- It is allowed as per Section 52 (1) (q) (iii) of the Indian Copyright Act: the report of any committee, commission, council, board or other like body appointed by the government if such report has been laid on the Table of the Legislature, unless the reproduction or publication of such report is prohibited by the government; This Standard was made by a government-appointed committee; and as per Section 39 of the Bureau of Indian Standards Act, 1986: Every rule and every regulation made under this Act shall be laid, as soon as may be after it is made, before each House of Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, both Houses agree in making any modification in the rule or regulation or both Houses agree that the rule or regulation should not be made, the rule or regulation shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule or regulation. Accordingly this standard, a statutory regulation by BIS, had to be tabled in the Indian parliament, and therefore it comes under the proviso of Section 52 of the Indian Copyright Act, hence template EdictGov-India. The objection of the BIS, as cited by SF, is as per later rules, e.g. Section 11. (1) of the Bureau of Indian Standards Act 2016: No individual shall, without the authorisation of the Bureau, in any manner or form, publish, reproduce or record any Indian Standard or part thereof, or any other publication of the Bureau. The publication was of 2005, accordingly it was made under the 1986 act. Moreover, as the URAA came into force in 1996, so the 1986 act comes under URAA cognizance, and not the 2016 act. - In response to your arguments above, at best the status is ambiguous, the only way to have the certainty is to ask the BIS explictly , and get an OTRS ticket filed, otherwise my view hasn't changed, namely that without explicit confirmation from the copyright holder (possibly of the view you present above) it can't be hosted. I'm as frustrated as you should be about potentially being unable to host what you genuinely feel to be "public", but it's easier to reject an ambiguous status at this stage then having to takedown a considerable effort at a later stage. - There is no ambiguity. The OTRS requirement stems from the BIS Act 2016. The BIS will never consent for OTRS, as they are getting money by selling the book. If they object to the work's hosting here, the onus will be on them to prove that the 2016 act had retrospective effect and covered 2005 publications. As per my reading of the act, there is no provision of retro effect. Therefore the book was published under the previous 1986 act, got tabled in the parliament, and accordingly, in spite of copyright, comes under a CC-type license as per Section 52 of the Indian Copyright Act. Therefore it can be hosted here under template EdictGov-India. If you want to object, the onus is on you to come up with specific rule positions, as I have done, instead of ambiguous ramblings and grumblings. Moreover, if BIS's claims were really valid, they would have been able to force a takedown of the work from the listed source by legal action. - Since the uploader was a new user, I helped him by putting the right templates. The picture is in PD by Italian law, since it was took in 1936. At the moment the author is unknown. The real name of the uploader, Wikicology, is Olatunde Isaac. Going by the title, he's in this picture, so it's not reliably own work by him. Wikicology has been revealed on EnWiki to be a serial copyright violator and in particular has there claimed authorship of a photo of him that somebody else took (see w:en:File:Wikicology.jpg). This is a prank. Hajdučka Republika Mijata Tomića uses Croatian insignia, not Serbian. This very flag posted here (on July 22, 2014) is Serbian. Where did You get the idea that this is "in use"? No source for that.
In the Constitution of this micronation project [4], page 5, article 19, "državnu zastavu čini bijela podloga na kojoj se crvenom bojom u lijevom gornjem kutu nalazi državni grb - šahovnica, a u sredini je plavom bojom označen lik Mijata Tomića." In short: state flag is a white background, in the left upper corner state coat-of-arms - chessboard (note: Croatian coat-of-arms), while in the middle is the portrait of Mijat Tomić marked with the blue color. This doesn't look like a picture to me. In my opinion it was taken from TV. The quality is very poor. And why is there green stuff towards the bottom of the image? Why is there weird black stuff on the right edge? The same problems are here [6]. That's a big website, as you can see by looking at the number of Facebook fans [7]. - I wouldn't necessarily give much weight to the initial keep closure by Yann - its a closure based on gut feeling, with no real evidence either way at that time. This photograph was probably taken by Sydney Newton (died 1960, so PD in UK in 2030). The original photograph was donated to English Heritage; the copyright may have been transferred too. The US copyright also seems suspect, as I see no evidence this was published close to the time it was taken. The publication date is likely to be after EH obtained the negative. In that case, it is not PD in the United States. However, I'm not really sure how US copyright works - this may technically be unpublished for US purposes.--Nilfanion (talk) 21:20, 23 April 2016 (UTC)

- I think in light of the fair use on en:wiki and the statement by the National Archives that these images are not able to be retained on Commons. However, it might be advisable to migrate them to en:wiki under fair use. That way the images would still be visible and you can follow the format on the one I have linked above. The picture seems to be a "formal picture" of this person and appears in at least one more site ([14]), while no OTRS release note has been received. The uploader of the picture isn't active in Wikimedia projects for years, so there's no use in leaving her a request for obtaining one. It has no place in the Commons in this situation.
