- I own lots of items that are copyright protected, that does not give me the right to republish them. A photograph of a utility object would put the copyright with the photographer, but an artistic representation of these objects puts the copyright with the designer of in this case the badge. Making a photograph of a 2D piece of art in the manner that you did does not even add a layer of copyright to the object, since it requires no artistic input. Now, the parachute symbol has been in use since the creation of the parachute, and is so simple that I am leaning towards giving this one a pass, I am consulting other contributors on this matter here. --Vera (talk) 15:05, 8 March 2013 (UTC)

This looks too complex for {{PD-textlogo}}, considering the light effects of the rings. Compare with http://www.ipmall.info/hosted_resources/CopyrightAppeals/2006/CCC%20Logo.pdf which shows that simply adding a border and three words to the uncopyrightable "CCC" logo made the new creation copyrightable. There are a few problems here:
- It says that this was taken by a user called FreddieM85 (talk · contribs). I guess that "M85" means that the photographer is a male person born in 1985. It also says that the photo was taken in 1985. Did the uploader take the photo as an infant?
- The image is watermarked with "Jon Woodward". Jon Woodward is likely the name of the photographer. This conflicts with the claim that the photographer is called Freddie.
- This looks like a scan from a printed publication, so the claim about it being an own work looks dubious. Stefan4 (talk) 18:14, 8 March 2013 (UTC)

- Earlier pictures you uploaded had been previously published on other sites, that combined with the low resolution makes it likely that you didn't produce those pictures but copied them, creating a copyright violation. This picture shows the kind of distortion you would see if it was posted behind plastic on some sort of bulletin board. You took a picture of a picture, violating the copyright of their first photographer by publishing it. Please don't disrupt the protocol by removing templates. A representative from Stanford claims this was taken by one of their photographers and provided to Commons without authorization by the Chemical Heritage Foundation. See ticket:2013030810012201 §FreeRangeFrogcroak 23:25, 8 March 2013 (UTC)
I'm the web developer at the Chemical Heritage Foundation. We did not provide this image to the Commons. We are in the midst of working with the GLAM initiative to legitimately share a number of our images, but this image isn't one of them. Stanford University has contacted us to make us aware that their policies preclude them from authorizing use of their copyrighted material on Wikipedia. They have asked us to file a deletion request for this image on their behalf; since one already exists, I thought I'd let you know how things stand from our end. Thank you! After today identifying some uploads as individual copyvios (grabbed from different blogs, photo-hoster, offical sites etc.) it´s difficult to believe that these remaining files would be own work: There are around 19 different digicams in use, some of them related to high professional landscape images and panoramics of cities in China and elsewhere. Examples: File:红水河第一湾.jpg (uploaded in 01.2013) similar to http://www.xyxy66.com/Article.asp?id=204&Page=6 (2012) = .jpg (last modified: 2012), File:那坡县黑衣壮美女.jpg + File:那坡县黑衣壮美少年.jpg (uploaded in 01.2013) = cropped from http://dcbbs.zol.com.cn/100/657_990504.html (11.2012, ©2013 CBS Interactive. All rights reserved). Despite of "his" arsenal of digicams (Canon EOS 5D, Canon EOS 5D Mark II, Canon EOS 7D, Canon EOS 60D, Canon EOS 10D, Canon EOS 350D DIGITAL, Canon EOS 400D DIGITAL, Canon EOS 600D, Canon EOS 500D, Canon DIGITAL IXUS 70, NIKON D90, NIKON D80, NIKON D700, NIKON D5000, NIKON D5100, NIKON D3X, Sony CYBERSHOT, Sony DSC-HX100, Olympus C765UZ) they are a significant number of files uploaded without any exif information and usually the resolution varies from upload to upload. And File:红水河晨雾.jpg comes with a mysterious shadow. Resuming: IMHO untrusted user uploading a bunch of unsourced/copyrighted material so these ones (per COM:PRP) can't be believed either.

I noted two images uploaded by this user in which they stated http://www.syriapath.com as the source and released the images to public domain and reported Khaled-binwalid-tomb2.jpg as copyvio. However, the site does not state anywhere its materials are in PD. For this reason, I nominate here the images uploaded by this user that were taken by Sony-Ericsson W800i camera (as in the aforementioned file), whether or not attributed to syriapath.com. These images seem to share a common feature: none of them are full 2 megapixel, they are reduced, so it is likely they are all from the same coopyrighted website.

- How can you stand to remove the image if you are not confident in their statements and their legal status? Moreover, the image data in accordance with Kazakhstan legislation can not raprostranyatsya copyright, as, in principle, to point to the appropriate licenses. Or photos taken on their own, the participants of the project. [edit]These photos show a recent monument in Kazahstan. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in this case.

The collages contains two non-existing or non-linked images so either replace them or link to them if still present. - The Czech law does not have a provision similar to the copyright law in the US where any work by the federal government is automatically in the public domain. In the Czech Republic, only works “where there is public interest in their exclusion from copyright protection” are in PD. It is debatable whether an official portrait of the president fulfills such a requirement (but the reasoning cannot be just “published on official webpage”). - I think, the fact that the portrait was not only incidentally used but explicitly declared as official would be considered as indication that it fully fall under regime of official works. But of course, every law interpretation can be opposed, especially when the law is vague.

Comment: Soudní dvůr EU v rozsudku ze dne 16. července 2009, Infopaq International (C-5/08, Sb. rozh. s. I-6569, bod 35) rozhodl, že autorské právo lze uplatnit pouze ve vztahu k předmětu, jako je například fotografie, který je původní v tom smyslu, že je autorovým vlastním duševním výtvorem. Jak vyplývá ze sedmnáctého bodu odůvodnění směrnice 93/98, o vlastní duševní výtvor autora se jedná tehdy, pokud odráží jeho osobnost. (citace zde, originál jsem nehledal). Je tedy vůbec otázka, zda není absurdní uplatňovat autorské právo na běžnou neuměleckou dokumentační fotografii či na užití prostých řemeslných fotografických technik. To je ovšem koncepční otázka pro celé Commons (počínaje otázkou, jsou-li tvůrčím dílem třeba záznamy průmyslové kamery nebo strojově zpracované fotky ze GoogleStreetView). That would mean at a government site that says that the image is creative commons or the like. I would suggest that if people want the image released that they write and seek permission. Thwap me if I'm wrong, but https://wikimediafoundation.org/wiki/Trademark_policy (although it's mostly about the image as a trademark obviously) seems to suggest that the puzzle globe image can only be used under fair use terms. - I may be misreading, but I think what you have quoted refers to using the Wikimedia Marks on derivative content, not creating derivative content from the Wikimedia Marks. Tell you what, I'll ask Maggie Dennis. The WMF is generally very liberal in permitting use of the trademarks by community members, but I'll run it past them just to be sure. Presuming that they are okay with it, trademarks (ours or anyone else's) should be properly labeled to caution reusers that there are restrictions beyond the creative commons license which apply, as explained at http://commons.wikimedia.org/wiki/Commons:Image_casebook#Trademarks." - i was quoting from the derivitives section (looking for any help from their communication); i'm confused about the difference between "Wikimedia Marks on derivative content, not creating derivative content". i don't know if i'm unconfused enough to have an intent. what is the foundation's intent? is it to allow derivatives only for non-commercial use? would a NC "fair use" license on english wikipedia better reflect this? i didn't see a "ask permission first before proceeding" statement. are they prohibiting transformative parodies? As I understand it: The community can generally use the marks in this sort of remix, for parody or otherwise, on the wikis & for internal use within the community projects. What is not allowed is, for instance, combining Wikispecies with Insectlopedia to make a new site or mega-ebook, and putting the Wikispecies logo on the front, or naming it "Wikispecies for Kids". --SJ+ 20:56, 22 March 2013 (UTC)

Deleted At the very least, this image must have a license -- {{Copyheart}} is not a permitted Commons license since it is not irrevocable. File:Indi-land-ball.png is licensed CC-BY-SA. In order to use File:Indi-land-ball.png, the license would have to be CC-BY-SA, and it is not clear that the WMF globe can be used at all.
