Note that this file was previously nominated for deletion in Commons:Deletion requests/File:Julien Vinson.jpg, closed after two days with the reason "no valid reason for deletion: ridiculous request." The discussion continued at User talk:Yann#Commons:Deletion requests/File:Julien Vinson.jpg. Notes follow that try to clarify the issues raised.

The file comes from La pensée nouvelle : les matérialistes (1865-1883), an album of 33 photographs, which the Bibliothèque nationale de France (BnF) considers to be a collective work in the public domain since it was published more than 70 years ago. However, the individual contributions in a collective work may still be covered by copyright. There is no claim by the BnF that this or any of the other images in the album are individually in the public domain.
French law, as of 1 July 1995, says copyright lasts for 70 years after the author's death. If the author were still alive in 1949 or later, the file would be non-free in 1995 and still non-free in 2018.
A sample of articles in the English Wikipedia in category:photographers and category:1949 deaths thru category:1955 deaths turned up 90 results, of which 16 were for people born before 1867. That is, if the photographer was a young adult when they took the photograph, there is a roughly 20% chance they lived long enough for it to still be covered by copyright today. The author is not given in the source publication, but no evidence has been given of a search to identify the author.

Keep Author is unknown, and work is more than 120 years old. Meets {{PD-old-assumed}} criteria. A consensus of Commons put 120 years as the threshold for that when we don't have the death date of the author. Stop trying to make end-runs around that. - @Abzeronow: I did not catch the link to {{PD-old-assumed}} in your previous comment, and did not realize you were referring to a formal discussion. 120 years seems very short, since it implies no more than 50 years between creation and death. My crude sample of photographers with Wikipedia articles indicates they they often started photography early and lived long. Still, I will accept the consensus and close this debate. The closure by user:Yann as "no valid reason for deletion: ridiculous request" was uninformative at best. After closure Yann claimed the BnF had said the photo was public domain, then brought up French wartime copyright extensions. Keep Rehash of previous arguments based on a likely misunderstanding of French copyright law. This is not a collective work as meant in French law since the fundamental characteristic of such collective work, "l'initiative d'une personne physique ou morale qui l'édite, la publie et la divulgue sous sa direction et son nom", is missing [2]. There had been speculation in 1910 this could have been a publication of the magazine La Pensée nouvelle [3] [4], but according to BnF catalog, this publication stopped in 1869. So we have no idea who published this, nor who took these photographs. Note that it comes from a compilation of photographs that the BnF presumably considers to be a en:collective work (France) in the public domain since it was published more than 70 years ago. But can the photograph be extracted from the collective work and published in a different context? If it was created around 1880, when Vinson was in his mid-30s, the photographer could have been alive 70 years ago. E.g. if the photographer was 20 and lived to 90, he would have died in 1880+70 = 1950. Aymatth2 (talk) 19:44, 22 September 2018 (UTC)[reply]
- 1883 is old enough to be PD-old-assumed. But if closing admin thinks COM:PCP should have us assume an 1950 death date, then be sure to include it with the Undelete in 2021 category. @Yann: The photographer could have taken the picture as a 18-year-old apprentice in 1883, then lived past age 82. Or as a 22-year-old, lived past age 86, etc. Unlikely, perhaps, but not wildly implausible. There is significant doubt about whether the image if free. @Yann: My grandparents were all born in the 19th century. They had relatively comfortable lives, and three of them lived into their eighties. My maternal grandmother was born in 1883 and died in 1973, aged eighty nine. Any photographs or other creative works by any of them would still be covered by copyright. If my grandmother had been born twenty years earlier, took the picture when she was twenty, and lived as long as she did live, it would be covered by copyright until 2023. Delete In the EU (etc.) you need to know who the creator of a work was or know that the creator is unknown to assume it is public domain. Unless such documentation is provided, we shouldn't be saying it's public domain in its source country and this can't be safely reused unconditionally by people in the EU. Keep currently in use on multiple projects (COM:INUSE). If any of those projects use it to (mis)represent real-life events, that's their problem and it should be fixed locally, not by deleting the image here. The image description on Commons doesn't say anything about the Dervish movement, so that's no reason to delete it. - Comment. The illustration is currently exclusively used to to represent real-life events when in reality its a work of fiction, of little educational use in these articles, furthermore it is not related to Dervishs at all as per cited source. If the issue was only in the English WP it would be easy to rectify it on that Wiki and keep the image. The problem is that it is used for the same purpose on multiple Wikis, making the act of fixing the problem in a language editors from that particular Wiki would understand a little tricky, hence the deletion request. Would removal of the image with an English edit summary on non-English WP sites be acceptable? --Kzl55 (talk) 08:24, 29 September 2018 (UTC)[reply]
  - @Kzl55: I'm not sure what the best course of action is. You could try to remove the image from a project using it incorrectly, but if the local editors object and revert you, you would need to explain your position and get consensus for the change, which would be extremely difficult if you don't speak the language. You would also need to be sure the change is okay by the project's policies and guidelines, which may differ greatly from what you're used to on your home project. It would probably be better to leave a message on the talk page of the offending pages regarding the image. Messages in English may not receive a response on non-English projects, but it's worth a shot (and definitely better than leaving only a machine-translated message). Ultimately, though, Commons can't (and won't) control what other projects do with the media hosted here, per COM:NPOV, so incorrect usage elsewhere is not by itself a reason to delete. clpo13_(talk) 23:32, 1 October 2018 (UTC)[reply]

User:Pugilist, the fact that the file still appears at Commons:Deletion requests/2018/09/28 means that the admins haven't decided whether it should be kept or deleted yet. (Edit conflict) Comment: Arbor to SJ's argument is not wholly unpersuasive. C-SPAN's homepage only speaks of Video coverage of the debates originating from the chambers of the U.S. House of Representatives and the U.S. Senate (emphasis added). The hearing did not take place in the w:United States Senate chamber afaict but rather the w:Dirksen Senate Office Building. What evidence is there that C-SPAN's claim 'contradicts the law'? The only other keeps seem to refer to C-SPAN itself which as you agree actually does seem to claim this isn't in the public domain. The general issue is that works of officers and employees of the US federal government, made as part of their official duties are ineligible for copyright but it's not clear to me who made these. Above it seems to be implied it's C-SPAN employees, not even contractors. BTW, in case it's unclear Template:PD-CSPAN itself says "This does not apply to Committee Hearings or other C-SPAN copyrighted material; such content is free only for non-commercial use and is thus not acceptable under Commons' licensing policy.". If C-SPAN claims that they own the rights, and require a license for commercial use, that is in direct conflict with the premise (stated in the template ["This file is in the public domain"]) that the video is in the public domain. I don't see how that's relevant. NC only licence types are explicitly rejected on commons per Commons:Licensing as insufficiently free for our purposes just like they were on wikipedia. The licensing information claims it is pubic domain in Isreal. Based on the template, this photograph does not meet the criteria outlined for the public domain license applied. 1. This photograph is clearly not "a statute, regulation, Knesset protocol or court decision". 2. This modern coastline photo has no evidence that it "was created more than 50 years ago" by the state of Isreal. In fact, beyond an assertion that it appeared on a Ministry of Tourism website, there is no evidence that this is a government work. It could be sourced to stock photos as an example. I don't see the image on the source page given. He states that his family owned a physical copy of the picture, not that they are the author. 1923 is an unimportant date for anything that's not from the US.
