- Keep The statue was dedicated August 8, 1888. Before tagging a US sculpture for deletion, it is often helpful to check SIRIS, http://siris-artinventories.si.edu/ipac20/ipac.jsp?uri=full=3100001~!11906~!4, which is a pretty good inventory of US sculpture. It also is a good idea to look at the WP:EN article on the sculptor, Karl Gerhardt (1853-1940). His dates immediately suggest that the work is pre-1923. . Jim . . . . - Keep Two words: Common. Sense. This statue is well beyond the 75 year S.O.L., as mentioned above. It is part of the Gettysburg Battlefield Historic Site. - While I agree that this DR was ill-advised, Common Sense has little to do with copyright. Being part of the Gettysburg Battlefield Historic Site and being photographed thousands of times a day have nothing to do with copyright status. 75 years is nowhere near old enough to assume that a work is out of copyright -- in the US it's 91 years at the moment (1923) and in many other countries 1888 is right on the border. - Keep This is posed shot in public place. The subject's consent is not needed, the subject's protest is not a reason to delete. Commons has OTRS-permission to host the photo and it is even used. Free licenses are irrevocable. Sorry, reality bites. What to do now? Please upload a better photo, of course also under free license. Deleted: Per [6] "The subject, photographer or uploader of an image may request that it be removed from Commons. The reasons for removal may vary from: it causes embarrassment, was published without the required consent, etc. Generally, images are not removed simply because the subject does not like them, but administrators are normally sympathetic to removal requests if good reasons can be given. " Finland laws shown on same page show that consent is required for the picture to be published, and comercially used (with exceptions of course). In this case with the request of the subject, and the need for photos taken in Finland to have the subject's consent for publication, this image is removed. Kept, I do not believe, that the photo is offensive. Even if somebody considers it offensive, this is usually not a reason to delete it. Commons needs photos about parodies also. And Commons has whole categories for things considered offensive by a lot of people, for example, Category:Anti-Christianity and Category:Criticism of Islam. - As Leyo says, ozone indeed usually has the bent-chain form. It's an easy mistake to make when one only thinks about, for example, trying to keep all the atoms neutral rather than charged, but that is sometimes one of the least important concerns in overall stability. I strongly doubt that the flickr user is the photgrapher. The only photos on her photostream taken with the same camera (Nikon D3S) are in the photo album sampling of spring summer 2013 collections. The album description ("love these") shows already that this is not the upload of a photographer but of a fan. The album contains various photos from different events taken with different, very expensive cameras while the rest of her uploads, mostly private images, is taken with amateur DSLRs. Another photo [7] from mentioned album is taken with a Nikon D3S and contains a name in the Exif which shows that photos from that album are not created by the flickr uploader. The Vatican sources (which are considered primary) show that both the Vatican and Holy See both use the arms with the gold key on the right, whereas common belief and some secondary sources claim that the two entities emblems are different, with the Vatican using the gold key on the right and the Holy See using it with the gold key on the left. Instead of following the primary source, and because Esoglou and Bellae artes kept edit warring and fighting, both versions were uploaded. This file originally had the gold key on the left but now it has been switched. That dispute was never resolved, but I'm not too interested in bringing it back up because it was very heated and ugly. - A file which is on the Commons for five years and a further four years in the English Wikipedia is very likely used by other websites. I did not verify every instance linked above, but some of them:
- [10] very likely used from Wikipedia since the Webpage links itself to en:Philipse Manor Hall. Very unlikely that a teacher is holder of copyright of all the pics onn the linked webpage created for appearantly a test.
- [11] claims Copyright 2014, our pic was first uploaded to EN:WP in 2005, so it is clear who copied whom.
- [12] claims all pics are in the PD, very likely just another imperfect reuse of WP. Considering context I don't think this page was around, when the file initially was uploaded in 2005.
- [13] Whatever this is, but I think, that is surely not the original copyright holder, under no circumstances.
- [14] IMO also not the source, since the pic there has a smaller resolution. I have no clue wether the site was around long enough, but the specific pages was archived by the Internet Archive wayback machine in 2013 firstly. Very likely not the copyright holder.

I disagree that the only mitigating factor should be some inappropriate usage. i tried to get a clearly racist file deleted here, and the ONLY criteria by which it could be deleted was that it was original art by a nonnotable wikipedian (ie someone not known publicly for their artwork), and thus out of scope. no one successfully argued that it could be deleted as hate mongering. Im not going to belabor the point, and I Withdraw my request. The commons has a problem: where do we draw the line with postings of original art? if we are not a free webhosting service, then why is this work here? we also have thousands of images of commercial products whose packaging is under copyright. saying "we have them now" is not a rationale for keeping them. however, this problem will not be solved here, and i guess i dont even want to address it here if there is strong support for keeping such images. PS i thought at first this was a flag proposal from a legitimate source, so i was briefly fooled, and afterwards confused: if an uploader doesnt specifically say in the description of their fictional flag its relation to reality, anyone could assume its a legitimate proposal. - Keep, per previous discussions, in fact I find it kind of odd that this flag, which was previously widely used on user pages, has disappeared from them. This flag is not misleading as it's properly tagged as being a proposal. my issue with the deletion of these false files comes down to two things: 1. (One) Fundamentally, I believe that Wikimedia Commons should be home to all (non-heinous) free media. Free culture isn't just about educational content - it's about making all sorts of intellectual property free to use. It should not be gatekept to a certain type of media. If there were another free media repository out there that was hosting non-educational free media, I would be fine with the Wikimedia Commons closing its doors to somethings. But honestly, we're pretty much all there is, so we have a responsibility to keep free media alive by embracing all of its diversity. 2. (Two) Even without a scope change, I believe that the Wikimedia Commons' "educational purpose" should be interpreted to include cultural and artistic education, not just "the transfer of knowledge". And when I say culture, I mean all culture, not just cultures and subcultures we subjectively label as "worthy". So I oppose these DR's on the basis of my interpretation of this policy—depictions of fantasy and fanart are, broadly speaking, culturally educational. Note how this flags integrates various cultural iconography from Chinese history based on the Five (5) Races Flag.

What is this? On the one hand there is an app for Android inviting people to upload their pictures. On the other hand there are jerks who nominate those pictures for deletion. Good thing I didn't waste my precious time uploading the many saplings of the arboretum I want to start an article about in nlwiki.
Oh well, mapping on Openstreetmap is just a tad easier. If it exists, one can simply add it to the map. I was trying to add wikidata tags for the objects I'm adding, and where applicable wikipedia entries. But I'm about to give up. If a WP article happens to exist, I'll point to it, but adding content doesn't seem to be my forte.

- The Belgian copyright law prohibits you from taking and distributing photos of copyrighted works without permission from the author. See for example COM:FOP#Belgium for a general explanation and this page for the copyright holder's opinion about a specific work. For this reason, certain categories about Belgian things contain warnings not to upload any photos. Unfortunately, I didn't see the option to put my uploads under CC-BY-SA-NC though.

- Commons doesn't accept images which can't be used commercially, see {{Cc-by-nc-sa}} and Special:MyLanguage/Commons:Licensing/Justifications.
- Permission should be documented by using the process described at COM:OTRS.
- I don't know how to change laws. Some members of the French parliament tried to change the French law some time ago, but failed, so photographs of buildings, statues, information boards and furniture are still prohibited in France. On the other hand, other people managed to make improvements in Russia, so it will be legal to use photographs of buildings commercially in Russia starting on 1 October. - OK, I was under the false assumption that going out and taking pictures of the statues myself, would make the pictures suitable for upload. Maybe I'll ask the sculptor for explicit permission on Saturday when another statue will be revealed. But probably I won't. He was very clear about not wanting to release the rights if they can be exploited commercially. Besides he abhorrs technology, so he would probably not be willing to send emails granting permission.
- So, I'll simply give up. Also the article I started to write about him on nl.wikipedia got nominated for deletion. Not encyclopedic enough... I think it's worthwhile and actually artistic what he's doing. That's why I started out to go and take pictures of his works in the first place. The only positive thing that came from it, is that I met him in person now. (His carvings had gotten my attention before already).
- What strikes me as perverse about this silly law is that apparently it's even prohibited to TAKE these pictures. This is new to me. The problem with it is that it makes my mapping activities for Openstreetmap a whole lot more complicated, as I was using those pictures as memory aids. I hope it's still OK to indicate the existence of these statues/works of art/building on OSM. But it seems like I'd have to do it there and then. Or maybe I should stop and take notes, instead of snapping a quick picture and moving on. Those pictures are the notes of my mapping.
- The other reason for taking pictures (and uploading them) was to record a point in time for those objects. What it looked like at that moment. Now it seems as if some enlightened people consider I took something with me, which belonged to somebody else. They're just 1s and 0s people. Not the objects themselves or even part of them.

- No, I looked at it. I understand your comment, but the point here is that, although the overall "costume" in the Ukrainian case can be regarded as a "modified or original representation of a character" the issue here is in the Darth Vader mask. It's copyrighted, it's covered by COM:TOYS and cannot be regarded as a de minimis element within the picture. On the contrary. The picture is of course a modified representation, but keeps unmodified prominent elements of the original copyrighted element. - If it's being actively worn by a person in a manner like an article of clothing, then: 1) It's a little dubious whether it can be called a "toy" in the most useful meaning of the word. 2) Its "utilitarian" function is specifically not copyrightable under United States law. The image may end up needing to be deleted in the end, but I wish you would stop throwing the word "toy" around, because I don't think that it clarifies any issues in this case. - The diagram on Derivative works explains that a picture taken in country where the freedom of panaorama is allowed can be uploaded under a free licence. - Yes because the graffiti is a DW, but for example, the picture File:Gateway to space 2016, Budapest, Darth Vader.jpg was taken during a Star Wars exhibition. So the Darth Vader costume here is not a DW, it is an original copyrighted costume and mask, so it is a 3D artwork, like a statue. The answer of the lawyer Mike Godwin is clear : "Suppose someone dresses up as, say, Spider-Man, and has a photo taken. The photo is neither a copyright violation nor a trademark violation.", if we change spider-man by darth vader, we got the same case. Please make individual request and be sure you are not in a FoP or Spider-man case.

- So every pictures that are showing a costume, or somebody wearing a costume, should not be deleted because it is not a copyright violation. It is a different case for pictures that are showing statues or toys.
