No reason why this is in the public domain in the US given. It doesn't come under the standard pre-1923 rule, and it would be difficult to prove any other situation: first one would have to prove it was published under the definition of the law, then that it was either published without notice, or that it wasn't renewed (which is damn hard for photos, since only the renewal records for books and journals are readily available). This is a jpg/JPG problem. Somehow I managed to upload a media file named "File:Trowulan Gate, East Java 1342.jpg" and another one named "File:Trowulan Gate, East Java 1342.JPG". The author of these files is claimed to be Paenigenome at English Wikipedia, but this is questionnable. The image descriptions also state that "The image was taken in Prof. Ben-Jacob's lab, Tel-Aviv University, Israel." Imho OTRS-ticket is necessary to prove authorship and permission.   •  Keep Well, we know the photos from this series are from Conn Smythe's personal collection, who was the principal owner of the Leafs at the time. Theoretically, any old photograph could have been published in the U.S. within 30 days, but there is no indication here (not even a hint) whatsoever of any American involvement with the photo itself that would even trigger COM:PCP. The great likelihood is that this photo was taken by the Leafs organization - possibly even for Smythe himself who was serving with the Canadian Army at the time and would have presumably been following the playoffs from afar. If the photo belonged to a news organization, I would have doubts (it might have been shared with other papers, although not sure photo newswires existed at the time), but a photos in the personal files of the Canadian owner of a Canadian team, notwithstanding the fact that some photos show games against U.S.-based teams, can be assumed to not have been published in other countries (absent some kind of hint otherwise). Conceivably, every old anonymous photograph on Commons, and every old photograph where we don't know the full backstory on the photographer, was possibly taken by or for an American news organization, or could have been published in the U.S within 30 days. It's always possible. If that's the standard, then we have hundreds of thousands (millions?) of images to nominate for deletion. But that isn't the standard. We need more than maybe, possibly, perhaps, could be, dunno - which is the basis for this nomination. We rarely know everything about an old photograph (even when we have the name of the photographer). But this photograph was in the collection of the principal owner of the Leafs, and it is therefore reasonable and safe to assume that its provenance is from the Leafs organization. The balance of probabilities in this case leans heavily towards what we know, not toward conjecture without any support. Absent some scintilla, or even a whisper, of evidence to the contrary, anything else is just making up hypotheticals.   • Obvious keep.
  1. "Unused" is not valid grounds for deletion;
  2. The phrase that may have offended nominator was trimmed with trivial effort;
  3. I suggest all images from top secret torture camps should be considered in scope;
  4. The three dozen or so images uploaded by Cesar Monroy are particularly valuable. To the best of my knowledge they are the only non-official photos we have from the base during the years he was there, and they contain particularly valuable images, like the cliff where a Medal of Honor winner, and later murderer, disposed of the corpse of his victim; the capture a Cuban refugee; the culling of deer on the base. I believe it would only confuse viewers to delete some properly licensed, and completely in scope images, for frivolous reasons, given the explosive nature of other images.   • In my opinion, if an image is otherwise in scope, the author's intent, isn't relevant. There have been some discussions of some images related to human sexuality where those favoring delete based their arguments on the author/uploader's description, asserting the author/uploader's intent was to be a showoff. And I argued that, if a sexual show-off uploads an image which, nevertheless, is useful in a clinical context, their intent is irrelevant.
In the case of Sergeant Monroy's images, I suggest that, since they are themselves highly in-scope, it is not relevant in a deletion discussion what his intent was. We aren't obliged to include original captions, so long as we comply with the original license. If the description is a problem, change the description. Don't delete the image.   • You are right about the caption being vandalised in 2012. The original caption was "A dumb-ass marine didn't want to be in cuba anymore, so he shot himself in the side of his stomach, the bullet (5.56) went through him, and through the wood of his post. This is the exit hole in the wood." I can see your point about the preservation of the integrity of the series, and the pictures can be viewed as a poignant illustration of life at Guantanamo Bay. I suggest you ask the DoD to take down the image first from their official sites. Once removed from DoD sources, the licence can be challenged on Commons (taking it down from Commons would not stop re-upload here and elsewhere in the future). Refer to http://www.dvidshub.net/image/1199779/craig-joint-theater-hospital-bagram as an example of where this is displayed and released.

PD claim is invalid. Image is taken from the Dr Macro website, which does not provide the information required to determine the image's copyright status. Current rationale is unsupported boilerplate.The claim here is particulary bad, because a photo taken in 1923 plainly cannot have been taken before January 1, 1923; and because a photo from a London stage production may well have been published in the UK rather than the US. Mr. Ogre: The citation that you are referring to relies on Indiana law. While the link does not function, the underlying Opinion Letter is available at: http://www.in.gov/pac/informal/files/Lt.Governor_inquiry_by_Chad_Frahm_re_Tourism_photos.pdf and provides that, even under Indiana law "[The relevant agency of the State of Indiana] may not limit a person’s commercial use of an image [obtained under the Indiana Access to Public Records Act] in which [The relevant agency of the State of Indiana] owns the copyright." Regardless of what the law is in Indiana, what you are saying is plainly NOT the law in the State of New York. In New York, records released under the Freedom of Information Law are public and are NOT copyrighted. I'm atually the administrator of that website. Meddling with Nature is the project of my partner and some of his collaborators. I have his full permission to share the files I've uploaded (and others that I will upload) under a license that is compatible with wikimedia. Is it a problem to have a file listed as available under two different licenses? I had just assumed that (if they found both sources) people would go with the less restrictive license for most purposes. Let me know if that's a problem, and I can do what I need to do :-)

So it's very definitely taken prior to 1963. The copyright situation however is less quantifiable. Normally promo shots like this would have been taken by the studio, therefore they would hold the copyright. The question is, which studio? That leads to the question, does that studio still exist? And if it does, did they renew the copyright. I'll bet that the latter question is no, as most promo shots were taken then forgotten once the movie marketing was over. Around that time DeCarlo was working for Universal, so there's a good chance they hold the copyright, though whether that particular photo's copyright was renewed is open to question. I wouldn't say it's a slam-dunk obvious deletion, but then again it's not an obvious keep either. You're certainly right that the B&W nature of the image is pretty much irrelevant to its date; such images are still circulated for use in newspapers, for example, where most photos are still not in color (both in advertising and editorial content). For images like this, we need to establish the date and jurisdiction of publication in order to determine its copyright status. Not every picture taken during a publicity session was actually published contemporaneously, too; some sat in files, unused, for years before surfacing. And if the photo was taken for a magazine or newspaper, its original publication was almost certainly copyrighted, and the copyright might or might not have been renewed - we just can't tell without knowing which periodical was involved.  Keep This was a promo shot for the movie "Swamp Water" so is likely to have been taken circa 1940/41 and is easily prior to the 1963 cutoff. Generally speaking promo shots like this are left to to become PD after the relevant marketing campaign was finished, especially when they involved young, and at the time unknown/relatively unknown, actors/actresses.
