UK: I agree with the rationale in the earlier nomination - as Mattes is the model in the images, she is clearly not the photographer. Although it is great that she has cleared use of the images from the subject's perspective, we still need clearance from the actual photographer to have this on Commons. - See this photo's description page, as compared to this random photo, which is credited as a "US Air Force photo", and is thus in the public domain. This image was created by one of several sockpuppets for DisneyFXHD. The channel this depicts does not exist and was speedy deleted on Wikipedia for being a blatant hoax. I'll post the link to the AfD, but it's very clear that this is a hoax that one particular person is trying to perpetuate using Wikipedia and a few social media sites. I've e-mailed Disney to let them know about this, so hopefully they should step in soon with the social media sites. Until then, all I can do is ensure that they can't use Wikipedia to further the hoax. If you're interested, part of the reason this is a clear hoax is the lack of any coverage about this channel in reliable source. I can't see where FX and Disney ever teamed up to make a channel in India, let alone any coverage of them yanking the channel after only a few days. Tokyogirl79 (talk) 06:01, 3 December 2014 (UTC)
- Here is the link to the AfD page. All of the various sockpuppets have been blocked on Wikipedia, but I don't think that this translates into being blocked on WC, so they may need to be blocked on here as well. I do want to note that when the newest sockpuppet tried to re-create the page on the mainspace, they tried to assert that the channel closed due to copyright issues (if Disney had agreed to partner with FX then copyright issues would largely be a moot point) and that after the split the channel closed and re-opened as just FXHD. It also claims that it had a TRP of "96 Millions", which would suggest that there would be coverage somewhere if they did have that many viewers over its few days of being open. It's a pretty blatant hoax overall, to say the least. (This page shows that the top show in India as a whole received only about 10 million TRP, so....) - It is ironic that all sorts of obscure stuff that nobody really cares about (including their creators) is speedy deleted every day, but uploading (with a clearly untrue self-created claim) the logo of a major corporation particularly noted for obsessively pursuing even the most trivial breaches of its IP, is allowed to stand for nearly a week after speedy is requested. This Picture is and has been in public domain. It can be found on Google and multiple other websites. It is a part of a school course page w:Draft:IGCSE_American_History-Corinth,_MS_Coursework_Help. - 2. An external website [1] reused the en.wikipedia article, including the 600x454 image. Ok.
- 3. You copied the copy of the image from that external website. Ok.
- 4. You resized the 600x454 copy to 1014x765 and gave it a .png extension. (With no apparent advantage. A similar result could be obtained by displaying the original file as File:Fdr train.jpg|1014px.)
- 5. You uploaded that duplicate to Commons as File:President Roosevelt Cross-Country Train Tour.png.
- 6. You displayed the duplicate on the page Draft:IGCSE American History-Corinth, MS Coursework Help of the en.wikipedia as a 550px thumbnail.
- One might as well display the original Commons file in that page. Is there a reason to keep the stretched duplicate?
- A reference to Capra does not seem immediately obvious on the webpage you mentioned as the source. Can you please tell more precisely where it is?

The dinosaur is 'art', at least in the minimal sense protected by the law, and as the Akron Fossils and Science Center where it is located was not established until after 2000, it is doubtful that it is a pre-1989 work. Since the US does not have Freedom of Panorama for art, and it's inclusion is obviously not de minimis since it is mentioned in the image caption, this photograph is a copyright violation. - I'm the uploader. I can probably buy that logic... but can I have a link to what the definition of "'art', at least in the minimal sense protected by the law" is, to confirm? For next time, and similar images? For example, on the photo, there are also dinosaur targets. Are they also "art", or not, because they have a functional purpose (to be targets)? I admit I have never been in the playland, so there is some chance the dinosaur is meant to be climbed on or slid down or something, but for safety's sake we can hypothesize it's just decorative. For a more relevant example, though how about File:Garden_of_Eden.jpg - that's a museum exhibit, intended to be an instructive diagram - is it also "art" for our purpose? --GRuban (talk) 23:29, 3 December 2014 (UTC)
- To be honest, my statement about 'in the minimal sense' was meant more as an 'artistic critique' than an evaluation of how well it met the criteria. The actual 'definition' is honestly quite vague, and buried in Title 17, but here it is...
“Pictorial, graphic, and sculptural works” include two-dimensional and three-dimensional works of fine, graphic, and applied art, photographs, prints and art reproductions, maps, globes, charts, diagrams, models, and technical drawings, including architectural plans. Such works shall include works of artistic craftsmanship insofar as their form but not their mechanical or utilitarian aspects are concerned; the design of a useful article, as defined in this section, shall be considered a pictorial, graphic, or sculptural work only if, and only to the extent that, such design incorporates pictorial, graphic, or sculptural features that can be identified separately from, and are capable of existing independently of, the utilitarian aspects of the article.

- Basically, all that's required to be 'art' is to have a aspect of creativity in the design that goes beyond the purely functional, and meets the threshold of 'some minimal degree of originality'. Such works can only be portrayed in 'de minimis' cases, where they are not 'intentionally' included, but are a minimal part of the image that is incidentally included. As far as the "Garden of Eden" photo, I would call it art, in a way, but it's less clear cut since it appears to be a permanently installed part of the building, more along the lines of decor. Since it's not 'explicitly' intended as art, so I would say it falls under the exception that allows for photographs of buildings from 'public places', which includes parts of the interior that are open to the public. - Rereading, I missed what you said about the targets. If you took a photo specifically of them, from close enough that they were discernible, it would be an issue, but just as vague background elements in an image they are fine.. de minimis. This is not my own work. This picture was the fist one I uploaded to Commons (I changed my account name from II...Richard...II to Archimëa). When I added it, I didn't knew anything about licences. I founded it on the web in a video game board thread or somewhere else. Simply delete it.

[edit]This gallery of images is composed of images with "FBMD" in the meta, images which are smaller than facebook but not marked, images which are even smaller than that, maps, and the only unifying theme is the town where the pictures come from. It's highly unlikely that any single person took these images - especially as there are no camera meta data and the ones I checked of the right sizes had "FBMD" in meta, it's more likely they're culled from internet than own work.

- I went quickly over those two guidelines, and they do make sense to a certain point. Though, if we follow them strictly, how would it be possible to have pictures of such products at all, short of persuading their manufacturers / copyright owners into releasing them publicly (what will probably never happen)? At the same time, please keep in mind that this particular product comes from a country that has far, far less strict copyright laws than it's the case with the US copyright laws. - I'm confused about this. The image is not just of the artwork on the packaging, or even just the packaging itself, but of an open package displaying the contents. The illustration makes up a pretty small percentage of the image. Doesn't that count as de minimis? If not, then by all means delete it, but then a huge percentage of the images in Category:Candy (and Category:Beverages, and...) should also be deleted, not just the rare image that has been randomly placed in Category:Food packaging. I should also note that the deletion request above this one, File:Hopea Toffee.jpg, seems to meet criteria #2 (Images of logos too simple to allow copyright) in the boiler plate in Category:Food packaging. They contains complex shadings and bevels which are not present in the plain version of the NBC logo (previously discussed at Commons:Deletion requests/File:MSNBC 2008 logo.svg and Commons:Deletion requests/File:MSNBC logo.png) and which rise above the threshold of originality. They differ from File:NBC logo.svg in the same way that Windows logo - 2006.svg differs from Microsoft Windows logo (Pre-XP).svg.
- File:27 KSNT logo.png – was clearly marked as non-free on English Wikipedia according to the original upload log, so it should never have been transferred here
- File:Beartooth NBC, Great Falls, MT.jpg – the non-free logo is the primary subject of this photo, and no freedom of panorama exception applies, so this is an unauthorized derivative of said non-free logo
- File:Nbcnewyourknewlogo2011.png – based on File:NBC logo 2011.png according to the file description page; that file has been deleted from Commons on copyright grounds

This seems like a very silly deletion request. Antiquated mass market electronic appliances/toys are being flagged as if they were unique works of art. The same argument would apply to other good looking toys and appliances such as Apple II, Roomba, Treo, Furby etc etc Yet photos of all these are established as fair use in Wikis.

- This advice isn't documented or refers to applicable law. To browse texts to find excuses to keep the media, instead of performing an objective assessment of the situation, is probably one of the worst road we could take. Kaffiend, I understand your desire to keep these images, and I truely sympathise. However, coming from the same spot as you, I would seriously advise against investing yourself emotionally in the defence of images in such situations. We have to make do with the US system of law, which is in some respect quite dysfunctional. This is a given against which there is nothing we can do, and we really are not the worst victims anyway. The silver lining is that this is a win-win situation for us: when the images are kept we are progressing in our aim of a Free encyclopedia and Free culture; when the images are deleted because of ridiculous laws, we are exposing the ridicule. The only bad outcome would be keeping images in spite of the law, as this would give credit to the notion that you can have a dysfunctional legal system without suffering consequences. The only argument put forward in these discussion so far is the TOY one, which doesn't seem relevant on close reading. - I believe, and I think that it is also the view of Gazebo, that the TOY thing applies. The main purpose of Aibo is amusement, arguably making it a toy; their use in research does not change that fact, a bit like Lego being used in research.

- Clearly COM:TOYS has to have limits so that we can decide what is a toy and what is not. Some things will be clearly toys, and some things like Aibo are less obvious. Our own gut feel about whether it is a toy seems irrelevant, and so does the assertion that "the main purpose of Aibo is amusement, arguably making it a toy". What we need is a definition that clarifies the importance of intended purpose, actual use, marketing and other criteria. In the absence of a clear line of reaosning that establishes Aibo as a toy, on such criteria, it is not appropriate to be destroying Wikicommons content of value to others. If there are deletion guidelines that recommend differently to that, please raise them. I did take the time to read the TOYS guidelines and the readily available sources and described what was found earlier, which seems to immediately dispel the TOYS argument. - I'd further note that the ONLY citation in COM:TOYS that seems to deal with a definition is one the one that I mentioned, and the one that would appear to categorically dispel any categorisation of AIBO as a toy (irrespective of our subjective views). To continue a quote on the relevant section 'The [relevant] case did not settle the usefulness issue for all toys. For example, toy stunt plane launchers were found “useful” by a district court because launchers launch toys into the air, which, this court reasoned, is a “use” beyond just portraying a real item'. Usefulness seems to immediately quash copyright in this one article which forms the basis for COM:TOYS, and clearly AIBO were functionality beyond portrayal, and had widespread use as programming tools, research units, home survellance devices etc 14:32, 4 December 2014 (UTC)

- Rama, I appreciate your engagement, but disagree with your current thinking. There doesn't seem to be an argument that Aibo is a toy in the meaning of US Copyright. At the moment having looked at the Wikipedia policy, and the cited article, Aibo doesn't fit into the definition, so the policy does not apply. There's no real ambiguity about that. Thank you for pointing me to the precautionary principle.
- Earlier, the argument is raised that the 'main purpose of Aibo is amusement'. That is not a criteria that seems to be relevant or even discussed in Wikipedia policy or its cited articles. If you believe it is a relevant criteria, then there should be a discussion at the policy page about why coverage should be extended, not on a specific outlying deletion request. The fact that a work may be useful does not preclude copyright for features that do not contribute to its usefulness. And, by the way, the USCO agrees with me. Any discussion of a post 1978 mass produced object should always include a search at http://www.copyright.gov/records/, particularly in cases like this where the name is unusual enough so that only a limited number of records will appear. . That's different to what you wrote, that toys are not utilitarian objects and receive copyright protection. It's already complicated enough with the overlap of Japanese and US jurisdiction, uncertainty about what constitutes a toy, and about what makes a toy utilitarian in terms of protection from copyright. I hope that we can conclude at this point that upon reading the TOYS guidelines, they are not relevant to this case, and no deletion should occur on that basis. Kaffiend It takes a certain level of arrogance to come here with 49 edits on Commons and 349 on WMF as a whole and tell several highly experienced editors that they don't understand US copyright law. However, that arrogance rises to an extreme when you argue that the US Copyright Office was wrong when it registered this copyright. Do you really expect Commons to keep these images based on your opinion when it goes against the USCO registration?
You are also wrong to try to separate toys from sculpture. There are only eight categories of copyright in the USA, see 17 USC 102:
- (1) literary works;
- (2) musical works, including any accompanying words;
- (3) dramatic works, including any accompanying music;
- (4) pantomimes and choreographic works;
- (5) pictorial, graphic, and sculptural works;
- (6) motion pictures and other audiovisual works;
- (7) sound recordings; and
- (8) architectural works.
Just as computer software has copyright as "literary works", so toys have copyright as "pictorial, graphic, and sculptural works". Except for actual buildings, all 3D copyrighted works have copyright as sculpture.
Further, as I noted above, even works that are primarily utilitarian can have a copyright as sculpture if their shape is not an essential part of their utility.
- "Such works shall include works of artistic craftsmanship insofar as their form but not their mechanical or utilitarian aspects are concerned; the design of a useful article, as defined in this section, shall be considered a pictorial, graphic, or sculptural work only if, and only to the extent that, such design incorporates pictorial, graphic, or sculptural features that can be identified separately from, and are capable of existing independently of, the utilitarian aspects of the article." 17 USC 101

Jameslwoodward Jim, personal attacks are not welcome. I was invited to contribute, and claim only to have carefully read the the commons guidelines on toys. Commons policy does differentiate on the basis of toys, and that is the core of this deletion request. I don't claim to understand US copyright law, and I suspect few can make such a claim honestly. If you believe the commons guidelines are out of tune with US copyright law, which is what you seem to be saying, then argue for a change to the guidelines. A proposal to change the guidelines in the way you favour is sure to attract expertise, and you can engage and debate with experts. It is not cool to intimidate members of the broad user base who are making honest contributions and seeking to apply existing policy as it stands. If you believe there are reasons to delete these works other than because they are copyright according to the toys section, then go ahead and start another deletion request on that topic.
You also seem to have a difference of opinion with the US Copyright Office on what they do. Their view, described in Circular 1, is "copyright registration is a legal formality intended to make a public record of the basic facts of a particular copyright". They make no assessment, as you erroneously assert above. It also seems unclear to what extent a 1999 copyright for a robot dog would also cover subsequent model AIBOs, AIBO robot cats and so forth which are parts of this deletion request. - For other arguments, I'd like to have a fair chance to review the relevant guidelines and respond. It would make more sense for them to be in separate deletion requests rather than this one, in my opinion. They should also specify the concern with reference to the relevant guidelines. An argument on the basis of authority by an "experienced editor" or on the basis of US law, where such law has already been interpreted for the Wiki guidelines, is not helpful nor in the spirit of Wikis. We have an inconsistency where other non-useless (utilitarian) robots of stylised design have unchallenged derivative works on the commons [[6]], [[7]], [[8]] and it will be helpful to establish why there is this differential status. It also appears there is live debate in the Wiki policy area on whether US copyright does apply across the commons. I'm running out of steam here. I don't see how you can say:

I didn't write the law quoted above, Congress did. It's perfectly clear that a registered copyright is prima facie evidence that a copyright is valid. Copyright Basics, which you quoted above out of context, says exactly that on page seven.
As for the fact that you believe that the Commons guidelines (which ones, specifically?) don't deal correctly with the US law on this subject, please remember that the guidelines on whether or not something is copyrightable are written generally, to cover the law in all nations. The law on utilitarian objects varies widely from country to country. That's true in this case -- toys have no copyright in Japan. But even granting the guidelines are wrong, that is not a reason to ignore the law, as you seem to suggest. It may be a reason to change the guideline.
Your suggestion that somehow the issues here need a separate DR has no basis in Commons practice. A DR considers all of the aspects of an image. See COM:Deletion requests.
The concept of separability (see the quote from 17 USC 101 above) applies to two of the robots you mention and perhaps the third -- Roomba and Ultimaker do not have a copyright as sculpture because their shape is not clearly separable from their function. ASIMO is not as clear a case, but since it is intended to be a humanoid robot, I suspect that it, too, would not pass the separability test. On the other hand, the various shapes of Aibo are stylized animals and have nothing to do with their functions as robots.
Also, the fact that WP:Other stuff exists is never a valid argument on Commons. We have more than 24 million images here. My best guess is that at least one percent, almost a quarter of a million images, should be deleted for copyvio or other reasons, but we simply don't have enough volunteer staff to do the work. If you think that other images have the same problems as these, by all means tag them with {{Delete}}, but don't argue that they are a reason to keep these. . Jim . . . . [edit]These are the only uploads of this new user. There are three problems here.
- First, is he a notable artist or are the works out of scope? The only information on that is that the WP:RO page https://ro.wikipedia.org/wiki/Artist_Andrei_Marian_Moga has been deleted for lack of notability.
- Second, is the uploader actually the artist and are all the paintings shown in all the images actually his own work?
- Third, two of the images have a young man in them, presumably the artist. If our uploader is, in fact, the artist, then he cannot be the photographer in those two cases and the two images cannot be "own work" as claimed.
Therefore, in order to keep these, we will first need evidence that the artist meets the WP standards for notability. That probably means that we should delete the images unless the WP:RO article is restored.
If we decide that these images are not out of scope for lack of notability, then we will need a free license from the artist using OTRS and a separate free license from the photographer of the two images that include the artist, also using OTRS.

- Several things:
- First, you claimed that the image was "own work" when you admit above that it is not. While we generally assume good faith -- that users do not lie to us -- when it is obvious that a claim is not correct, we take action.
- Second, with both your User Page and the gallery you created, you tried to use Commons for self promotion, in direct violation of COM:ADVERT.
- In almost all countries, including the United States, paying for a portrait does not give you the copyright unless there is an explicit work for hire agreement. Most portrait photographers retain copyright because selling multiple copies is a way to make money. Unless you have purchased the copyright from the photographer in writing, in order to keep the image on Commons the photographer will have to license it, see OTRS.

- It has been used by the U.S Department of Defense as far back as 2001, during the invasion of Afghanistan in the form of a leaflet [13], meaning that the U.S government undoubtedly have copyright over the image, being the first known and therefore original publishers. - I found this image on the Associated Press website [14], which is very similar to the FBI version [15] though the latter has been cropped, enhanced and de-colorized. The image was apparently taken in Afghanistan of April 1998 and the author is listed as "Anonymous". However, it is listed as being uploaded on the 2nd of May 2011, 12 years after the FBI first used it, and 9 years after the Department of Defense produced it in Afghanistan as a wanted poster. I also found the same image, this time with the color and enhancement, but it is cited as being from Reuters [16] and then the same image cited as being from the Associated Press [17]. It is clear that an Associate Press or Reuters photographer/journalist did not take this image, as it was obviously from some unknown al-Qaeda operative or associate to Osama bin Laden. If the image doesn't have a verifiable author and was taken in Afghanistan and first produced there, wouldn't that make in the the Public-Domain according to the United States? - You are correct that if the image were taken in Afghanistan in the 1990s and first published there, that it would be PD. However, it is up to you to prove that that is the case. It seems to me much more likely that it was first published outside of Afghanistan. The fact that the author is unknown does not affect the copyright in the short term in most countries -- that is, in most countries an image with an unknown author may have a shorter copyright, but it will still be more than 15 or 20 years. . - I wish the U.S could take pictures of everything, and then all images would be in the public domain. It appears that it was taken in Afghanistan, at least according to the Associated Press [18]. The U.S. did officially publish it in Afghanistan when they distributed the leaflets and posters with that image on it in September 2002, thereby making it accessible to the public for public use. - I don't follow. I don't wish to sound ignorant, but I found another source which is easier to navigate [20]. This shows the leaflet containing the Osama bin Laden image in Afghanistan, and as stated, were held by an Afghan on November 27th 2001 which proves it was published there. Keep- The image was first published in the country of origin, Afghanistan when the U.S Department of Defense produced material with that image printed on it for the civilian population of Afghanistan to use. The source [21] states it was held by an Afghan on November 27th 2001, which is the first recorded publishing of the image. The image was taken in April 1998, and Osama bin Laden was based out of Afghanistan during that period. The AP source [22], cites the location as Afghanistan, lists the photographer as anonymous and was only uploaded to the AP archive in 2009, in contrast to this photo which has been in use by the FBI since November 2001 [23] which was the month and year of first publication [24]. Found this image here on the Associated Press website which states that it was submitted in 1998 [25]. This is before the FBI used it in 1999. Unsure whether this constitutes as being 'published' material or not, However, it is blatantly obvious that the Associated Press did not take this image of bin Laden, but they must have got it from some source, some how, so I don't know if it is allowed on Commons. - Comment I have uploaded the uncropped version, thumbnail to the right. This was found by a Google image search based on the apparent original hosted by Associated Press. Whichever license the consensus judges to apply to the cropped version should apply to the original. - Delete It is apparent that my comment above about the status of this image is wrong. I was under the incorrect impression that all Afghan images before 2008 were PD.
