In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Belgium. The sculptor, Leonhard Mennicken, died in 1969, so this work is still under copyright and this image infringes on it.

An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Belgium. This shrine was built in 1961, so it will remain under copyright until 2031 at the very earliest and likely much longer. These images infringe on that copyright and cannot be kept on Commons without a license from the shrine's creator.

Looking at this, I don't see how this can be PD. The captions are clearly not original to the film, and the score can't be either. The first two minutes is an explanatory crawl clearly written for the 2009 restoration. All of these can be copyrighted by the restorationist. Keep The creative commons license is a CC0 1.0 Universal as clearly stated on the archive.org page. Archive.org is very strict and diligent over such matters and therefore I have no reason to believe it shouldn't be released under its current license.   • 1) That does not mean it's your work, and 2) the English article says Richard Kloaian claimed copyright on the restoration, and his efforts were certainly enough to give him the right to do so. The upload at Archive.org was by WCCA-TV, which is not the copyright holder and therefore has no right to upload the film under a CC-0 license without the holder's permission. Comment That source doesn't say the copyright belongs to Richard Kloian. He could have prepared the video...sure. But all I see in terms of his accreditation for the video is a comment by a certain "Stephen T. Dulgarian" that just says he should be credited for it as a gesture of personal respect. Which furthers my point that perhaps he wasn't even credited or held the rights at all to it. Also, that's not Loris Tjeknavorian's work. His work was part of an entirely different rendition of the movie entitled Credo. So again, we need proof of a copyright or else we are to accept this as a matter of good faith by archive.org and the WCCA. Furthermore, preparing the video by adding subtitles and intertitles is enough to claim copyright (and copyright is automatically given for) said subtitles and intertitles. OK, second try. I've split up my upload in File:Das Wohltemperirte Clavier titlepage 2.jpg to a new file and the situation is different. Please compare these 2 images. The only thing which varies is a 5-10% different contrast. IMO Common's should not be a mess contacting such copies, especially if the format is wrong. It's not the exact duplicate, but a redundant file.

I don't know how the format of File:WK title.png is wrong. Anyway, to my eyes, they both look different but I can't say which one is unambiguously better. Please see its resolution problems above, the compression makes image a little blurry. The JPG format is better for photographic-data like this one. I'm not a specialist but the opposite example is very well explained in {{BadJPEG}}.  Delete (pl): Plik został wg szczegółów podanych na stronie wykonany aparatem fotograficznym 25 stycznia 2007, a potem zamieszczony na internetowej stronie sióstr prezentek. Wpisujący ją z tej strony nie uzyskał zgody ani od robiącego zdjęcie ani od sióstr prezentek (nie ma takiej informacji o zgodzie) i jako taki powinien być traktowany jako naruszający prawa autorskie. W opisie nie umieszczono wzmianki o tej procedurze. Podanie informacji o nieznanym autorze jest też problematyczne skoro autor zarówno obrazu jak i zdjęcia są do ustalenia. Tego nie uczyniono.

  •  Delete Warto zauważyć, że plik nie przedstawia całego obrazu. Kadr zdjęcia uciął kilkanaście centymetrów z lewej i prawej strony. Wskazane byłoby zamieszczanie zdjęć obrazów całych, najlepiej w kontekście obramowania uzupełniającego całość i mającego istotny wpływ na odbiór i efekt patrzenia. Umieszczanie fragmentów obrazów nie jest w tym wypadku prawdziwe i sugeruje niepełny efekt. Poza tym widoczny jest u góry po prawej na zdjęciu i pliku efekt odblasku złotego tła, być może flesza. Należałoby raczej skupić się na dobrym, profesjonalnym zdjęciu bez żadnych efektów ubocznych, robionym na bardzo dobrym sprzęcie i przez fachowców.  Delete (pl): Wpisujący plik nie uzyskał zgody ani od robiącego zdjęcie ani od sióstr prezentek (nie ma takiej informacji o zgodzie) i jako taki powinien być traktowany jako naruszający prawa autorskie. Folder z którego robiono to zdjęcie też nie został bliżej określony. Podano w opisie nie znaną datę. To też musi budzić wątpliwości. W opisie nie umieszczono wzmianki o procedurze jakiej poddano obraz fotografując go z folderu. Podanie informacji o nieznanym autorze jest też problematyczne skoro autor zarówno obrazu jak i zdjęcia są do ustalenia. Tego nie uczyniono. Plik jest bardzo złej jakości: kontury są zamazane, o zmienionej konfiguracji barw i odcieni. Jest słabo czytelny i jako taki powinien być usunięty względnie poddany starannej obróbce cyfrowej i rewaloryzacji.

Zła jest również ostrość ustawienia aparatu lub skanowania z matrycy lub kopii. Widać efekt zamglenia. Tak zamieszczone pliki będące przekręconymi kopiami orginału w zasadzie nie powinny być przesyłane i jako takie natychmiast usuwane. While most of the conditions seems to comply with the license, there are some that don't. I'm wondering whether this is a valid license or not (see below)

For instance, IMHO some the following conditions do comply with the CC-BY license:

  5. or with an easily visible credit placed near the photo in each instance in which it is used:  Don't know. Here it seems to be a little bit more tricky. Can the author request a specific way of acknowledging attribution?
  6. Please credit authorship as follows:  © Günter Prust:  Not OK. This seems to be a clear contradiction of the license terms as (c) != CC-BY
  7. Please maintain the original file name in all uses:  Not OK provided that the ND clause has not been invoked, anybody can modify the file and I assume that the name is one of the features of the picture that can be changed according to CC-BY.

  • About your point 5: From a quick look, it might be tempting to believe that it goes contrary to the license, but an analysis may show it is not the case. The important word is "or". First, remember that he CC licenses require that the reusers must mention the url, if any, that the author associates with the work (for example, see section 4(b)(iii) of the CC-BY 3.0 Unported). With that in mind, it seems that this author merely offers alternative options to reusers who might prefer to be exempted from some of the requirements of the license. That is something that the author is allowed to do. My understanding of the alternatives offered by this author is that a reuser can credit him in any of the following manners: Option A: Simply by linking the reused version to the description page of the file on Commons, which is then considered to be the url specified by the author, as per the CC license. Under this option A, it seems that the author exempts the reuser from the requirement to write the name of the author with the reused version, the implied rationale being that that information is already on the Commons page linked. (That exemption may not be entirely clear, but it is not important for the present discussion.) Option B: By including the credit near the reused version. Under this option B, it seems that the the author exempts the reuser from the requirement of mentioning the url associated with the work. Note that the author does not require a credit near the reused version in all cases. He requires it only if the reuser chooses to opt in the exemption of the url associated with the work. If the reuser doesn't want to use that option, he has only to comply with the normal requirement of the license and mention the url associated with the work.
  • About your point 6: The author of a work under a CC license can require the wording that pleases him as attribution. The attribution that is required by this author includes a reminder that the work is copyrighted in his name. It goes without saying that a work under CC-BY is copyrighted, or it wouldn't be licensed, but if this author thinks it goes better with reminding it clearly and he wants to make sure that it is included in the wording of the attribution, I don't think there's anything wrong with that. Many other users also include such a reminder in the wording they require for attribution.
  • About your point 7: The CC licenses indeed require that the name given to the work by the author must be maintained. If the reuse is a derivative, the derivative may get a new name, but still the original name must be mentioned. It is a requirement of the CC licenses (for example, see section 4(b)(ii) of the CC-BY 3.0 Unported).

As you've stated above, OPTION A is fine. However, your analysis of OPTION B IMHO makes it unfeasible. According to your analysis, Under this option B, it seems that the the author exempts the reuser from the requirement of mentioning the url associated with the work. Note that the author does not require a credit near the reused version in all cases. He requires it only if the reuser chooses to opt in the exemption of the url associated with the work. So, it could be possible for a reuser to reuse the picture, not to include the link to the commons page and to include a credit notice that reads  © Günter Prust. In the options he offers, the author never offers an exemption to the obligation of section 4(a) of the license, which is the obligation of the reuser to provide a copy of the license or to link to the url of of the license. That obligation to link directly to the url of the license (or to provide a copy of the license), which is edicted by section 4(a) of the license, is distinct from the other obligation to link to the url that the author specifies to be associated with the work, which is edicted by section 4(b)(iii) of the license. This author exempts the reuser from the obligation of section 4(b)(iii) if the reuser uses what we named option B offered by this author. But under any option, this author never exempts the reuser from the obligation of section 4(a). So, if a reuser chooses option B, he would still have to comply with every license terms from which he is not exempted, which means that he would have to write at least something like this: «John Doe (2005) by Guenter Prust, © Günter Prust, CC-BY 3.0». (The apparent double mention of the author's name comes from the fact that the first mention (without umlaut) is actually a part of the image's title mandated by section 4(b)(ii) of the license, whereas the second mention (with umlaut) is part of the attribution credit mandated by section 4(b)(i) of the license. This double mention required by the author, once in the title and once in the attribution, may seem like overkill, but he is entitled to require it, and if a potential reuser doesn't like those obligations of the CC licenses, well, nothing forces anybody to use a work, so he just can not use the work.) This author makes clear that the file name is the title he attributes to his work. That would normally be assumed to be the case anyway also for any file published under Creative Commons licenses, unless the author specifies a different title. This author reminds it explicitly. It would breach the terms of the CC license if a rename were done carelessly and without preserving the mention of the original name somewhere in the accompanying information, yes. That's one of the good reasons why actually we don't rename files carelessly and why, when we must, for strictly limited reasons, rename a file, if it's a CC-licensed file, we take care to preserve the mention of the original title. That practice also applies when, for example, CC-licensed material is copied from Flickr or other sites. Transfer bots are programmed to do that. Most users do that diligently. Well, I haven't seen any option in the 'Move and replace' tool to keep somehow the original name (beyond the redirection). On the other hand, both the built-in flickr upload tool and Magnus' flickr2commons allow to change the name of the original file and no mention to its inconvenience is stated. CC licenses (up to their versions 3.0) typically list four mentions, decided by the author, which must be preserved by the reuser: 1-attribution, 2-title, 3-license url (or license text), 4-other associated url (if any). The reuser can't pick which obligations of the license he would ignore, unless specially exempted by the author. The reuser has some freedom about the location of those mentions, but not about their presence. It's not that the four elements can't be moved, but their presence must be preserved. For example, if an author has placed his attribution text in the form of a watermark over the image, Wikimedia reusers often remove the watermark but copy its text in the description. Thus, the mention is moved, but it is preserved. (The practice of removing watermarks is questioned by some people, but that's another discussion.) Similarly for titles. It's not that file names can't be changed, but the mention of the original name attributed to his image by the author should be preserved in the description. Also, just because it is possible to do something technically does not mean that it is allowed by the license. Any user can, technically, change or remove the attribution to the author. That does not mean that the license allows it. If a reuser uses an available technical possibility to alter one of the informations (for example, change a file name, etc.), it can be expected that he will take care to use it in a manner that complies with the specific license of the file in question. Technical tools are flexible, which is good because different licensing statuses exist and allow different degrees of change to the informations relative to works. For example, pretty much anything is allowed with public domain works, but the removal of informations is more restricted depending on one license or another. If we look at flickr files transferred by bot tools, they almost always preserve and include the mention of the original name, generally in the source field or in the description, even when the Commons file name is different. In general, unless indicated otherwise, the user name that the author used and the name he attributed to his image, in the original publication under a CC license, can be assumed to be, respectively, the attribution and the title. If user "Toto the dog" published the image "White flowers", well, that is that. It might be tempting to assume that an author either does not care or did not mean the attribution or the title to be those he wrote, but that would be a slippery road that we should not take. Anyway, no assumption is necessary at all in the case of the works of user Anstecknadel discussed here, as that author specifies explicitly that the names he attributed to his images are indeed the names that must be preserved and he insists to remind reusers to not forget to comply with this clause of the license. -- Asclepias (talk) 18:29, 28 October 2014 (UTC)[reply]

The depicted balloons likely incorporate copyrighted material due to either (1) being of an artistic shape or (2) having images or artwork on the outside. It seems unlikely that FOP would apply to hot air balloons that are not permanently installed (also, there is the question as to when FOP covers a 2D image applied to the outside of a 3D object as opposed to a 3D sculpture.)

Some of the images do have OTRS tickets; however, it is not clear as to whether these tickets cover the artistic elements of the balloons or whether the OTRS tickets only apply to the licensing of the photos; from what one understands, for a photo of an artistic object to be freely usable, it is often the case where both the photo and the object must be freely licensed or out of copyright.

Based on Copyright rules by territory and checking the original act under Canadian law, the FoP terminology and practice seems to mirror UK practices. As such many of the images listed are copyright ineligible as they are not faithful reproductions of 2D works, nor works of "artistic craftsmanship" but mainly inflated scale parodies of other objects.
The COM:FOP sentence If they're left in public space for their natural lifetime, they are considered "permanent" is relevant, as balloons for people to fly in are intended to be used in a public space when not hidden in a storage box. Consequently their natural lifetime and purpose is for display in a public space, albeit they are intended as machines for transport.
Anyway, it is complex and UK FOP tends to be interpreted generously by the courts, presumably the same situation applies in Canada, otherwise lawyers would be queuing up to demand money from every vehical with any sort of livery on it.
