No freedom of panorama in Italy - this building was recently modernized by famous architect Fuksas 93.39.206.242 15:08, 14 April 2011 (UTC)[reply]

 Keep the statement "this building was recently modernized by famous architect Fuksas " is false. For unknown reasons there's a widespread urban legend according which Fuksas redesigned the Palazzo dello Sport. Actually Fuksas was called to design an installation for the inauguration of the renewed building in 2003; such installation is no longer in place. Fuksas had no further role in the modernisation. This file was initially tagged by Hammersoft as Copyvio (copyvio) and the most recent rationale was: While the source does indicate "creative commons" in the caption of the image, it does not indicate what creative commons license. It could be a non-commercial license. We don't know. As such, this is a copyright violation and incompatible with Commons. Converted from a speedy to a regular DR by me, as it's not a clear copyright. Needs some clarification. -- Túrelio (talk) 20:57, 12 August 2012 (UTC)[reply]

  •  Delete Whether an image is available under a license compatible with Commons is a yes/no proposition. Either it meets the requirements or it doesn't. The problem here is the source indicates in the caption of the photograph "(Creative Commons)". This doesn't inform us as to what the license actually is. It could very well be a non-commercial license. We simply don't know. Without confirmation that the license is in fact compatible with Commons requirements, it's not a free license for our purposes. Not surprisingly, the image appears to be lifted. Have a look at this source. On that source, the image caption notes "Peter Kramer/NBC/NBC NewsWire via Getty Images". Oops. The Wikimedia Foundation has essentially informed Commons that an item with about any depth at all should be considered a 3D work and not eligible for {{PD-art}} when it stated that photographs of old coins are copyrightable: see Commons:When to use the PD-Art tag#Photograph of an old coin found on the Internet. This work too involves some depth, and there is possibility for creativity within. It is entirely plausible that a US court would rule this work copyrightable; this image ought to be deleted for that reason per COM:PCP. . I am the author of this photo. In principle, there is no problem... The military building dates from about 1880 and we can consider that the paintings are accessories. De minimis principle should apply (there is just a little french flag painted and also a wife jogger). So, it seems to me that this is not the original work of an artist but the work of anonymous painters of the army. This is one of 5 carved plaques at the Peace Gardens all used on the English Wikipedia Peace Gardens page. They are carved so not entirely 2-D. One is on a post which is a 3-D object but contains words. I do not mind - I only put up pictures in an attempt to be helpful. It just seems to me silly that some people have decided that items put on public display for information cannot be used for this purpose in Wikipedia. I notice that a picture of a shop front by me was also deleted. We should always weigh the uploader's wishes against the value of the image; since there are alternatives, and the image is on a sensitive topic (!) and the person fairly recognisable from the image - just delete. Put another way (since someone has already voted keep) - what evidence do we have that the uploader is the person depicted, or had their permission (COM:BLP)? The anonymous uploader has no other image uploads or other track record... PS while we're on the subject, doesn't the person in File:Selfsuck.jpg and File:Autofellatio B-W.jpg (uploaded by different users claiming own work) seem to be the same? German Imperial Eagle Outdated Depictions

These depictions of the Imperial Eagle of the German Empire are not in use anymore and have been replaced. The first two are derirative works of File:Wappen Deutsches Reich - Reichsadler 1889.svg which I as author finally uploaded to replace them. The third one isn't of reasonable quality anymore. The last one has been replaced by a better scan of the source: File:Wappen Deutsches Reich - Reichswappen (Klein).png. Most of the user's uploads appear to have been collected from the internet, and given a CC-0 license with no such evidence on the source websites. Two of the images turned out to be CC-BY-2.5-AU, which I fixed, but the others appear to not have a valid license. File:HELP.jpeg is actually from flickr but with a CC-BY-NC-SA license, which is not usable here. File:Risk Dice.jpg is from freedigitalphotos.net from the looks of it; the free 300x400 version appears in many places over the internet; the source site allows many usages but not enough to be considered free; in particular commercial use seems to be prohibited. Have not researched all the others but they appear to be similar.

Keep for now. File:Trude Sojka.jpg [ File:Foto Trude Sojka joven.jpg ] was nominated for deletion earlier and kept. At that time it did not appear elsewhere on the internet. Given the subject's history it is unlikely anyone other than a family member m or museum worker (and those sets overlap) would have had access to that photo. A photo of that age can hardly be expected to have exif. It is likely that we are dealing with a copyright holder or representative of the copyright holder. I am sorry I couldn't answer you before. Well, I am Trude Sojka's grand-daughter, from Ecuador. My mother, Anita Steinitz and I are the owners of all her pictures. We decided to publish them when we found out that many people have been surprised there is no article in Wikipedia concerning the Czech painter and sculptor Trude Sojka, a well-known artist in Quito, Ecuador, who died in 2007 and had her house turned into a museum. These pictures are very old; all of them are scanned (except for File:Biblioteca Hans Steinitz.JPG, which I took myself in the museum). That's why, as User:Dankarl said, their resolution is poor, they don't have EXIF, and I have no idea how to put it. Please, tell me what to do in order to keep these photos in Wikipedia. Okay, here is a start. Go to Commons:OTRS, read the instructions there, and follow them. Basically what it says is that we need a traceable email that gives permission for these images to be here and indicates that you are the copyright holder and understand the license you are granting. Probably best if it comes from the Museum email address, and has your Mom's name as well as your username. It is very important that you understand the permission that you are granting. It is irrevocable. You are not just putting them on Wikipedia you are letting users download them and use them, including possibly commercial use and derivative works. There are several CC licenses you can choose from but they all allow at least this much. Read about them and think carefully which you want. You still have the moral rights and personality rights to prevent disparging use, though that may be hard to enforce. If you decide you have uploaded more pictures than you want to leave here, mark the rest for speedy deletion-uploader request.
Then go through and identify the photographers on each photo, with dates if possible. Mark each (except the one you took) OTRS Pending (I think there is a template for this) and copy the explanation you gave here. With any luck that will keep them up until the OTRS email arrives and goes through review. Should that not work and some images are deleted, you can get them undeleted after the OTRS review. Also, if you can put a link to the commons images on the Museum website that will be further proof it's ok; not required but it helps. Sorry this is so complicated but the procedure exists to protect the artist or rights-holder and also the user who downloads and uses the image in good faith.

After today identifying around 10 uploads as copyvio (grabbed from different Panoramio-/Flickr-accounts, blogs, news sites etc.) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user uploading a bunch of copyrighted material (small/inconsistent resolutions, missing exif) so these ones (per COM:PRP) can't be believed either. As all the other already deleted files (15 + 10 actual copyvios, see also above) the images are mostly related to es:Instituto Tecnológico de Ciudad Madero (TEC, a technological institute in Mexico).

Under "Photographs of identifiable people" section of "Commons:Deletion policy" this image has an unethical objective, i.e., to pervert freedom of expression. This image is unacceptable as it mocks the prophet, whose no real photograph is available till date. Commons:Photographs of identifiable people deals with photographs of identifiable, living people. This is not a photograph, and Muhammad is not alive. He died nearly 1200 years before the creation of the earliest surviving camera photograph and 1378 years before this drawing was created. None of your other points have any basis in Commons' policy or applicable laws or bring up anything that wasn't already addressed in the numerous deletion discussions that you were told to read before starting yet another round of this. As the very first sentence of Commons:Project scope/Neutral point of view states, "Commons is not Wikipedia, and files uploaded here do not necessarily need to comply with the Neutral point of view and No original research requirements imposed by many of the Wikipedia sites." At this point, repeated deletion nominations of the same file without bringing up any new, relevant arguments is entirely unhelpful, and piling on multiple concurrent deletion discussions is particularly disruptive. Hallo Jergen, es geht darum, darzustellen, wie so ein Heft grundsätzlich ausgesehen hat. Da kann sich dann der Betrachter schon einmal einen Eindruck machen. Das ganze ist ja auch kein "Bild" sondern die Titelseite eines Heftes. Ansonsten müssen wir noch Jahrzehnte warten, bis wir den Leuten überhaupt was zeigen können. Und das kann es doch auch nicht sein. Das ist übrigens auch einer der Gründe, warum ich in diesem Bereich Pfadfinder/Jugendbewegung & Co in der WP nicht tätig bin. Es macht keinen Sinn, kiloweise Text ohne Bilder zu schreiben. Das muß dann wohl eine andere Generation machen. Jedenfalls ist vieles, was da steht ziemlich ungenau und teils nicht richtig.  Delete The whole 2D-3D question relates only to {{PD-Art}} -- it is shorthand for the Bridgeman vs Corel decision, which was about old master paintings. It, and {{PD-Art}}, have no application to text, which is always covered by copyright except in the seven countries that allow it under FOP.

Also, please remember that {{PD-Art}}, and the 2D-3D question relates to the photograph's copyright. To apply PD-Art, the underlying work must be PD. There is no question that we have a CC-BY-SA license to the photograph here -- the problem is that the work that has been photographed is not PD. .     Jim . . . . Interesting question -- subtle. The 3D/2D distinction is one of our shorthands. UK FOP allows "(a) buildings, and (b)sculptures, models for buildings and works of artistic craftsmanship...." Therefore, I think there are two questions:
(1) Does the fact that it was clearly a literary work before it was anything else -- the person typesetting the plaque must have worked from a text -- eliminate all other issues? If so, it must be deleted.
(2) Is it a work of artistic craftsmanship, as defined in Section 4? A work of artistic craftsmanship is not
"Section 4(1)(a) a graphic work, photograph, sculpture or collage, irrespective of artistic quality, (b)a work of architecture being a building or a model for a building..." because they are separately called out in section 4.

This is presumably a casting. It seems to me similar to all of "engraving, etching, lithograph, woodcut". The case law cited at Commons:Freedom of panorama#United_Kingdom suggests that there must be some creativity in the work if it is going to be classed as "artistic craftsmanship" -- this is a routine cast plaque. The type molds used for the letters might well have been set by computer. Not much craftsmanship in it.

  •  Delete {{FoP-UK}} does as far as I know only apply to artistic works. If the stone is an artistic work (of the kind covered by {{FoP-UK}}), then the engraver can't sue you for copyright infringement (see COM:L#Typographic copyright), and then the one who drew the coat of arms can't sue you either. However, this item does not only have artistic aspects, but also literary aspects. I don't see how {{FoP-UK}} would overcome the literary aspects, so I assume that the one who wrote the text can sue you for copyright infringement. --Stefan4 (talk) 23:54, 21 August 2012 (UTC)[reply]
