- Regarding the first find photograph, I find it doubtful the stuffed penguins are copyrightable since these aren't exaggerate, fanciful designs, but reasonably closely resemble nature, which is generally regarded as one of the criteria for copyrightability [1]. As for the nerf gun in the photo, I defer to other experts, though we should be sure to apply consistent principles e.g. to some of the pictures in Category:Water guns.--Eloquence (talk) 20:12, 28 June 2014 (UTC)
- The gun looks like the situation in User:Elcobbola/Models; that is, a copyrighted artwork. The fact that there are pictures in Category:Water guns does not mean anything as there are plenty of categories which are full of copyright violations.
- The penguins seem to look quite different to the images in w:Penguin, so your assessment looks uncertain.
- The source country of the toys is unknown. Since the source country is unknown, the copyright status in the source country of the toys is also unknown. For what it is worth, the source country may have laws similar to those described in this court ruling. --Stefan4 (talk) 20:58, 28 June 2014 (UTC)

Do you happen to know if it's been summarized, e.g. in a newspaper, blog post, etc. (regardless of language, I'm fine with reading French or using Google Translate)? - Short summary: Getty Images France hosted some pictures of two different chair models on its website. It was found that these photographs infringed the copyright to the chair models, and Getty Images France was fined for this. For pictures of the chair models, make a Google Images search for "LC2" (a fauteuil) and "LC4" (a chaise longue). --Stefan4 (talk) 14:54, 30 June 2014 (UTC)
- The piñata in the second photo seems to be copyrightable, if it can be compared to a container (a useful article) with a copyrighted design on the outside (also, the shape is likely not utilitarian.)
- As far as the first photo, there might be a utilitarian aspect to the Nerf gun if it is able to fire foam projectiles, though it may happen where a "foam projectile launcher" (a useful article) may simultaneously have artistic aspects on the outside; i.e. if it is designed to resemble a real gun in shape or overall appearance. A non-artistic functional spray bottle would likely be a useful article, but a squirt gun might be comparable to a spray bottle combined with artistic aspects on the outside to make it resemble an actual gun. (This article, which I have used as a reference in the COM:DW guide, may be of interest; it mentions a case of toy stunt plane launchers being considered a useful article (for launching objects) as opposed to a toy airplane being an artistic work that merely depicts the appearance of an airplane (and is therefore copyrightable.)) --Gazebo (talk) 06:59, 30 June 2014 (UTC)
- That might affect the copyright status in the United States. However, it still doesn't say anything about the copyright status in the source country, since the source country is unknown. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in France.
In each case, the image infringes on the copyright belonging to the creator of the work.

Deleted: This is indeed not the uploader's own work but this at times inadvertent claim is a typical problem of users who attempt to upload their first files to Commons. This logo is not eligible for copyright at least according to US law as it consists of typefaces and a simple geometric figure only, hence {{PD-textlogo}} would apply. However, this looks to me like an accidental upload. Shortly after the uploading user inserted this logo, File:Samsung card logo.jpg another logo was uploaded and inserted as replacement. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). - Delete Although it's possible this file could be put to educational use, it would need a better file name, a better description, and some categories for that to be realistic. All of that requires information that the uploader failed to provide, the file is not worth the trouble. As an aside, it would be nice if there was not software being actively distributed that gives no instruction whatsoever to uploaders about file names, licenses, or how to create useful descriptions. - Keep This photo is in use in articles in over a dozen different language editions of Wikipedia. If there were a legal problem with the file (for instance, a violation of the photographer's copyright, or of the subject's personality rights), that wouldn't matter, and we could delete it. But there's not: the photographer is a professional who's been in touch with our support team (OTRS), and has contributed hundreds, maybe thousands, of his photos under a free license over the years; and it was taken in a public place, so there is no privacy violation. Since there is no legal problem, this would first need to be taken up at each of the Wikipedias using the file; once each of those sites has stopped using it, a "courtesy deletion" based on the subject's personal preference might be possible, but would require some further explanation and buy-in from Commons community members. -Pete F (talk) 17:31, 4 July 2014 (UTC)

Unclear copyright status and unlikely to be own work: small/inconsistent resolution, per COM:PRP, considering User talk:Jorferto. The eswiki-based user uploaded in a row in 07.2009 photos from German, Austrian and French philosophers for illustrating his creations on eswiki in 07. and 08.2009. This file is most likely part of user's illustration efforts ignoring copyright issues.

- Kephir hasn't offered any arguments that weren't already mentioned in previous deletion discussions, and found insufficient then. There are many hundreds of "Special and fictional" flags on Commons, and there's been a de facto practice for many years that such flags are not usually deleted just for being special or fictional, but rather only if there's some additional aggravating factor (such as being hoaxing or hatemongering).
- By the way, some of your former nominations, such as Commons:Deletion requests/File:Bandera Gay Reino Unido.png were rather useless and non-productive, so I hope you're adjusting your modus operandi accordingly... AnonMoos (talk) 16:49, 8 August 2015 (UTC)

Reason of deletion : it is a manipulated national symbol and therefore illegal to be advertised as such. It is already transferred in several police departments across the country (There is laws about the national symbols and they should be respected). The moon symbol is representing the Chinese turtle/dragon God and all mongoloid countries represent that in their flags, it is irrelevant to our history, ethics, beliefs and insult in every manner.
