- This cover has been sold in the whole public in each German bookstore that time and was taken up as a jpg from a common public situation. Both, the cover designer Ekkehard Wagner and the owner of ‚Sounds’ Verlag are dead since more than twenty years. And, more important, they don’t left legal successors. No copyright problems. Assuming that the page is correct that it is anonymous (something of which I'm skeptical), this is copyrighted until 2015 at the earliest (year of creation, earliest possible publication), 2028 at the latest (latest possible first publication). - Lack of high-res and EXIF per se is not a proof of any wrongdoing, it's just a signal to look on the upload closely. That's just his workflow -- he use Picasa before uploading to resize them to 480x*, and it removes the relevant metadata. - The user uploaded >1000 pictures. Almost all of them have 480px or 640px resolution, ~half have no EXIF (the most of the rest have Canon 500D camera EXIF). This picture is no different from the whole bulk of uploads. He doesn't look like a copyvio uploader, his contributions look perfectly legitimate (albeit downscaled). If this is a copyvio -- this is a copyvio of a huge scale, that should be easily discoverable, but we don't see anything like this. What about the identity of User:Toilet, I think this beyond any reasonable doubt -- actually, at first he signed his photos as Toilet (e.g. this), then he changed the signature to Peter van der Sluijs. - La Directive CE n°93/98 du 29 octobre 1993 a porté la durée initialement applicable au titre de la protection du droit d'auteur de 50 ans à 70 ans. Actuellement, au décès de l'auteur, le droit d'auteur persiste pendant l'année civile en cours et les 70 ans qui suivent.
- Deux arrêts de la Cour de Cassation dans deux espèces différentes (Monet et Giovanni Boldini) en date du 27 février 2007 ont clarifié la question du cumul ou non des prolongations pour faits de guerre avec la période de 70 ans après le décès de l'auteur.
- Il a été jugé que la période de 70 ans couvrait les prolongations pour faits de guerre, hormis les cas où les auteurs ou leurs ayants droit pouvait prétendre à une durée de protection plus longue, laquelle serait alors seule applicable.
- Il en ressort (comme clairement indiqué dans la publication de la Cour de Cassation) qu'il convient de rechercher si à la date du 1er juillet 1995, les ayants droit de l'auteur pouvaient prétendre ou non à une durée de protection supérieure à 70 ans :
- dans la négative, seule la durée de protection de 70 ans s'applique : c'est le cas pour Robert Linzeler : en effet, dans ce cadre, les prolongations pour faits de guerre doivent s'ajouter à l'ancienne durée de 50 ans (50 ans + 14 ans + 272 jours = 64 ans et 272 jours et non à la nouvelle durée de 70 ans; la durée de protection étant de 64 ans et 272 jours au 1er juillet 1995, elle était donc inférieure à 70 ans, qui avait donc seule vocation à s'appliquer.
- Dans l'affirmative, c'est la durée la plus longue qui s'appliquera. C'est le cas des œuvres musicales et des œuvres d'auteurs morts pour la guerre (prorogation supplémentaire de 30 ans) : ce n'est apparemment pas le cas de Robert Linzeler qui est mort en 1941 mais à 68 ans. En tous les cas, cela n'est pas revendiqué par Wikipédia.
- Par conséquent, la protection de la coupe réalisée par Robert Linzeler, décédé le 25 janvier 1941, au titre de son droit d'auteur, a cessé le 1er janvier 2012 (1941 + 70 ans + année civile en cours).

This was previously hosted as fr:Fichier:Emmett Till.jpg according to the upload history, and likely also as de:Datei:Emmett Till und seine Mutter.jpg (based on the deletion reason) and possibly also as en:File:Till2.jpg (see the image caption in old versions of the English article and the statement on the Commons file information page that the image was available on English Wikipedia at some point). Derivative work of the painting, which is obviously one of the primary focuses of the image. The PD-USGov tag appears to only apply to the photograph - I don't believe Kinkade was ever a federal employee. Suggest {{Fair use delete}}. Dcoetzee (talk) 20:02, 9 April 2012 (UTC)
- Keep I have to strongly disagree about the focus; it's at least arguable that the uploader wanted to provide an available likeness of Kinkade. By the way, the source has now been moved to a different page at the Department of Defense website (http://www.defense.gov/news/newsarticle.aspx?id=18000) and shows the original picture has been somewhat cropped to remove a woman (Kinkade's wife?) standing next to him. If showing the painting at all--which I think is OK because it's relatively low-res--is not acceptable, perhaps this could be cropped further just to show Kinkade's face as a means of visual identification? I feel there is value in having an image of the late painter in Wikimedia Commons which at least one recent news story has utilized (http://www.dailymail.co.uk/news/article-2129383/Beloved-painter-light-artist-died-aged-54-sleep-relapsed-alcoholism.html?ICO=most_read_module) and value lost if it gets removed. - MollyTheCat (talk) 04:53, 14 April 2012 (UTC)
- Keep The suggestion that it is a "derivative work of a painting" is utterly absurd, Dcoetzee. It's a photo of Thomas Kinkade holding what appears to be a painting; he could also be holding a framed print copy of one of his paintings. Furthermore, it's not the complete painting, but a portion of a painting, with considerable perspective distortion due to the way Kinkade is holding the frame. By your rationale, if someone were to walk into a museum and snap a picture of a copyrighted work of art and donate that image to Wikimedia Commons and put the snapshot into the public domain, it would somehow violate the copyright of the original work of art. Wrong! You are completely misinterpreting Wikipedia copyright policy. It would benefit us all if you would review the policies carefully and refrain from proposing deletions of files in the future based on such flimsy reasoning. —Quicksilver@ 19:31, 8 May 2012 (UTC)

Indeed it would! Please read Commons:Derivative works thoroughly. We delete such photographs routinely. This work would be fine if the photo were cropped to eliminate most of the painting (under Commons:De minimis), which is an acceptable alternative to deletion. Contrary to the uploader's claims, the author of these images is not "unknown", but is very clearly stated at the respective sources (here, here, here, here, here) as "Mauer, Friedrich, Oberregierungsbaurat". You can see there also that the dates for three of the images are just estimates. One can find a Friedrich Mauer from Neckargartach (the municipality these images show) as having just passed his exam as Regierungsbaumeister in February 1919 (Zentralblatt der Bauverwaltung, Nr. 61/1919, search Google for "friedrich mauer" neckargartach). It's very likely that this is our man. As that particular exam stood at the end of the university studies, he must have been somewhere between 20 and 35 in 1919 (taking into account possible military service in WW I). In any case not old enough to assume he was dead in 1941 to justify the PD-old tag.

Possible copyvios uploaded by sockmaster Messina - photos from German magazines dated from 1898 up to 1911 - author is listed as unknown for all of these, but they're tagged with PD-Old - no evidence to support PD-Old - many of the authors of these images could've lived into the 1950s/1960s - I've also tagged a few of his last uploads that look like plain frauds - these are sourced to "Blätter_für_Architektur_und_Kunsthandwerk_1886", a magazine published from 1888 to 1917 according to several sources, including [14] and [15] (both in German) - the images look c1900s/1910s rather than 1886

All this photo was uploaded by Dembler under Attribution-Share Alike 3.0 Unported license and marker as his own work. But he admit that some of this photo was made by somebody else. This is possibly violation of Attribution of CC-BY-SA. 5 of 6 of this photo hasn't any exif information and some of them can be easily found on some site's and blogs published early, than Dembler upload them to commons (like [16], [17], [18]). Dembler says that authors gave him all copyright, but doesn't gave any evidence. I think this photo should be deleted as it's copyright's is doubtful. - The imageboard software is open source, and the screenshot aims at depicting the imageboard software, not the site itself, hence copyrighted images specific to the 4chan website are blacked out. See en:imageboard for further details. The Futaba code and its mirror and fork derivatives are software, and the screenshot acts as documentation of the aformentioned software. The screenshot contains no meaningful content that can be considered meeting the en:threshold of originality specific to 4chan, and the same imageboard form format is used, with derivative modifications, at places like krautchan, Futaba, tinychan, 4chon.net, ponychan, iichan, Komica/2cat台湾BBS, uboachan, touhou-project, tohno-chan, /bun/, UAchan, various chans linked from here, cirno.ru, cirnos, 410chan, 420chan, oneechan, /moe/, poolshlmer, 2ch.so, 38chan, Acfun 匿名讨论版, camiko, voile, and (formerly, dead site) ichan. Kept: The last comment is incorrect. We delete approximately 4,000 images every day. The proper place to begin a discussion of whether an image should stay on Commons is here where many people will see it, not on a talk page, which is essentially a private discussion.
