[edit]Flickr license for these low resolution images is not plausible, the Flickr uploader is located in Toronto, high resolution images available e.g. at this website have EXIF data including Copyright of David Franck, Germany (see single example at Website). Furthermore, at least the interior images are far beyond our understanding of Freedom of Panorama …

[edit]In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Canada. Although Commons has a longstanding policy (with which I disagree) that graffiti is not covered by copyright, these all appear to be commissioned works, and therefore the photographs infringe on the artists' copyrights.

The entire front of this newspaper is owned by this user? Even if the user is the sole owner of the newspaper, what about the photograph? This requires some detailed disclosure of copyright ownership, not just an opaque assertion of "own work". It's always possible, but it's more likely this is just another in the constantly seen misunderstanding that scanning something/uploading it makes the content one's own work. It is a fresh image taken from the original QuarkXpress file, which I own and remains in my possession. It is not a scan and the rules have not been misunderstood. I am closing this as deleted because there are too many open questions:
- Is User:Caerhys actually Terry Jackson? That seems likely, but we do get a great deal of identity theft here, so it is not beyond a significant doubt. That can easily be solved by Jackson sending an e-mail to OTRS from terry.jackson@wales.info which ties him explicitly to the newspaper.
- Is this actually the front page of the newspaper from 1998? If "no", then we don't want it, because it is a fake and therefore out of scope.
- If "yes", then does Jackson actually own the individual copyrights? The page has four copyrightable images and five pieces of copyrightable text. Were all of those licensed to the newspaper in a way that allows Jackson now to freely license them to the world? That seems unlikely, as newspaper contributions, unless done by employees, are almost always licensed as "first serial rights, and not "all rights" (those are USA legal terms -- UK words, but not concepts, may be different).
- Does Jackson actually own the copyright to the newspaper as a whole? When a corporation closes, assets, including copyrights, almost always end up in the hands of creditors, not employees or shareholders. What happened with this one?

The uploader of this file has requested that all but the newest revision be deleted (i.e. keep the "21 March 2015" revision, delete the remaining).
This file is a photo of a Russian wikipedian, only in use on his main user page at ru.wp. The file has been overwritten several times, by the original uploader, presumably to update the photo on his user page. A couple of months ago Sefan2 marked this with {{Split}}, requesting a history split into separate files. In the midst of processing Stefan2's request I noticed it was only in use as a user's profile photo. I asked the uploader if he had any objections to me splitting the file. - In my opinion, that poses an interesting, more general question: What makes an installation "permanent" for UK FoP being applicable - does it really not count as "permanent" as long as there is a fixed time frame, even if it's 20 years? - I think the general question is interesting and should be raised at a better location than this DR. My opinion is the length of display is not relevant to deciding if it is temporary or permanent display - whether it is 5 hours or 5 years. What matters is - is the intention to display for the natural lifetime of the work?
- With this work, the terminology used is consistently about a temporary installation: Its a loan (which both the artist or the council may terminate). The planning permission was granted with the fixed term in mind, so the council sees the loan as temporary. In that process, it was noted that the work could last for centuries, that it will be easy to remove and restore the original appearance of area (with implication the statue could be re-sited) and it was described as an interesting, if temporary, addition to the local landscape.
- The artist's perception of the loan is harder to see. I'm sure the council would have jumped at a permanent installation if that was offered - so the fixed term is the artist's idea. Its impossible to say if the fixed term is because he intends to remove it then. Given how the artist thrives on controversy, the loan may be a way of bringing attention to it again (there will be a debate about the statue near the expiry of the loan, and if it is removed that would stir the pot even more).--Nilfanion (talk) 11:20, 5 December 2015 (UTC)

It's a minority view, though published by well-known scholars (Barrelet/Egloff, Das neue Urheberrecht, 3rd ed. (2008), Art. 27 (5)). That's not directly relevant to UK issues, of course. - I'm no legal expert, so I'm not really aware of if that has been discussed in UK courts, though non-UK case law may be relevant to this. I very much doubt temporary would be defined in terms of "less than X days/years". My gut feeling on this - To call this work "temporary" feels wrong, but PRP has to apply unless something can be found.
- This newspaper article is worrying to me. It suggest a major reason for the installation being a "loan" is to prevent FOP applying to the statue.

- Hello Magog, I know the PD-Soviet template, but there only the question of backward reaching copyright for authors is discussed, who where eligible for copyright in the Soviet Union. The source I put in the images states, that civil servants in their line of duty were never eligible for copyright, hence nobody could claim copyright in the past for their work. Am I totally mistaken or has this never been considered?

- Addendum: en:Copyright law of the Russian Federation implies that the restoration was definitive for formerly copyrighted works. Also, en:Copyright law of the Soviet Union indicates to me that the photographies under Soviet law could not be copyrighted. - That is how I understood it. Retroactivly reinstating the copyright was only done for work previously copyrighted, not for work that was PD from the beginning. The discussion around PD-Soviet contains nothing useful about that matter. (Yes, I read it all before uploading the files to Commons :D)

- Addendum: en:Copyright law of the Russian Federation implies that the restoration was definitive for formerly copyrighted works. Also, en:Copyright law of the Soviet Union indicates to me that the photographies under Soviet law could not be copyrighted. All photoworks are copyrighted in Russia: their status in RSFSR are unimportant now, retroactivity (several retroactivities, especially Civil Code 2008 and recall of the Berne Convention reservation in 2012) has reinstated copyright for both RSFSR-copyrightable and RSFSR-uncopyrightable works after all. - I think, what you refer to in the Berne convention, is the retroactive protection of foreign work, which was PD in the Soviet Union before the convention. Soviet work which was PD wasn't retroactivly protected. --CaZeRillo (talk) 10:46, 9 December 2015 (UTC)
- The Berne convention extends rights for both foreign and domestic works. Russian legislation deprecates determine conditions for domestic people which are worse than conditions for foreign people. Recalled Russian reservation did not separate domestic and foreign works. Retroactivity for all soviet PD-work both due to expired terms and previous uncopyrightability was confirmed by Russian courts (including by the Supreme Court). For example, there was freedom of translation in RSFSR for foreign works (except some for works), retroacivity has cancelled it for old translation too. Alex Spade (talk) 12:03, 9 December 2015 (UTC)

Unclear copyright status and unlikley own work, most likely Flickrwashing. Uploaded on Flickr on 03.12.2007 by "oscar_10191" via https://www.flickr.com/photos/11868055@N02/2083878833 and transferred to Commons on same day by (renamed) Oscar 10191~commonswiki (talk · contributions · Statistics) = obviously the same person.

- With the book scans, the practice with fold-out pages seems to be to scan the page both folded and unfolded. In this sense it's not a mistake.
