- This is DR is the consequence of tagging the file twice with "File has no source" by Jcb. I personally found a ref now, howsoever the uploader himself seems not willing to give the source, very high probably it is an original file from the municipality (there are clear indication for format exporting). - Look there is a fundamental disagreement between my view of U.S. Copyright Law in relation to FDA recall law and how they relate and it has caused a huge mass deletion of my import from the FDA, it looks like I have been overruled, so you might as well just go ahead and speedy delete whatever I uploaded from the FDA, while they are all copyright-free and in the public domain including brandmarks and trademarks on packaging. These rights are waved when a health concern requires an FDA recall, but just delete them.Jasonanaggie (talk) 04:23, 27 September 2016 (UTC)

An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ghana.

I would have to refer to the copyright laws of Ghana before I make any submission on this issue with that said I do not think this pictures infringes on any rights the building is a public building and permission was sort from the managers before taking them. - Hello Flixtey, as I have clearly stated in my rationale above, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator in most countries. An image of a work that is still under copyright is a derivative work, and infringes on the copyright of the original work. Thus, we cannot keep such images on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ghana. Photographs of buildings are normally allowed if the building is old enough to be public domain (in many countries, where the architect has been dead for at least 70 years). Photographs of more recent buildings may be restricted because of the architect's copyright, though some countries have exceptions that allow photographs to be taken of any building in a public place but Ghana is not one of those countries. See Commons:Freedom of panorama. For the record, article 19(1)(f) of this online version of Ghana Copyrights Act, 2005 restricted panorama freedom to cinema or television or in a broadcast by television. Hi Wikicology there are two structures that you have tagged for deletion the independence arch which was built so many years ago and the new presidential library what you have to know is I had permission to take those pcitures since i wasnt using it for any commercial purpose but for a social good like this I do not see where your problem lies where there have been several picture of the same structure on commons already--Owula kpakpo (talk) 19:14, 26 September 2016 (UTC)
- Independence arch was constructed in 1960s after Ghana independence on March 6, 1957, which means its copyright has not expired. I am glad you admit that the presidential library is new which is why its eligible for deletion. Places such as Black Star Gate, Independence Square, (and or independence arch) usually allow photography but this does not automatically mean that such photos can be distributed under a public domain dedication or a free content license; the intent of a venue allowing photography may be to facilitate photography for personal usage and/or non-commercial sharing on social networking sites, for example. Wikimedia Commons is not a commercial project, but the project scope requires that every single picture may be used commercially via free licenses. Every image or media file must be free of third-party copyrights. Owula kpakpo, unless you have authorization from the copyright holder, or in situations where this does not apply, do not upload works derived from other non-free works onto Commons, or they will be deleted. I see that you are new here. Please do not be offended that your images were nominated for deletion. Firstly, there is no COM:FOP for sculptures in the US, so on this basis it is a copyvio. Additionally, the monument is not a work of the US government but of a private foundation, which had to be pay licencing fees for the use of MLK's image and copyrighted quotes on the memorial. Unfortunately, all of the photos in this nomination are not free for hosting on Commons.

- I was a contributor for many of the original images, including photos I had taken myself. All of my photos were deleted, which helped me learn about the rule against publicly displayed works of art. At that point, I added only photos that were included in official U.S. Government websites (primarily, the U.S. Park Service site). I am quick to say I am not an expert, but try to learn, but I did have a conversation with one of the image experts at wikimedia commons who thought that using images from the government sites would be all right. Since then, I do see that some "original" photos by others have been added (including the one in the info box), with the U.S. Government photo I had put there moved to the gallery. I appreciate this editor's efforts to ensure that the photos that remain are allowed. If it turns out that even photos taken from official U.S. government sites are not allowed, then I will learn more.... NearTheZoo (talk) 12:48, 17 March 2012 (UTC)
- I'm afraid that the issue is that you need permission from both the sculptor (or whoever the copyright holder of the sculpture may be) and the photographer. The {{PD-USGov}} template only confirms that you have permission from the photographer, but you still lack permission from the sculptor. I hate it when images are deleted because of lack of FOP, but as I see it, there is nothing that can be done here. - Quite frankly, I am sick of Wikipedia editors crippling the mission and functionality of Wikipedia by going around and nominating images, such as those listed above, for deletion out of bogus copyright infringement claims. First of all, the entire site and all of it's contents are owned by the Federal Government of the United States, in the context of this memorial, it is not that NPS allowed a private foundation to place their memorial in this location and now acts as its custodian. The memorial was authorized by congress, was paid for with private funding, and upon completion, was turned back over to be managed by the NPS. I have never seen any claims of copyright by the sculpture of the main statue, nor have I seen such claims from the stone masons who carved all the text. The rampant deleting of such images is pathetic, and seem to cripple the encyclopedic functionality of this entire site. Above all else, these images would be considered fair use no matter their resolution as they are not being used for any monetary gain and are used for educational purposes. I would like to know why it is that someone decided to start caring so much about the MLK memorial that they are always deleting images, but conveniently ignore the plethora of other DC Memorial (installed post 1978) pictures throughout Wikipedia. Better get on the case, I see some pictures over on the Korean War Memorial page that Frank Gaylord might want Wikipedia to pay for! </rant> Something Original (talk)

Keep- As the owner and operator of the memorial under Commemorative Works Act (40 USC 89) the United States government has widely published noncopyrightable images of portions of the memorial. I can't imagine that the owner of the statue's copyright (who is this, by the way?) would want to suppress photos of this statue which have already been published by the National Park Service. The purpose of the statue is to enhance the legacy of Dr. Martin Luther King, Jr., by erecting a highly visible outdoor monument in a place frequented by tourists. Nobody is going to suffer any revenue loss if this picture appears in a Wikipedia article, and such an article without any picture makes no sense at all. The government owns and enforces copyrights on works created for it by others -- the Sacagawea dollar is a prime example. Unless you can prove that the MLK National Memorial contract explicitly transferred copyright to the Federal government and that the Federal government has chosen to put it into the public domain, we can't keep these images. And, as I noted above, the King heirs required that his quotes be licensed specifically for this purpose -- it would be extremely surprising to find that they had allowed those copyrights to become PD. . These are photos of Stone of Hope (2011) by still-living artist Lei Yixin (1954–). Unfortunately there is no freedom of panorama in US for sculpture so these are derivative works of a work protected by copyright until at least 2089. - Keep the images which don't show King's words, if that's the perceived problem. Have the King family lawyers contacted Wikipedia about any of these? If not, why the need to delete, and just move them to Wikipedia if that's a concern (I don't know why Wikipedia trusts Commons with images which, instead of being deleted, can be moved to the Wikipedia collection). In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). According to http://www.president.lv/pk/content/?cat_id=10432 all of the classes of the order for civilian are without any accessories on the ribbon bar, for military with swords, and for honourary medals with star. - You can see this on description of the lowest photo on the left ("Miniatures of the Order (All classes)"), and also you can see that any of classes of any Latvian orders has no rosettes on ribbon bars on Digital book "The State Decorations of Latvia". There is a big difference between ribbon (suspension for the medal) and ribbon bar (generally issued for wear in place of medals).
