And how this is copyright violation when I directly sourced the original article? And it's thus far the only photo released of the suspect?

Delete Non-free images don't belong in Commons, they belong on the wiki where the image is posted. There is going to be a special rationale for "only photo released on something" on that wiki, so upload it there. Epic Genius (talk) 01:54, 5 December 2015 (UTC)[reply]

I can't understand what use this can possibly have. Ok, it's a rock with some kind of cement, but it's not even identified, seems to be an absolutely useless picture. Darwin Ahoy! 18:20, 5 December 2015 (UTC)[reply]

  •  Keep: Interesting use of depth of fiels in photography (in a situation where it would not be “necessary”, judging from the sunlit scene and the exposition time given in the photo’s EXIF), also an useful close up of the castle wall texture — good not only as a stock decorative background or for entry-level Geology educational media, but also to document the materials and techniques used in the 1930s’ restorations of historical monuments in Portugal. -- Tuválkin 01:14, 6 December 2015 (UTC)[reply]

Choking Rescue Training Devices

Every year, thousands of Americans of all ages die as a result of choking and thousands more are hospitalized due to choking-related injuries. According to a 2010 report issued by the American Academy of Pediatrics, one child dies every five days from choking, and more than 10,000 children are taken to a hospital emergency room for food choking injuries each year in the United States.[1] Choking occurs when an object gets lodged in the throat and prevents air from entering or exiting the airways. The victim will exhibit difficulty breathing and show respiratory distress. Choking can occur suddenly and unexpectedly, and if not treated promptly, can be fatal. [2]

Choking Relief Training FBAO Extraction Training

There are certain rescue maneuvers, primarily the Abdominal Thrust Maneuver and the Back Slap method, which can help save a choking victim’s life.[3] Both techniques are easily taught and learned. Choking Rescue Simulation devices are available so that choking rescue protocols, such as those of the American Heart Association and Red Cross, can be practiced.

Anti Choking Trainer The Act+Fast Anti Choking Trainer is a light-weight neoprene vest that users wear to practice the Abdominal Thrust Maneuver. When the correct technique is employed, a foam plug shoots into the air, giving the user immediate tactile and visual feedback. Act Fast’s reality-based training approach allows students to practice their technique until they master it, in addition to testing their skills in various choking rescue scenarios, such as self-rescue and victim rescue. Abdominal Thrusts can be practiced on the Anti Choking Trainer while the user is standing, sitting, or lying down.[4]

The Act Fast Blue Trainer has an internal air bladder for learning the Abdominal Thrust Maneuver while following the American Heart Association protocol. The Act Fast Red Trainer, which also has a Back Slap Pad, allows students to learn the Red Cross protocol. Demonstrations using this device have been performed on television by Dr. Mehmet Oz on The Dr. Oz Show, Dr, Richard Besser on The Katie Couric Show, and Dr. Andrew Ordon on The Doctors Show.

Choking Charlie The Choking Charlie manikin, developed by Laerdal Medical, is an adult torso specifically designed for training students in the performance of the Abdominal Thrust Maneuver (Heimlich Maneuver). Cast by a human specimen, Choking Charlie’s realistic anatomy and response-using simulated boluses provide instructors with a tool for instructing and practicing this lifesaving technique. To operate, the user puts talcum powder on a bolus and then inserts it into the mouth. Once the bolus is lodged inside the throat, the user can practice abdominal thrusts; when performed correctly, the bolus is expelled. [5] Choking Charlie can be used to simulate a conscious victim or an unconscious victim, with the simulator placed upright or on the ground. A demonstration using this device has been performed on television by Dr. Lisa Masterson on The Doctors Show.

Choking Manikins These life-sized Simulaids manikins are available in child, adolescent, and adult sizes. Each manikin’s head and upper torso allows practice of abdominal thrust, chest thrust, and back blow procedures for clearing foreign body airway obstructions. Simulaids are made with specially selected durable vinyl to create tactile realism. When correct technique is used, the manikin will expel the object causing the obstruction. Each manikin has a ribcage, xiphoid process, and jugular notch to provide anatomical reference points for the demonstration of hand placement for CPR technique. Each manikin comes with two objects that will lodge in the oral pharyngeal space, representing any object stuck in the air passages of a victim. Once the object is lodged, the student must use the anatomical landmarks to decide where to place their hands and how much pressure is required to accomplish the maneuver. This trainer gives users immediate visual feedback when the procedures are done correctly.[6]

The licensing tag fails to explain why this photograph is supposed to be in the public domain according to applicable state law. Only US federal government works are public domain by default. Sandstein (talk) 09:58, 5 December 2015 (UTC) Withdrawn, there is apparently Template:PD-CAGov, with which the file is now tagged. Sandstein (talk) 08:16, 6 December 2015 (UTC)[reply]

  • According to the source [3] DMV photos become a public record after someone's death and are released by the state following confirmation of the death by a local coroner. The image was upload to en-wiki originally, so it could be restored there under fair use if this is not enough for licensing. Cwobeel (talk) 19:00, 5 December 2015 (UTC)[reply]
It is in the source. I copy/pasted the text from there. In any case, if commons is too stringent on licensing, the image can be restored to en-wiki per fair use rationale.Cwobeel (talk) 04:38, 6 December 2015 (UTC)[reply]

After today identifying 25 uploads from 2015/2014 as copyvio (mostly [99 %] grabbed from Flickr, details at user talk) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user uploading a bunch of copyrighted material (small/inconsistent resolutions, missing/inconsistent exif) so these ones (per COM:PRP can't be believed either. Not nominated are two files (File:Estilo mas vendido.jpg + File:Vista trasera de sgm.jpg) by technical reasons (most likely own works). All files related to es:Calama, a city in Chile.

Uploader is most likely sock of 3x times blocked user Thearxx08 (talk · contributions · Statistics) who inserted the uploaded images at related eswiki article es:Calama (and sub-articles) on same day = [6] + [7] + [8] + [9] etc.

The uploader claims to have personally created all these photos in 2015 and claims to be the author and copyright holder. That seems unlikely given the appearance of the photos and some of the contradictory dates mentioned by the uploader. Some of the photos appear to be old enough that there is a good chance the copyright has expired, but if they are to be kept, truthful source, authorship and copyright information needs to be provided.

The photos of the Captain Cook figure outside and on board a modern boat appear to be associated with an event in 2012 where the figure was transported on a modern boat from the Captain Cook Cruises company to commemorate a transit of the planet Venus across the Sun. (According to the event details, the real Captain James Cook tracked a transit of Venus back in 1769.) Australian freedom of panorama is stated as applying to permanently situated works; however, the listed photos show the Captain Cook figure from a temporary display.

I think DM could rationalize some of these, and one can doubt the creative work claim for a simple mannequin (we don't normally doubt this for photographs of simple shop displays). Licencing for these pictures is in doubt. Screenshot is of copyright work, shot of phone has the company name in it and appears culled from PR material, and the logo is not the simple txt item we often accept. Commons:OTRS assertions may clarify matters, but I believe these all need a careful eye from an expert here

Hertha Hillfon (1921-2013). Copyrighted until 2084. Works of art must be permanently placed in a public place outdoors for other rules to apply. Thuresson (talk) 00:28, 12 December 2015 (UTC)[reply]

Deleted: In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in for indoor wotks in Sweden. .     Jim . . . . (Jameslwoodward) (talk to me) 14:35, 12 December 2015 (UTC)[reply]

Could this be classified as a COM:DW in the same way as COM:TOYS' are? Josve05a (talk) 22:18, 5 December 2015 (UTC)[reply]

Hm, perhaps if the design i copyrighted? I guess most toys are. I have never heard about that for candy. /Hangsna (talk) 22:21, 5 December 2015 (UTC)[reply]
All designs are copyrighted by default, no? It is a kind of art, isn't it? Might not be fine arts. but still copyrightable (not sure if still in copyright) art. (Unless it is COM:TOO simple).
(And technically, candy is a kind of edible toy.)
I'm not sure, hency why I'm bringing up the question. Josve05a (talk) 22:29, 5 December 2015 (UTC)[reply]
I guess its made in some kind of "molding" process but would that really make it art? Perhaps it stamped out or so. Sound a bit drastic to me. Also, I had to work a lot to find this "good" example, many have errors in text (and this one is not symetric left and right) and its so soft so for being arts, its really low quality. Compare to a Barbie doll, look the same perfect "art" all the time. /Hangsna (talk) 22:33, 5 December 2015 (UTC)[reply]
I am also not sure but i think this should be OK for commons. Candy are not toys. Also, the only edible toy are kinder egg, and only copyrightable part there is the toy. ;) /Hangsna (talk) 22:36, 5 December 2015 (UTC)[reply]

Deleted: Toys are not copyrighted as "toys", they are copyrighted as "sculpture" and this is treated the same. Essentially any creative design has a copyright unless the work is entirely utilitarian, and even then, any decoration that is not utilitarian has a copyright. Where is the evidence that this was published without a copyright notice? The eBay source is a loose headshot photo that does not indicate publication. If the photo has never been published, the license is wrong and the image is in copyright. czar 22:19, 5 December 2015 (UTC)[reply]

The seller's original listing (see ebay link) states that the photo came from the Theatre World publication's "archive, a large privately held, important archive of twentieth century American theatre and film production still photographs and other related theatre and film memorabilia." --Light show (talk) 23:09, 5 December 2015 (UTC)[reply]

Deleted: In order to keep it, you would have to prove that it was published without notice before 1989. Since notice could be elsewhere than directly on the photo (at the bottom of a poster or at the masthead of a magazine), the fact that there is no notice on the photo proves nothing. .     Jim . . . . The source (eBay) does not show where this photo was first published, so the license cannot be verified that it was published without a copyright license (especially if published in an AP newspaper...) czar 22:21, 5 December 2015 (UTC)[reply]

The ebay listing states it is Wire photo, and wire photos were not copyrighted, according the U.S. Library of Congress. The fact that it was printed and dated to publicize a film, is evidence of publication per copyright law. Where or when it was reprinted is secondary, since an image would have its own copyright. Per copyright definitions:

Publication has a technical meaning in copyright law. According to the statute, “Publication is the distribution of copies or phonorecords of a work to the public by sale or other transfer of ownership, or by rental, lease, or lending. The offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display constitutes publication. A public performance or display of a work does not of itself constitute publication.” Generally, publication occurs on the date on which copies of the work are first distributed to the public.

--Light show (talk) 22:51, 5 December 2015 (UTC)[reply]

Actually there’s nothing on the original upload that indicates it’s from AP or a wire photo—not even anything connected with “movie studio” as the template claims.

The statement re: wire service photos never being copyrighted as per the Library of Congress is a fallacy. This is the advisory for AP/Wide World. The photo in question is from Associated Press, but the LOC advisories for all wire service photos carry the same advice. The LOC checked into the copyright status of various photos in their collection and this is what resulted from their investigation:

  • In an attempt to determine if AP/Wide World registered any copyrights and if those copyrights were renewed, Specialists in the Prints and Photographs Division of the Library of Congress searched the Copyright Office files. It was found that only a few images were registered for copyright and those copyrights were not renewed.
  • However, the Library’s legal office has advised the Division that photographs published with proper copyright notices between 1923-1963 may be protected if properly renewed, while works published after 1963 and unpublished photographs in the collection may be protected even if they were not registered with the Copyright Office.Dr. Blofeld (talk) 18:27, 7 December 2015 (UTC)[reply]
The sellers described the image clearly: "1976 Young Actor Robert DeNiro Wire Photo". The sellers are a professional dealer specializing in selling news wirephotos, have been since 2003[11], have a 100% feedback rating, with all of their sales feedback at 5 stars, including "item as described."
Regarding the LOC statement that they "may be protected," that fact is assumed if it had a copyright notice. The text added nothing new. The whole point of the LOC's extensive research on this was to see if the 8 million wirephotos that Corbis bought and is reselling copies of, are copyrighted. See also copyfraud article. --Light show (talk) 18:47, 7 December 2015 (UTC)[reply]

Deleted: The LOC statement is silly. A great many AP photos were never published and therefore will be copyrighted for many years from now. Of those that were published. most would have been in newspapers or magazines with a single copyright notice covering the whole issue. The Ap did not publish works itself, but only provided them to others, so it proves nothing that this has no notice or is not registered at USCO., .     Jim . . . . Reasons for deletion request -ILWUHist (talk) 21:36, 4 December 2015 (UTC) Picture is not of Harry Bridges.[reply]

Deleted: This may or may not be Harry Bridges -- that would not be a reason to delete. However, this is a newspaper photograph and if published in 1934, would have been covered by the newspaper's general copyright notice at the masthead. The newspaper still exists (after several mergers), so it is likely that the copyright was renewed -- newspapers are careful about that. So either it will be under copyright until 95 years after 1934, or, if first published after 1989, until 120 years after 1934. .     Jim . . . . Poor quality ({{BadJPG}}, orphaned/replaced by better alternatives.

DMacks (talk) 21:59, 21 November 2015 (UTC)[reply]
If somebody adds to an article and needs such a ion, it is quite likely that an orphaned image on Commons is not (searched for and) found. Hence, the user uploads such an image anyway. --Leyo 22:22, 21 November 2015 (UTC)[reply]
The remaining two do not seem to have other images of these chemicals available. I agree that it's likely that someone would not look for them first, especially so simple a structure if one has the ability to create one. I disagree that "orphaned but not superceded" is alone a valid reason to delete. This DR prompted me to look at en.wp and find a place that one could/should be used and then also spread it into fr.wp. But do the remaining two actually exist? If there's no obvious use-case for an orphaned image, then delete is surely reasonable. DMacks (talk) 23:36, 22 November 2015 (UTC)[reply]
Delete all. The remaining two seem known in ab inito and by various spectra in a ref or two each (I checked SciFinder), but nothing seems notable about either one...can't see an article being written anytime soon or any need for structures of such simple formula-diagrams. DMacks (talk) 05:10, 1 December 2015 (UTC)[reply]

  •  Keep My first argument was : If some Web sites, think relevant to talk about about Diazenium and its conjugate acid Diazynediium and to use similar files (the firsts result with google in few seconds : [12], [13], [14]), I don't think they are out of scope. These files can be useful for someone even if it is not in a Wikipedia article, as evidence, similar ones are currently used in internet, and I don't see any reason to delete until there is no better versions. --Christian Ferrer (talk) 15:37, 5 December 2015 (UTC)[reply]
Reasonable concern. ChemSpider and similar sites are merely databases compiled by scouring the web and/or chemical literature for almost anything and everything that is mentioned. Well below en:WP:GNG for example, but doesn't rule out having some educational value. Since it really is so easy to create them (as Leyo and I say) in a better form, I'm contributing:
as replacements drawn to current MOS, and with added description terms to help others find them. DMacks (talk) 21:04, 5 December 2015 (UTC)[reply]
Many thanks to both of you. I agree to keep the new versions. The second one that had a strange geometry before is correct now. Also the names make more sense. --Leyo 13:36, 6 December 2015 (UTC)[reply]

Interesting case! However seems there is no reason to doubt own work as claimed & accordingly no reason to delete it. — Preceding unsigned comment added by 91.221.59.27 (talk • contribs)
It is a highly sensitive photograph uploaded in a small resolution of 500×643 (and with a small white border visible). The only reason we seem to believe it was uploaded by the depicted person herself (I’ll let aside the copyright intricacies of “the subject is not the copyright holder”) is the username who uploaded it. Is it too much to ask for a bit more?
But anyway, if you insist on having an exact external source, take a look at e.g. one of those many Tumblr copies from five years ago.
