This image was obviously not taken by the FBI as claimed since the FBI never had custody of Bin Laden. The FBI is well known to ignore copyright in using images of wanted people and this is certainly one of those cases. . Jim . . . . (Jameslwoodward) (talk to me) 22:42, 12 October 2014 (UTC)
- It has been used by the U.S Department of Defense as far back as 2001, during the invasion of Afghanistan in the form of a leaflet [1], meaning that the U.S government undoubtedly have copyright over the image, being the first known and therefore original publishers. The FBI have used it since 1999. No copyright tag is even present on the image. StanTheMan87 (talk) 12:23, 13 October 2014 (UTC)
- That may well be, but governments are notorious for using whatever image they can get for wanted people. As I said, the FBI certainly didn't take this image and I doubt very much that any other Federal employee did. - I found this image on the Associated Press website [2], which is very similar to the FBI version [3] though the latter has been cropped, enhanced and de-colorized. The image was apparently taken in Afghanistan of April 1998 and the author is listed as "Anonymous". However, it is listed as being uploaded on the 2nd of May 2011, 12 years after the FBI first used it, and 9 years after the Department of Defense produced it in Afghanistan as a wanted poster. I also found the same image, this time with the color and enhancement, but it is cited as being from Reuters [4] and then the same image cited as being from the Associated Press [5]. It is clear that an Associate Press or Reuters photographer/journalist did not take this image, as it was obviously from some unknown al-Qaeda operative or associate to Osama bin Laden. If the image doesn't have a verifiable author and was taken in Afghanistan and first produced there, wouldn't that make in the the Public-Domain according to the United States? - You are correct that if the image were taken in Afghanistan in the 1990s and first published there, that it would be PD. However, it is up to you to prove that that is the case. It seems to me much more likely that it was first published outside of Afghanistan. The fact that the author is unknown does not affect the copyright in the short term in most countries -- that is, in most countries an image with an unknown author may have a shorter copyright, but it will still be more than 15 or 20 years. . - I wish the U.S could take pictures of everything, and then all images would be in the public domain. It appears that it was taken in Afghanistan, at least according to the Associated Press [6]. The U.S. did officially publish it in Afghanistan when they distributed the leaflets and posters with that image on it in September 2002, thereby making it accessible to the public for public use. Here is the proof [7]. To save you time from scrolling throughout the page, it's the 19th and 22nd image used by the U.S Department of Defense during Operation Enduring Freedom. - I don't follow. I don't wish to sound ignorant, but I found another source which is easier to navigate [8]. This shows the leaflet containing the Osama bin Laden image in Afghanistan, and as stated, were held by an Afghan on November 27th 2001 which proves it was published there. Keep- The image was first published in the country of origin, Afghanistan when the U.S Department of Defense produced material with that image printed on it for the civilian population of Afghanistan to use. The source [9] states it was held by an Afghan on November 27th 2001, which is the first recorded publishing of the image. The image was taken in April 1998, and Osama bin Laden was based out of Afghanistan during that period. The AP source [10], cites the location as Afghanistan, lists the photographer as anonymous and was only uploaded to the AP archive in 2009, in contrast to this photo which has been in use by the FBI since November 2001 [11] which was the month and year of first publication [12]. Found this image here on the Associated Press website which states that it was submitted in 1998 [13]. This is before the FBI used it in 1999. Unsure whether this constitutes as being 'published' material or not, However, it is blatantly obvious that the Associated Press did not take this image of bin Laden, but they must have got it from some source, some how, so I don't know if it is allowed on Commons. Comment I have uploaded the uncropped version, thumbnail to the right. This was found by a Google image search based on the apparent original hosted by Associated Press. Whichever license the consensus judges to apply to the cropped version should apply to the original. This file's license states that it was PD in home country in 1996. This is the novel Chander Pahar by Bibhutibhushan Bandyopadhyay. PD-India is author's life + 60 yrs for those who died in 1941 and later. The author died in 1950. So how can this work be PD-India on URAA date? Hrishikes (talk) 12:21, 19 October 2014 (UTC)

What more can be said? DLindsley is evidently wrong, and when he/she continues the erroneous edits even after being explained everything, I find this abusive and harassing. The not detrimental to the image of the Euro clause is comparable to personality rights attached to pictures of living people. - I've read the discussion and think these images don't meet the terms of the Definition of Free Cultural Work that should be met per the Wikimedia licensing policy, in particular the freedom to "make changes and improvements, and to distribute derivative works". I don't see how the requirement for "faithful likeness" would be in the scope of "permissible restrictions". I also don't think the copyright and the personality rights are comparable. Photos by Gabriel Hackett on Getty Images run from 1891-01-01 up to 1978-01-01, plus an outlier of 1800-01-01. But that's probably not a valid origin, since it's only a portion of what the Bower book cover shows.
- I can't find a source for the 1930 date.
- The photographer may or may not be by the Gabriel D. Hackett shown in "Cornell Capa és Gabriel D. Hackett (Keér Dezsõ), 1970" (Hungarian Museum of Photography, inventory number 2002.777, accession number 53.1995, digital scan number 00040093).)
- So we have a photograph from possibly as late as 1944, presumably in Germany. If the photographer is an organization or truly lost to history (anonymous), German copyright runs 70 years from first publication, so copyrighted until the end of 2014. And if the photographer is known — which is quite plausable considering Klaus Barbie: The Butcher of Lyons probably has a photo credit — by definition the photographer had to still be alive at least until 1944, and with 122 year lifespan, potentially alive until 2066 at the extreme end; 70 years p.m.a. in Germany still means this work would expire at the end of 2014 at the earliest, and possibly as late as 2136, but probably much earlier once the photographer's identity is researched. --Closeapple (talk) 00:52, 31 October 2014 (UTC)

Even though inIT used this photo at other places, it is not proved that inIT is the copyright holder. The photo of nw-news and the photo of commons are the same things, but the details are different. Please compare these two photo. We are able to understand that inIT photo was edited. In other words, the photo of nw-news is origin. And the copyright holder of this original photo is STKG. [edit]This file was initially tagged by Smooth O as no permission (No permission since)... which is technically correct, however the main problem here is a large pile of Derivative works without copyright release. A single example suffices, page 110, image of researcher clearly marked "copyright." This problem persists throughout the entire file which uploader tells me is course work for grade school children. However it is also a pile of COM:COPYVIOs without an OTRS form from every single photographer whose pictures were used in the publication. The title of the work appears self-promotional as well - if the work were curricula, there would be no reason to say "by ___name__". The most common photographer name I found credited in the PDF was Devon Edmonds, author of "Tree Frogs (Complete Herp Care)" although there were other, non-credited images as well. - Comment Notes on more COM:COPYVIOs. Starting on page 151-162, the images are credited to Richard Bartlett, author of "In Search of Reptiles & Amphibians" and other books. Bartlett's work is available for licensing through University of California Berkeley. Additional pictures are from herpetologist Kerry Kreiger, whose website is clearly marked "Copyright © 2008 SAVE THE FROGS!TM All Rights Reserved." While the text on page 163 implies that some level of contact was maintained with these photographers, each would have to COM:OTRS their images here, and since each picture referenced to a particular photographer is clearly labeled (c) in the File nominated for deletion, I don't think those people intended for their work to be Open Sourced. There is also the issue that this document claims the group to be non-profit - a claim they don't repeat on their website where it says that their non-profit status is underway sorta. I really suggest a careful reading of COM:L by you and your photographers to be sure you know what rights exactly you would no longer have to this work. - Image was first distributed in Iraq during the 2003 invasion in the form of those wanted posters which were accessible to the Iraqi public. Not once did I state that they were photographed by the U.S government, merely distributed by them in its country of origin, Iraq in the first date of publication, 2003. I have given the U.S government attribution, as the source is a affiliated U.S Department of Defense website, and under their terms and conditions, "Use of appropriate byline/photo/image credits is requested."[20]. What I have just written is clearly permissible under the current license this file is under. If you disagree, use a source to prove that they were posted elsewhere pre-2003, as that is your only chance in determining this file is not in the Public-Domain. Deleted: If it is an image taken by an employee of the US federal government than it doesn't mean that the file is PD in Iraque, where the file has been published and the file is clearly not PD under the copyrightlaw of Iraque. As long as we don't know who took those images we cannot be sure who owns the copyright and/or that the file is indeed PD. There are way to much assumptions here and there is no hard evidence. - The source is here [28], but yellow jump suits are not always used in these types of facilities. I'm sure a plethora of color-coded jumpsuits existed, perhaps based on circumstance of arrest, or by behavior exhibited by certain detainees, such as at Guantanamo Bay [29]. I don't know about you but when I take pictures I like to hedge my bets and take a series pictures at the same time in the hope of getting a decent one I can use. If you can produce a similar but not identical image taken at the same time that has not previously been seen on the net then I will believe that you were the drone operator. So most of the picture still inside the devices and don't want to delete, it only have few spaces. - Delete at least File:Image of Ayman al-Zawahiri.png, and maybe File:Image of Osama Bin Laden.png (per COM:PRP): Commons:Flickrwashing. Claimed source "Ayman al Zawahiri" claimed as "Taken on June 16, 2011" by Andres Pérez is unlikely to be the copyright owner. A comment on the Flickr page says "this looks like a video still, did you take this photo?" and the uploader never replied. Furthermore, the image has existed in some form since at least 2009, because it was in this ad for a July 2009 screening of the short film The Terrorist. - I'd expect you to look and read the sources and the summary before listing these files for deletion. You're just wasting your own time and mine. Most of those men were detained in Iraq between 2003 and 2011, and the images were taken by U.S employees, at the U.S Internment Facility Camp Bucca, hence the {{PD-USGov}} tag. That is more than sufficient proof to assert a U.S employee took the images, unless you are unable to decipher English, much less comprehend it. Furthermore, the images were distributed in Iraq first, as source [41] shows that the Iraqi Interior Ministry had distributed them, which is the reason why {{PD-Iraq}} is in use. Moreover, the Iraqi Interior Ministry is a legal entity, and therefore the images are in the public-domain, under Iraqi copyright law.
- File:Mullah Omar.png is the only file thus far which has questionable copyright grounds, out of all the files you have cited in this list and the others as being eligible for deletion. I have recently discovered that the image was published via the BBC in 1998 [42] before the U.S Department of Defense in 2001, and therefore not in Afghanistan. - that the photos uploaded are actually the ones taken at Camp Bucca (or anywhere else by a U.S. government employee);
- that "sufficient evidence to assert" something somehow started being the same as meeting the Commons:Burden of proof in the month and a half since you've been on Commons, since it hasn't in the 9 years I've been here or the 10 years I've been on English Wikipedia, and you yourself have already discovered that at least one upload wasn't the work of a U.S. government employee;
- where in your cited source [43] it says that the photos, not just the list of names, came from the Iraqi Interior Ministry;
- that because something "is a legal entity, ... therefore the images are in the public-domain, under Iraqi copyright law", since that's not one of the criteria in {{PD-Iraq}};
- what this new meaning of "legal entity" is, since the other 350,000,000 native English speakers on this planet, perhaps all "unable to decipher English, much less comprehend it", have a totally different definition for that phrase than you do.

- The source states that most of those men were detained at Camp Bucca [44],[45]. Furthermore, when it doesn't explicitly state that Camp Bucca was the detention facility, it still states that they were either captured or detained by U.S forces, or shows them wearing the same jumpsuits as the detainees who it mentions were kept at Camp Bucca.
- I never stated the image File:Mullah Omar.png was the work of a U.S government employee, try and quote me on that. Where in that sentence do I state that the a U.S employee took the file image File:Mullah Omar.png? I placed it under a Wikimedia commons license template {{PD-URAA}} as I thought it was published in Afghanistan, the origin of the image before it was published elsewhere. I was wrong, it was published via the BBC 3 years before the U.S government.

Image was first distributed in Iraq during the 2003 invasion in the form of those wanted posters which were accessible to the Iraqi public. Not once did I state that they were created by the U.S government, merely distributed by them in its country of origin, Iraq in the first date of publication, 2003. I have given the U.S government attribution, as the source is a affiliated U.S Department of Defense website, and under their terms and conditions, "Use of appropriate byline/photo/image credits is requested."[49]. What I have just written is clearly permissible under the current license this file is under. If you disagree, use a source to prove that they were posted elsewhere pre-2003, as that is your only chance in determining this file is not in the Public-Domain.
