I moved this image to Commons from en.wiki since it was tagged as free and had been deemed PD at a deletion debate at w:Wikipedia:Files for deletion/2009 April 10#1936 Pittsburgh flood0007.jpg. However, now that I examine the case more closely, I see that it came from Flickr here, where the Flickr uploader "upheld" states that his mother took the photo and lists it as "all rights reserved". I suspect that w:User:Egpuhl, who first uploaded the image to Wikipedia, is the same person -- his only actions on Wikipedia were to upload this photo, and he did so on the same day that "Upheld" uploaded it to Flickr. But I can't prove that. I see that a Wikipedian contacted "upheld" on Flickr just today. I'd like to keep this around a week or so so we can figure out what's appropriate. – Quadell (talk) 11:43, 3 August 2013 (UTC)

Comment At present the photo on Commons has insufficient information. Curious, I did a reverse image search and found the Flickr image linked above. - Comment From the (deleted) history of the image at the original upload on en:W, en:User:Egpuhl uploaded this photo as {{self|GFDL-no-disclaimers|cc-by-3.0}}. More than a year later, en:User:Buffs changed the license tag to {{PD-Pre1978}}. If the uploader is heir to the photo and its rights, and the photo had NOT been published before 1978, the uploader's license would be legitimate, and the changed PD license would be incorrect. I shall alert User:Buffs to this discussion as well to see if they have any additional info or feedback. -- Infrogmation (talk) 14:20, 3 August 2013 (UTC)

There is no EXIF data and the image appears to have been used prior to the original upload date of 1 November 2006. Eg: it appears in this article of September 2006. There are plenty of other images of Kejriwal, so why take the chance of a potential copyvio? Sitush (talk) 12:59, 3 August 2013 (UTC)

Configured with source = "Revista 220 Anos Santana, da Associação Comercial de São Paulo - Distrital Santana – Julho de 2002 – Nº2 – Ano 2" + author = "unknown" + {{PD-self}} by uploader Pedu0303 + exif-data from 2009 = a configuration which IMHO doesn´t work. This image seems to be most likely a (resized) photo of a photo (COM:DW) and needs permission from the original photographer who took this image in 2002 or before. - Why all my files nomination for deletion? The Google Earth pictures I took from screenshots. My logos to 150,000 articles in the Hebrew Wikipedia are my creation. - Comment I would think we would need the author, if that's Igor Ignatyev, to contact COM:OTRS to give permission, from a zonawar.ru email address, rather than a gmail address as above. Keep – According to Commons:Project scope#Must be realistically useful for an educational purpose, it says that if a file is in use, then it is automatically deemed "educationally useful". It does not say that if it is unused that it is out of scope; rather, it says that the usefulness is determined by the quality of the image, the existence of similar images on Commons, etc. This is a high-resolution image of a book cover, the only one of it's kind, for which the author has provided OTRS approval to Wikimedia Commons. It does not meet any of the criteria for deletion, and therefore should be kept. Senator2029 13:16, 7 August 2013 (UTC)

The picture is mine - perhaps I used the incorrect nomenclature for the photo. This a purely a pro-bono/love of the genre thing where I helped out with some of the media parts of the project. I wasn't paid. I don't get anything. Well - I might have got a thank you and shout-out on their website. - This is an Election symbol as allotted by Election Commission of India to many Political parties in many different elections. It's use is governed by The Election Symbols (Reservation and Allotment) Order, 1968, as in following references, [3], [4], [5]. - Comment This is without doubt a messy situation. I'm really not good when it comes to the arcane aspects of copyright & I've noticed today that there is something called the "threshold of originality" which, like many things copyright-related, seems to be rather subjective in law. What is certain is that this image is a cut from one shown on a copyrighted website and that the various links provided by Tall.kanna do not in fact address the concern. Some predate the image and are full of references to other laws/regulations that will require legal expertise ... and none seem to show the image itself.
Who actually created this image? I did suggest on the en-WP talk page for the political party in question that the most likely simple solution to this is to attempt to get from the party some form of OTRS permission for re-use. For reasons that I'm not going to bother explaining, I would be surprised if this was not given, assuming that they do have the authority to give it. It was because of this optimism that I did not nominate for deletion myself - I was hoping that those who clearly have an affinity with the party might be able to resolve it via OTRS in a very timely manner. - Sitush (talk) 00:24, 4 August 2013 (UTC)
