyrighted to the author (Part II, Provisions as to State and Government department). Nor are state symbols such as the anthem explicitely exempt from copyright (Part III, Exceptions to exclusive right to copyright). There is freedom of panorama in Russia for architecture, but not for sculpture. This is after WWII sculpture and the photo violates sculptor's copyright.

- The photograph is of the commemoration, not the memorial. The memorial happens to be there but the photo is taken sideways, so that it is not the central theme. - The subsection 3 of the section 25a of the Finnish Copyright Act (404/1961, amended 607/2015) says (in Finnish): "Taideteoksen kuvaaminen on sallittua muissakin kuin 1 tai 2 momentissa tarkoitetuissa tapauksissa, jos teos on pysyvästi sijoitettu julkiselle paikalle tai sen välittömään läheisyyteen. Jos taideteos on kuvan pääaihe, kuvaa ei saa käyttää ansiotarkoituksessa. Tekstiin liittyvän kuvan saa kuitenkin ottaa sanomalehteen tai aikakauskirjaan.", translated to English: "A work of art may be reproduced in pictorial form in cases other than those referred to in subsections 1 and 2 if the work is permanently placed at, or in the immediate vicinity of, a public place. If the work of art is the leading motive of the picture, the picture may not be used for the purpose of gain. A picture having a material connection to the text may, however, be included in a newspaper or a periodical."
- So, I think the main issue is what the law means with "the leading motive" ("pääaihe" in the Finnish original). In pure technical sense, I think the memorial is the leading motive of the picture: it is located in the centre of the picture, it fills a significant part of its area and the camera is (or at least seems to be) focused on the memorial. However, if the event can be considered as the leading motive, you may indeed be right and the image should be kept. I would let the administrators decide.
- The "Don't take it personally" (Finnish: "älä ota poistopyyntöä henkilökohtaisesti") is part of the Finnish version of the template that is automatically added to the uploader's talk page when nominating a file for deletion using the "Nominate for deletion"/"Ehdota poistettavaksi" link in the left pane. So, it is not my text really. In addition, the English version of the template does not even have that text and I use Commons in English. (As a side note, the English version of the template says: "Arguments which focus on the nominator will not affect the result of the nomination.")
- Anyway, I create deletion requests on regular basis, especially about derivative works of works of arts located in Finland (some examples: 1, 2, 3, 4, 5). My deletion requests are never personal, and this one is not an exception. Image whose copyright status is impossible to properly verify. It's claimed as "CC/own work", but a google image search reveals that it's a grayscale conversion of a colour photo from the subject's own PR kit -- and absent OTRS confirmation it's impossible to verify that the uploader is the photographer. I treat this picture as a kind of POV-pushing. It claims to represent some propaganda material from 1919, but no source is identified. С какой стати Вы предполагаете НЕ добрые намерения у украинского издательства "Класс", г. Киев? Я эту открытку (поштову листивку) не рисовал, не правил, не изменял. Обратной стороны не сканировал, поскольку не сканирую у открыток обратные стороны. Она прошла через мои руки, сканирована и отправилась к тому, кому это интересно. Описание файла переименовано практически дословно, как Вы хотели. Кому что принадлежит, нужно спрашивать в ДСБЕЗ (Державная служба борьбы с экономической злочинностью), а не у человека, предполагающего добрые намерения издателя. ...На чьей стороне? На оранжевой, как и Нацбанк (монеты), и Укрпошта (конверты). С таким подходом Вы можете поставить под сомнение вообще любой загруженный конверт или открытку или документ. - The person credited for the creation of this cat is Ralph Chaplin (1887-1961). This cat was thus created in the US before 1961. At that time, it was necessary to have a copyright notice, and even so the copyright needed to be renewed. See COM:HIRTLE. Both images are taken from http://gaulivel.com/company-structure/. To me they seem intricate enough to meet the threshold of originality. If the company really means to release those images under a free license, we need confirmation via OTRS. For the logo, the claim of "own work" also seems doubtful given the explanation.

The reason for requesting deletion is partly a user request, and partly for technical reasons. This arrangment was developed before the scoring extension for music was present on Wikimedia projects, and a better version could now be made by working from the original score. The instrumentation used is not ideal, and although passable a transposed piccolo for a fife is not ideal, I am also of the view that the tempo may be wrong, something that as I no longer have the original Musescore file is not easy to remedy ShakespeareFan00 (talk) 19:24, 9 June 2018 (UTC)
