  • Neutral leaning on keep for now. @Tschaensky: , the uploader and righs holder, hasn't been active for years which could be the most simple courtesy way of handling this. Otherwise, this was taken in Austria so Commons:Country_specific_consent_requirements#Austria applies. The commercial reuse restriction is the only claim but I don't see any violation of their legitimate interests from this as it was a public sporting event. @Túrelio, Ricky81682, and Eva Weissová: I have a proposal here. Is there anyone who would object if Ms. Weissová would provide a better picture of herself, duly licensed, and then we would delete this one as a courtesy? By "better" and "duly licensed" I mean:
  1. Satisfactory to her.
  2. Reasonable for purposes of identification in an article.
  3. Reasonably high resolution, no noticeable camera jitter, decent focus, etc.
  4. License clearly from the person that owns the copyright of the photo in question (probably provided through the OTRS process unless that is someone who already has a longstanding account here)
    • NOTE that Ms. Weissová is presumably not the copyright holder of a photograph of her, unless it is a selfie.
  5. License must allow derivative versions and both commercial and non-commercial use. It's fine if it requires attribution.

See the "LY company" and "Gang Heng" logos as they are both comprised of extremely simple shapes and texts and yet they are ruled copyrightable by the courts. These CRH logos are apparently more sophisticated than those two. All I did was translate the previous version of the image which was in German, so its license was considered the same. I might make one further comment that this image is a reductive analysis. The original score is for a symphony of instruments, and this particular arrangement is a simplified reduction to just two staves by its author, and not a direct copy of the score itself. None of the annotation and text is from the original either, it is the analysis which is being presented. Much of the content of the excerpted portion of the score it was derived from has been deliberately excluded (e.g. instrumentation), removed for the purpose of demonstrating the kind of harmony it's using. I'm believe this is a flickrwashed photo. I spent some time at the Wayback Machine and TinEye and other archives trying to find direct proof, but I can't find any relevant pages that kept an archive of this actual image. I can tell you from memory that it was used online by w:Erica C. Barnett for several years prior to 2008. It was probably on her Myspace in 2003 or so. It was also at sites like publicola.net and thestranger.com well before 2008.m The Flickr account that this photo is copied from doesn't give any confidence that they are the photographer or copyright holder.   • DeleteKeep I recall seeing this image at a date prior to the upload date of 2008, however, on those occasions I recall seeing it credited to Buster Benson (the Flickr uploader). The uploader, Buster Benson, appears to be a person known to the subject of the photograph (e.g. [4]), therefore, it is not unlikely that he was in a position to take this headshot. Further, the headshot in original form is inscribed with writing he appears to have applied indicating his personal knowledge of the subject. The uploader, Buster Benson, is a book author published by Penguin ([5]) and a close review of his Flickr account shows no evidence of purloined images, even though he has uploaded many thousands (a combination of personal photography of friends and family and original artwork). It seems unlikely to me he would have uploaded thousands of personal photographs and one stolen photo. I have conducted a reverse image search which failed to find this image in other form on an earlier date elsewhere. I have manually checked Publicola.net (via the Wayback Machine) and TheStranger.com and failed to find this image there.     • This is an indication that Barnett has been in communication with Buster Benson, in regards to a review of his app. "Known to" is correct in the sense that they've communicated in their respective professional capacities. Not sure how that translates to any kind of copyright or personality rights. It takes a lot of imagination to make anything of it. Erica C. Barnett herself has tried to tell us that the photo is used without permission. Benson is claiming to have once met Barnett, he posted a modified version of an image of her, and she says it's used without permission.

      A close review of his Flickr account? Can't have been all that close. I didn't have to scroll down very far to find evidence of purloined images. And again, from here. And this taken from here, captioned "At @jessicahische’s happening book launch party.", indicating perhaps acquaintance? Or just showing up at an event? To take social media like flickr or instagram posts and imagine "personal knowledge" is a stretch.

      And so on. This isn't evidence of some grand intellectual property piracy scheme. This flickr account is filled with family snapshots, Benson's own artwork, and various social media images of things like the T-shirt from the Unknown Mortal Orchestra show, or pages from a book he likes. ALL the images are tagged CC BY-SA. To me it looks like someone who set their default flickr licensing to CC BY-SA 15 years ago and hasn't thought about it since, going on to post 9,300 images from all manner of sources, all with the same CC BY-SA license. It's pretty strong evidence that Benson either doesn't understand copyright, or doesn't think it's something to make an effort to get exactly right on his flickr account.

      Commons:License laundering doesn't encourage bending over backwards to extend the benefit of the doubt to suspected flickrwashing. The exif data, and the fact that it's a png, make it an outlier compared with similar photos that do look like Benson took himself[7][8], etc. The photo stream is 9,000 jpgs and this one png outlier, a typical default screeshot format, again suggesting the original photo was browsed on the web, then altered, probably for innocent purposes, probably using the same default license as all the other images, original and copied. It's not impossible he took the photo, but we need way more confidence than this, and by the way, it's a terrible bio image. We really prefer not to have weird Dutch angles and this odd cropping on a photo intended only to identify a person for a Wikipedia biography.

      It gets even weirder if you wonder, if it's true this person is not notable by Wikipedia standards, why do we even need a photo of them at all? The subject doesn't want this photo of her on Wikipedia, Chetsford doesn't want there to be an article about her, yet wants to keep a dubiously licensed, not very useful or informative portrait of her?   • Hi, i'm the uploader of these files. I'm not too familiar with appealing deletion requests here on Commons. What criteria would I need to provide in order for a photo here to remain on Commons? As well, I haven't gone through all the photos thoroughly yet but two photos on this list immediately stand out in particular. Photos 1 and 3 of the Rambunctious dragster both seem to be scans of photos taken by the Flickr uploader (John Lloyd) but dated with the dates of the scans, how would I go about proving they're allowed? I haven't gone through all of these. Having looked at them now, I'd agree that 1 & 3 are fine. But the problem is the Flickr user account "Insomnia Cured Here" who is uploading recent scans (recent w.r. to copyright still being in force) and claiming to license them as CC-by-sa. Mostly procedural nomination; file was prematurely transferred to Commons with unresolved licensing issues.

This image is a scan of an illustration from a childrens' book, Elemoont by Andrei Lubensky, that was uploaded to English Wikisource by the author along with other images from the book, and the text of the book (Wikisource version was edited by the author).

At the time of upload OTRS confirmation was solicited and received resulting in tickets 2008032110005275, 2008032510017013, 1427529, and 2008032510005044 (I'm going by references found; I don't have OTRS access myself). However, it appears an oversight was made: the OTRS releases cover contributions by the author and one credited illustrator (Dmitry Boyarchuk), but not the second credited illustrator (Alexandr Saphonov).

It seems essentially impossible now to determine what the contributors contributions actually were. The cover image (s:File:Слун англ.jpg) seems likely to have been a collaboration. The internal illustrations, of which this file is one of a series (1, 2, 3), could have been drawn by anyone, including Lubensky (the book's author), but do not appear likely to be collaborative works in any technical sense (they were clearly drawn by a single person). My highly personal and unsubstantiated take is that these were most likely drawn by Lubensky both because they are extremely simple and they are intrinsic to the story in the chapters that they appear in.

The intent to license this work, including illustrations, freely is clear and uncontroversial; so this nom is mainly about the failure to specify in detail the legal author of the internal illustrations or the failure to cover Saphonov's contributions in the OTRS ticket.

In addition, these internal illustrations are extremely simple. They are just numbers and a question mark that have been mirrored and combined with the unmirrored original. There is certainly some creativity there, but, I would assert, it is at best questionable whether it rises above the threshold of originality.

Putting the factors together (clear intent to license freely, at best borderline TOO, problem stemming from a technicality with 2007 OTRS) I would like to see this kept (in which case I will transfer the remaining illustrations here from enWS), but I may be missing something and in any case I think it merits community discussion (hence the nom). And those MS Office stars/explosions? How poorly the elephant was cut out? Are we to believe this was the work of a professional, or a prankster who shrunk the eyes of some elephant found in a coloring book? No mention of this work whatsoever to be found with Google besides Wikimedia projects? This just reeks of Urker Vistaart.. @Alexis Jazz: Possibly. But when I researched this a while back I found enough to substantiate it as at least minimally plausible.

The writing is not actually very good (at least in the English translation) so I'm not surprised no critical attention is evident, and provided one accepts the story that it was given away for charitable purposes it could not have provided any commercial success for the author (that might have induced him to write more and gain a reputation as an author).
If it had been a new upload today I would have applied a more stringent standard—out of the concern you raise, and because as potential self-publishing it would be out of scope for Wikisource—but we have a lot of grandfathered-in works on enWS and the community there has consistently given them a pass even if far shy of modern policy and standards (to my great frustration, but them's the breaks). --Xover (talk) 10:49, 28 November 2019 (UTC)[reply]
